There's no question that Hamas violated international law when it attacked Israel on October 7, and as it continues to hold hostages in Gaza. But more than seven months into Israel's response, the issue of whether Israel is violating international law—or even committing war crimes—is coming to a head. Washington is debating holding up deliveries of weapons to Israel. And the International Criminal Court is rumored to be preparing a case against leaders of both Hamas and the Israeli government. What's happening in Gaza may seem unprecedented. But as the legal scholar Oona Hathaway writes in Foreign Affairs, “The conflict in Gaza is an extreme example of the breakdown of the law of war, but it is not an isolated one.” Hathaway is the Gerard C. and Bernice Latrobe Smith Professor of International Law at Yale University School of Law and a nonresident scholar at the Carnegie Endowment for International Peace. In 2014–15, she took leave to serve as special counsel to the general counsel at the U.S. Department of Defense. Foreign Affairs Deputy Editor Kate Brannen spoke with her on May 13 about the causes of that breakdown—and what, if anything, can be done to salvage the rules meant to protect civilians in wartime. Russia's invasion of Ukraine has tested the international legal order like never before. For many, the fact that a nuclear power and member of the U.N. Security Council would commit unveiled aggression against another state seemed like it might be the death knell of the international system as we know it. But last week, in the annual Breyer Lecture on International Law at the Brookings Institution, Oona Hathaway, the Gerard C. and Bernice Latrobe Professor of International Law at Yale Law School, argued that international law and institutions responded more robustly than many initially anticipated—and may yet emerge from the Ukraine conflict stronger than before.In this episode, we are bringing you the audio of Professor Hathaway's lecture, followed by a question and answer session with Constanze Stelzenmüller, the Director of the Center on the United States and Europe and the inaugural holder of the Fritz Stern Chair on Germany and trans-Atlantic Relations at the Brookings Institution. This week we have an emergency podcast episode on the war in Ukraine. We're joined by our two colleagues and leading international law scholars – Oona Hathaway, the Gerard C. and Bernice Latrobe Smith Professor of International Law at Yale Law School, and Scott Shapiro, the Chalres F. Southmayd Professor of Law and Professor of Philosophy at Yale Law School. In this conversation, which took place Sunday, February 27 even as a fluid situation evolved, we focus on the legal theory implications of the war. We get into Oona and Scott's book The Internationalists and whether Putin's invasion constitutes a challenge to the global legal order described in their book. In addition, even if in the global order a norm exists against aggression and conquest, do some countries seem to be exempt from operating under these norms? We next compare the American domestic criminal law system to the international legal system and ask why internationally we tolerate a system where one actor can veto attempts to make it operate within the system. A debate emerges if Russia is actually avoiding the norms of the legal system right now given the costs it is facing through the global response to their invasion. In the conversation, we discuss the efficacy of “outcasting” and whether current American and European sanctions can be effective. After, we touch on Putin's case for war and how his justification compares to other historic “war manifestos.” There's a lot to discuss here and we're lucky to have two of the experts in the field here to break it down. Scott Shapiro and Oona Hathaway have just published The Internationalists: How a Radical Plan to Outlaw War Remade the World. Scott J. Shapiro is the Charles F. Southmayd Professor of Law and Professor of Philosophy at Yale Law School, where he is the Director of the Center for Law and Philosophy. He is also the Visiting Quain Professor of Jurisprudence at University College, London. He earned his BA and PhD degrees in philosophy from Columbia University and a JD from Yale Law School, where he was senior editor of The Yale Law Journal. He is the author of Legality and editor of The Oxford Handbook of Jurisprudence and the Philosophy of Law. He lives in New Haven, Connecticut. Oona A. Hathaway is the Gerard C. and Bernice Latrobe Smith Professor of International Law at Yale Law School and the Director of the Center for Global Legal Challenges. She has published essays and opinion pieces in The New York Times, The Washington Post, Los Angeles Times, The Guardian, and Foreign Policy. She served as the Special Counsel to the General Counsel at the U.S. Department of Defense in 2014-2015, for which she was awarded the Office of the Secretary of Defense Award for Excellence. She is a member of the Advisory Committee on International Law for the Legal Adviser of the US Department of State and an active member of the US Supreme Court bar. She earned her BA from Harvard College and a JD from Yale Law School, where she was Editor-in-Chief of The Yale Law Journal. She lives in New Haven, Connecticut. Introspection 2.0   Same spirit as the first iteration. Deep, slightly down tempoIndie and dark progressive House driven by big bass lines and (I hope ) original eclectic melodies.   