In his second interview with BizNews, the real founder of uMkhonto weSizwe Party (MKP), Jabulani Khumalo, bluntly calls Advocate Dali Mpofu a liar for claiming that he secretly set up MKP with former President Jacob Zuma. However, he says Mpofu was part of a plot to hijack the party he had founded. He also describes how he had guns pointed at him twice after false claims that he was going to deregister MKP. He speaks of how Zuma is making “all these mistakes” because he is bitter and angry - especially at President Cyril Ramaphosa. Khumalo is outraged at the corruption accused in MKP's top structure - and says they are not in MK to work for the people. “They are in there to fight their battles”. As for the Government of National Unity (GNU), Khumalo says: “For me, it's a joke. People of South Africa need a government that is clean…GNU is doing nothing for the people. They are only trying to safeguard their positions in the government.”

Economic Freedom Fighters (EFF) leader Julius Malema has responded to the recent resignation of former Chairperson Advocate Dali Mpofu, who has announced his departure from the party to join Umkhonto We Sizwe. Speaking on the social media platform X, Malema hinted that at least two more senior EFF leaders are likely to leave soon. Despite this, Malema confidently declared that the EFF remains resilient and unshaken. Mpofu's resignation could signal further shifts within the party as it prepares for its upcoming elective conference in December, as the party grapples with an ongoing wave of resignations among its senior members. We're into an extremely tough time in our past, 1851, and about to hear about the struggle for control of an area of the Amatolas that the Boers had named Waterkloof - better known by local amaXhosa as Mtontsi. It was a case of jungle warfare as you're going to hear. The area of operation was only 40 square kilometers and yet it remained out of Britains control for most of the 8th Frontier War. If you have an old steam driven hard copy map of the area, or can fire up your trusty digital device of choice, go to Google maps and focus on the area between the Kat and Koenap Rivers, to the west of the town of kwaMaqoma which used to be known as Fort Beaufort. Just to add a bit of post-modern spice here, nearby Cookhouse wind Farm is one of the largest in South Africa on the high ridge east of the Great Fish River. The Waterkloof itself is a deep, narrow valley, six kilometres long, bounded by the Kroomie Heights to the south and to the north by a second series of majestic ridges falling away to a rolling plateau. Running roughly south-east and open at its western side, it comes to a head in a high, grassy tableland fringed with bushes and gigantic trees. To the east, this tableland falls away into another deep, heavily-forested gorge, known as Fuller's Hoek. It was in this gorge, in a gigantic overhanging cave of a type that proliferates in the area, that amaNqika chief Maqoma had his headquarters. The plateau is linked to the Kroomie by a narrow ridge and where this joins the plateau is a 'horseshoe-shaped flat', approximately a square kilometre in area and fringed by towering forests. In due course it would be named 'Mount Misery' by the British troops who fought in or near there. In the mountain fastnesses above, there are two reserves today - Mpofu and Fort Fordyce. Here you'll still find the Chacma baboon, black wildebeest on the escarpment, blue duiker, mountain reedbuck. If you're lucky you'll spot the Cape Parrot, and eagles, while the playful Knysna Loeries abound. The Caracal is the largest predator there these days, but in the past leopards would stalk here - eating a snack of rock dassie. By February 1851 the bitterness of the 8th Frontier War was becoming more evident with descriptions of British troops being captured and tortured to death by the amaXhosa. Settlers and regular troops marched through the Thyumie valley in February in revenge, burning everything and carrying a flag which had the word “Extermination” emblazoned for all the see. Governor Sir Harry Smith had advocated extermination of the amaXhosa and the Khoekhoe in letters and conversations - he was panikcing besieged in King Williams Town and chaos was the order of the day - the governor was lashing out. No quarter was being given by either side - man against man. Somerset was stung into action. On 7th September he sent a large patrol into the Waterkloof, 600 men from the 74th Highland Regiment under Lieutenant Colonel Thomas Fordyce. The man who was to give both his name and his life to these mountains.

Advocate Dali Mpofu (SC) has warned that the rights of former president, Jacob Zuma under Section 19 of the Constitution would be infringed if he were to be declared as ineligible to stand for public office.  Mpofu is representing the Umkhonto weSizwe Party before the Electoral Court. The party is appealing the decision by the Independent Electoral Commission to uphold objections to the standing of former President, Jacob Zuma for public office under Section 47(1)(e) of the Constitution. Section 47 states that anyone who is convicted of an offence and sentenced to more than 12 months imprisonment without the option of a fine is disqualified to stand for public office. Mpofu has lamented the attitude of the IEC towards the former President and says the exclusion of the former President would disenfranchise supporters of the party, Zuma and the MK party. Sakina Kamwendo spoke to SABC reporter, Zoleka Qodashe.

