Military action is a stark theme this week, as Oregon and Illinois sue the Trump administration over its attempts to federalize National Guard troops for deployment into both states. Mary and Andrew break down not one, but two temporary restraining orders that block deployments to Oregon, as Trump appointed Judge Karin Immergut cites Trump's own words to show the facts don't support what he alleges about “war ravaged” cities. Then, they dig into the administration's fourth deadly boat strike on alleged drug traffickers near Venezuela, highlighting how the lack of apparent legal authority might play out, as Attorney General Pam Bondi answered questions from the Senate Judiciary committee Tuesday. Last up, Andrew and Mary turn to two consequential decisions that don't bode well for the Trump administration: one decision out of Boston, barring efforts to deport non-citizen activists; and a second finding of a “likelihood of vindictive prosecution” from a Nashville judge as it relates to the seeming retaliatory charges against Kilmar Abrego-Garcia.Further reading: MSNBC's Carol Leonnig and Ken Dilanian report: Top prosecutor is rejecting Trump pressure to charge New York AGMary And Tess Bridgeman's piece for Just Security: What the Senate Judiciary Committee Should Ask A.G. In this episode, Brian Karem, Mark Zaid, and Tom Arnold discuss the week's news, focusing on the implications of Jimmy Kimmel's return to television, the ongoing Mar-a-Lago FOIA suit, and the legal challenges facing Donald Trump. They explore the significance of Trump's handling of classified documents, the indictment of James Comey, and the impact of Trump's recent speech at the UN. The conversation highlights the uncertainty in US politics and the importance of standing up against political bullying. Hosted by Simplecast, an AdsWizz company. In Mary and Andrew's estimation, there is no effort from the Trump administration to say things softly, the quiet part is very much out loud. They begin with the indictment of former FBI Director James Comey by Trump's newly installed U.S. attorney for the Eastern District of Virginia, Lindsey Halligan, noting how much these targeted charges upend the tradition of a separation between the White House and the Justice Department. The next stop is Portland Oregon, where the president announced his intent to deploy troops to the city in a Saturday Truth Social post, calling it “war ravaged”. Oregon immediately sued to stop the national guard deployment, so Mary and Andrew catch listeners up on where this stands and what to expect. And last, they turn to Trump's domestic terror memorandum, announcing his intent to investigate left-leaning groups he suggests may be funding political violence. President Trump's pressure campaign to take action against perceived adversaries is unrelenting. Mary and Andrew start this week by breaking down a public push for Attorney General Pam Bondi to prosecute Trump's political foes, just as Virginia's U.S. Attorney was ousted for failing to bring charges against Letitia James and Jim Comey. The focus then turns to the government's attempt to control critics and silence opposition after last week's abrupt suspension of Jimmy Kimmel, backed by FCC Chair Brendan Carr, as well as what the president designating ANTIFA as a “terrorist organization” actually means. On the flip side comes the effort to dismiss investigations into those aligned with Trump's cause. See MSNBC's reporting on the FBI bribery investigation into “Border Czar” Tom Homan that was shut down after Trump returned to office. And last up: Mary shares the reasoning behind a court's decision to block the removal of dozens of Guatemalan children, citing that the governments explanation "crumbled like a house of cards.” And a reminder: There are still tickets available for MSNBC Live – our second live community event featuring more than a dozen MSNBC hosts. Last week saw the reemergence of Donald Trump as he pushed the Big Lie from Mar A Lago and the GOP leadership forced its members to get in line or get out of the way. Liz Cheney tried to push back but found herself in the crosshairs of Kevin McCarthy who instead of moving on from the election has made it the central theme of the GOP. Meanwhile, the SDNY has found itself with a treasure trove of dirt inside Rudy Giuliani's hard drive. Could their appointing of a so called, “Special Master,” to sort through files be a sign that they're getting ready to flip Trump's other former lawyer? Finally, MSNBC's Jonathan Capehart joins Mea Culpa to discuss the GOP's sidelining of Liz Cheney, what happened to Tim Scott and so much more. Last week's fatal shooting of Charlie Kirk was deeply disturbing, and as Andrew establishes at the start, “murder is murder” and those responsible must be held to account. So Mary and Andrew begin with where the investigation stands and how the FBI has handled the case, as well