The nomination of U.S. Sen. Markwayne Mullin (enrolled member of the Cherokee Nation/R-OK) to become the next Homeland Security Secretary hit a rough patch Wednesday.  Outgoing Homeland Security Secretary Kristi Noem lost the faith of President Donald Trump, but the pick to replace her, Sen. Mullin, lost the faith of the Senate Homeland Security Committee Chair, U.S. Sen. Rand Paul (R-KY), for mocking him for being attacked by his neighbor nine years ago, as Matt Laslo reports. “You told the media that I was a ‘freaking snake' and that you completely understood why I had been assaulted. I was shocked that you would justify and celebrate this violent assault that caused me so much pain and my family so much pain. I just wonder if someone who applauds violence against their political opponents is the right person to lead an agency that has struggled to accept limits to the proper use of force.” Mullin is a former MMA fighter and was not backing down. “I think before I can start my opening statement, I have to address the remarks of the chairman made calling me a liar. Sir, I think there’s — everybody in this room knows that I’m very blunt and direct to the point, and if I have something to say, I’ll say it directly to your face.” While the heated exchange made national headlines, most Republican senators, like U.S. Sen. Ted. Cruz (R-TX), shrugged it off. “The two of them don’t like each other. There’s no ambiguity on that.” U.S. Sen. Ron Johnson (R-WI) said, “I’m not going to get involved in that.” U.S. Sen. Roger Marshall (R-KS) told National Native News cited his mother’s wisdom. “Reminded of what my mom would say, ‘if you don’t have something good to say about somebody, don’t say it.’ And, you know, those rules we learned in kindergarten still apply up here as well.” Even Mullin's home state colleague, U.S. Rep. Frank Lucas (R-OK), was taken aback by the barbs. “In my time in Congress, rarely have I seen such an intense exchange between two members of the same party, especially in the [U.S.] Senate. Clearly, both of them are very strong-willed, very confident in their point of view and perspective and their memory. It was just fascinating.” While most Republican senators are refusing to weigh in, Sen. Lucas says he is not discounting Chairman Paul or Mullin's accounts. “I know from having served with Markwayne in the House, I suspect the case in the [U.S.] Senate is the same — members have an insight into the nature of each other that no one on the outside can have. I never impugn the opinions of my colleagues, so maybe there was a little bit of truth in what they both had to say.” (Courtesy Asm. James Ramos / Facebook) Assemblymember James Ramos (Serrano/Cahuilla/D-CA) is urging for the establishment of California Native American Day as an official paid state holiday. A bill introduced by Asm. Ramos would designate the fourth Friday of September as a paid holiday for state employees. Ramos, along with tribal representatives, legislators, and labor leaders, held a press conference Wednesday in Sacramento., Calif. Ramos says the legislature and the state should honor California's First People with the paid holiday. “It’s true and just that this has to happen. It’s time that the voices continue to move forward and to make sure that we’re calling out for respect and honor for California’s First People and tribal elders.” Ramos say they have many worthy holidays, but the bill creates justice for past atrocities toward California Indian people who have lived through colonization, including the mission era and gold rush eras. Denver’s bison transfer included a ceremony with songs and prayers for the bisons’ safe return to tribal lands. As the Mountain West News Bureau’s Rachel Cohen reports, one source helping them is in Denver, Colo. where the local government manages a herd. Snow was falling fast and hard at a mountain park west of the city earlier this month, when 34 bison were gifted to four tribes or nonprofits. They represent the water and the fire and the thunder and the clouds and the snow. They represent all that. But at the same time, they represent us as Indigenous people.” Tribal leaders said the animals would add genetic diversity to their growing herds – and help feed tribal members with a historic food source. This is Part 10 in a series celebrating the 40th Anniversary of Harvard University Press' 1985 publication of Richard A. Epstein's "Takings: Private Property and the Power of Eminent Domain." We continue our celebration of this anniversary with a fair use and transformative reading, taking a close look at ch. 5 continuing in the same section which Richard calls ""Takings Prima Facia," which makes the analogy between private law takings in the common law harm tradition and the