Advocate Dali Mpofu had a hard time with former public protector Thuli Madonsela at the section 194 inquiry into suspended public protector Busisiwe Mkhwebane's fitness to hold office. Mpofu was uncomfortable with Madonsela changing her affidavit statements, saying some pages were not signed by the commissioner of oaths. Madonsela said her first statement had typos, that she had to amend it and make corrections and was alone with no commissioner of oaths when she made the amendments. The committee said Mpofu must prove if it's law that each page should be signed by a commissioner of oaths in which he referenced. Madonsela said Mpofu fabricated lies about the affidavits.

The parliamentary committee conducting an inquiry into suspended public protector Busisiwe Mkhwebane's fitness to hold office and her legal counsel fought over the resumption of proceedings. Mkhwebane's legal team, led by advocate Dali Mpofu, was unhappy about the inquiry resuming as it has not been paid by the public protector's office. It was also unhappy about witness Bianca Mvuyana not making an affidavit. Mpofu asked Mvuyana if she had opted not to make an affidavit as communicated to the legal team and she denied not wanting to make an affidavit. A shouting match ensued between Mpofu, chairperson Qubudile Dyantyi and some MPs.

Jacob Zuma Foundation spokesperson Mzwanele Manyi believes Jacob Zuma's legal counsel has demolished Cyril Ramaphosa's arguments in court and says he is abusing presidency resources. The former president filed a case against the president arguing that Ramaphosa is an “accessory after the fact” in relation to charges Zuma is pursuing against prosecutor Billy Downer and journalist Karyn Maughan. Ramaphosa wants the court to set aside the prosecution as unconstitutional and unlawful. He has asked for an interdict to prevent any “further steps” in pursuing the prosecution and to excuse his appearance in the criminal court on January 19, as demanded in Zuma's summons. The president argues that Zuma brought the case with the ulterior purpose of ruining his chance of being re-elected president of the ANC. Former ANC member Carl Niehaus says he wants the president removed immediately.The interdict application judgment was reserved for Monday.

Former president Jacob Zuma's private prosecution of News24 specialist legal journalist Karyn Maughan and senior State advocate Billy Downer got under way in the KwaZulu-Natal High Court in Pietermaritzburg on Monday. The matter was adjourned to 2 February 2023, with an urgent application by Maughan to be heard in December. Maughan's urgent application was postponed due to a conflict of interest on the part of Judge Rishi Seegobin. He did not elaborate on what these are. Downer has launched his own application to have the private prosecution declared an abuse of court processes. The applications by Maughan and Downer will not be joined, but are likely to be heard one after the other. During Monday's proceedings before Judge Nkosinathi Chili, Zuma's advocate Dali Mpofu conceded that the private prosecution was "unique" and "even strange" for him as a legal practitioner. He said it was also "unique" because Zuma, a former president, was the private prosecutor. Mpofu said Zuma had put down a R500 000 deposit to continue with the prosecution. Advocate Wim Trengove SC, representing Downer, told Chili they had launched an application against the private prosecution and would ask the court to hear it. Zuma has accused Maughan of colluding with the State to publish his medical records without his permission. Zuma wants Maughan's urgent application to be dismissed, arguing that he was entitled to prosecute the journalist. The charges against Maughan and Downer relate to News24's publication of an update on Zuma's medical condition. The medical document was attached to court papers lodged at the High Court in 2021. Documents filed with the court are deemed to be public records unless a judge instructs otherwise. There was no instruction in this instance. It didn't reveal details of Zuma's condition. Last month, Maughan filed an urgent application asking the court to set aside Zuma's prosecution. She argued that the summons issued against her by Zuma's legal team was a gross abuse of court processes and, therefore, should be thrown out. She said the former president had not obtained a nolle prosequi (a Latin phrase that translates to "not wishing to prosecute") certificate from the Director of Public Prosecutions to entitle him to institute a private prosecution against her. In addition, she said Zuma lacked standing to institute the private prosecution. "He has no substantial and peculiar interest in the issue of the trial since he has personally suffered no injury as a consequence of the offence he alleges I have committed."

