Has Citizens United Undermined Democracy?

In a high-stakes presidential election year, in partnership with the Newt and Jo Minow Debate Series at the Northwestern Pritzker School of Law, Open to Debate is taking a look at more than a decade of the Citizens United Supreme Court case. The 2010 landmark decision that ruled the free speech clause of the First Amendment prohibits the government from restricting independent expenditures for political communications by corporations, including nonprofits, labor unions, and other associations, changed the landscape of political spending in the U.S. This gave rise to Super PACS and an increase in election campaign spending. Since then, there have been questions about whether the decision has harmed our democratic process. Those who support the decision argue it upholds free speech, allowing diverse voices in the political arena, and broadens the range of discourse by enabling groups to freely express their views and support candidates or policies. Those against it argue that it allows a disproportionate influence from corporations and special interest groups, and leaves the voices of ordinary citizens overshadowed by the financial resources of a few, eroding the principles of equality and fair representation.  With this context, we debate the question: Has Citizens United Undermined Democracy?     This debate is presented in partnership with the Northwestern Pritzker School of Law as part of the Newt and Jo Minow Debate Series. By any definition of "originalism," there is a vast body of case law that does not conform to it.How do and should modern originalists - and here one might specifically include lower-court judges who consider themselves originalist - handle this case law? On this day in legal history, November 10, 1919, the U.S. Supreme Court delivered a pivotal decision in Abrams v. United States, a case that profoundly impacted the interpretation of the First Amendment regarding free speech. This ruling upheld the 1918 Amendment to the Espionage Act of 1917, making it a criminal offense to urge the curtailment of war material production intended to hinder the U.S. war effort against Germany. The case originated when Hyman Rosansky was arrested for distributing leaflets in New York City, denouncing American intervention in Russia and advocating for the cessation of weapon production against Soviet Russia. These leaflets, printed in both English and Yiddish, led to the arrest of Rosansky and six other Russians, all of whom had emigrated from Russia to the United States​​.The trial, which concluded on October 23, 1919, resulted in varying sentences for the defendants. Gabriel Prober was acquitted, while Hyman Rosansky received a three-year sentence. Jacob Abrams, Hyman Lachowsky, and Samuel Lipman were each sentenced to 20 years and fined $1,000. Mollie Steimer received a 15-year sentence and a $5,000 fine​​.In a 7-2 decision, the Supreme Court ruled that the defendants' First Amendment rights were not violated. Justice John Hessin Clarke, writing for the majority, argued that the intent to hinder war production could be inferred from the defendants' words, posing an imminent danger as per the "clear-and-present-danger" standard. However, in a powerful dissent, Justice Oliver Wendell Holmes Jr. contended that free speech should only be curtailed when there is a clear and present danger of immediate evil or intent to bring it about. This dissent would later influence the legal understanding of free speech rights. The Abrams case was eventually largely overturned by Brandenburg v. Ohio in 1969, marking a significant shift in the legal stance on freedom of speech.The U.S. Court of Appeals for the Fifth Circuit recently ruled that part of the ATF's regulation on "ghost guns" exceeds the agency's authority. This rule, which targets privately made firearms without serial numbers, was deemed to conflict with the Gun Control Act. Judge Kurt D. Engelhardt emphasized that it's not within the ATF's remit to create laws, a responsibility that belongs to Congress. The court affirmed that the ATF must adhere to existing statutory limits until Congress acts. The ruling vacated and remanded parts of a lower court's decision, with Circuit Judge Andrew S. Oldham critiquing the rule as overreaching. The case stems from a challenge by manufacturers, dealers, individuals, and gun-rights groups against the Biden administration's reinterpretation of the 1968 gun law. The ATF's rule aimed to regulate ghost guns by treating disassembled frames or receivers as firearms, requiring serial numbers, background checks, and transaction records. The District Court for the Northern District of Texas had previously invalidated this rule, but the Supreme Court allowed regulation to continue pending legal proceedings. The case, VanDerStok v. Garland, is part of broader efforts to increase enforcement against untraceable ghost guns.‘Ghost Guns' Rule Exceeds ATF Authority, Appeals Court HoldsUS appeals court calls Biden's 'ghost gun' limits unlawful | ReutersThe U.S. faces a significant backlog in processing labor permits, complicating efforts to manage the influx of undocumented immigrants and alleviate labor shortages. The Biden administration's move to grant temporary work permits to almost 500,000 Venezuelans is threatened by this backlog at the immigration agency. This slowdown impacts the U.S. labor market recovery, as foreign-born workers, essential during the pandemic, now contribute less to the labor force. The backlog includes around 350,000 Temporary Protected Status (TPS) applications, mostly from Venezuelans facing long wait times. Businesses like New York's Mirror Lake Inn Resort & Spa are seeking to hire migrants through TPS for various roles, highlighting the dependency on foreign labor. Despite efforts, USCIS faces challenges due to funding issues and increased processing times, exacerbated by the pandemic. A former U.S. president has been indicted on charges of mishandling classified documents, including the willful retention of classified information and obstruction. The 49-page indictment of Mr. Donald Trump can be accessed via the following journals: NYTimes & WSJ. Did you know that the definition of classified information is largely dependent on presidential executive orders? And did you know that President Richard Nixon's executive order on classified information, is the model that many look to for clear examples of what type of disclosures may cause damage to our national security and, hence, should be protected as classified information? In this episode, Professor Heidi Kitrosser speaks to us about the willful retention of national defense information, and the legal implications of such conduct under the Espionage Act. She will also directly address Mr. Trump's retention of classified documents in Mar-a-Lago. In addition, she'll tell us about the history of classified information, e.g., what constitutes classified information? Who can designate information as classified? Who has access to them? And how all of this plays out in our system of separation of powers? With regards to this last point, Prof. Kitrosser points out something interesting - that U.S. courts and Congress may be intentionally skirting the responsibility of defining and categorizing classified information. She explains why this may be to their political benefit. Ms. Kitrosser is a professor at Northwestern University Pritzker School of Law. She is an expert on the constitutional law of federal government secrecy, and on separation of powers and free speech law more broadly. She is the author of the following book: Reclaiming Accountability: Transparency, Executive Power, and the U.S. Constitution, which was awarded the 2014 Chicago-Kent College of Law / Roy C. To explain the whirlwind of recent developments, I sought out two of my favorite observers of the legal academy: Dan Rodriguez, former dean of the Northwestern University Pritzker School of Law, and Anna Ivey, former admissions dean at the University of Chicago Law School.When I asked them to join me, I selected as our topic the U.S. News law school rankings—specifically, the withdrawal of dozens of schools from the rankings, followed by the announcement of significant revisions to the rankings methodology. But it's impossible to discuss the rankings in a vacuum, so we wound up having a wide-ranging discussion that touched on two other possible major changes—abandonment of the LSAT (or any other test) as an admissions requirement, and an end to affirmative action—and the future of legal education more generally.How do Anna Ivey and and Dan Rodriguez really feel about the U.S. News rankings?