as the lawsuit filed against FBI Director Kash Patel over alleged politically motivated firings at the Bureau. Then, co-editor-in-chief of Just Security, Ryan Goodman stops in to share his research around the end of “the presumption of regularity” in the Trump era, amid growing frustration from many lower courts. And lastly, Andrew and Mary dig into the latest twists and turns in the President's attempt to fire Fed Governor Lisa Cook.A note to listeners: After today's recording, Tyler Robinson was charged with felony aggravated murder, among other charges.Further reading: Here is Ryan Goodman's research in Just Security: The “Presumption of Regularity” in Trump Administration LitigationAnd a reminder: There are still tickets available for MSNBC Live – our second live community event featuring more than a dozen MSNBC hosts. In this episode Hawk covers the lawsuit filed against Kash Patel, the FBI, Pam Bondi, the DOJ, the Office of the President, and the United States of America. The case was brought by three senior FBI veterans—Brian Driscoll, Steven Jensen, and Spencer Evans—who each served more than two decades in federal law enforcement.Hawk focuses on the allegations that Kash Patel and Dan Bongino were central figures in unlawful firings of FBI agents who had worked on politically sensitive cases, including the January 6 investigation and the Mar-a-Lago search. The lawsuit claims these terminations were politically motivated, ordered by figures like Emil Bové and Stephen Miller, and in clear violation of federal law and constitutional protections. The discussion highlights the experiences of agents like Walter Giardina, who was dismissed while caring for his dying wife, and Chris Meyer, who was wrongfully accused of involvement in cases he never touched. Hawk underscores how Patel and Bongino admitted to knowing these actions were unlawful, yet still carried them out under political pressure. This video also examines new reporting from the New York Times, testimony from Kash Patel before Congress, and the broader implications for the FBI, government accountability, and the politicization of law enforcement.Hawk provides detailed context on how these decisions not only undermined careers but also raised serious concerns about democracy, due process, and the independence of federal institutio SUPPORT & CONNECT WITH HAWK- Support on Patreon: https://www.patreon.com/mdg650hawk- Support Hawk's Merch Store: https://hawkmerchstore.com- Connect on TikTok: https://www.tiktok.com/@hawkeyewhackamole- Connect on BlueSky: https://bsky.app/profile/mdg650hawk.bsky.social- Connect on YouTube: https://www.youtube.com/@hawkpodcasts ALL HAWK PODCASTS INFO- Additional Podcasts Available Here: https://www.hawkpodcasts.com- Listen to Hawk Podcasts On Your Favorite Platform:Spotify: https://spoti.fi/3RWeJfyApple Podcasts: https://apple.co/422GDuLYouTube: https://youtube.com/@hawkpodcastsiHeartRadio: https://ihr.fm/47vVBdPPandora: https://bit.ly/48COaTBSimplecast: https://hawk-droppings.simplecast.com- Hawk Podcasts RSS Feed: https://feeds.simplecast.com/pPVtxSNJ

Charlie Kirk, a conservative activist and ally of President Trump, was shot and killed Wednesday as he hosted one of his campus debates at Utah Valley University. A witness described the moment a single gunshot was fired, saying, "people started screaming." Investigators say it appears the shooter in the killing of Charlie Kirk acted alone and it was a targeted act. FBI director Kash Patel said law enforcement had someone in custody, suspected of the killing, but hours later, that person was released. CBS News' Scott MacFarlane reports. Conservative activist Charlie Kirk was a close ally to President Trump. A fixture at Mar-A-Lago, he advised Mr. Trump on some of his Cabinet picks. He was also an early champion of JD Vance to be the president's running mate. In a four-minute video recorded from the Oval Office, Mr. Trump described Kirk, saying, "he's a martyr for truth and freedom and there has never been someone who was so respected by youth." Charlie Kirk motivated young Republicans through his organization, Turning Point USA. He used podcasts and campus tours to build his political movement. CBS News' Nancy Cordes looks at his impact. CBS News chief Washington analyst Robert Costa and former Republican House Speaker Kevin McCarthy join "CBS Mornings" to discuss conservative activist Charlie Kirk's political influence. Nearly a third of Americans were born after the September 11th attacks. Nicole Sganga reports on one survivor who is working with teachers to ensure future generations never forget. Usher joins "CBS Mornings" to discuss his partnership with Ralph Lauren as the face of the new fragrance "Ralph's Club New York." Actor Zosia Mamet joins "CBS Mornings" to talk about her new book, "Does This Make Me Funny?" a collection of essays she describes as a "charcuterie platter" of her brain, reflecting