When it comes to the relationship between capitalism and crime, those on the left generally think of exploitation. People often turn to crime, so the thinking goes, because they can't make ends meet by legitimate means. Whatever your views on that framing, there is also another – far less discussed – connection between capitalism and […]
Navigating Drug Possession Charges in El Paso: Insights from Attorney Carl DeKoatzIn this episode, El Paso criminal defense attorney Carl DeKoatz joins the conversation to pull back the curtain on the complexities of drug possession law in a border city. From simple marijuana joints to multi-kilo "bridge cases," this episode provides a roadmap for anyone caught in the crosshairs of the Texas legal system. The Border Reality: From Misdemeanors to Major TraffickingLiving in El Paso, Texas, means being on the front lines of drug enforcement. Carl notes that while some states—like neighboring New Mexico—have moved toward legalization, Texas remains a "strict enforcement" state.Marijuana Possession: Even a single joint can lead to an arrest. While some officers might issue a ticket for drug paraphernalia, many choose to arrest to gain the legal authority to search the vehicle for larger quantities.Medical ID Cards: A common myth is that a medical marijuana card (from Texas or elsewhere) offers total protection. Carl is direct: "It's illegal. That's how you should live your life".The "Vape" Trap: One of the most dangerous areas for citizens is the use of THC vapes or edibles. In Texas, these are classified as State Jail Felonies, regardless of the amount. These cases are handled in the District Court (the "glass building" on San Antonio Street) rather than misdemeanor court. The "Unknowing" Defendant: Bridge Cases and Used CarsBeing a border community, El Paso sees a high volume of "bridge cases." These often involve individuals—frequently young or impressionable people—who are conned into driving a vehicle across the border without knowing it contains hidden compartments of narcotics."I've had clients where the title comes back to a previous owner because a car was sold for cash and never re-registered, leading police back to innocent people. In bridge cases, we fight to prove the client truly had no knowledge of the drugs in the door panels or tires".Why the "Fighter" Reputation MattersA recurring theme in Carl's practice is his belief in the jury trial system. While many attorneys prefer to take any deal offered to avoid the courtroom, Carl's willingness to go to trial—averaging 3–4 major trials a year—actually helps his clients get better plea deals.Trust and Leverage: Prosecutors are more amenable to favorable terms when they know the defense attorney isn't afraid to take a case to a jury.Innocence is Worth the Fight: Carl affirms that if a client is truly innocent, they should go to trial. He shares a memorable case where a client was acquitted after establishing that a fatal incident was a tragic accident, despite overwhelming initial evidence.Pretrial Diversion (PTD): For first-time offenders, the ultimate goal is often Pretrial Diversion. This allows the defendant to complete classes and stay out of trouble in exchange for a full dismissal, keeping their record clean.Protect Your FutureDrug convictions can follow you for a lifetime, affecting employment, housing, and civil rights. Whether you are facing a misdemeanor marijuana charge or a complex felony manufacture/delivery case, you need an attorney who understands the El Paso courts.Carl DeKoatz Law FirmAddress: 718 Myrtle Ave, El Paso, TX 79901Phone: (915) 577-0913Website: https://dekoatzlaw.com
New research is raising concerns about the Government's proposed ban on vape flavours, warning it could have serious unintended consequences for public health. A county-by-county analysis suggests that almost 60,000 former smokers nationwide could return to cigarettes if only tobacco-flavoured vapes are allowed. In Clare alone, it's estimated that more than 1,200 ex-smokers could relapse. Joining Alan Morrissey on Tuesday's Morning Focus to discuss the findings and the concerns around the proposed legislation was Ken Heffernan, former smoker and spokesperson for Respect Vapers. This podcast features attorney Carl DeKoatz, an El Paso-based lawyer with over 13 years of experience. While his firm handles family law, probate, and estate planning, the discussion focuses primarily on his "bread and butter": Criminal Defense, specifically involving state and federal cases, DWIs, assault, and drug possession.State vs. Federal PracticeDeKoatz highlights a major distinction between the two systems:State Law: More flexible and relationship-based. Building rapport with prosecutors and judges in El