public law takings where the government is a defendant. He titles chapter 5, "Partial Takings: The Unity of Ownership," because he's taking a look at the natural law of the natural coherent unity of the very nature of incidents of ownership (possession, use, disposition/abuse) and the American constitutional order, how these things interact and hang together, ensconced as it is in the purpose of the Constitution. That moral purpose is the protection of individual liberty against claims by a simple majority in a democracy, or judicial or executive fiat, or by the government in any other way in a taking of private property. It's also a good reflection on nature of property per se, whether public or private. For governments are owners as well as takers of property. Today we discuss the entirety of his chapter 5 from pp. 57 to 62.. At the end, this episode concludes with a reading of Psalm 52 in the ESV and January 27th in Streams in the Desert (Cowman Publications, Lost Feliz Station Lost Angeles, Calif. 1925 original non-woke edition). Excellent stuff here. Excellent. Every college student should read this book. It's a superb introduction to the political philosophy of the American regime. Praise the Lord. Clayton County Georgia (2020) (part 11 in a series) about the faulty assumption that unexamined and unexplained transgenderism premises about sex and gender are properly included under "sex discrimination" language in Title VII of the 1964 Civil Rights Act --This continues to be a real hoot. Part 11: We continue our in-depth examination of sex, gender, and separation of powers in the US Supreme Court decision Bostock v. Clayton County, GA 590 U.S. 644 (2020): the Republican dispute, how to understand it, and what to do about it. We introduce Justice Kavanaugh's strong dissent (although there are a couple of issues, one kinda tacky, the other a bit more serious) grounded in the moral arc of separation of powers: to protect individual liberty. Justice Kavanaugh rightly concludes that the Court threatened individual liberty under the guise of protecting it -- a serious charge indeed -- and one I think is probably correct. We get through the bottom of his page 6 in the slip opinion of his dissent. Part 11. (Courtesy Elizabeth Carmel) The Washoe Tribe announced its acquisition of more than 10,000 acres of land north of Lake Tahoe. This new WélmeltiɁ Preserve marks the largest tribal land return in the Sierra Nevada and third largest in California. KUNR's Mariel Day has more. The Washoe Tribe recently finalized the purchase of the land in partnership with organizations like the Wildlife Conservation Board. The land spans across from the northeast of Lake Tahoe and to about 20 miles north of Reno. Washoe Tribal Chairman Serrell Smokey says this is an opportunity for the tribe to revitalize their traditional practices, stewardship and language preservation. “The Washoe People, being removed from our lands, fought hard to get every little bit back, and now we actually have something to call ours.” Although the preserve is the first under the Waší·šiw Land Trust, they hope to acquire more of the Washoe homelands. In the meantime, Smokey hopes to start restoring the land and focus on conserving the wildlife and its natural resources – while ensuring it's a safe place for everyone. Super Bowl Halftime headliner Bad Bunny recently won three Grammys, including Album of the Year. He's from Puerto Rico and one song explores colonization in his home and Hawaiʻi. HPR's Cassie Ordonio spoke with Puerto Ricans and Hawaiians last year about the similarities between the islands. Bad Bunny's song, “Lo Que Le Paso A Hawaii”, translates to what happened to Hawaiʻi. Many locals say it highlights stark similarities and is a reminder of the islands' colonial past. Daniel Kauwila Mahi is a Native Hawaiian artist. He interpreted the song as Bad Bunny protecting his homeland by taking a political stance against statehood. Puerto Rico became a U.S. territory in 1898, six years after the overthrow of the Hawaiian Kingdom. Mahi underscored that Native Hawaiian musicians have been raising issues of over tourism and sovereignty rights. These artists include, but are not limited to, Sudden Rush, Braddah Iz, and “Israel Kamakawiwoʻole's Hawai‘i ‘78”. “For this broader conversation is how Kanaka Maoli and Latino culture have been. through music since Paniolo came to Hawaii and our have have influenced each other for a lot longer than people think.” Angel Santiago-Cruz is a 69-year-old Puerto Rican who has lived in Hawai‘i for about 40 years. He joined the U.S Army with a guarantee to be stationed in Hawaiʻi. He wanted to see what statehood looks like. “What are you going to lose?” One lyric that stood to him was to never forget the lelolai. Santiago-Cruz says it's an expression from the jibaro, which is a person who is connected to the land. “When the Hawaiians say, ea, that’s an expression for your Hawaiianness, that’s an expression to the connection to the island. Today, in the first in this series, Bob sits down for lunch with Alex Su, chief revenue officer at Latitude Legal, over Thai iced tea and tofu dishes at Phnom Penh House, a Cambodian restaurant in Alameda that Alex considers something of a personal institution, frequenting it for both family meals and business meetings.   