  On this episode, the fifth installment of our eight-part, issue-specific series, we'll explore how nonprofits can boldly and safely advocate for gender and reproductive justice. We'll review recent policy developments and discuss how nonprofits can respond through legislative, executive, and judicial branch advocacy. Join us as we break down the rules and share recent examples of how nonprofits are advancing gender and reproductive justice.     Attorneys for this episode    Quyen Tu  Brittany Hacker  Melissa Marichal Zayas    Shownotes  Gender and Reproductive Justice Headlines  Executive Branch Actions  Since taking office, President Trump has signed several sweeping executive orders that undermine the rights of transgender people and women and reduce access to reproductive health care.   These include, for example, orders that terminate federal diversity, equity, and inclusion programs; rescind executive orders that expanded access to reproductive health care; ban transgender people from serving in the military; limit coverage for gender-affirming care; and require federal agencies to recognize only two, “not changeable” sexes.  The DOJ has announced that, outside of extraordinary circumstances, it will stop enforcing the Freedom of Access to Clinic Entrances Act, a law that protects reproductive clinic staff from violence and harassment.   HHS Secretary Robert F. Kennedy Jr. has directed the FDA to review its approval of the medication abortion pill Mifepristone.   We've also seen major funding cuts across several agencies. HHS, for example, has terminated NIH grants focused on LGBTQ+ health issues and frozen millions of dollars of Title X funds, which help provide reproductive health services in low-income communities.    Litigation  Many nonprofits, as well as state attorneys general, have filed lawsuits challenging the executive orders that seek to curtail LGBTQ+ rights and DEI initiatives.   In February, for example, a group of several civil rights nonprofits, along with Crowell & Moring LLP, filed a lawsuit on behalf of Chicago Women in Trades to challenge the Trump administration's anti-DEI executive orders. As a result, a federal court has temporarily blocked the Labor Department from requiring Chicago Women in Trades and other federal contracts or grant recipients to certify that they don't operate any programs that violate Federal anti-discrimination laws, which one of these EOs would require.   Many other provisions of these EOs, however, remain in effect as the cases make their way through the courts.   The National Council of Nonprofits has a continuously updated chart tracking executive orders that impact nonprofits and their current legal status. Just Security has an even broader resource that is tracking all legal challenges to Trump administration actions.    Legislation  Congress is currently considering deep cuts to Medicaid. These proposed cuts would lead to an estimated 8 million Americans becoming uninsured, and would eliminate all federal funding to Planned Parenthood, including funding for preventative health screenings and testing. Proposed budget cuts would also further restrict transgender peoples' access to gender-affirming care.   In Missouri, the state legislature recently approved a new ballot referendum that, if passed, would repeal last year's voter-approved constitutional amendment guaranteeing a right to abortion. This ballet referendum will appear on the ballot in November of 2026 or earlier if Missouri's governor calls a special election.     What can 501(c)(3)s do to respond?   As a reminder, 501(c)(3)s cannot support or oppose candidates for elective public office. This means they can't engage in activity that helps or hurts the chances of a candidate winning an election.  But here's what they can do: They can engage in an unlimited amount of non-lobbying advocacy, and they can engage in a limited amount of lobbying.    Non-Lobbying Advocacy   Educate the public about issues of importance to your organization  The Center for Reproductive Rights' tool, Repro Red Flags: Agency Watch, which tracks key Trump administration appointments and actions related to reproductive health.   PFLAG is tracking and reporting on federal and state legislation and litigation impacting the LGBTQ+ community through its weekly Policy Matters Newsletter and Executive Orders Explainers and Resources web page.  The National Women's Law Center has released a report highlighting how the cuts would impact women and LGBTQ+ individuals.  Engage in administrative advocacy  A March letter sent by Equal Rights Advocates and several other civil rights organizations to Acting EEOC Chair Andrea Lucas urges her to immediately withdraw a series of letters and guidance documents pressuring employers to abandon DEI programs.   Hold a rally  In April, the Coalition for Inclusive Schools & Communities, Live in Your Truth, and the Montgomery County Pride Family held a  rally in support of inclusive education outside the U.S. Supreme Court during oral arguments in Mahmoud v. Taylor.  