Paso allows for more nuanced negotiations.Federal Law: More rigid and procedural. Success depends heavily on legal research, case law, and attacking the government's procedures.Assault and Family ViolenceDeKoatz notes that most assault cases involve domestic disputes (couples, roommates, or family members). Key insights include:The "Dropping Charges" Myth: DeKoatz clarifies that victims do not "press" or "drop" charges; it is always the State of Texas vs. the Defendant.Non-Prosecution Affidavits: While a victim's desire not to proceed helps in negotiations, the state may still prosecute if there is strong evidence like Ring camera footage or photos of injuries.Success Rates: Approximately 85% of his cases are resolved without a conviction, often through classes or deferred probation.Protective Orders: He warns clients to respect Emergency Protective Orders (EPOs) immediately after bonding out to avoid secondary charges for illegal contact.DWI Defense StrategyDrunk driving is a major focus of the firm. DeKoatz offers blunt advice for those pulled over:Avoid "Riding Dirty": Many DWIs start with "wonky" stops for expired registrations or broken tail lights. Keeping a car in good repair removes the officer's probable cause. The Golden Rule: If you've had even one drink, do not talk and do not take tests. * Accept the Arrest: He advises clients to accept they will be arrested rather than trying to "be a cool guy" and talk their way out of it. Refusing field sobriety and breathalyzer tests gives the defense a much stronger starting point to challenge a blood warrant later.Mitigation: For high BAC cases (0.15 or higher) or accidents, where "Pretrial Diversion" (PTD) is usually off the table, he uses character packets (letters from bosses, priests, etc.) to humanize the client and negotiate better deals.Drug Possession: The "Vape" FelonyA significant portion of the conversation covers the disparity in Texas drug laws regarding marijuana:Flower vs. Concentrates: While a small amount of leaf marijuana is a misdemeanor, THC vapes, cartridges, and edibles are classified as State Jail Felonies. The New Mexico Border: Many people are caught bringing legal products from New Mexico into Texas, unaware they are committing a felony.Juveniles: DeKoatz emphasizes protecting the records of students caught with vapes in schools, aiming for expunctions so a "one-off" mistake doesn't ruin their college or career prospects. The El Paso AdvantageDeKoatz concludes by emphasizing that in El Paso, reputation matters. Having practiced in the 34th Judicial District for over a decade, his ability to tell a prosecutor "what the case really is" carries weight because he has a proven track record of winning at trial when negotiations fail.Attorney: Carl Adrian DeKoatzFirm: Carl DeKoatz Law FirmAddress: 718 Myrtle Ave, El Paso, TX 79901Phone: (915) 577-0913Website: https://dekoatzlaw.com

===== MDJ Script/ Top Stories for November 21st Publish Date: November 21st Commercial: From the BG AD Group Studio, Welcome to the Marietta Daily Journal Podcast. Today is Friday, November 21st and Happy Birthday to Stan The Man Musial I’m Keith Ippolito and here are the stories Cobb is talking about, presented by Times Journal Cobb targets millions in federal funds to counter drones, boost World Cup security Smyrna denies five-story apartment building Interrogation videos highlight third day of trial for man accused of killing Acworth neighbors Plus, Leah McGrath from Ingles Markets on rice All of this and more is coming up on the Marietta Daily Journal Podcast, and if you are looking for community news, we encourage you to listen and subscribe! BREAK: INGLES 10 STORY 1: Cobb targets millions in federal funds to counter drones, boost World Cup security Next summer, Cobb County will play host to international soccer teams prepping for the 2026 FIFA World Cup, one of the biggest sporting events ever. With Atlanta set to host eight matches at Mercedes-Benz Stadium, Cobb will handle training, transportation, and fan events. But with that comes challenges—crowds, security, and logistics. To prepare, county officials are asking for Homeland Security grants to boost safety measures, including $7.5–$12 million for drone detection tech. Training sites? Atlanta United’s grounds in Marietta, KSU’s Fifth Third Stadium, and possibly Pace Academy. “The more popular the team, the bigger the crowds,” said Cobb EMA Director Cassie Mazloom. STORY 2: Smyrna denies five-story apartment building The Smyrna City Council shot down a rezoning request for a 250-unit apartment complex this week, with a 5-2 vote against the proposal. Wood Partners South Acquisitions LLC had pitched a five-story mixed-use development on 6.7 acres along Highlands