on life, acting and growing up with famous parents. This episode begins with Mary and Andrew digesting the 2-1 decision from the Fifth Circuit Court of Appeals halting the Trump administration's ability to use the Alien Enemies Act to deport Venezuelan nationals accused of being members of Tren de Aragua. Andrew calls the administration's recent arguments “outlandish” before moving to the questionable legality of the U.S. military's deadly boat strike last week – an unprecedented action which left eleven dead. Next, they move to Monday's Supreme Court decision undoing limits set by a lower court on how ICE conducts immigration raids. Plus, a federal judge issues a win for Harvard University on the topic of frozen and terminated funds. Mike Johnson's claim that Donald Trump was an undercover FBI informant working to bring down Jeffrey Epstein is nothing more than political fan fiction. It comes after every other narrative—calling Epstein a hoax, smearing survivors, and demanding the public “move on”—has completely collapsed. The idea that Trump, who partied with Epstein, publicly called the scandal a Democrat hoax, and routinely defamed survivors, was secretly the Serpico of Mar-a-Lago is absurd on its face. If it were true, the files would already be released and Trump himself would be shouting about it from every podium. Instead, there's silence, spin, and desperate storytelling designed to distract from the reality: survivors were ignored, Epstein was protected, and the files remain locked away.At its core, this narrative is just another attempt to shield powerful people from accountability by rewriting history with Trump as the unlikely hero. But it collapses under even the slightest scrutiny—because the contradictions are glaring, the evidence is nonexistent, and the cruelty toward survivors is undeniable. Rather than offer transparency, Johnson offers a bedtime story, hoping the public will swallow it whole. Yet the truth is clear: if Trump really was an informant, then we should all be demanding the release of the files to see his supposed heroics. And since they refuse, we know exactly what this is—another cheap distraction to keep the truth buried, while the survivors still wait for the justice they deserve.to contact me:bobbycapucci@protonmail.comBecome a supporter of this podcast: https://www.spreaker.com/podcast/the-moscow-murders-and-more--5852883/support.

After a Labor Day weekend that saw a judge halt the Trump administration's attempt to deport dozens of Guatemalan children already loaded onto airplanes, Andrew and Mary had planned to start their conversation there. Devin Nunes is the CEO of the Trump Media & Technology Group (TMTG). Devin begins the conversation talking about Truth Social on Trump Media & Technology Group (TMTG), is pivoting aggressively toward a multifaceted digital ecosystem that integrates cryptocurrency, artificial intelligence, and financial services to transcend its origins as a social media platform. In 2025, key deals have underscored this trajectory: the February launch of Truth.Fi with a $250 million fund dedicated to mergers, acquisitions, and crypto-focused ventures signals a push into decentralized finance. By July, TMTG amassed $2.5 billion for investments in Bitcoin and crypto ETFs, aiming to capitalize on volatile markets amid platform revenue struggles. An August partnership with Perplexity AI enhances search and data capabilities, positioning Truth Social to rival tech giants in AI-driven content delivery. The most ambitious move came on August 26 with a $6.4 billion digital asset treasury collaboration involving Crypto.com and Yorkville Acquisition Corp., incorporating Cronos (CRO) tokens for user rewards, payments, and a new ETF, which fosters blockchain integration and monetization. The conversation then switches to the Russia Hoax, The declassified documents released by Director of National Intelligence Tulsi Gabbard in July and August 2025 have reignited debates over the so-called Russia collusion hoax, revealing what proponents describe as irrefutable evidence that the Obama administration orchestrated a fabricated narrative to undermine Donald Trump's 2016 presidential campaign and subsequent presidency. These materials, including a long-suppressed House Permanent Select Committee on Intelligence (HPSCI) report and whistleblower accounts, allege that key figures like former CIA Director John Brennan directed the publication of implausible intelligence assessments claiming Russian preference for Trump, despite internal knowledge that such claims were based on four pieces of bogus or "ridiculous" evidence, and that Russia had not interfered with U.S. voting infrastructure as initially briefed in a December 2016 Presidential Daily Brief. The [DS] was searching for the Devin Nunes documents at Mar-A-Lago, but the Partiots locked them in a safe where the [DS] could not touch them.