Initiate or participate in litigation  In May, a Michigan state court permanently struck down three of Michigan's abortion restrictions, agreeing with Northland Family Planning Centers and Medical Students for Choice—two nonprofits plaintiffs represented by the Center for Reproductive Rights—that the restrictions violate the state's constitutional amendment.  Fund advocacy  Public and private foundations can fund advocacy through general operating grants or specific project grants.    Lobbying  501(c)(3) public charities can engage in lobbying, but they are limited in how much lobbying they may engage in.  Under the federal tax rules, most public charities can choose between two tests to determine how much lobbying they can engage in: the insubstantial part test or the 501(h) expenditure test.  Under either test, lobbying includes attempts to influence legislation at any level of government. The exact activities that will count as lobbying will depend on which test the organization uses.   When engaging in lobbying, remember to track and report your lobbying on your annual Form 990, stay within your lobbying limits, and use unrestricted funds.   In addition to the tax rules, federal, state, or local level lobbyist registration and reporting requirements may apply when engaging in legislative and executive branch advocacy. These requirements vary by state and city, so make sure to confirm the types of activities and thresholds that trigger reporting in the jurisdictions where you are lobbying.   The IRS considers ballot measure advocacy a form of direct lobbying because the voters act as legislators when they vote to approve or reject a ballot measure, but keep in mind that your organization may also be required to register and report on ballot measure activity under state or local campaign finance laws.  Since 2022, 501(c)(3) public charities have helped to pass ballot measures that establish a right to abortion in eleven states.    Resources  The Advocacy Playbook for Gender and Reproductive Justice  Public Charities Can Lobby (Factsheet)  What is Advocacy? 2.0 (Factsheet)  Administrative Advocacy: Influencing Rules, Regulations, and Executive Orders (Factsheet)  What Nonprofits Needs to Know About Lobbying in Your State    Understanding the Federal Lobbying Disclosure Act (Factsheet)  Investing in Change: A Funder's Guide to Supporting Advocacy

Tamara Lea Spira's Queering Families: Reproductive Justice in Precarious Times (U California Press, 2025) traces the shifting dominant meanings of queer family from the late twentieth century to today. With this book, Spira highlights the growing embrace of normative family structures by LGBTQ+ movements--calling into question how many queers, once deemed unfit to parent, have become contradictory agents within the US empire's racial and colonial agendas. Simultaneously, Queering Families celebrates the rich history of queer reproductive justice, from the radical movements of the 1970s through the present, led by Black, decolonial, and queer of color feminist activists. Ultimately, Spira argues that queering reproductive justice impels us to build communities of care to cherish and uphold the lives of those who, defying normativity's violent stranglehold, are deemed to be unworthy of life. She issues the call to lovingly wager a future for the world's children, the planet, and all living beings against all odds, and in increasingly perilous times. John and Bart to talk to Anna Feder about the short films series Resistance of Vision  The brainchild of San Francisco IndieFest founder/director Jeff Ross, with veteran film curator, documentarian, and cinema exhibition consultant Anna Feder serving as the Director of Programming, the Resistance of Vision film festival kicks off with debut presentations across the country, with screenings taking place in locations on each coast, as well as the Midwest and the South.  The four short film programs/topics announced for the inaugural festival are Fight The Power (Racial Justice), Our Bodies, Our Choice (Gender and Reproductive Justice), This Is An Emergency (Environmental Justice), and Which Side Are You On? (Labor and Housing Justice).  Regarding the film selections for the groundbreaking film festival series' debut, Feder said, “As so many people around the country look to find voice for their grave concerns due to actions taken by the current administration or make some kind of sense out of living within this unprecedentedly frightening political climate, these films and film programs help to articulate that and start vital conversations we need to have to educate and inspire change.”  Resistance of Vision is committed to showcasing stories of resilience and the fight for liberation that are often excluded by corporate-controlled exhibition channels.

