In 2020, Alaskans passed a first-in-the-nation voting system which helped energize similar reform efforts around the country. In 2024, Alaska voters are now presented with a ballot measure to repeal this same Final or “Top Four” system that includes a unified open primary of all candidates plus a ranked choice general election. Meanwhile, voters in Nevada, Idaho, Colorado and other states consider measures to pass major elements of the “Alaska model.” This Purple Principle episode features discussion with election law expert and reform advocate Scott Kendall, a major catalyst behind “Top Four” in the frontier state. He explains the impetus behind the initial reform in terms of the perverse motivations elections have traditionally provided to candidates and elected representatives. “We have set up a system that gives all the wrong incentives and then we're surprised when people act on those incentives,” says Kendall, a former chief of staff to independent Governor Bill Walker. “It's as though a teacher graded their students' success on how much they misbehaved in class. And we wanted to change that.” By contrast, Republican state Senator Robert Myers stands in favor of the repeal effort, noting the longstanding Alaska tradition of forming bipartisan coalitions in the state legislature. “I think this a problem in search of a solution,” Myers told us at the 2024 Alaska State Fair. “The way it was passed… a lot of people voting for campaign finance changes didn't realize they were voting to put in a jungle primary and ranked choice voting general election.” New System, Long Tradition? Independent Alaska House Representatives Calvin Schrage and Rebecca Himschoot see the Top Four or Ranked Choice Voting system differently. They think it will preserve and strengthen Alaska's less partisan, more pragmatic political tradition. “Going door to door on my campaign, I'm also talking to voters a lot about the initiative,” says Schrage, the House Minority Leader representing parts of Anchorage. “I think returning to the old system further empowers extreme partisan individuals to choose candidates for us.” Prior to election, Rep. Himschoot was a career educator with a window on family and community challenges in her historically low-income southeast Alaska district. She doubts she would have entered politics without the Top Four system. “It's a planetary test,” says Himschoot. “If we can keep open primaries and ranked choice voting, we have a chance at our state getting to a better place.” Tune in for Part Two of this exploration of the frontiers of election reform. In Landmark Ruling, Alaska Supreme Court Rules that Gerrymandering is Unconstitutional***Today's Links now located below the script***You're listening to the American Democracy Minute, keeping YOUR government by and for the people.The Alaska Supreme Court ruled Friday, April 21st that partisan gerrymandering is unconstitutional, invalidating the 2022 maps drawn from a redistricting commission which had strayed from its constitutional intent to be nonpartisan. Alaska voters approved the 1998 constitutional amendment ballot measure creating a redistricting board by a 52% to 48% margin. The new board was to be staffed by two members appointed by the governor, and one each by the House speaker, Senate president, and chief justice of the state Supreme Court.After two previous cases striking down gerrymandered state house & senate voting districts and forcing court-ordered interim maps for the 2022 midterms, for this case, the state justices delved into the history and the intentions of the original law. In the 144-page ruling, they concluded, “We expressly recognize that partisan gerrymandering is unconstitutional under the Alaska Constitution.” The Anchorage Daily News quotes Scott Kendall, attorney and chief of staff to former Gov. Bill Walker, as saying, “This is an incredibly important case. For the first time the Alaska Supreme Court has interpreted the equal protection doctrine to prohibit gerrymandering for partisan purposes. Many western states are making significant structural changes to their campaign and election laws. Innovations like ranked-choice voting and new campaign financial disclosures rules are taking hold in many states, including California, Washington, Arizona, and Alaska. These changes are having real impact on the ground, as evidenced by the recent primary election in Alaska, where ranked-choice voting resulted in a Democrat being elected to Congress for the first time in five decades.Other legislative changes across the west address political speech and its funding sources, including Alaska’s recently enacted ban on so-called “dark money;” Arizona’s Proposition 211 measure, which was passed in the recent election; and Oregon’s consideration of introducing a similar measure on the ballot in 2024. In addition to significant policy debates over the merits of these policies, lawyers are challenging their constitutionality based on First Amendment speech and association grounds. APF released the following press release recently."Yesterday, the Institute for Justice (IJ) teamed with a group of Alaska families to defend the state's Correspondence School Allotment Program (CSAP) against an NEA-funded lawsuit that seeks to end parents' ability to use their correspondence school allotments for private educational services. IJ, a nonprofit public interest law firm, has filed a motion to join the case, to defend Alaska families and the current school choice program. Alaska has overhauled its election process. The biggest change coming is the exclusion of closed primary party elections. Scott Kendall, Attorney and Former Chief of Staff to Alaskan Governor Bill Walker, breaks down the major changes with John Howell and explains how this will help future elections.
In the latest episode of Toppling the Duopoly, host Shawn Griffiths and his guests discuss a lawsuit that seeks to overturn the will of the people in Alaska, who approved a comprehensive reform amendment in November 2020 that: Shines a light on dark money in state politics Implements a nonpartisan top-four primary Makes Alaska the second state to adopt ranked choice voting Joining Shawn to talk about this is Jason Grenn, executive director of Alaskans for Better Elections, and Scott Kendall, attorney for the group. Alaskans for Better Elections spearheaded the campaign for the amendment, which was on the ballot as Ballot Measure 2, and is now an intervening party in the lawsuit against it. The plaintiffs in the lawsuit assert that the new system harms individual rights to association on the ballot, but the courts have already weighed in on this in multiple states for similar systems, and found this claim to hold not merit since it treats voters and candidates equally from the onset of the electoral process. Jason and Scott talk about Ballot Measure 2, the lawsuit, and continued efforts to increase voter education on the new electoral system created under the amendment, which they say is boosting support even more. Even legislators are coming together and forming cross-partisan coalitions as the new system shifts the incentive structure to put voters before party.