Alex's career path is anything but linear. He started as an associate at Sullivan & Cromwell in New York, clerked for a federal judge in Chicago, then drifted through a plaintiff's firm, a brief solo practice, and ultimately a leap of faith into legal tech sales – joining e-discovery company Logikcull in 2016. From there, he moved to Everlaw, then to Ironclad, where he served as head of community development, building a reputation that spread well beyond any job title.   That reputation was shaped in large part by TikTok, where Alex's comedic, self-effacing videos skewering law firm culture – partners, associates, privilege logs and the absurdities of BigLaw – earned him more than 100,000 followers, got shared inside Ironclad's internal Slack, and ultimately helped land him his next job. TikTok e Snapchat foram incluídos inicialmente no processo, mas fecharam acordo com a acusação. Quem levou o caso à Justiça é uma jovem de 20 anos, identificada pelas iniciais K. G. M. Segundo a ação, ela criou uma conta no YouTube aos 8 anos e abriu perfil no Instagram aos 9 – rede social onde, afirma, chegou a passar mais de 16 horas conectada em um único dia. Send us a textI'm really excited to bring you this episode's guest. When I began ultramarathoning several decades ago, the only way I could learn about races and people in that space was through a black-and-white magazine delivered to my mailbox called Ultrarunning. It had pages and pages of mundane rows of race results that still held fascination for me. Plus stories about races in exotic-sounding places like Auburn, Calif. and where I first heard about this crazy race called the Barkley Marathons that at that time no one had ever finished, and long before Netflix, no one else but me and a few others had heard of. I also read about people who became my first idols in the sport like Marshall Ulrich and Roy Pirrung, who I've had the great honor to chat with both on this podcast and in-person. But one who absolutely left me in awe who I never got to meet was Ann Trason, who I got to see – briefly – when she zoomed past me on Hope Pass in the Leadville Trail 100 in the 90s. Ann won the Western States 100 a mind-boggling 14 times, twice less than two weeks after winning the Comrades Marathon in South Africa. Western States is considered the most prestigious 100-miler in the US, and Ann, who in 1994 set a course record of 17:37:51, now lives close to the 99-mile mark of the course. Comrades is the oldest ultramarathon in the world, having begun right after WW1, and is roughly 55 miles, and is so esteemed that the entire country basically shuts down to watch it. Very few Americans have ever won it. Ann set the Leadville course record of 18:06:24 in 1994 that was only broken this past year by Anne Flower. She finished second, not just among women, but overall. In 1996, she not only completed the Grand Slam of 100-milers – Western States, Leadville, Vermont, and Wasatch Front – but she won them all. Ann set 20 world records, including for 50 miles in 5:40:18 and 100K in 7:00:47. All the way back in 1987, Ann became a Nike-sponsored athlete when women's sports hadn't taken hold like they have today, and ultramarathoning hadn't achieved any of the attention and popularity it now has. Ann retired from ultramarathoning in the 2000s due to injuries and the onset of rheumatoid arthritis, which has ravaged her body. As a result of her many accomplishments, as well as her continuing contributions to the sport as a race director, coach, writer, supporter, and much more, she was inducted into the Ultrarunning Hall of Fame in 2020. After a long time out of the spotlight, Ann arrived at an Arizona race called Across the Years, which begins three days before New Year's and finishes three days after it, just wanting to engage with the ultrarunning community in her joyous way, and push her walker – with all of its lights and decorations – for some laps around the 1.41-mile looped course. I have spoken with several people who told me how delighted they were to get to chat with Ann out there, and in the end, one of the event's highlights was when she completed 100 miles and earned a buckle – all while pushing that walker.