Public Protector Busisiwe Mkhwebane's advocate, Dali Mpofu SC, threatened the chairperson of the Section 194 Inquiry, African National Congress (ANC) MP Qubudile Dyantyi, and several MPs asked that he be investigated for it. In terms of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act - commonly referred to as the Powers and Privileges Act - it is illegal to threaten an MP in the performance of their functions, and it could carry a prison sentence of up to three years. On Tuesday morning, Mpofu asked for a postponement to work on the litigation following the Western Cape High Court ruling which overturned President Cyril Ramaphosa's suspension of Mkhwebane. The Democratic Alliance (DA) subsequently appealed to the Constitutional Court, and Mkhwebane applied to the High Court to uphold its ruling while this case was underway. Ramaphosa, acting Public Protector Kholeka Gcaleka, the African Transformation Movement (ATM), the United Democratic Movement (UDM) and the Pan Africanist Congress of Azania subsequently joined the latter matter, and according to Mpofu, there has been a "flurry" of court papers that he needed to respond to, and he couldn't prepare for the cross-examination of witness Nelisiwe Thejane. Furthermore, he said Mkhwebane was sick and at her doctor and couldn't attend the proceedings. As he has done throughout proceedings, Mpofu interrupted and spoke over Dyantyi, and Dyantyi eventually asked that he be muted. In one exchange, Mpofu said: "You are not entitled to abuse me like you are abusing me. I'm senior to you in many ways, not just in age, but in many ways. You know it. So, you have no right to abuse me. But fine, you have the power now, you can exercise it, but you'll pay one day, ja." Dyantyi, smiling, said: "Are you threatening me now?" To which Mpofu responded: "Ja." Dyantyi asked him to conclude, and Mpofu said: "Actually, it is not a threat. It is a promise." DA deputy chief whip Annelie Lotriet said she was extremely concerned about what Mpofu had said to Dyantyi as, in terms of the Powers and Privileges Act, no MP may be threatened when conducting their duties. Freedom Front Plus chief whip Corné Mulder agreed. ANC MP Violet Siwela said she was a "little bit disappointed" and suggested that Dyanyti looked into it in terms of the Powers and Privileges Act. ANC deputy chief whip Doris Dlakude also agreed with Lotriet and Mulder. "What we are pleading for is that there should be no threats to anyone," said Dlakude. Mpofu was backed up by ATM leader Vuyolwethu Zungula, UDM leader Bantu Holomisa, and Economic Freedom Fighters MP Omphile Maotwe. Dyantyi denied Mpofu's request, saying he could continue with his cross-examination on 21 September, but the MPs will continue to ask questions of the witness. This led to another monologue by Mpofu, and when Dyantyi tried to proceed, he once again spoke over him. Mpofu was once supported by Maotwe, Zungula and Holomisa. The latter suggested that Mpofu should challenge it in court. Section 8 of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures states: 8. (1) A person may not by fraud, intimidation, force, insult or threat of any kind, or by the offer or promise of any inducement or benefit of any kind, or by any other improper means (a) influence a member in the performance of the member's functions as a member; (b) induce a member to be absent from Parliament or a House or committee; or (c) attempt to compel a member to declare himself or herself in favour of or against anything pending before or proposed or expected to be submitted to Parliament or a House or committee. Section 27 (1) of the Act further states: "A person, including a member, who contravenes Section 7 or 8 (1) commits an offence and is liable to a fine or to imprisonment for a period not exceeding three years or to both the fine and the imprisonment."

