On July 2, 2024, the US Supreme Court granted certiorari in the case, Food and Drug Administration v. Wages and White Lion Investments, LLC. In Explainer Episode 70, expert Jeff Stier discusses the FDA's regulatory action prohibiting specific vape flavors from being sold by these two companies, and the legal issues that the Supreme Court will review in the October 2024 term. What are the implications of the FDA prohibiting the sale of these vape flavors? What regulatory process did the FDA use to make this determination? Why did the FDA decide to allow certain vape flavors, and not others? What are the effects on the FDA's decision in this case on smokers? In promoting public health? On consumers? On the companies?
The approach the FDA has taken to regulating e-cigarettes and vape products, particularly those that are flavored, has been the topic of conversation for some years. Experts debate the best methods for review, risks and benefits involved in such products, and the means by which the FDA reviews such applications. Jeff Stier joined us to discuss a recent Fifth Circuit decision (Wages and White Lion Investments, L.L.C., doing business as Triton Distribution v. FDA) concerning the FDA's approval (or lack thereof) of flavored cartridge e-cigarettes --the state of the flavored e-cigarette market, the facts of this case, the existing circuit split, and the potential ramifications of this decision moving forward. In late February 2023, the FDA released its responses to the December 2022 Reagan-Udall Foundation reports on the FDA's Human Foods and Tobacco programs. In this follow-on explainer podcast, we once again host Jeff Stier to discuss what these initial responses include, what issues they address, and what one might want to watch moving forward. On December 19, 2022, the Reagan-Udall Foundation for the Food and Drug Administration, an independent 501(c)(3) organization created by Congress “to advance the mission of the FDA to modernize medical, veterinary, food, food ingredient, and cosmetic product development, accelerate innovation, and enhance product safety” released the second of two highly anticipated reports on its state of affairs. The first, released December 6, 2022, served as an operational evaluation of the FDA's Human Foods program, which had struggled significantly during the course of the supply chain issues brought on during the COVID pandemic. The second December 19th, 2022 report covered “certain components of FDA's Tobacco program,” evaluating operations there. Both were highly anticipated not just because of the serious and pertinent issues they addressed, but because questions circulated concerning how the Foundation is made up of many former FDA high officials, and how the report would rate the proceedings of the current FDA team.In this podcast Jeff Stier, a senior fellow at the Consumer Choice Center, senior fellow at the Taxpayers Protection Alliance, and a policy advisor to the Heartland Institute breaks down some of what the reports say, and what the next steps for both the FDA and Congress may be.Featuring: Jeff Stier, Senior Fellow, Consumer Choice CenterVisit our website – www.RegProject.org – to learn more, view all of our content, and connect with us on social media.*******As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.

Health policy expert Jeff Stier joins the podcast to discuss all things concerning the regulation of e-cigarettes and vapes: How did the FDA get the authority to regulate tobacco in the first place? What is synthetic nicotine, and what might its developement demonstrate about the interplay between federal agencies and their statutory authority? What are the most recent FDA actions in this area, and what is likely to come next?In June Jeff narrated an Explainer video on the same topic, which you can view here:https://www.youtube.com/watch?v=B2_brl2u9g0Featuring:- Jeff Stier, Senior Fellow, Consumer Choice CenterVisit our website – www.RegProject.org – to learn more, view all of our content, and connect with us on social media.

In 2013, Big Four consulting firm Ernst & Young, a global leader in assurance, tax, transaction and consulting services, rebranded as ‘EY.’ What maybe few of us picked up on at the time was that part of that rebrand made an explicit Purpose statement front and center: ‘Building a better working world.’ But in this, our latest ‘Is Purpose Working?’ season in collaboration with RedThread Research sponsored by edtech leader NovoEd, that was actually a hugely important internal cultural shift and pivot for the company: “By everyone knowing our purpose statement, it creates a golden thread--so no matter where you are in the world, what culture you have, whether you're a new employee or a tenured employee, what service line you're in and what work you do you come to work to do every day, we are all connected by the fact that we are all building a better working world.” Join us, then, for a deep-dive into why this global service leader adopted Purpose and how it’s helping, as well as the critical role it sees L&D in that pivot, framed as a key role in helping people become performers, colleagues, leaders—and people. Helping us understand are two excellent speakers, Tal Goldhamer, Partner and Chief Learning Officer - Americas, EY, and his colleague Jeff Stier, EY Americas Consulting Purpose & Vision Realized Leader. As ever, our investigation is aided and sharpened up by the participation of RedThread, this time Stacia flying solo: and it’s a genuinely fascinating and at times moving and personal exploration, featuring a 6th Century CE Anglo-Saxon poem, as well as: EY’s in the unique position to bring the power of a large firm to support our people on their personal journey of discovering their individual talent that they develop for themselves, their teams, their clients, their communities, and for the world ; details of how EY individuals have found Purpose through internal, L&D-led, Purpose programs ; an intriguing new concept in our Purpose journey—the idea of nested Purpose ; why the guys believe that personal purpose and personal vision and organizational purpose are part of what gives daily meaning to the work that you do daily ; how, if you want to be an organization that claims to be purpose- and vision-led, you need to be led by leaders who themselves are purpose- and vision-led—which means developing a platform and program around personal purpose and vision ; and so much more.

In this Explainer episode, Jeff Stier tells the innovative story of Impossible Burger, a company that developed leghemoglobin to mimic the taste of meat in non-meat-based products. Instead of rushing to regulate this new development, FDA took a hands-off approach, allowing the company to bring a beneficial, and widely recognized as safe, product to market. Jeff argues that innovation, rather than heavy-handed regulation, ought to be the primary way of reducing harm.Featuring:- Jeff Stier, Senior Fellow, Consumer Choice Center and Taxpayers Protection AllianceVisit our website – www.RegProject.org – to learn more, view all of our content, and connect with us on social media.