Except for the Lana track which I picked up from Introspection 1.0, the set has a clear continental European feel. The artists and remixers are mostly from Northern Europe. The production is distinctively Nordic or German. I used no Latin flair nor samples and tried to concentrate on the mixing only.   Official thanks to Lars, who sent me some German tunes. Not only do I love them but it has opened a new direction for seeking new sounds. Lars, I am very grateful.   A word on the passing of Frankie Knuckles:  In the near future I will (how could I not?) fittingly mark the occasion with hopefully a live set at home with friends. Should the result be good enough I will upload the set. Reading the posts from the average punter like me and from DJs  he influenced or supported during his career, the common thread was on how much joy and what a nice gentle man he was. Whatever I’ll do, shall reflect the joy and gentleness. The Peacemaker Project     Highlights: Started where I left it with “Summertime Sadness” which turns out to be one of the weakest tracks of the set. A bit lazy of me.. Begining  the big bass line theme with Andrey Exx's great remix of the classic “ Be Good”. Whoever is the vocalist is amazing and I love the atmosphere the production has achieved. Continuing with the male vocalist of the same classic, this was a fluke but a happy one. “Be Good to Me” by Croatia Squad. Listen from the break at 15:36 and be in bliss with the disco keys they have introduced in what was a rather dark and progressive rendition. With the nest track “Feel Good” the set is at cruising spend. The Moe Turk Remix of the Ran Salman and Ordonez track is just top shelf progressive indie house. “Never You Mind” by Kant..  I LOVE anything Kant is currently producing.. From Denmark, those gys are subtle, inspired.. Released in 2014, this is going straight into my top ten.. Do not miss!! In case you did not get the heavy hint DO NOT MISS!! And maybe, just maybe buy the track on Beatport.. “Mirage” by Vanilla Ace. From London, very talented, remixers of Basement Jaxx and Nora en Pure. “Mirage” is again key and bass driven with a voice sample ( did not even had to had it).. I t is so easy to listen to and yet so intricate. Deep, Progressive or Chill you choose. “Barfuss auf Wolken” from KlangKueunstler .. which translates (I think) as “Walking Barefoot on the Cloud”.. My niece recognized the sample from somewhere, I didn’t.. Thank you Lars. Indie German track, with great guitar, showing how fusion should be done.. Happy tune! “Come with Me” sexy deep house based again on a big bass line, perfect percussions and synths pas in what is for me the perfect key for deep house (Gm). Hot since 82 serving up the remix. Sexy track .. “Come with Me, Close your eyes and kisssss me …” The Kant remix of “Everyday Everynight” if ever there was a track which dropped naturally, this was the one.. It is everything I attempted to make you feel here.. And again the Danes are showing how music can be clever and fully enjoyable.. If this is Indie.. well, I love Indie.. Amber Jolene with Nolan on the vocals.. “Everybody Wants Something”.. you know the track, Akabu is really smashing it recently and this remix is both a bit challenging and immensely sexy!   ATTENTION TOP TRACK !!.. The Maja Jane Coles remix of “Rule the World”.. If the Doors where performing today this would be what they would sound like.. Driving, melodic and the dimension  Maya Jane Coles has given the track is unmistakable. Love it!! As for Maya Janes Coles, she is firmly in my top ten current DJ and actually one of the very few, for whom I would move mountains to see and hear. Great talent!   “Wir Sind Frei” from the Peacemaker Project.. It is a collective of artists.. from Germany mainly.. here is their website http://www.thepeacemakerproject.com and their SoundCloud page https://soundcloud.com/thepeacemakerproject Same as KANT I love everything they do, they are bringing brains, style and elegance to House and are NEVER boring, always having a melodic dimension to anything they do. This is the current tip of the creation in House music.. and I am quite happy to say, it is in Europe… The track is good and I did not feel like “mixing it in” for the sake of it..
