The Teamsters say that it's a breach of contract and will be announcing a strike. TEAR which is aided by former guest of the show Desiree Wood, is out of money. TEAR would help drivers who were abandoned by bankrupt or criminal Motor Carriers. Desiree Wood began writing about her experiences as a single, Mexican-American female entering the trucking industry in 2008 on the “Ask the Trucker” blog. Using only a cell phone, her story entitled “A Day in the Life of a Lady Trucker” caught the attention of Dan Rather and became the basis for four of his investigative reports into truck driver training. In 2010, after realizing other trucking associations were not addressing poor and unsafe training nor sexual assault in any meaningful way, Desiree formed REAL Women in Trucking. Recognized internationally by policymakers and drivers, Desiree is lauded for her advocacy for truck drivers and specifically women entering the industry. She is an expert on entry-level truck driver training fleet practices and provides insight to law firms on truck driver recruiting, retention and training programs. She is sought out by scholars, universities, and the public sector who seek an authentic truck driver perspective. She provides support and leadership for legislative/public policy efforts including the Jason's Law movement to improve truck parking, the FHWA National Coalition on Truck Parking, as well as state and local truck parking plans and programs. TNCRadio.LIVE Truckers Emergency Assistance Responders Truckers Emergency Assistance Responders – T.E.A.R. was founded in 2019 by three truck drivers who saw a need to help fellow drivers that suddenly find themselves stranded out on the road and unable to get home with their belongings. Issues such as carrier abandonment, wage theft, retaliation, truck accident, sexual misconduct between trainers/co-driver teams, and other various scenarios are what cause truck drivers to become stranded out on the highway with pets and belongings. Too often, these drivers must suddenly find a way to get home, if they have a home at all. Truckers Emergency Assistance Responders – T.E.A.R. is a 501 (c)(3) charitable organization recognized by the IRS in October 2019. T.E.A.R. is not a handout but rather a hand-up to help fellow truck drivers in distress, get back to work after a traumatic event to fill the gap when other driver resources are not available.

It’s not an easy task exploring the reasons for the decline of truckings’ "American Dream" for OTR drivers, company drivers and owner operators. We can make a list of everything wrong with trucking and how it affects truckers, but to pinpoint the problems in order to resolve them is much more difficult. It is a highly intricate and complicated web of obstacles, involving rules and regulations interwoven with industry practices, systems and schemes. Although most of us weren’t a part of trucking prior to deregulation, most will agree that trucking and truck drivers played a major part of the American Dream during that time. Deregulation is not the sole reason for the decline of the American Dream, it has however, caused trucking to evolve into an industry of "them against us" but in order to fix something, we need to understand it. We have the honor to have with us Steve Viscelli, sociologist and long time researcher of  truck drivers and the trucking industry. His pursuit to find out why truckers work so hard and how long-haul trucking went from being one of the best, to one of the toughest blue-collar jobs in the U.S. led him to obtain his CDL and continue his research from behind the wheel. His research, along with his time Over the Road, resulted in his book, “The Big Rig - Trucking and the Decline of the American Dream” Also with us will be our long time friend and fellow advocate Desiree Wood of Real Women In Trucking who will be sharing her present real-time experiences for those who may not be aware of what is currently happening within her organization. Thursday 1-24-19  6PM ET  347-826-9170 Part 2 Join us tonight as we have a follow up show with trucker Dominic Oliveira and his Attorney from Public Justice, Jennifer Bennett. Dominic will review his lengthy legal ordeal with New Prime, Inc that ended up in the Supreme Court and Ms. Bennett will explain the legal timeline of events and arguments and how this decision will positively affect truckers in the future. Desiree Wood, who contributed in an Amicus brief, will co-host the show. On 1-15-19 the U.S. Supreme court ruled that Transportation Independent Contractors were no longer held to the 1925 Federal Arbitration Act (FAA). In the past, only employees were exempt from forced arbitration. The decision was held by a unanimous 8-0 decision, with Justices Neil Gorsuch and Ruth Ginsberg strongly agreeing. (How many times in a lifetime will we see that?) For years Carriers have misclassified truckers leased on to carriers as Independent Contractors( IC) for the  purpose of having the trucker pay for all expenses while the carrier still asserts control over most aspects of how the IC does business, many times resulting in the IC earning little, sometime less than minimum wage, and worse yet, end up owing the carrier money. This misclassification had also forced IC’s into arbitration. In March 2015 trucker Dominic Oliveira sued New Prime, Inc in a class-action suit claiming a Fair Labor Standards Act violation for failing to pay its apprentices  lawful minimum wage. Prime claimed that he must go through arbitration, Attorney’s for Dominic said “No” and the rest is history

It’s been over 7 years since the focus of Americas truck parking shortage took center stage when New York truck driver Jason Rivenburg was murdered as he parked in an abandoned gas station. His widow, Hope Rivenburg,brought the truck parking crisis to the forefront, lobbying for the bill “Jason’s Law” ,which was eventually included in MAP-21. The National Coalition on Truck Parking was created by the U.S. DOT's Federal Highway Administration (FHWA) to address the shortage of truck parking across the nation. From Jasons Law, to Map 21, to the National Truck Parking Coalition, many drivers are still struggling to find adequate truck parking. Also with us is Desiree Wood of Real Women in Trucking, who has worked side by side with Hope Rivenburg from the beginning of Jasons Law, to the 1st truck parking survey, and continues to be a voice at the Truck Parking Coalition meetings. “It’s all about Safety”  These are the famous words you’ll hear whenever a call to action needs support, usually creating laws and regulations affecting professional CMV drivers. Along with such calls for more laws will follow the lobbyisst in support, fitting their agendas.  Where is the call to action for ”Michaels Law Amendment” an Amendment to 18 U.S. Code 926A proposed by James Lamb of the SBTC?  The proposed amendment, would expand the existing Federal “Interstate Transportation of Firearms” statute into a right-to-carry law for all Americans engaged in interstate commerce. According to the Department of Labor, one person is MURDERED in the transportation industry EVERY WEEK!  Should the NRA be supporting this? Next, CRST refers to safety also in their request for exemption at the FMCSA. According to CRST, allowing CLP holders (Commercial Learners Permit) to drive team, with little or no OTR driving experience, U.S. highways would be safer and more productive.