Testifying before the section 194 committee on Monday was Busani Baloyi, a former COO in the public protector's office who had several altercations with Mpofu who was not happy with how she answered questions. Suspended Public Protector Busisiwe Mkhwebane didn't want to work with her former spokesperson, Cleopatra Mosana, because she disrespected her by calling her "Busisiwe", the Section 194 Committee heard on Wednesday. The committee's hearings to determine whether Mkhwebane misconducted herself or is incompetent resumed with the testimony of Gumbi Tyelela, the acting head of corporate services at the Office of the Public Protector. According to Tyelela's affidavit, Mosana's last working day was 30 April 2019. She worked as the Public Protector spokesperson for one year and 10 months. She left having given 24-hour notice. "I recall it was on a Monday morning when I was called to the PP boardroom, just after 08:00. Present was both Ms Mosana and the then chief of staff, Linda Molelekoa. The PP came in," reads Tyelela's affidavit, which he confirmed to the evidence leader, advocate Nazreen Bawa SC. The affidavit continues, "She was upset and indicated that she no longer wanted to work with Ms Mosana as she did not want to be doing her work, and that Ms Mosana was disrespecting her by calling her by her first name 'Busisiwe'." "She indicated that Ms Mosana must go home and serve her notice from home. No details were provided as to what precisely in relation to Ms Mosana's work had brought this about. "I intervened and requested that Ms Mosana leave the room whereafter I informed the PP that what she had done was dismiss Ms Mosana without any process and that she could not do so. Apprised that she did not want to work with Ms Mosana any longer, I requested that she allowed me to deal with the matter going forward." Mosana was offered another post, but she declined. "She wanted to remain in the private office. She wanted a meeting with PP to find out what she had done, but we cautioned her against this as the PP had clearly indicated that she no longer wanted to work with her." A labour dispute ensued, and the legal proceedings cost the Public Protector R468 574.58, according to Tyelela. The Commission for Conciliation, Mediation and Arbitration (CCMA) subsequently ordered the Office of the Public Protector to pay Mosana R529 536.56. Following the CCMA ruling, the office sought legal advice and was informed a review process would cost in the region of R450 000, "but that there was a reasonable prospect of success". The Public Protector is now seeking to review the CCMA ruling on Mosana. The matter is still pending. At the time, Mosana had been in the firing line, having to answer questions on the controversial South African Reserve Bank (SARB)/CIEX and Vrede dairy farm/Estina reports. "If it is true, you would agree it would be almost unheard of for someone, say it was a minister or the chairperson of this committee, to call them by their name," said Mkhwebane's counsel, advocate Dali Mpofu SC. Tyelela agreed. Mpofu said at least you could call Mkhwebane "you". Mpofu added that Mkhwebane might not have wanted to work with someone who needed to be "spoon-fed". Tyelela also testified about several other labour disputes during Mkhwebane's term at the office. Tyelela's cross-examination by Mpofu continued into the afternoon.

Former State Security Agency (SSA) director-general Arthur Fraser once called Public Protector security manager Baldwin Neshunzhi to tell him to "pull up his socks" in supporting Busisiwe Mkhwebane, the Section 194 Committee heard on Thursday. Neshunzi testified before the committee, which is tasked with inquiring into Mkhwebane's fitness for office, on Thursday and lifted the veil on the SSA's influence at the office. Before he started, advocate Dali Mpofu SC, on behalf of Mkhwebane, objected to him testifying, claiming his evidence would be irrelevant. Evidence leader advocate Nazreen Bawa SC, however, differed. After 30 minutes of mostly Mpofu complaining, Neshunzi was sworn in and started his explosive testimony. Neshunzhi was tasked with investigating whether there was something wrong with the office's leave system in that it allowed some people to appear to be at work while they actually were not. He could not find anything wrong. Mkhwebane was unhappy about this. According to his affidavit, he was told training had been arranged for him at the SSA. Neshunzhi said he was given a sealed letter to take to Fraser. He was then told he had failed to investigate an alleged IT security breach properly. Mkhwebane then instructed him to leave the office, and he had to hand in his laptop and office keys. Neshunzhi considered it a suspension. He asked whether he was suspended but did not receive an answer. The letter to Fraser asked that the SSA "recall" Neshunzi for training. Neshunzi was later asked to do another investigation. This time, he had to determine whether documents President Cyril Ramaphosa lodged with the office were leaked. He found there was no leak, as the Presidency issued a statement on the documents. He said his relationship with Mkhwebane subsequently deteriorated. "There was an expectation that I would be her ears and eyes in the office, and I was letting her down," read Neshunzhi's affidavit. "I subsequently received a telephone call from Mr Arthur Fraser, and was informed that I was not providing the support to the [Public Protector] as I was hired to do. He advised that the [Public Protector] was complaining about my lack of support. This occurred during the end of 2019." At the time, Fraser was employed as the national commissioner for correctional services. Support Neshunzhi said Fraser told him to "pull up your socks" and go beyond the call of duty to demonstrate his support for Mkhwebane. At the time, he added, he did not know how he failed in his job as Mkhwebane did not directly relay it to him. Later, Neshunzhi sought the SSA's assistance in developing a proper case management system for the office. He said he thought it had the required expertise as it was the "custodians of information in the state". "One of the persons from the SSA involved was Mahendra Moodley at the SSA offices, I understood him to be an expert in IT, and in fact, some whiz kid in that field." Moodley is the SSA operative who allegedly gave Mkhwebane the wording of her controversial recommendation in the CIEX report that Parliament should amend the Constitution on the SA Reserve Bank's mandate. During his cross-examination of former Public Protector investigator Tebogo Kekana, Mpofu suggested Moodley was an expert on economics. Despite Neshunzhi directly contradicting this, Mkhwebane's team did not raise the matter during cross-examination. Mpofu again said Neshunzhi's testimony was irrelevant and complained News24 reported he tried to block the testimony. Neshunzhi continued to be questioned by MPs into the afternoon. In the months before her appointment as Public Protector, Mkhwebane worked at the SSA.

