This episode is with Rob Whiteman, the Chief Executive of CIPFA. Rob is a very thoughtful and influential commentator on local government and public service reform. He has had a hugely interesting and varied career including stints as Chief Executive at the London Borough of Barking and Dagenham and at the UK Border Agency (UKBA). Rob was at Barking and Dagenham when the BNP won an unprecedented number of council seats and he describes how the council worked to reengage with local communities to push back against some of the dangerous propaganda which had led to this election outcome. The learning from this is very relevant for council leaders today as many of our communities become increasingly polarised. As the former head of UKBA, Rob also provides some historical context and contemporary commentary on the small boats crisis. We spend most of our time talking about the state of local government and the main drivers for the financial crisis the sector finds itself facing. We discuss what the solutions could be including a return of a more radical version of Total Place, more collaboration between councils on issues like children's social care and the potential of enhanced powers for Mayoral Combined Authorities. I also ask a new question “What would you do it you were Prime Minister for a day?”. Rob has a pretty radical answer!

Welcome to Episode 8 of Compliance Man Chooses the Target with Tim Khasanov-Batirov. The goal is to highlight matters that should be on agenda of practitioners that deploy compliance programs in industries or countries of active anticorruption enforcement. Today we will focus on future of compliance in the reality of emerging markets. Target #1: What is Compliance? During last ten years, Compliance Man has been witnessing interesting phenomena. Compliance became a popular concept in business and legal communities. Many countries have adopted laws, which deploy compliance philosophy. Many corporations have huge compliance departments. In the very same time, there is no universally acknowledged methodology what to consider compliance system or compliance as such. This problem extends far beyond borders of emerging markets being a global challenge for professional community. Compliance as professional occupation has to pass certain stages of development like internal audit did in early 2000s in order to form universally recognized standards. Target #2: Next Generation of Compliance Professionals Based on what we have discussed earlier on we came to another challenge, which is preparation of new generation of compliance professionals. Let’s take the following example. When employer hires a graduate from a law or medical school, he/she has a clue what knowledge and skills a graduate has. In case of hiring a young compliance professional, it is impossible to evaluate his/her academic proficiency as there are so many courses, trainings, academic programs which might not share even very basic compliance methodical approaches.      Target #3: Think Globally Act Locally? Implementation of corporate anticorruption program in the reality of emerging markets requires necessity to address both local legislation and extraterritorial laws as for instance UKBA and FCPA. Big multinationals also have piles of internal ethical rules to be deployed at their subsidiaries internationally. In addition, as previously mentioned we have been witnessing a boom of local compliance initiatives and sometimes new laws which companies have to follow as well. As a result, compliance officer faces the necessity to implement many requirements, which sometime might contradict to each other. We are back to our more rounded format for this episode on a variety of topics including anti-corruption enforcement across the globe, the new French anti-corruption law, Sapin II, the Agricultural Bank of China compliance enforcement action by the state of New York Department of Financial Services; how corruption influences as much as it pays money and individual accountability for corporate malfeasance is not a Democratic or GOP issue but a law enforcement issue. We end with a well-deserved one minute rant from the panel about what is in the front of their mind. Mike Volkov discusses the internationalization of anti-corruption enforcement. He refers to the comments from the ACI FCPA conference, by Kara Brockmeyer and Dan Kahn about the increasing international enforcement efforts against corruption. This extends far beyond cooperation but also to enforcement. Recent examples are VimpelCom and Embraer where other countries received proceeds from fines and penalties. How does a company begin to deal with this type of complexity? Who does it disclose to? Who does it pay? When will the US give credit for payments made to other countries and when does it not? Finally this year saw of the third joint DOJ/SEC week long training for foreign prosecutors put on in DC. How do such events assist enforcement efforts, particularly around cooperation and mutual assistance? He explains what does it all means and then pivots into a discussion of where he might see state regulators such as the state of New York Department of Financial Services or state banking regulators becoming more aggressive if the Trump administration pulls back? He discusses how these issues may have relevance for areas of compliance other than bribery and corruption and if so how. Finally, he ends with a reverse states’ rights discussion of Democratically aligned states fighting federal roll back of rights and privileges through litigation. He discusses the genesis of the law and why prior French efforts at anti-corruption law and enforcement was so harshly criticized by the OECD. He articulates how Sapin II differs from the UKBA, FCPA, the Brazilian Clean Companies Act and other anti-corruption laws across the globe. He talks about where he envisions French enforcement efforts going and the whistleblower protections of the law. Jay Rosen takes us through a Paul Krugman NYT post on some of the invidiousness of corruption, focusing on the corrupting nature of compliance around undue influence. Rosen explains incentives more than anything else and how such incentives skew the marketplace. We consider whether Trump’s discussions with the Carrier Corp over jobs was unduly influenced recalling President Kennedy’s ‘jawboning’ of the US steel industry in the 1960s. He also discusses the remarks of Sally Yates at ACI national FCPA conference about individual accountability and how this is not a GOP or Democratic issue but a criminal enforcement issue. Dimitris Dalakoglou, University of Sussex, gives a talk for the Arrival Cities COMPAS Seminar Series. In 2010, it was reported that out of the 510 border guards employed in the country, 473 were, in fact, serving in Athens. Indeed, deployment of border guards in cities has become standard practice these days; for example, in the summer of 2013 UKBA organized a large-scale operation in London’s underground stations stopping and checking migrants and people of migratory origin. This urbanisation of security and military techniques developed supposedly to protect the borders of a nation-state from a military attack is just part of a wider process which reconfigures the social class divisions in Western European metropolises. This new political economy which often passes over the bodies and lives of non-Western migrants, at the time of crisis, finds one of its major materialisations in the centre of Athens along the Greek part of the common European borders. This paper, drawing from an 18-month long ethnography in Athens, will attempt to set a light to the urban everydayness that follows the current financial crisis.

