Contempt of Court in Deutschland – Reformbedarf oder Überreaktion? Dysfunktionale Strafverteidigung steht auf der Agenda der StPO-Reformkommission des BMJV. Aber wie groß ist das Problem wirklich? Dr. Mathias Grzesiek spricht mit Prof. Matthias Jahn, der zuletzt auf dem 47. Strafverteidigertag in Köln zu diesem Thema referiert und in der Juniausgabe der StV publiziert hat, über die Unterschiede zwischen dysfunktionaler Verteidigung, Konfliktverteidigung und Prozesssabotage und warum diese Differenzierung für die Reformdebatte entscheidend ist. Prof. Jahn ordnet insbesondere einen der zentralen Vorschläge der Reformkommission ein: die geplante Contempt of Court-Regelung als neuer § 177a GVG mit Ordnungsgeldern bis 3.500 Euro. Dabei beleuchtet er die mit diesem Vorschlag verfolgten Ziele und setzt sich mit den wesentlichen Einwänden auseinander. Außerdem richtet sich der Blick auf die USA, wo eine solche Regelung zum Alltag gehört, und darauf, wo ein Vergleich mit dem deutschen Recht an seine Grenzen stößt. Prof. Jahn veranschaulicht den Status quo in Deutschland anhand des prominenten Beispiels der Rechtsanwältin S. im Zündel-Verfahren vor dem LG Mannheim. Schließlich bewertet er vor dem Hintergrund des erwarteten Abschlussberichts der Kommission im November 2026, welche der diskutierten Vorschläge realistisch in ein Reformgesetz einfließen könnten.
