The ANC has rejected comments made by expelled former Secretary General Ace Magashule that he had not received any communication from the party that he provide reasons to the national disciplinary committee why he should not be expelled. Magashule missed the deadline to oppose disciplinary findings against him on charges of misconduct and bringing the party into disrepute. This relates to his unsanctioned attempt to suspend party President Cyril Ramaphosa and his failure to apologize. The ANC National Disciplinary Committee's decision was a result of Magashule missing the deadline. Reacting to judgment in the President Cyril Ramaphosa and former president Jacob Zuma court case, former ANC member Carl Niehaus said the judiciary will lead the country to collapse. Ramaphosa had applied to the Johannesburg high court to set aside his prosecution as unconstitutional and unlawful. He asked the court to interdict any “further steps” in pursuing the prosecution and to excuse his appearance in court on January 19, as demanded by the former president. Zuma filed a case against Ramaphosa, arguing he is an “accessory after the fact” in relation to charges Zuma is pursuing against prosecutor Billy Downer and journalist Karyn Maughan. The court granted Ramaphosa the interdict which means he does not have to appear in the dock on Thursday. Jacob Zuma Foundation spokesperson Mzwanele Manyi said their suspicions were vindicated by the appointment of three judges instead of one. Manyi had said the appointment of a full bench confused and intrigued the foundation.

Former African National Congress (ANC) Veterans' League spokesperson Carl Niehaus has been expelled from the ANC. The ANC's national disciplinary committee (NDC) found Niehaus guilty of six charges of misconduct. The charges are in connection with comments Niehaus made in July outside former president Jacob Zuma's residence in Nkandla, northern KwaZulu-Natal, where he protested against Zuma's incarceration for being in contempt of the Constitutional Court. In a letter dated 12 December 2022, ANC NDC chairperson Ralph Mgijima cited Niehaus' disparaging remarks against the judiciary as having led to him being charged by the party. Niehaus had called the Constitutional Court's ruling "a travesty of justice”. “The flimsy report of the state capture report of the Public Protector was used to force president Zuma to announce the state capture commission eventually. President Zuma did not want to do so of his own volition,” Niehaus said. According to the findings, Niehaus also said, “The law is being used selectively as an instrument to fight political and factional battles.” In his defence, Niehaus argued that the utterances were made while executing an order of the Umkhonto we Sizwe Military Veterans' Association as its national spokesperson. He also argued that the ANC does not have a policy on what utterances may not be made against the judiciary. The NDC, however, indicated that the ANC's national executive committee (NEC) in 2018 supported the establishment of the state capture commission under then Deputy Chief Justice Zondo and called on all ANC members to give full cooperation to the commission and respect its recommendations. Mgijima also highlighted that on 29 June 2021, ANC national spokesperson, Pule Mabe, reiterated the ANC's position on the Constitutional Court judgment when he said that although the party was going through a difficult period, the party “reaffirmed its commitment to upholding the rule of law and fulfilling the aspirations of our constitutional democracy”. ANC member Fikile Mbalula was among party leaders who testified against Niehaus. However, his testimony was later not given any consideration when passing judgment as the accused was not afforded the opportunity to cross-examine him. Niehaus brought former MKMVA treasurer-general Des van Rooyen to give testimony on his behalf. In his findings, Mgijima said the committee believed that the charges for which Niehaus had been found guilty were severe. “As such, the charged member's plea that he be sanctioned with a reprimand if found guilty is wholly inappropriate." The NDC resolved that “the charged member [Niehaus] is expelled from the ANC". In handing down such a hash ruling, Mgijima said the NDC had taken into consideration that the utterances were made by Niehaus “at a time when the circumstances surrounding the arrest and subsequent committal to prison of former president Zuma was very volatile as evidenced by the subsequent riots which took place in KwaZulu-Natal and parts of Gauteng and resultant loss of life and limb and damage to and loss of property”. The NDC found that Niehaus had not demonstrated any remorse and persisted in his view that the ANC was violating its constitution and his rights by disciplining him. “The NDC took into consideration the fact that the charged member is a senior and long-standing member of the ANC, had served a term of imprisonment for his political beliefs, and held strong and sometimes contrary views on the policies of the ANC and positions adopted by the NEC from time to time." Niehaus was not immediately available for comment.

