The Respect for Marriage Act "poses a pretty significant risk to religious Americans, both individuals and organizations. Like the Equality Act, it hopes to cement into federal law the idea that marriage is not the institution, defined by God, consisting of the union of one man and one woman. It goes, obviously, far beyond that...The first thing it does is to repeal the Defense of Marriage Act that was passed by huge bipartisan majorities and signed by Pres. Clinton in the 1990s. It also imposes an obligation on many — including, potentially, religious organizations — to recognize same-sex marriage. And that's the piece that creates a lot of the religious liberty problems. And then the last thing it does is to define marriage for federal government purpose," said Greg Baylor, director of Center for Religious Schools and Senior Counsel for Government Affairs at Alliance Defending Freedom. Summary: Judge Kenneth Starr joins Dr. Jim Denison and Dr. Mark Turman to discuss the Constitution, religious liberty, the Supreme Court, the separation of church and state, and how Christians can find hope for the future of religious liberty. Show notes: Judge Kenneth Starr (former solicitor for the U.S.), Dr. Denison, and Dr. Turman discuss the state of American law and religious liberty, which is covered in fuller length in Judge Starr's book Religious Liberty in Crisis. They consider some of the biggest questions posing America. They reflect on the Constitution, why it's so permanent and important, the protection of religious liberty, and some relevant religious liberty cases in recent years. Dr. Denison first discusses the Equality Act and the danger it poses to religious liberty. Judge Starr shares the same concerns but has faith that the Supreme Court will uphold the Constitution if the Equality Act were to become law. Judge Starr suggests that the Constitution will be an excellent “sea wall” to the coming cultural tsunami Dr. Denison writes about in The Coming Tsunami. They then delve into a discussion of the church-state separation, which Judge Starr unpacks and deconstructs. Yes, the states must remain neutral in regards to religion, but that does not mean they should be hostile to it. He encourages more nuance when we discuss the so-called wall of separation. Dr. Denison describes the two extremes that evangelicals can often take: running from politics or thinking that only Christians should run the government. As faithful Christians, we should be involved in the culture and politics, but we should also keep the kingdom of God separate from “Caesar's” kingdom. Dr. Denison and Judge Starr then consider the purpose of the federal courts, specifically the Supreme Court's role in our government, and how it is often misunderstood. Within this, they take a close look at the new celebrity status many Justices are acquiring. Dr. Denison delves into the new wave of celebrity culture that pervades America at large. Finally, Judge Starr defines some confusing terms, like accommodation and stare decisis, and why they might be relevant to some cases now before the court. Judge Starr also considers the possibility of the Supreme Court overturning Roe v. Wade, at least at the federal level. He then gives final, parting thoughts about the permanence of the Supreme Court and the political climate. Soon, the U.S. Senate will begin debating a bill that would have far reaching consequences for Bob Jones University and other religious institutions. That bill – known as the Equality Act – forbids discrimination based on sexual orientation and gender identity (SOGI) and contains no exemptions for religious organizations to exercise their beliefs. To better grasp the impact the Equality Act could have on BJU, I talked with Greg Baylor of Alliance Defending Freedom where he serves as the director of the Center for Religious Schools and Senior Counsel for Government Affairs. Greg provides us with great information on the basics of the Equality Act, how it will affect the Religious Freedom Restoration Act and what we can do to prevent this danger piece of legislation from becoming law.

"The Fairness for All Act essentially creates all the problems that The Equality Act creates, and then exempts a handful of people from those problems, and then they call that a victory for religious liberty," said Greg Baylor, senior counsel of Alliance Defending Freedom. "I would say it's a victory for religious liberty not to create the problems in the first place." Baylor is a previous guest on Respect Life Radio, where he discussed The Equality Act , which passed the U.S. House of Representatives in May 2019. The Fairness for All Act is purported compromise legislation, proposed in December by U.S. Rep. Chris Stewart, R-Utah. "The Equality Act is certainly a broadside frontal assault on religious freedom, and specifically, those who hold what are becoming the so-called 'wrong views' about controversial issues like the morality of homosexual behavior, about the definition of marriage, about the distinction between the sexes," said Greg Baylor, senior counsel of Alliance Defending Freedom. "It would impose a Sexual Orientation and Gender Identity (SOGI) nondiscrimination obligation in a whole host of settings. We're talking about businesses, places of public accommodation in their relationships with customers." Baylor listed other groups that would be affected by the proposed Equality Act: employers, landlords, public schools, private schools, recipients of federal financial assistance, higher education, and many religious social service agencies.
Just how big a threat is the Equality Act to religious freedom? According to the Alliance Defending Freedom's Greg Baylor, it would pose the biggest threat to religious freedom in the history of the American republic, placing the full force of the federal government behind a terribly destructive gender ideology.