April 11th- 17th officially marks Black Maternal Health Week—a week-long campaign centered on activism, awareness, and community-building for Black mamas and Black birthing people. Elizabeth Dawes, Director of Maternal and Reproductive Health and Senior Fellow at the Century Foundation and Co-Founder of the Black Mamas Matter Alliance, sits down to talk with us about the status of the Black maternal health crisis in the U.S. and the myriad, ongoing attacks to the Black community's health, rights, and wellbeing from the new administration. The U.S. maternal mortality crisis has seen an overall reduction in maternal death rates in every racial group except for Black birthing people-- due to racism and inequity at institutional, systemic, and interpersonal levels. This is despite continuous, targeted, and hard-fought advocacy since 2014. A new case with tremendous possible consequences for U.S. sexual and reproductive health and rights has made its way onto the Supreme Court docket. Medina v. Planned Parenthood of South Atlantic is a culmination of decades of anti-choice activist's attacks to Planned Parenthood and other reproductive health care providers, specifically targeting efforts to kick these providers out of Medicaid. Jessica Mason Pieklo, Senior Vice President and Executive Editor of Rewire News Group and co-host of Boom! Lawyered, sits down to talk with us about the implications of this case for the country's most vulnerable. The question in front of the Supreme Court is whether the Medicaid statute confers a right to its recipients to go to providers of their choosing. Not only does this open doors to re-defining “qualified” and “unqualified” reproductive health care providers, it allows an opportunity for legal conservatives on the court to meander around Congressional conferring of rights via statute. The United States, overall, received an ‘F' grade, while 5 states received an ‘A' and 25 states failed. Jennie Wetter, Director of the rePROs Fight Back initiative and host of the rePROs Fight Back podcast, sits down to discuss this staggering loss of rights and the continuous fight for our right to bodily autonomy with Tarah Demant, Interim National Director of Programs, Advocacy, and Government Affairs at Amnesty International USA. While 2024 had some bright spots, including abortion-related ballot measures passing in 7 of the 10 states where they were on the ballot, we are still experiencing the fallout of the 2022 Dobbs decision. The human rights crisis unleashed by that decision has led states to continue restricting abortion access and has emboldened anti-rights advocates to increase their attacks on gender-affirming care. The Emergency Medical Treatment and Active Labor Act (EMTALA) is a landmark federal law that revolutionized the right to emergency healthcare and provides crucial protections for pregnant people. Alexa Kolbi-Molinas, Deputy Director at the ACLU's Reproductive Freedom Project, sits down to talk with us about the status of the case and what we can continue to do to protect emergency abortion services.When EMTALA was originally passed by Congress in 1986, the law directed every hospital in the country with an emergency department to provide whatever healthcare was necessary to any individual who visited the hospital presenting with an emergency medical condition. This is especially important for pregnant people, who require intensive attention in and outside of emergency situations. For the nearly 40 years EMTALA has been in effect, it was understood across party lines that if someone needs emergency abortion care, EMTALA protects that access. But following the overturning of Roe v. Wade, Idaho's extreme abortion ban did not feature an exception for those in emergencies. The Department of Justice sued Idaho to ensure EMTALA's nationwide reach and the case advanced to the Supreme Court. Medicaid, the United States' largest public health insurance program, currently insures over 72 million people with low incomes. Medicaid covers a host of health needs, including those related to sexual and reproductive health (SRH). Madeline Morcelle, Senior Attorney at the National Health Law Program (NHeLP) and co-chair of the National Coalition for Gender Justice in Health Policy, sits down to talk with us about how Medicaid is indispensable for SRH coverage and how recent proposed cuts would impact those who are enrolled.Medicaid plays an essential role in securing SRH for those with low incomes and other underserved communities, including Black, indigenous, and other people of color, people with disabilities, women and LGBTQI+ people, young people, and people with limited English proficiency. States are required to cover family planning services and supplies, pregnancy-related care, and abortion within the Hyde Amendment's exceptions. The House recently passed a budget resolution that requires at least a minimum of $880 billion in budgetary cuts from the Energy and Commerce Committee—who's vast majority of financial jurisdiction is centered in Medicare, Medicaid, and the Children's Health Insurance Program (CHIP). Candace Bond-Theriault discusses the need to center LGBTQIA+ communities in the conversation about reproductive health, rights, and justice. Bond-Theriault asserts that for reproductive justice to be truly successful, we must acknowledge that members of the LGBTQIA+ community often face distinct, specific, and interlocking oppressions when it comes to these rights. Family formation, contraception needs, and appropriate support from healthcare services are still poorly understood aspects of the LGBTQIA+ experience, which often challenge mainstream notions of the nuclear family. Candace Bond-Theriault, JD., LL.M. is a queer lawyer, writer, mother, and social justice advocate working at the intersections of law, policy, reproductive health rights, racial justice, LGBTQIA+ liberation, economic justice, and democracy reform. She is Adjunct Professor of Sociology and Criminology at Howard University, and Senior Director of Policy at the Black Women's Health Imperative. Her book Queering Reproductive Justice: An Invitation (2024), blends advocacy with a legal, rights-based framework and offers a unified path for attaining reproductive justice for LGBTQIA+ people.

