Today, we have an exciting new episode of the Passing Judgment podcast where we're joined by Dahlia Lithwick, senior legal correspondent at Slate and author of the book "Lady Justice". In this episode, we explore a range of intriguing topics, from the court's centrist decisions and its challenges to regulatory agencies, to the crucial cases that will shape the future of the First Amendment and technology. And don't miss out on our exploration of Georgia legends Sally Yates and Stacey Abrams, their divergent paths in the legal system, and the disparities in access that still persist today. Here are three key takeaways from the episode:1️⃣ The episode highlights the impactful work of Stacey Abrams, who fought against voter suppression and created a successful model for other states. This is a reminder that grassroots efforts are integral in shaping our democracy.2️⃣ We explore the incredible legacy of Pauli Murray, a constitutional hero who played a pivotal role in shaping the thinking about the 14th Amendment. Murray's contribution often goes unrecognized, underscoring the importance of acknowledging the work of unrecognized individuals who fight tirelessly for equality and justice. It's a reminder that progress is driven by nameless heroes.3️⃣ We discussed the impact of prominent lawyers like Roberta Kaplan, whose high-profile lawsuits have brought about significant legal victories.Follow Our Guest:On X formerly known as Twitter: @DahliaLithwick.Follow Our Host:On X formerly known as Twitter: @LevinsonJessica

Would you give up on a 16 year old kid for life? The Judge gave Bobby Bostic a sentence of 241 years in prison without the possibility for parole until he was 112 years old. Bobby was an accomplice in two armed robberies. Judge Evelyn Baker sentenced him to die in prison without giving him an official life sentence. If he had been given a life sentence he would have been eligible for parole after 25 years. Judge Baker said, "your mandatory date to go in front of the parole board will be 2201. Nobody in this room will be alive in the year 2201." A very dark statement, that Judge Baker later regretted. She began to do research about the brain of a teenager and when it is fully developed. The Judge became an advocate for Bostic's release. She was the first person he hugged 27 years later when he was released. A lot had to happen before that release. Laws had to change. In 2010, The Supreme Court mandated parole hearings for juveniles that were sentenced to life without parole. The problem was that ruling did not apply to Bobby because the way he was sentenced was multiple offenses that added up to life. He fell into a legal loophole. The failed appeal before the Supreme Court was argued by Ken Starr, Sally Yates, with the support of 100 plus law enforcement officers, prosecutors, and former judges. The Missouri law was changed in 2021 that gave Bostic an opportunity of a parole hearing. In those 27 years of prison, Bobby reformed into a model prisoner. He wrote seven books on his typewriter. He wrote letters to people and sought funding for his college education. And like in the movie "Shawshank Redemption," he built a fully stocked library with the help of St. Louis Public Libraries. Again, after several letters seeking help. Bobby was released November of 2022. Bobby says, "I want to be a mentor and teach young people to take a different path than I did when I was a young child myself." Bobby Bostic books (Amazon), Dear Mama, A Generation Misunderstood, Life Goes On In Prison, Mental Jewelry, Mind Diamonds, When Life Gives You Lemons make Lemonade, and Endless Moments In Prison.

And on today's show, we're republishing one of those episodes, which originally ran on October 4, 2022: In 2021, the National Women's Soccer League faced a crisis. Explosive allegations from players of abuse, sexual harassment, and unrelenting coercion by one of the NWSL's most successful head coaches set off a reckoning across the entire league. The commissioner resigned. Games were canceled. Players had no collective bargaining agreement and the specter of a canceled season loomed, all while governing bodies opened investigations into misconduct and toxic work environments. And in October, a long-awaited report investigating the failures of the NWSL was released by former acting attorney general Sally Yates, which detailed systemic abuse within the league, and specifically “a culture of abuse, silence, and fear of retaliation” that perpetuated the misconduct. Jennifer Karson-Strauss directed the E60 film, “Truth Be Told: The Fight for Women's Professional Soccer,” and joins the show to discuss the film's investigation into allegations of abuse, sexual coercion and a toxic work environment in the league, as well as the lack of action taken by NWSL leadership. Over the past few years, we've heard shocking allegations from women athletes about experiencing sexual harassment and abuse. And earlier this week a report was released outlining a pervasive culture of abuse among coaches in the National Women's Soccer League. Elite women soccer players were subjected to a range of abuse - from belittling comments to sexual advances.Sally Yates, former Acting Attorney General, led the investigation – which was a response to allegations made last year against coaches by a number of women players. Many of the charges had been reported in the past but never acted upon. Host Michel Martin speaks with Steph Yang, staff writer for The Athletic who covers women's soccer and Julie DiCaro author of the book "Sidelined: Sports, Culture and Being a Woman in America".In participating regions, you'll also hear a local news segment to help you make sense of what's going on in your community.Email us at considerthis@npr.org.

And on Monday, a long-awaited report investigating the failures of the NWSL was released by former acting attorney general Sally Yates, which detailed systemic abuse within the league, and specifically “a culture of abuse, silence, and fear of retaliation” that perpetuated the misconduct. Dahlia Lithwick is the senior legal correspondent at Slate and host of Amicus, Slate's award-winning biweekly podcast about the law.  Her work has also appeared in The New York Times, Harper's, The New Yorker, The Washington Post, The New Republic, and Commentary, among other places. Lithwick won a 2013 National Magazine Award for her columns on the Affordable Care Act. She was inducted into the American Academy of Arts and Sciences in October, 2018. ABOUT LADY JUSTICE “Stirring…Lithwick's approach, interweaving interviews with legal commentary, allows her subjects to shine…Inspiring.”—New York Times Book Review “In Dahlia Lithwick's urgent, engaging Lady Justice, Dobbs serves as a devastating bookend to a story that begins in hope.”—Boston Globe Dahlia Lithwick, one of the nation's foremost legal commentators, tells the gripping and heroic story of the women lawyers who fought the racism, sexism, and xenophobia of Donald Trump's presidency—and won After the sudden shock of Donald Trump's victory over Hillary Clinton in 2016, many Americans felt lost and uncertain. It was clear he and his administration were going to pursue a series of retrograde, devastating policies. What could be done?   Immediately, women lawyers all around the country, independently of each other, sprang into action, and they had a common goal: they weren't going to stand by in the face of injustice, while Trump, Mitch McConnell, and the Republican party did everything in their power to remake the judiciary in their own conservative image. Over the next four years, the women worked tirelessly to hold the line against the most chaotic and malign presidency in living memory. There was Sally Yates, the acting attorney general of the United States, who refused to sign off on the Muslim travel ban. And Becca Heller, the founder of a refugee assistance program who brought the fight over the travel ban to the airports. And Roberta Kaplan, the famed commercial litigator, who sued the neo-Nazis in Charlottesville. And, of course, Stacey Abrams, whose efforts to protect the voting rights of millions of Georgians may well have been what won the Senate for the Democrats in 2020. These are just a handful of the stories Lithwick dramatizes in thrilling detail to tell a brand-new and deeply inspiring account of the Trump years. With unparalleled access to her subjects, she has written a luminous book, not about the villains of the Trump years, but about the heroes. And as the country confronts the news that the Supreme Court, which includes three Trump-appointed justices, will soon overturn Roe v. Wade, Lithwick shines a light on not only the major consequences of such a decision, but issues a clarion call to all who might, like the women in this book, feel the urgency to join the fight. A celebration of the tireless efforts, legal ingenuity, and indefatigable spirit of the women whose work all too often went unrecognized at the time, Lady Justice is destined to be treasured and passed from hand to hand for generations to come, not just among lawyers and law students, but among all optimistic and hopeful Americans.