Supporters of former eThekwini mayor, Zandile Gumede and her 21 co-accused were visibly angry in court when it was announced that her corruption trial would be postponed to 29 March 2022. The postponement was, in part, as a result of Gumede's legal representative advocate Jay Naidoo having suggested that the high profile corruption, money laundering and racketeering case be set from July to September 2022. The news was met with great displeasure by Gumede's supporters, who, despite her legal team motivating for a trial date starting in July next year, accused the State of not having a solid case against her hence the numerous postponements. Speaking to the media outside the Durban High Court, staunch Gumede ally, Nkosentsha Shezi, questioned why the public and some media houses were denied entry into the court room. "When she [Gumede] was arrested and her house searched, the media and the public where privy to the proceedings and now that she is being charged with trumped up charges, both the media and the public are no longer allowed to witness the proceedings. If the NPA has nothing to hide, then why is the media not allowed? "Doing things in secrecy is not giving this case any credibility. What is going to happen is that they are going to slaughter justice in there and Gumede will not have a fair trial," said Shezi. He accused the NPA of "being used like a gangster" to target people who the current ANC leadership did not consider as allies. Another Gumede ally, Carl Niehaus, said: "Today uMama uZandile Gumede is again, for the umpteenth time, appearing in the Durban High Court in the perpetually postponed and politically motivated trial against her." He added that "this harassment must end now". The case started in early 2019 when the Hawks arrested Gumede and later her co-accused, accusing them of having unduly benefitted after the awarding of a R320-million waste contract in 2017. In total, the accused face 2 793 charges. In its docket, the State alleged that Gumede, former city manager Sipho Nzuza and others were involved in a criminal enterprise to fleece the eThekwini metro out of money.

How that personality gave rise to the insurrection on the Capital on January the 6th. The events that have unfolded over the past few days here in South Africa has shone a spotlight on our vulnerable society and how political leaders and personalities use the status quo to advance their own agendas and to protect their own selfish interests. What we saw here in the province of KZN and Gauteng was a well orchestrated attempt by the faction of the ANC aligned to Jacob Zuma who has been imprisoned for contempt of court. Zuma and his RET faction has always been a Cult of Zuma within the ANC organization itself. With the RET faction realising that their Zuma faction was slowly being rooted out and confronted by the Ramaphosa faction, it was time for them to stage a fight back to protect their criminality and own looting of the state coffers for over a decade. Their aim was to destabalise the economy and SA as a whole by crippling our supply chain and infrastructure. The names of those responsible are already known according to the Minister of Police and Minister of State Security. A reformed National Prosecuting Authority has put key players like suspended Secretary-General Ace Magashule on the defensive as he faces Free State-related corruption charges in court in August. The ANC itself has put its own reform into top gear. In the past week, it has suspended RET spokesperson Carl Niehaus, Mpumalanga leader Michael Ngrayi Ngwenya and on Wednesday suspended the Eastern Cape renegade politician, Andile Lungisa. And as I've said before in a podcast on political cults that history is littered with examples of this. Show people the contradicting statements and utterances of these characters and cognitive dissonance sets in. Their minds simply short circuits in an attempt to justify and legitimise the contradictions and flip flops. Some people will wake up and some won't. There is no doubt that the criminal element took over the chaos which was instigated by the hidden hands under the veil. Many were opportunist going along with the masses and got swept up in herd mentality. And as this dies down within the next few days, and communities pick up the pieces in the aftermath, this will have an effect on peoples mental health, physical health and overall well being. But they will rebuild. Those who instigated this madness should be held accountable. South Africa has a fragile economy and may have survived this past week of violence and mayhem. But only just.