A complete lack of abortion access and a climate of fear amongst patients and providers has descended over Texas in the past few years. Wendy Davis, former Texas state senator and Senior Advisor for Planned Parenthood Texas Votes, sits down to talk with us about the current landscape for abortion access in Texas and her famous 2013 filibuster.Texas currently has a complete ban on abortion with extremely limited exceptions. Only a few years prior, in 2021, Texas passed SB 8, which banned abortion at six weeks of pregnancy and allowed virtually any private citizen the ability to sue someone who accessed or attempted to access an abortion. Recent ProPublica research has found data on increased poor health outcomes and death due to the impacts of the present abortion ban. Part 1: While serving on a diversity panel, biologist Latasha Wright is asked if representation in STEM matters, prompting her to reflect on her experiences. Latasha Wright, Ph.D., Chief Scientific Officer, received her Ph.D. from NYU Langone Medical Center in cell and molecular biology. She continued her scientific training at Johns Hopkins University and Weill Cornell Medical Center. She has co-authored numerous publications, presented her work at international and national conferences. BioBus enables Latasha to share her love of science with a new generation of scientists. Latasha spearheaded the creation of the first BioBase community lab, the BioBus internship program, and our Harlem expansion. Everyday that Latasha spends teaching students about science in this transformative environment helps her remember that science is fun. She loves sharing the journey of discovery with students of all ages. Part 2: LFC's childhood experiences with nature – and with bigotry – come together to inform her career in environmentalism. Bridgette Jackson, Director of Public Policy at In Our Own Voice: National Black Women's Reproductive Justice Agenda, Kat Olivera, Director of Government Relations at the National Latina Institute for Reproductive Justice (NLIRJ), and Fajer Saeed Ebrahim, Senior Policy Manager at the National Asian Pacific American Women's Forum (NAPAWF), sit down to talk with us about the reproductive justice policy agenda. NAPAWF, NLIRJ, and In Our Own Voice lead the Intersections of Our Lives Collaborative, which developed the comprehensive policy framework for achieving reproductive justice. The agenda is structured around three key pillars: healthy body, healthy families and communities, and healthy democracy. For Black History Month, we are going back through the archives and listening to the voices of some of the incredible Black Women who have been on the show.Essence Ellis: Reproductive Justice in the Wake of Overturning Roe v Wade NOTE: This episode was recorded and published BEFORE the final Supreme Court decision was released, effectively overturning Roe v. Wade and stripping folks with a uterus of their rights. For many folks, it felt like the earth shook when Politico published the leaked draft of the Supreme Court's case on Roe v. Wade. Reproductive Justice activists turned up their microphones and voices for louder advocating for reproductive rights.There are a lot of questions we ask have about what the work of Reproductive Justice will look like if the leaked draft is accurate. There's a great deal of fear and concern, and rightly so. Thankfully, we have the wisdom of folks like Essence Ellis, a recent graduate of Yale Divinity School, whose ministry is centered at the intersection of theology, public health, and women's rights. Today, Ross is an associate professor at Smith College in Northampton, Massachusetts, and a partner with 14th Strategies Consultants, with which she runs “Calling In” training sessions at organizations around the country. The global gag rule, which prevents non-governmental organizations who receive U.S. global health funding from providing, counseling on, referring for, or advocating for abortion in their own country and using their own, private resources, has been reinstated by President Trump. Lori Adelman, Executive Director of Planned Parenthood Global, and Caitlin Horrigan, Senior Director of Global Advocacy at Planned Parenthood Federation of America, sits down to talk with us about what the expanded global gag rule is, what it means for health practitioners and patients abroad, and how it can be repealed.When the global gag rule is in place, there is a deep disrupting in health service delivery, bolstering an anti-human rights agenda globally, undermining trust in medical providers, and weakening civil society allies. Communities have less access to centralized, essential care, which can force people to turn to unsafe methods of abortion. Thankfully, there are policy solutions. Send us a textReproductive Justice: Birthing The Next 7 GenerationsIn this episode, we sit down with Camie Jae Goldhammer (Sisseton-Wahpeton Oyaté), BirthKeeper, Reproductive Justice advocate, and founder of Hummingbird Indigenous Family Services, to define, discuss, and explore how Indigenous birthing practices, breastfeeding, and community care intertwines to combat colonial and capitalist systems of oppression that disproportionately affect Indigenous, Black, and, Brown people. The maternal mortality rate of American Indian and Alaska Natives is 8 times higher than white Americans, with 80% of deaths being preventable. Before Hummingbird was founded, there were no resources in the Pacific Northwest specifically for Native parents and families. Camie shares her own birth journey and how it led to her career serving over 3,000 Native moms and parents.This conversation with Camie is a love letter to Native mommas, parents, and communities as she shares her wisdom as an Indigenous Lactation Consultant and Full Spectrum Doula, having co-created the first and only lactation counselor training created for Native people by Native people. Hummingbird's mission is to have healthy Indigenous babies being born into healthy Indigenous families being supported by healthy Indigenous communities.
