Welcome to this explosive edition of Light ‘Em Up!In these critical and delicate times that we find ourselves in — democracy is in clear and present danger.As nothing feels certain or safe and everything appears to be in “transition” we interrogate and examine the Trump Administration and its efforts to suspend the “great writ” of Habeas corpus.Habeas corpus is a legal doctrine whose original purpose was to contest detention by the king. The origins of the writ, or “written order” (its Latin name means, loosely, “produce the body”), can be traced to 13th century England.On June 15, 1215, at Runnymede, the barons who had banded together to impose legal restrictions on King John's power forced him to affix his seal to the Magna Carta.One of its curbs on the sovereign's power reads, in part, “No free man shall be seized or imprisoned…except by the lawful judgment of his equals or by the law of the land.”The writ of habeas corpus appears in the U.S. Constitution. Article 1, section 9, clause 2 includes this single sentence: “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”Habeas corpus requires a jailer to produce a prisoner in a court of law so the basis for detention can be reviewed. The Constitution presupposes this right, but its use has been sharply restricted during past wars.Fast forward to the present, as Donald Trump continues on his “revenge tour” — his administration has shown itself to be big on conducting legal proceedings without due process for the defendants it pursues, just as George W. Bush did with “enemy combatants” at Guantanamo Bay, Cuba, post 9-11.The Trump White House continues to break things like “Wreck it Ralph”— and has floated the idea of suspending Habeas corpus in the context of an “alien invasion” as it pertains to immigration, sparking widespread and grave concerns about the erosion of fundamental rights and the separation of powers.With mass deportations taking place without due process and the suspension of Habeas corpus, the rule of law and democracy itself is under a serious threat.While the Constitution allows for the suspension of Habeas corpus in cases of rebellion or invasion where the public safety is at stake, it is a power that must be exercised sparingly and only in extraordinary circumstances. Circumstances that we clearly are NOT in.With this probing, penetrating and pointed look … we ask out loud if we are on a collision course with the tyranny that brought about a coup d' état in Chile in 1973, where the military ousted then President Allende, General Agusto Pinochet seized power, democracy collapsed and repression, murder and great suffering followed (all backed and funded by the US CIA & State Department in the Nixon administration).As we challenge you to think critically, we probe further, examining the historical suspension of Habeas corpus, we think you'll be surprised to hear that one of the Presidents considered to be the “GOAT” (greatest of all time) suspended the writ of Habeas corpus, and we'll deliver the facts not the fiction surrounding this.We'll itemize some of the “pitfalls” and potential terrible consequences of decisions such as this, as we've learned through a FOIA request that the FBI has ordered its agents to scale back white-collar crime investigations to pursue more immigration crime instead.The rule of law and democracy are endangered!Previous Supreme Courts have held in reverence and referred to Habeas corpus as, “the fundamental instrument for safeguarding individual freedom against arbitrary and lawless state action.”The current Supreme Court has been at best tepid in its support and defense of the U.S. ConWe want to hear from you!

In 2019, Mr. Dorsey and Mr. Salah both applied for transfer to a minimum security institution. At the time, Mr. Dorsey, a dangerous offender, was incarcerated at a medium security facility; Mr. Salah was sentenced to concurrent life sentences and is incarcerated at a different medium security facility. Mr. Dorsey's case management team, his Manager of Assessment and Intervention, and his Warden all agreed that he met the criteria for reclassification to minimum security but, because of his dangerous offender status, his transfer request had to be approved by the Regional Deputy Commissioner and then the Assistant Commissioner of Correctional Operations and Programs. In September 2019, the Regional Deputy Commissioner assessed Mr. Dorsey's public safety rating as moderate. His request was denied.Mr. Salah's case management team, his parole officer, and his Manager of Assessment and Intervention recommended reclassification and transfer to a minimum security facility, but, in October 2019, a new Manager of Assessment and Intervention and Intervention was assigned to his file. He assessed Mr. Salah as a moderate escape risk, so the Warden wrongly denied his transfer request.Mr. Dorsey and Mr. Salah each applied under the Habeas Corpus Act, R.S.O. 1990, c. H-1, for a writ of habeas corpus ad subjiciendum with certiorari in aid. Although they did not apply under the Charter, they alleged that the denial of their transfer requests engaged ss. 7, 9, 10(c) and 12 of the Charter. On consent, the applications were joined for the purpose of determining a common threshold legal issue: whether Mr. Dorsey and Mr. Salah could resort to habeas corpus to challenge the denials of their applications for transfer to lower security prisons.The applications were dismissed on the grounds that habeas corpus was not available for denials of reclassification, which were not deprivations of residual liberty. After the application judge's decision, Mr. Dorsey was reclassified and transferred to a minimum security institution, but he continued his appeal. The appeal was dismissed. The evidence after two trials seems clear that Lyle and Erik Menendez murdered their parents in Beverly Hills in 1989. They were convicted after their second trial in 1996. The brothers filed a Habeas petition asking the court to vacate the conviction based on new evidence. On Thursday, 10-3-24, District Attorney Gascon stated there will be a hearing at the end of November. Tupac's family hired Alex Spiro, Alec Baldwin's attorney in the Rust case, to investigate to see if Diddy has any connection with the murder. Now that Diddy is in custody, that