The overturning of Roe v. Wade is a watershed moment for the privacy of people seeking reproductive care. A person's browser history, search history, location and private messages can be used by law enforcement or private citizens to pursue people who are suspected of having or aiding an abortion. When people's most private digital information can be used against them, can tech companies change their practices to better protect their users' privacy? As some states try to outlaw websites that tell people how to access abortion care, can advocates ensure that reliable health information remains online? In this episode, you will hear from Alexandra Givens, President and CEO of the Center for Democracy and Technology (CDT); Cecile Richards, former President of Planned Parenthood; and Nabiha Syed, President of The Markup, as they discuss ways advocates are working to protect users' privacy and access to information at this critical moment for reproductive rights. Did we nearly have a 50 year head start on some of Big Tech's stickiest ethical dilemmas? Say hello to the “What If” men of The Simulmatics Corporation. As so expertly illuminated in Jill Lepore's book IF/THEN: How The Simulmatics Corporation Invented the Future, the company aimed for a radical idea: Use computers to predict and influence people's behavior. Today we call it business as usual. But as issues of algorithmic bias, misinformation, and privacy protection continue to raise red flags about the future of predictive algorithms and artificial intelligence, what clues can we find in the past?  Scott is then joined by Nabiha Syed, President of The Markup, an investigative journalism startup exploring how powerful actors use technology to reshape society. Listen in for a fascinating conversation about algorithmic harm, possible roads to effective regulation, and why progress starts with the willingness to get things wrong. In the months since the January 6 attack on the Capitol, one thing people on both sides of the political aisle seem to agree on, is that social media bears at least some responsibility for spreading the lies that led to the attack. But, is that true? And if it is, even a little bit, what should lawmakers do about it? Those questions are what [Un]Common Law will explore in our new series called “UnChecked.” A look at the legal doctrines, case history, and legislation that gave birth to the internet as we know it. This first episode is all about Section 230, the law that makes it possible for companies like Facebook and Twitter to publish content created by their users. Specifically, Section 230 states that, "no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." In other words, online platforms can't be held liable for the speech that is posted on their sites. Almost as importantly, Section 230 also gives those platforms the freedom to moderate, or remove content as they see fit. Many Republicans say Section 230 enables tech companies to censor conservative voices. While some Democrats say the law has allowed platforms to wash their hands of harms associated with hate speech, terrorism, and harassment. Many lawmakers, from both parties, have expressed a willingness to make changes to the status quo, but what those changes look like has yet to be determined. In this episode of [Un]Common Law we hear from: Gigi Sohn, former FCC Counselor, now a fellow at the Georgetown Law Institute for Technology Law and Policy. Jeff Kosseff, professor of cybersecurity law at the U.S. Naval Academy and author of a book about Section 230 called, “The 26 Words That Created the Internet.” Rebecca Kern, Technology and Cyber Policy reporter for Bloomberg Government. Jessica Melugin, director of the Center for Technology & Innovation at the Competitive Enterprise Institute. Elizabeth Banker, former Deputy General Counsel at the Internet Association. Nabiha Syed, attorney and president of The Markup, an investigative journalism startup that explores how powerful actors use technology to reshape society.

Love it or hate it, the freedom to say obnoxious and subversive things is the quintessence of what makes America America. But our say-almost-anything approach to free speech is actually relatively recent, and you can trace it back to one guy: a Supreme Court justice named Oliver Wendell Holmes. Even weirder, you can trace it back to one seemingly ordinary 8-month period in Holmes’s life when he seems to have done a logical U-turn on what should be say-able.  Why he changed his mind during those 8 months is one of the greatest mysteries in the history of the Supreme Court.  (Spoiler: the answer involves anarchists, a house of truth, and a cry for help from a dear friend.)  Join us as we investigate why he changed his mind, how that made the country change its mind, and whether it’s now time to change our minds again. Nabiha Syed is the President of The Markup. Just what is The Markup, you ask? If this is your introduction to The Markup, we stand as both disheartened that you’re not already a regular reader, yet delighted that we may serve as your guide by way of this week’s show. The Markup, an investigative journalism startup that explores how powerful actors use technology to reshape society, which, if you’ve never explored the pages of the publication, might sound like a bite far too big for any publication to take. And yet, what we hope you discover in our conversation this week, this approach is not only a standard readily achievable, but with the right tools and an eager team, it can serve as a standard bearer for other institutions of the fourth estate to follow. It turns out that beyond the top notch journalistic chops, central to The Markup’s DNA is a dedication to developing and releasing the same data analytics investigative tools used by their reporters. This transparency in the process allows the publication to report news that is, as Syed calls it, “bulletproof.” And you can get in on the action. Take Blacklight, for example. This Markup service asks you to input any website address you frequent and will report back the user-tracking technologies at work on that site that are accessing information about you through your computer and your behavior while using it. Why would they need such a tool at the news site? Because data — and how it moves through our economy — is part of the central story of the anthropocene. The Markup has invested as heavily in technology tools and journalists as it has in traditional journalism and the results show in every story. That’s why we’re so lucky to have Nabiha Syed on the show this week. We talk about what it means to exist in the journalism space, and about building a news organization bespoke for us, our modern age, and dedicated to the modern information perils that stand before us. Before BuzzFeed, Nabiha was an associate at Levine Sullivan Koch & Schulz, a leading media law firm, and the First Amendment Fellow at The New York Times. She has worked on legal access issues at Guantanamo Bay, Cuba; represented asylum-seekers in south Texas; counseled on whether to publish hacked materials; and spoken about misinformation at the inaugural Obama Foundation Summit. For her work, Nabiha was named a “40 Under 40 Rising Star” by the New York Law Journal in 2016, a finalist for the Outstanding Young Lawyer of the Year Award from the International Bar Association in 2017, and received an inaugural Reporter’s Committee for the Freedom of the Press award in 2018. Prior to BuzzFeed, Syed co-founded the nation's first media access law clinic, currently in its 10th year of operation at Yale Law School, and served as a First Amendment Fellow at The New York Times. Nabiha has been described as “one of the best emerging free speech lawyers” by Forbes magazine, and a “real reporter's lawyer” by the Reporter's Committee for the Freedom of the Press, which recognized her with an inaugural award in 2018. Real Talk about Fake News | Nabiha Syed in conversation with Claire Wardle and Joan Donovan: "Fake news” isn't exactly new: Tabloids have long hawked alien baby photos and Elvis sightings. Many have thus argued that fake news—propaganda, misinformation, and conspiracy theories—have always existed, and therefore requires no new consideration. When we agonize over the fake news phenomenon, though, we are not talking about these kinds of fabricated stories. What we are really focusing on is why we have been suddenly inundated by false information—purposefully deployed—that spreads so quickly and persuades so effectively. This is a different conception of fake news, and it presents a question about how information operates at scale in the internet era. In this Databite talk, Nabiha Syed explores how existing First Amendment theories fail to adequately explain our digital information economy, and how that theoretical incoherence leaves users and social media platforms ill-equipped to deal with “fake news” and other “bad” speech online. Nabiha also offers several factors to be considered in any systemic theory that can help move us beyond the troubled status quo.