And welcome to the program on your Monday afternoon. And, boy, I tell you what, it is good to be back in a red state. I was I was up in in the blue state capital of the world. Two of them. We were up there in, Rhode Island and Connecticut over the weekend. And, man but did you know what? The only and I mean this. The only political banners, signs, or flags that we saw while we were in Rhode Island and Connecticut, or Trump? I didn't I didn't see. I didn't see any Gavin Newsom 2028 signs. I didn't see any old faded Biden Harris signs. I didn't see any old faded Harris Walt signs. I didn't see any of those things. The only signs that I saw. And one of them was a guy in in a pickup truck. I thought it was great. He was flying a, thin blue line American flag, and he was flying a Trump flag, and we gave him a good honk there. Way to go. Thumbs up, buddy. Thumbs up. Good job. Now Rhode Island voted for I think I think they got I think it was 51 no. No. No. It's like fifty six forty four, something like that, for Kamala Harris. But Trump was able to win some counties that hadn't been one since Reagan in that election. So that that was pretty cool. But, anyway, had a great time. Now I'll be honest with you. I was a little worried when I left to take a couple days off. Because the last time I took a couple days off, I came back, and it seemed like all you know what broke loose. You folks had not minded the store. But this time, I have to commend you. You did a great job. You did a great job while I was away. So while I was away, I'm sitting there and, you know, still working while I'm away, you know, scrolling on my phone, looking for for breaking news stories. And I see several stories that I just went, wow. Number one. What? Nine days with no murders in Washington DC? Nine days? People in Washington DC are like, man, we're loving this. We're we're able to get out there and and walk around and and do things. That's absolutely awesome. Right? Yeah. You know it is. You know if you are a a resident of New York City, I mean, Washington DC, that you gotta be loving life right about now. Right? Yeah. Then I saw that that big giant what was it? $400,000,000 fine against Donald Trump or something ridiculous like that from Leticia James, that got thrown out. Yay. Big win for Donald Trump. Then I saw that the stock market hit another record high. Another big win for Trump. Then I saw that Canada moved all the retaliatory tariffs on The United States. Another win for Trump. But this one, I had to kinda double check. Had to double check this one because I was I was scrolling down there, and it says, FBI rage John Bolton's home. And I was like, no. No. They did not. Shut up. Had to move along, move along, move along. And then it popped up again. And I was like, well, hold on. There's something else. And then we find out that, yes, indeed. The FBI did raid John Bolton's home, and I think it's absolutely glorious. Listen. Remember, this was the same guy that had no problems whatsoever with the FBI raiding Mar A Lago. No. No. Let's see how how many when that well, that seemed to be the catchphrase all over Washington DC when the FBI raided Mar A Lago. Well, let's see how this plays out. Well, let's see all of the well, it didn't play out very well, did it? No. It did not. In fact, president Trump talked about it. This is, this is Trump talking about the raid on Mar A Lago and John Bolton. Are more raids like that coming, sir? Are more raids like the one on John Bolton's house coming? More raids? I don't know. So you have to ask the Department of Justice. They raided my house. I can tell you that. They did a big raid on my house. They took away everything that wasn't pinned down, and they took away some of that too. Now they raided Mar A Lago. They started that. These were bad people that we had in our government before. They raided Mar A Lago. They went into my wife's area. They went into my son's area, my young son. And, what ...