investigation may be easier to do. It would be natural to question Keefe D and Suge Knight. I will cover more Diddy updates in this week's podcast.Karen Read's retrial has a new special prosecutor who will be paid up to $75k for the prosecution. Hank Brennan's, who worked on the defense team for Whitey Bulger, has an hourly rate is $250 per hour.Hannah Gutierrez motion for New Trial, Dismissal and Immediate Release was denied by the judge. A decision still hasn't been made in the Alec Baldwin motion to reconsider the dismissal of his case.Jury election for the Sarah Boone case begins on Monday, October 7th. She was arrested in 2020 for the murder of her boyfriend. She said they were playing hide and seek and he hid in a zipped up suitcase. Police found a video in Sarah's phone of Jorge Torres pleading to be released because he couldn't breathe. Sarah has gone through 8 different attorneys. The judge said that she was going to have to represent herself due to her behavior. Boone wrote an advertisement and is now being represented by a private attorney using the battered spouse defense. The court denied the motion to suppress her police statements.Netflix and Fiona Harvey and going through mediation for the Baby Reindeer Show Lawsuit. However, Netflix also filed an Appeal to the Anti-SLAPP denial. I will keep you in the loop. He went into court to formalize the plea and sentencing hasn't happened yet.The headlines are saying that one of the doctors in the Matthew Perry case has plead guilty. Appeals. Grounds for Appeal. An appeal in criminal law is a request to a higher court to review and change the decision of a lower court. The grounds for appeal can include: Legal Error: Arguing that a legal mistake was made during the trial. Insufficient Evidence: Claiming that the evidence presented at trial was insufficient to justify the verdict. Prosecutorial Misconduct: Alleging improper actions by the prosecutor. Ineffective Assistance of Counsel: Arguing that the defense attorney's performance was so poor it affected the trial's outcome. Sentencing Errors: Challenges to the legality or reasonableness of the sentence imposed. Procedure and Standards of Review. The appeals process involves several steps: Filing a Notice of Appeal: This is the first step, usually filed with the trial court. Preparation of the Record: The trial court record, including all documents and transcripts, is prepared for the appellate court. Briefs Submission: Both parties submit written arguments (briefs) to the appellate court. Oral Arguments: In some cases, the court allows oral arguments from both parties. Standards of Review: De Novo Review: The appellate court reviews legal issues with a fresh perspective. Abuse of Discretion: Used for reviewing decisions at the trial court's discretion. Clear Error: Applied when reviewing factual findings. Habeas Corpus. Purpose and Procedure. Habeas corpus is a legal procedure that challenges the legality of a person's detention, imprisonment, or other restraint. Key Aspects: Initiating a Petition: A person in custody files a petition arguing their imprisonment is unlawful. Grounds for Habeas Corpus: Typical grounds include constitutional rights violations, lack of sufficient evidence, or errors in applying the law. Federal and State Considerations. Habeas corpus petitions can be filed in both state and federal courts, but the considerations differ: State Habeas Corpus: Used for challenging a state court's decision on grounds of constitutional rights violations. Federal Habeas Corpus: Typically employed after state remedies are exhausted, challenging federal constitutional violations. Exhaustion of State Remedies. Before a federal habeas corpus petition can be considered, the petitioner must exhaust all available state court remedies. Affirmative action is making headlines as a Supreme Court blockbuster, but there's a closely watched financial reporting case and two others dealing with criminal matters on tap as well in the November sitting that actually kicks off on Halloween. Bloomberg Law Supreme Court reporters Kimberly Robinson and Jordan Rubin bring listeners up to speed in this latest episode of Cases and Controversies. The two affirmative action challenges out of Harvard and the University of North Carolina are set for argument on Monday. The justices will follow up with argument in coming days on cases dealing with the Bank Secrecy Act and technical habeas issues. The episode will also breakdown what's been happening outside of the courtroom. This includes two emergency requests stemming from the 2020 presidential election, new comments from Justice Samuel Alito on last term's draft opinion leak, and the next Supreme Court postage stamp. Como decía, hoy vamos a hablar un poco de los latinismos en el español, pero… Primero de todo… ¿Qué es un latinismo? En esencia es una palabra o expresión que proviene del latín. El latín es una antigua lengua que se extendió por todo el imperio romano. Esta lengua es la base de las lenguas románicas como el español, portugués, italiano, catalán o francés. Algunas de estas expresiones son muy conocidas, pero otras son utilizadas sobre todo para impresionar o para intentar parecer más inteligente. No obstante, es cierto que muchas se utilizan en ámbitos técnicos, como por ejemplo en el campo jurídico. Mi idea para este episodio es presentarte algunas de las palabras o expresiones más conocidas que provienen del latín. Algunas están tan integradas en el español que pocos dirían que provienen del latín. Bien. Vamos a ver algunos ejemplos: Alumni Se refiere, como seguro que sabes, a los antiguos alumnos de una institución académica. Y continuando en el ámbito académico, tenemos: Campus Esta palabra literalmente quiere decir campo y se refiere a un terreno plano. Se utiliza mucho en el ámbito universitario para designar las zonas donde hay parques o jardines o simplemente espacio abierto. Currículum Seguro que sabes esta. La palabra currículum es ampliamente utilizada y es donde resumimos nuestra experiencia laboral y logros académicos. Normalmente enviamos currículums a las empresas para encontrar trabajo. Algunas personas utilizan un exceso de creatividad parar escribir su currículum. Es decir, exageran en lo que escriben, pero eso es otra historia