Public Protector Busisiwe Mkhwebane has the "final say" on the reports issued by her office, senior manager for executive support Futana Tebele testified on Wednesday. During his testimony before the Section 194 Committee that is inquiring into Mkhwebane's fitness for office, Tebele continually referred to Mkhwebane as the "executive authority". Responding to a question from evidence leader advocate Ncumisa Mayosi, Tebele said Mkhwebane reads all the reports issued by her office and sends them back if she is not happy with them. After prompting from Mayosi, he said Mkhwebane has the "final say" on all reports. The crux of the charges before the committee – that Mkhwebane had behaved improperly and is incompetent – stem from scathing court rulings against her in relation to the Vrede dairy farm report, the CIEX/Reserve Bank report, the CR17 matter and the so-called "rogue unit" investigation. The implication of Tebele's testimony is that Mkhwebane had the "final say" on these reports. There has been testimony before the committee that Mkhwebane instructed investigators not to include the GuptaLeaks in their Vrede dairy farm probe. Mayosi asked Tebele if he was involved in the Vrede investigation. He said he wasn't really part of the investigation. He said there was "an opinion" that they needed to check whether there was a public-private partnership, which he was involved in due to his experience in that field. Mayosi asked if he recalled being involved in discussions about the GuptaLeaks and the Vrede project and whether he asked Reginald Ndou, the executive manager for the provincial investigations and integration unit, not to use the GuptaLeaks. Tebele said he didn't recall such discussions and couldn't remember telling Ndou not to use the GuptaLeaks. Tebele said there was tension in the quality assurance unit because the lawyers had to report to Mkhwebane's chief of staff, who wasn't a lawyer. Adding to the tension was Mkhwebane insisting that investigators determine deadlines. Tebele testified that Mkhwebane's backlog-clearing initiative "created a lot of pressure on people within the office of the Public Protector to work". Investigators were required to report to Mkhwebane directly and via their executive managers. "There was lots of pressure on them to complete their work with frequent and constant meetings being held to ascertain how far investigations were and what was being done in respect of reducing the backlog," he added. He said Mkhwebane didn't take kindly to deadlines not being met. Tebele said in his affidavit that Mkhwebane would reprimand employees who didn't meet deadlines and would sometimes raise her voice. He told the committee he could sometimes see how the "executive authority" was "hammering" investigators. However, he said he never experienced harassment, intimidation and harassment, nor did he see Mkhwebane doing this. The hearing continued into the afternoon, with Mkhwebane's counsel, advocate Dali Mpofu SC, cross-examining the witness. Tebele, Mkhwebane and Mpofu are participating through the virtual platform.

