Precatório, Data Venia, Impetrado, Habeas Data, Fungibilidade dos recursos, Erga omnes, Dilação e Bis in Iden. Não, você não está em uma aula de idiomas, mas poderia estar numa audiência da justiça. Os termos falados fazem parte de um vocabulário que, fora dos tribunais, chamamos de ‘juridiquês'.Só que essa linguagem faz com que o entendimento da justiça fique apenas para aqueles que vivem imersos nela ou que passam muito tempo tentando traduzi-la. Por isso, o Conselho Nacional de Justiça lançou, em novembro do ano passado, o Pacto Nacional do Judiciário pela Linguagem Simples.Trata-se de um conjunto de ações que visam dotar os órgãos da Justiça de uma comunicação mais clara, objetiva e acessível ao cidadão. A ideia não é simplificar o direito em si, mas incentivar o uso da língua portuguesa para tornar conceitos complexos compreensíveis para qualquer cidadão evitando que o ‘juridiquês' seja um obstáculo à compreensão das decisões judiciais pela sociedade, e assim democratizando o acesso à Justiça.Para debater o assunto, trouxemos ao estúdio de ES OUVE a advogada e linguista que é referência em Linguagem Simples aqui no estado, Elseana de Paula. The Interview: Cyrus Farivar on Xtracycle Touring with Kids Cyrus [“suh-ROOS”] is an investigative tech reporter at NBC News in San Francisco. In addition to being a radio producer and author, Cyrus was most recently a senior tech policy reporter at Ars Technica. He was also previously the sci-tech editor and host of “Spectrum” at Deutsche Welle English, Germany’s international broadcaster, from 2010-2012. Cyrus is the author of multiple books, including Habeas Data (2018) and The Internet of Elsewhere (2011). Praised by The New Yorker, among others, Habeas Data takes a look at legal cases that have had an outsized impact on surveillance law in America. His first book focuses on the history and effects of the Internet on different countries around the world. In 2019, Cyrus and Olivia Solon won the Technology Reporting award from the Society of Professional Journalists, Northern California Chapter for their coverage of Silicon Valley, including reporting on privacy, facial recognition, and more. Two years earlier, Cyrus and Joe Mullin also won the Technology Reporting award from SPJ NorCal for their August 2016 story: “Stealing bitcoins with badges: How Silk Road’s dirty cops got caught.” Cyrus has also reported for the Canadian Broadcasting Corporation, National Public Radio, Public Radio International, The Economist, Wired, The New York Times, Slate, and many others. DERECHO AL OLVIDO ¿Que es el DERECHO AL OLVIDO? | ¿Cómo se ejerce el derecho al olvido? | ¿Nos engañan las empresas que prometen borrar tu rastro de Internet? | Habeas Data Lo primero que debemos tener en cuenta es que internet, la red por antonomasia, es la plataforma que hace posible la existencia de redes sociales. Los buscadores como google, msn, yahoo, bing, youtube, etc, son las herramientas que hacen posible que encontremos el contenido en la red, la herramienta que nos permite buscar entre trillones de cosas. Cada vez que subimos algo a la red, se visualiza, se comparte, se descarga, se distribuye, de manera que el contenido acaba estando alojado en multiples soportes, directamente conectados o móviles que no forman parte de la red. Lo que se sube a las redes sociales, se queda en las redes sociales de forma casi irremediable. Poco a poco, las plataformas de búsquedas y las webs que visitamos van captando datos sobre nosotros, que nos gusta, a donde vamos, que edad tenemos, nuestros hábitos de compra, nuestro círculo de amigos, incluso nuestras opiniones y formas de pensar, y trazar un perfil financiero a base de nuestros habitos de compra. Todo ello va conformando un perfil digital de cada uno. Cuando estos perfiles teóricamente anónimos se relacionan con una persona o empresa, lo que tenemos como resultado es una identidad digital, que puede ser visitada por cualquiera. Quien quiera saber sobre nosotros, podrá encontrar nuestra identidad digital, y solo visitando los sitios en que de alguna forma estamos relacionados, podrá conocer nuestro perfil digital. Si esta identidad digital, este perfil digital, que conforma nuestra reputación digital o online, cada vez más importante ya que nuestro contrato de trabajo, por ejemplo, puede depender de ello, no es el que queremos, la única forma de borrarlo es ejercer el derecho al olvido. Los datos subidos a la red por nosotros o por terceros sobre nosotros, son nuestros. Tenemos derecho a la intimidad y a que nadie nos conozca, o nos conozca solo en parte. ( habeas data ) Tenemos derecho a que se olviden de nosotros ( habeas data ) cuando ya no queremos estar en la red con el perfil digital que teníamos, queriendo desaparecer o cambiar de identidad o reputación digital. La ley de protección de datos (Lopd), y el nuevo reglamento general de protección de datos personales (RGPD), regula el derecho al olvido, y obliga a quienes tengan acceso a nuestros datos a dar trazabilidad y transparencia de los datos que tienen y para qué los tienen, además de como los usan. A través de estas obligaciones, el derecho al olvido puede ejercerse solicitando a estas empresas que los links a nuestros datos o publicaciones que se refieran a nosotros se oculten y no puedan ser encontrados. En esto consiste el derecho al olvido. Este procedimiento de ejercicio del derecho al olvido se denomina “Habeas Data”. Si no se retiran los links ( habeas data ) , se podrá acudir entonces a la Agencia de Protección de Datos para solictar el Habeas Data y la sanción a quien no accede a nuestra petición, o bien iniciar el proceso de Habeas Data o ejercicio del derecho al olvido ante los tribunales.