Ira Putilova has been detained today by UKBA officials. Ira is an LGBTQ person from Russia who is currently claiming asylum in the U.K for her own safety. In Russia she was harrassed, followed, and attacked, by state officials, the police and Neo Nazis because of her political activism and LGBTQ status; if she is returned to Russia she is likely to face torture, detention, and potentially death. She was taken to Yarls Wood Immigration Removal Centre and may face imminent deportation. Her campaign asks everyone reading this to spread the word about Ira and her situation, and to contact groups or people who might be able to help. Foreign nationals are making a full-time living by illegitimately selling same-day visa appointments because of long-standing problems with the UK Border Agency's online booking system. People wanting to take advantage of the premium same-day service to extend or renew their existing visas are resorting to buying appointments from unofficial agents operating from abroad. The costs can escalate to four times the price of an original appointment when individuals book through a Uk-based immigration specialist.

Visa Trouble at London Metropolitan University

The UK Border Agency recently revoked London Metropolitan University's licence to sponsor overseas students, meaning that it can no longer recruit or continue to teach current students. According to the Government, the UKBA found systemic failings in the way the university managed its records. It found that many students did not have permission to study in the UK, did not have the correct English language or academic qualifications, while in other cases there was not enough evidence students were attending their courses. London Met on the other hand does not recognise these problems, and is taking legal against the UKBA's decision. Wesley Stephenson asks why the licence was revoked. Has London Met been lax in its recruitment and monitoring of students, or has it fallen victim of a complicated visa system? Why did the UKBA act now? Was there overwhelming evidence of systemic failings, or was there political pressure to take tough action?

Border guards and other Home Office staff are due to strike today (July 26th) in protest at staff cuts, pay and privatisation. The move has been condemned by the government who say the action by workers in the Border Force is designed to cause maximum disruption on the eve of the Olympics. Around 120,000 passengers are expected through Heathrow on Thursday alone. The Report examines the reasons behind the strike. Unions say the drive to ensure no queues at Heathrow has come at a cost. They point out the UK Border Agency and Border Force has cut a thousand more jobs than planned and staff are being drafted in from other areas to ensure immigration desks are fully manned. But they complain these staff aren't fully trained and security is being jeopardised. Adrian Goldberg also investigates concerns that UKBA is not doing enough to trace and deport many people who should not be in the country.