Public Protector Busisiwe Mkhwebane replaced the staff she purged from the Office of the Public Protector with officials from her previous employer, the State Security Agency (SSA), recently reinstated Free State head Sphelo Samuel testified. On Friday morning, Samuel fielded questions from MPs serving on the Section 194 Committee conducting an inquiry into Mkhwebane's fitness for office. The MPs largely traversed topics covered during his main testimony on Wednesday and cross-examination the previous day. African National Congress MP Judy Hermans asked Samuel why he thought Mkwhebane had an "orchestrated plan" to destroy the Office of the Public Protector, as he previously testified. He said there was a purge of senior managers, and Mkhwebane replaced them with people who would be loyal to her. Hermans added it was a serious allegation and asked if external sources were at play. Samuel said some officials from the SSA came in to replace those purged. There was also an official who left the SA Revenue Service (SARS) under a cloud. Samuel did not name him, but most probably referred to Luther Lebello - who has been referred to as former SARS commissioner Tom Moyane's "hit man". Lebelo was cited in both the Nugent Commission into the functioning of SARS and in the Zondo Commission testimony as being instrumental in the sidelining of senior staff who were key to the functioning of SARS, which enabled the capture of the institution. In February, Mkhwebane defended her decision to appoint Lebelo as chief of staff in December. Samuel testified earlier Mkhwebane insisted Public Protector staff should obtain security clearance, but he did not believe it was necessary for them to do his work. He applied twice, both times unsuccessfully. He believed it was a way for Mkhwebane to get rid of some staff. Democratic Alliance (DA) MP Mimmy Gondwe asked Samuel, who has worked under every Public Protector, whether they also required it and what clearance level - confidential, secret, top secret - Mkhwebane required. Samuel said it was never a requirement for Public Protector staff to apply for security clearance. This only happened once Mkwhebane became Public Protector. She required they apply for top secret clearance. The meeting got off to a rocky start. Committee chairperson Qubudile Dyantyi announced MPs would question Samuel. DA MP Kevin Mileham hardly finished his first question before the ATM's Vuyo Zungula raised a point of order, asking that advocate Dali Mpofu SC, should confirm he had concluded his cross-examination of Samuel. Dyantyi said Zungula was not Mpofu's "spokesperson", and Zungula would complain bitterly about this. Mpofu did complain he did not finish his cross-examination on Thursday afternoon. "This is completely unfair, we can't run this like a kangaroo court," said Mpofu. He added someone should have given him the courtesy of indicating he was "being gagged" or that his cross-examination was finished. Zungula and Economic Freedom Fighters MP Omphile Maotwe said Dyantyi was unfair, and he should allow Mpofu to continue with his cross-examination. The other parties did not support this and said the time frames given to the parties in this inquiry had been clearly set out in its rules. Mpofu was still unhappy and accused the inquiry of breaching both the audi alteram partem principle and principle of fairness. He claimed it had "never been done before" to stop a legal representative from asking all their questions. Dyantyi explained that on Wednesday, when they started, he gave time frames to the evidence leader, advocate Nazreen Bawa SC, who finished at 15:30. He said he would re-examine Mpofu's time at 15:00 on Thursday, which he did, and extended his time. On Thursday, at around 15:30, Dyantyi informed the committee he extended Mpofu's time for cross-examination until 17:00. President Cyril Ramaphosa didn't risk a conflict of interest in the investigation into the alleged cover-up of a theft at his Phala Phala game farm when he suspended impeached Public Protector Busisiwe Mkhwebane, the Western Cape High Court has heard. This was the argument of his counsel, advocate Karrisha Pillay, SC, on Tuesday during Mkhwebane's application to have her suspension declared unlawful and to scupper the parliamentary removal process against her. On Monday, Mkhwebane's counsel, advocate Dali Mpofu, SC, argued that the Public Protector was investigating six cases against Ramaphosa – including the Phala Phala saga – and that it constituted a conflict of interest that precluded Ramaphosa from suspending her. He said the suspension came days after she started an investigation into the Phala Phala theft. But, according to Pillay, in terms of Section 96 of the Constitution, the risk of a conflict exists if the president derives a private benefit from exercising an official duty. She said the only one of the cases involving Ramaphosa's personal interests was the Phala Phala matter. She also pointed out that the Public Protector Act required the Deputy Public Protector to fulfil the functions of the Public Protector in the event that she became unable to do so. Acting Public Protector Kholeka Gcaleka stated that the office's investigations would continue, the court heard. "There is no suggestion the Acting Public Protector won't execute her duties," Pillay added. In those circumstances, the risk of a conflict between the official duties and private interests didn't exist. According to Pillay, Ramaphosa also agreed to cooperate with the investigation. "There is no evidence before this court to contradict the president's statements," she added. Ramaphosa sent Mkwhebane a letter on 18 March, Pillay said, to ask her to give reasons why he shouldn't suspend her. "Many, many letters" between the two followed, which meant Mkhwebane was appraised of the fact that Ramaphosa was considering her suspension. Judge Matthew Francis, who is hearing the matter along with Judges Lister Nuku and Judge James Lekhuleni, said the Acting Public Protector's continuation of the investigation didn't mitigate the risk. But Pillay responded there was no risk because the president had no say in who the Acting Public Protector was. The hearing continues. The court is expected to hear Mpofu's response and argument from the Democratic Alliance's counsel.

