My name is Stacie and I am an agist. I have never been interested in dating anyone more than a few years older or younger than me. My friend, Tonya, though... Well, she's quite different.We begin by chatting about our friendship when I was newly divorced from Lanie's dad and she was single, as well. We, along with another friend, called ourselves the Neapolitan Sundae.  We three friends were different in many ways and our preferences when it came to men were different too.  Tonya noticed back then, when I was 31, that I was biased when it came to age.Tonya shares the story of how she and her boyfriend of 11 years now met. There is a 16 year age gap that Tonya was initially uncomfortable with. When they met, Tonya was turning 41 and Brennan was 25. Tonya resisted Brennan initially, but Brennan persisted!We discuss some concerns about dating much younger or older:If significantly younger, I worry about looking older than him and staying as fit. Tonya shared that she isn't concerned about the physical differences between the two of them and reminded me that appearance comes and goes. Tonya shared that Brennan was concerned about Tonya dying on him. I completely get it! That is a reason I don't date men much older than me. I don't want to get short changed! Younger men I've dated have either been unsure about children or definitely want children. I'm not having anymore babies. Tonya shares how this topic impacted her and Brennan's relationship.Careers and finances may not align. We have an in-depth discussion about how attraction and chemistry may be different when you date younger or older.  We shift the discussion to Tonya convincing me to date younger men. I was approached by HULU for a female empowering show casting women over 40 to date young men. Milwaukee music is incredibly lucky to have Kelsey Kaufmann. The owner of the Cactus Club has booked literally hundreds of shows, helped produce large-scale festivals, and was at the forefront of changing laws that prohibited all-ages shows at certain venues in Milwaukee. After managing the iconic Bay View club for a few years, further bolstering its already-sterling reputation, and bringing some impressive acts to town, Kaufmann bought the bar this February. Just over a month after officially taking over, the world turned on its head. Though times are unexpectedly tough for Cactus Club, Kaufmann and her staff are committed to keeping the business running and continuing to give interesting artists a platform. Earlier this week, My First Band host Tyler Maas caught up with Kaufmann to ask her about some of the struggles venues around the country are facing in the midst of a pandemic, some of the interesting things she's doing to bring in revenue and keep Cactus Club active during this unprecedented time and some of the positive and affirming things that have happened during her time as the bar's owner. Of course, the conversation eventually shifted to her experiences as the drummer for past and current projects like Cougar Den, Centipedes, Gallery Night and Body Work. Along the way, Kaufmann also discussed booking tours for her bands as a teenager, falling in love with D.I.Y. culture, being stranded in rural Utah for a week when Cougar Den's van broke down and some of the favorite concerts she's ever brought to Milwaukee. On March 19, 2019, the Supreme Court decided Washington State Department of Licensing v. Cougar Den, Inc., a case involving the 1855 Treaty between the United States and the Yakama Nation of Indians, and whether the “right to travel” granted within the treaty preempts the state’s fuel tax on the importation of fuel. Cougar Den, Inc. is a wholesale fuel importer that is owned by a member of the Yakama Nation. Cougar Den imports fuel from Oregon via Washington public highways to the Yakama Reservation where it is sold to Yakama-owned gas stations within the reservation. In 2013, the Washington State Department of Licensing, because Cougar Den imports the gas by using Washington public highways, assessed the importer $3.6 million in taxes, penalties, and licensing fees. Cougar Den appealed to the Washington Superior Court, claiming that the 1855 Treaty between the United States and the Yakama Nation preempts this tax, since it reserves, among other things, the “right, in common with citizens of the United States, to travel upon all public highways.” The Washington Superior Court held that the tax was preempted by the Treaty, and the Washington Supreme Court affirmed that judgment on appeal. Washington then petitioned the U.S. Supreme Court for certiorari, arguing that the 1855 treaty does not forbid the State from imposing a state-wide tax on all fuel importers who transport fuel via ground transportation, including those members of the Yakama Nation. The Supreme Court granted certiorari to consider whether the 1855 treaty preempts this importation tax on members of the Yakama Nation. By a vote of 5-4, the Supreme Court affirmed the judgment of the Supreme Court of Washington, but without a majority opinion. Justice Breyer, joined by Justices Sotomayor and Kagan, concluded for a plurality that “the ‘right to travel’ provision of the 1855 Treaty between the United States and the Yakama Nation of Indians pre-empts the state’s fuel tax as applied to Cougar Den’s importation of fuel by public highway for sale within the reservation.” Justices Gorsuch and Ginsburg filed an opinion concurring in the judgment--thereby providing the necessary additional votes to affirm the lower court--but on a different rationale. Unchallenged factual findings as to the Yakamas’ understanding of the 1855 treaty terms, they reasoned, indicate that the treaty “does not permit encumbrances on the ability of tribal members to bring their goods to and from market.” Chief Justice Roberts dissented, joined by Justices Thomas, Alito, and Kavanaugh. Justice Kavanaugh also filed a dissenting opinion, which was joined by Justice Thomas. To discuss the case, we have Tom Gede, Principal at Morgan Lewis.