Parkway, near Technology Court. The plan included 250 apartments—mostly one- and two-bedroom units—plus retail space, a pool, and a courtyard. Councilwoman Latonia Hines acknowledged the project’s quality but questioned the location. “It’s a great development—just not here,” she said. The Planning Board and city staff had already recommended denial, citing conflicts with the area’s industrial zoning. STORY 3: Interrogation videos highlight third day of trial for man accused of killing Acworth neighbors On the third day of Matthew Lanz’s murder trial, the defense finally had its turn. Lanz, now 26, sat quietly in a green jumpsuit, his hair unkempt, his face hidden behind a scruffy beard. Prosecutors played interrogation videos from 2021, where Lanz, then 22, denied killing his neighbors, Justin and Amber Hicks. “I didn’t murder them,” he said. “Someone murdered them.” The Hicks, both 31, were found shot to death in their home, their two-year-old son unharmed nearby. Lanz is accused of breaking in through a back window and pulling the trigger. The trial, a bench trial at the defense’s request, will hinge on Judge Sonja Brown’s decision. Prosecutors rested their case Wednesday, leaving the defense to decide if Lanz will testify. In one chilling video, Lanz asked police if Amber Hicks had been pregnant. She wasn’t, but his comment left the courtroom uneasy. We have opportunities for sponsors to get great engagement on these shows. Call 770.799.6810 for more info. We’ll be right back. Break: STRAND THEATRE STORY 4: State Senate election appears headed toward runoff It looks like Democrats Jaha Howard and Roger Bruce are headed for a runoff in the special election to fill the state Senate seat vacated by Jason Esteves. Unofficial results show Howard leading with 32.6% of the vote, followed by Bruce at 25.4%. The six-candidate race was a whirlwind, with just over a month to campaign. “We had to gear up in days,” Howard said, calling the campaign a “faith journey.” Bruce, a Capitol veteran with 22 years in the Georgia House, leaned on endorsements from big names like former Gov. Roy Barnes. The runoff is set for Dec. 16. STORY 5: Smyrna limits vape shop locations, approves Tolleson Aquatic Center contract This week, Smyrna’s City Council cracked down on vape shops, unanimously passing an ordinance to define and restrict them. “Right now, they’re just lumped in with general retail,” said Community Development Director Rusty Martin. “This lets us set some boundaries.” The new rules? Vape shops—defined as retailers primarily selling alternative nicotine or vapor products—can’t open within 1,000 feet of another vape shop, schools, or daycares. In other council news, Arrow Waste got the green light (6-1) for a temporary office on Riverview Road, despite concerns about a nearby fuel tank. Also approved: a $16.23M contract for the Tolleson Aquatic Center, set to open in 2027. And now here is Leah McGrath from Ingles Markets on rice We’ll have closing comments after this. Hackaday Editors Elliot Williams and Tom Nardi start this week's episode off with an update on the rapidly approaching 2025 Supercon in Pasadena, California. From there they'll talk about the surprisingly high-tech world of vapes, a flying DeLorean several years in the making, non-contact pulse monitoring, and the potential of backyard radio telescopes to do real astronomy. You'll hear about a dodecahedron speaker, a page turning peripheral, and 3D printed tools for unfolding boxes. They'll wrap things up by taking a look at the latest generation of wearable smart glasses, and wonder if putting a bank of batteries in your home is really with the hassle. Local vape shop owners say that the flavored tobacco ban Mayor Johnston signed into law last year represents an existential threat to their businesses and a major blow to the City of Denver's sales tax revenues. But will that be enough to convince Denver voters to repeal the ban this November? Producer Paul Karolyi sits down with two local vape shop owners — Kristen Hensel of Rusty's Vape and Smoke Shop and Philip Guerin of Myxed Up Creations — to talk about how kids get access to vapes, the Zyn plant being built in Aurora, and what the flavored tobacco ban means for their businesses. Paul talked about the Geek Bar website, this CU Anschutz report on Denver's flavored tobacco ban, the surge in nitrous oxide, aka “whippets,” in Denver, and Gov. Jared Polis' position on a statewide flavored tobacco ban, which he said he opposed in 2022. He also cited reporting on the repeal campaign's 17,000 signatures and $328,000 raised. We've reached out to the Food & Drug Administration for comment on Phil's claim of regular attempted busts at his shop and haven't heard back.