He reported "misconducts" he observed, including that Mkhwebane instructed they do not make adverse findings against politicians, including Ace Magashule. Dali Mpofu, who leads Mkhwebane's legal team, told the committee it may be improper for the witness to give evidence as it "may clash with a criminal proceeding that is under way". He cross-examined the witness who he first referred to as a "disgruntled employee" and questioned his claims of what he found to be odd.

A Western Cape High Court judge asked Public Protector Busisiwe Mkhwebane's lawyer whether she was alleging that Chief Justice Raymond Zondo lied. The court is hearing Mkhwebane's application for an interdict to prohibit Parliament's Section 194 Committee from continuing with her impeachment proceedings and to prevent President Cyril Ramaphosa from suspending her. This comes after the committee decided to forge ahead, despite Mkhwebane's initial application to the Constitutional Court for a rescission of its decision, which effectively gave Parliament the green light to continue. The matter was suspended on 26 April after it emerged that self-described legal analyst Ismail Abramjee sent an SMS to Parliament's counsel, advocate Andrew Breitenbach, SC. It read, "Hello Adv Breytenbach (sic). Re: The Public Protector case tomorrow. I have it on very good authority that the ConCourt has declined to hear the Public Protector's rescission application. The decision will be made known sometime this coming week but not later than Friday. I thought I'd just share this with you on a strictly confidential basis. Thanks." On Wednesday, Mkhwebane's advocate, Dali Mpofu, SC, described the SMS as "the biggest scandal to ever hit our courts". As it turned out, the Constitutional Court announced that it would not hear Mkhwebane's rescission application a week later than Abramjee predicted. Mkhwebane has since applied for the initial rescission decision to be rescinded. Mpofu argued, "The mere fact that the judgment is delated by a week, cannot by any stretch of the imagination be read to mean that what Mr Abramjee was saying was not going to happen on the 29th if it had not been outed. So let's just stop there." He said Zondo gave an interview to the SABC on 28 April. "He said he was asked three times: 'Has the decision been made?' He gave three different answers. Mpofu said the first time after the question was asked, Zondo said the matter was pending and the Constitutional Court would announce the decision when ready. "Let's pause there, he doesn't say decision isn't made," Mpofu said. The second time, Zondo said the Constitutional Court would announce when a decision is taken. Judge Nathan Erasmus said Mpofu was, by implication, saying Zondo was lying. "No. No, no, no, no," Mpofu responded. "How else must I read it?" Erasmus said. Mpofu said, "Well I don't know [Judge] Erasmus." Mpofu added that Zondo didn't give a "clear and unambiguous answer" and that Mkhwebane, owing to her confusion, instructed her attorneys to write a letter to the Constitutional Court to gain clarity. "This is as clear as mud," Mpofu said. He said the letter Mkhwebane's attorneys sent was a "nice letter". He added that the answer they got was that the court didn't want to engage. This came on the same day as the court's rescission decision. "It's not a fighting letter." "What should concern you is a situation where there is a possibly - I wouldn't put it higher than that - there is a possibility that someone on the Constitutional Court leaked a judgment to influence you - this court." The matter will continue on Wednesday afternoon and Thursday has also been set aside for it. Erasmus is hearing the matter with Judges Mokgoatji Dolamo and Derek Wille.

The Airports Company South Africa (ACSA) is implementing several emergency measures to secure a sustainable supply of jet fuel at the OR Tambo International Airport (ORTIA), in Johannesburg, and to prevent airlines from having to cancel flights because of not being able to get fuel from their regular suppliers. Fuel supplies at ORTIA are impacted as a result of damage to Transnet Freight Rail's (TFR's) rail infrastructure in KwaZulu-Natal after a destructive storm on April 11 resulted in widespread flooding and damage to infrastructure. This has resulted in some fuel suppliers enforcing force majeure on fuel supply contracts. However, not all airlines use the same fuel suppliers. ACSA, on May 9, met with executives from TFR, the Central Energy Fund (CEF), the South African Petroleum Industry Association, the Board of Airline Representatives and the Department of Mineral Resources and Energy to develop a plan to mitigate jet fuel shortages. ACSA CEO Mpumi Mpofu told media afterward that jet fuel supply to ORTIA was stable, with about three-and-a-half days worth of fuel currently available at the airport. “Comfortable” stock holding of jet fuel at ORTIA is about five days' supply, she pointed out. Mpofu explained that while there was a jet fuel supply and demand “mismatch” at ORTIA, the issue was small and confined to only some fuel suppliers, consequently impacting only two airlines. ORTIA was able to continue jet fuel supply to 40 other international airlines during the time of disruption. In this regard, an international airline cancelled 14 flights between April 24 to May 1 – a situation in which 3 150 passengers were impacted. Another international airline cancelled a single flight on April 24, affecting less than 100 passengers. To address the situation, she said a shipment of 20-million litres of fuel landed in the Port of Durban would be pumped to the refinery of the National Petroleum Refiners of South Africa at about 19.00 on May 9, after which it would be piped to ORTIA. In addition, ACSA, together with the CEF, has developed a framework to provide as much as 1.5-million litres of jet fuel to airlines that have been impacted by force majeures being enforced by their suppliers. A possible Plan B will see the CEF issue directives to airlines for a jet fuel swap. Meanwhile, ACSA said TFR had informed it that rail infrastructure between Durban and Johannesburg would return to 50% of its capacity by June 9, with 100% set to be restored by the end of October.

