This litigation update will discuss the United Natural Foods case, where a new National Labor Relations Board (NLRB) Acting General Counsel ordered the withdrawal of a Complaint issued against two unions, which occurred shortly after President Biden removed former General Counsel Peter Robb in January 2021. After the Supreme Court eliminated Chevron deference in Loper Bright Enterprises v. Raimondo (Sup. Ct. 6/28/2024), the Supreme Court in United Natural Foods vacated a divided Fifth Circuit opinion (where the majority had afforded deference to the Board), resulting in a recent Fifth Circuit oral argument which occurred on February 3, 2025. This Day in Legal History: 11th Amendment RatifiedOn February 7, 1795, the 11th Amendment to the U.S. Constitution was ratified, restricting federal judicial power over lawsuits against states. The amendment was a direct response to the Supreme Court's 1793 decision in Chisholm v. Georgia, which held that a private citizen of one state could sue another state in federal court. This ruling alarmed many states, as it threatened their sovereign immunity and exposed them to lawsuits from individuals. In reaction, Congress swiftly proposed the 11th Amendment, which was ratified by North Carolina on this day, completing the necessary approvals. The amendment states that federal courts cannot hear cases against a state brought by citizens of another state or a foreign country. This reinforced the principle of state sovereignty and limited the reach of the federal judiciary. The amendment effectively overturned Chisholm and set a precedent for later expansions of state immunity. Over time, the Supreme Court interpreted the amendment broadly, extending protections to cases brought by a state's own citizens as well. The 11th Amendment remains a cornerstone of federalism, shaping the balance of power between states and the national government.Federal agencies have pulled out of law school recruiting events following President Donald Trump's executive order freezing hiring across the government. More than a dozen agencies withdrew from NYU's public interest career fair, and others skipped a similar event hosted by Georgetown and George Washington University. The freeze, which affects federal legal jobs and prestigious honors programs at agencies like the DOJ and IRS, has left many law students scrambling for alternatives. While some large law firms are looking to hire displaced junior lawyers, there are limited openings, especially for first- and second-year students whose summer jobs were canceled. Firms like Morgan Lewis, Quinn Emanuel, and Elsberg Baker & Maruri are among those actively considering affected candidates. However, with most Big Law summer associate spots already filled, many students may struggle to secure positions. The memo threatens disciplinary action, including termination, for attorneys who decline to sign briefs or appear in court due to personal objections. Critics argue that this undermines legal ethics and pressures attorneys to prioritize loyalty to Trump over their professional responsibilities. Historically, DOJ lawyers who found themselves in ethical conflicts could ask to be reassigned or resign, but Bondi's directive appears designed to force them into compliance or out of the department entirely. Abby is the founder and executive director of the Bridge of Books Foundation, a nonprofit organization doing amazing work within New Jersey, enhancing access to literature among children in need. Abby was named a New Jersey Hero by the New Jersey Hero Initiative and has certainly lived up to the title. Throughout its 20 years in operation, Bridge of Books has distributed 1.3 million books to underprivileged children throughout New Jersey. Abby is a former attorney who, during her practice, pursued mental health and children's rights cases. She represented individuals who were involuntarily admitted into psychiatric hospitals, protecting the rights of children and providing a voice for them during trying times. This profession introduced Abby to New Jersey's population of disadvantaged youth and later allowed her to reach children in need through her nonprofit work with Bridge of Books.Abby is deeply dedicated to her craft as she hand picks books based on reading levels and interests of children. Her mission is to “bring the world to children through books”. She aims to encourage development of literacy skills and love for reading. She has worked with food pantries, schools, and state prisons to reach the largest number of children. Though Bridge of Books has touched a great deal of lives, they still have much to do. As Legislative Counsel to the ACLU AIDS Project in the late 1980s, Chai played a leading role in drafting and negotiating the Americans with Disabilities Act of 1990. She later played the same role on the ADA Amendments Act of 2008. Chai also led the drafting and negotiating of the Employment Non-Discrimination Act, a bill to prohibit discrimination in employment on the basis of sexual orientation and gender identity. As a law professor at Georgetown Law, Chai created a Federal Legislation Clinic where she and her students helped non-profit organizations advance their legislative social justice goals. The Clinic's clients included various disability organizations and Catholic Charities USA. Chai also founded and directed Workplace Flexibility 2010, an effort designed to bring employers and employees together on policy approaches to advance workplace flexibility.Chai served as a Commissioner of the Employment Opportunity Commission (EEOC) from 2010 to 2019 where she played a significant role in establishing the rights of LGBTQ employees under existing sex discrimination laws, enhancing the employment of people with disabilities, protecting the rights of pregnant workers, and leading a proactive effort to prevent harassment in the workplace. From 2019 to 2021, Chai was a Partner and Director of Workplace Culture Consulting at Morgan Lewis, where she helped employers create safe, respectful, diverse and inclusive workplaces. She continues to consult with Morgan Lewis on selected projects. In 2021, Chai became a free-lance civil rights advocate. She assists with legislative and regulatory work regarding civil rights, particularly for LGBTQ+ people, people with disabilities and women. She also serves as Vice Chair of the AbilityOne Commission, a federal agency devoted to the employment of people with significant disabilities.Chai attended Barnard College and Harvard Law School and clerked for Judge Frank M. Coffin on the First Circuit Court of Appeals and for U.S. Supreme Court Justice Harry A. German-born Christoph Feddersen would not be where he is today, the Vice President & General Counsel at Collins Aerospace in Charlotte, North Carolina, were it not for the tremendous opportunities he was given to stretch himself. Early opportunities came at international law firms Cleary Gottlieb and Morgan Lewis, and they continued to pop up in later roles as executive assistant to the chairman and CEO at United Technologies and vice president and general counsel for UTC Aerospace.