But this one, I had to kinda double check. Had to double check this one because I was I was scrolling down there, and it says, FBI rage John Bolton's home. And I was like, no. No. They did not. Shut up. And then move along, move along, move along. And then it popped up again. And I was like, oh, no. Hold on. There's something else. And then we find out that, yes, indeed. The FBI did raid John Bolton's home, and I think it's absolutely glorious. I mean, this remember, this was the same guy that had no problems whatsoever with the FBI raiding Mar A Lago. No. No. Let's see how how many well, that that seemed to be the catchphrase all over Washington DC when the FBI raided Mar A Lago. Well, let's see how this plays out. Well, let's see all of the well, it didn't play out very well, did it? No. It did not. In fact, president Trump talked about it. This is, this is Trump talking about the raid on Mar A Lago and John Bolton. Are more raids like that coming, sir? Are more raids like the ones on John Bolton's house coming? More raids? I don't know. So you have to ask the Department of Justice. They raided my house. I can tell you that. They did a big raid on my house. They took away everything that wasn't pinned down, and they took away some of that too. No. They raided Mar A Lago. They started that. And these were bad people that we had in our government before. They raided Mar A Lago. They went into my wife's area. They went into my son's area, my ...

It's been another wild week, after the D.C. Attorney General sued the government for attempting to install the head of the D.E.A. as D.C.'s emergency police commissioner. Following an emergency hearing, US Attorney General Pam Bondi backed down and re-wrote the directive. But Andrew and Mary highlight why that's just the start: it's no longer just the D.C. National Guard being deployed in the nation's capital, National Guard units from five other red states are being sent to the city, making a complicated stew of who's in charge and who has jurisdiction. Next, they weave this thread into last week's trial over whether California's National Guard performed law enforcement operations in Los Angeles, a potential violation of The Posse Comitatus Act. And with Russia and Ukraine so much in the news, Andrew offers some reflections from the 2019 Special Counsel's report that exposes Russia's long-held goal of taking over the Donbas region. And last up, Andrew and Mary fill listeners in on two DC Circuit cases that have their attention: a decision allowing the Consumer Financial Protection Bureau to be dismantled and another that allows Trump to withhold billions in foreign aid.And a reminder: tickets are on sale now for MSNBC Live – our second live community event featuring more than a dozen MSNBC hosts. When “War is peace. Freedom is slavery. Ignorance is strength” we are living in an era of alternate facts. Mary and Andrew apply this Orwellian concept to what's happening this week, after President Trump cited section 740 of the Home Rule Act to federalize the DC police force and send in the national guard to the nation's capital. They detail how the president was able to do this and why Congress will be the ultimate arbiter of this move. Then, they highlight some litigation befitting this theme, with Judge Breyer's trial starting this week on the use of the national guard in Los Angeles, and some decisions including not to unseal grand jury testimony in the Ghislaine Maxwell case, plus an Appeals court blocking contempt proceedings in JGG. Last up, Andrew and Mary take a look at Judge Henderson's opinion in the OMB case and why it deserves more attention than it's received. Further reading: Here is President Trump's letter to Congress citing section 740, courtesy of the New York Times. And some exciting news: tickets are on sale now for MSNBC Live – our second live community event featuring more than a dozen MSNBC hosts. That's the question Andrew and Mary tackle in their 150th episode together, starting with the distraction of the Office of the Special Counsel's investigation into Jack Smith for possible Hatch Act violations. They also examine a Southern California ruling to halt immigration stops based on race. On the other coast, they look at a temporary block of Trump's order restricting birthright citizenship—a case where Mary has particular expertise via her role in a related birthright citizenship case: CASA v. Trump. Finally, SCOTUS paves way for mass layoffs of federal workers, and DOJ opens investigations into former FBI Director James Comey and former CIA Director John Brennan.Listener Note: This podcast was recorded several hours before the Supreme Court decision allowing for the dismantling of the Department of Education. After Friday's Supreme Court ruling to limit nationwide injunctions, Mary and Andrew begin by breaking down what it means for future challenges to executive actions as they make their way through the courts, and what's next for Mary's birthright citizenship case. They also tackle the DHS lawsuit against all federal judges on the district court in Maryland, before reviewing the Justice Department's plans to prioritize cases revoking citizenship—aka ‘denaturalizing' US citizens.