A group of advocates has come out in support of Advocate Dali Mpofu following a strongly-worded opinion piece, penned by Editor-in-Chief of News 24, Adriaan Basson, saying it is offensive. Basson refers to what he calls Mpofu's 'thuggish behaviour' at the Judicial Service Commission's interviews for a new Chief Justice last week, in particular his questions to Gauteng Judge President Dunstan Mlambo regarding allegations of sexual harassment. The advocates say the article is not only an insult to Mpofu, but also racist towards non-white advocates in the legal fraternity. The Jacob Zuma Foundation has announced that the former president will lay criminal charges against State advocate Billy Downer for allegedly leaking affidavits containing information about his health. The charges will be laid on Thursday, according to foundation spokesperson Mzwanele Manyi. In a tweet on Wednesday, the foundation said: "As indicated in court on 22/09/21 H.E Prez (sic) Zuma will be laying criminal charges against adv Billy Downer for his admitted conduct which is in breach of Section 41 (6) read with [Section] 41 (7) of the NPA Act." The foundation invited the media to a briefing outside the Pietermaritzburg SAPS on Thursday at 13:00. During Zuma's court case last month, his advocate, Dali Mpofu, SC, said, "Former president Zuma takes the strongest possible exception to what was done with his confidential information and the way it was treated in this court." Mpofu said it amounted to "criminal activity", and added that Zuma wanted to lodge a complaint of prosecutorial misconduct against Downer with Judge Piet Koen, who is deciding his application for a special plea.

The case brought by Public Protector Busisiwe Mkhwebane against National Assembly Speaker Thandi Modise and others entered its second day YESTERDAY in the Western Cape High Court. Modise's legal representative, Advocate Andrew Breitenbach sought to counter arguments made by Mkhwebane's counsel Advocate Dali Mpofu. These included the suggestion that parliament was not entitled to add details to the grounds for the removal of the Public Protector and should have stuck to what is contained in the constitution. Mpofu also argued that it was unfair that the rules do not allow Mkhwebane's legal representative to take part in the meetings of the panel that will determine whether she is fit to hold office. The much awaited case of the ANC's suspended Secretary General, Ace Magashule is expected to be heard before the end of the month. A full bench of the High Court is expected to hear the matter where Magashule is challenging his suspension. Magashule who has sought the service of the Senior Council, Advocate Dali Mpofu wants his suspension to be nullified by a court of law. Meanwhile, some have questioned Mpofu's decision to represent Magashule and former President, Jacob Zuma in his corruption case. EFF Leader Julius Malema says Mpofu has a right to discharge his professional duties without fear and the EFF will not interfere in his private responsibilities.

Mpofu believes the involvement of women in this rite of passage to manhood of Xhosa boys may save lives as some of the initiates die during this ritual. Every year, during the initiation season, the Eastern Cape province experiences death of initiaties.

“All positions will be contested. All members of the EFF are available to take up the leadership positions. We are available, but not for positions we may not have the capacity to occupy,” said EFF party leader Julius Malema, while addressing the media on Monday. Malema perhaps gave the clearest indication that he would be contesting for a second term in the top position as president, saying he did not have the skill set required for other positions in the party, such as Secretary-General and Treasurer-General. With speculation mounting that Dali Mpofu is gearing up to contest Malema for the top job, Mpofu refused to answer when that question was put to him. In this week's episode, the Sunday Times politics team asks the question, could any other EFF members contest Malema as leader of the party and actually come out successful?
