I'm super excited to welcome today's guest, Marc Edelman – a passionate and influential voice in debates over the rights of college athletes. Marc is a Professor of Law at the Zicklin School of Business, Baruch College, City University of New York, where he writes and teaches on sports law, antitrust law, intellectual property law, and gaming / fantasy sports law. He also serves as the Faculty Athletics Representative for Baruch College.  In addition to his full-time role as a law professor, Professor Edelman is the founder of Edelman Law, where he provides legal consulting and expert witness services to businesses in the commercial sports, entertainment and online gaming industries. Some of Professor Edelman's recent clients include a Major League Baseball team, the Arena Football League Players Union, and several online fantasy sports providers.  He joins us today to discuss his recent paper, The Collegiate Employee-Athlete, recently published in the University of Illinois Law Review, and co-authored with Michael McCann and John Holden. Last week the news came out that Major League Baseball has suspended Trevor Bauer for two seasons, and Marc Edelman joins the show and talks about why MLB may have a hard time making that hold.

In this episode, we interview Marc Edelman, is a tenured Professor of Law at the Zicklin School of Business, Baruch College, the City University of New York, where he writes and teaches sports law, antitrust law, intellectual property law, and gaming/fantasy sports law. In this episode, Marc tells us how he got into this abstract career, how he fell in love with it, as well as how he overcame the challenges he faced.  

The federal legislation known as The Professional and Amateur Sports Protection Act of 1992 (PASPA) outlawed sports betting throughout the United States except in Nevada, Oregon, Delaware and Montana. In 2018, after years of frustration among other states that wanted to legalize sports gambling within their borders, the US Supreme Court overturned PASPA – holding that the PASPA violated the anti-commandeering doctrine of the 10th Amendment. This decision opened the doors for many other states to begin licensing sports gambling operators. Last month, New York became the latest state to legalize online sports gambling – a decision that has been praised by libertarians and sports gambling operators alike, meanwhile criticized by certain other groups.
