If you have read ahead in Romans 7, you’ve probably asked the question, “How do marriage and death relate to sanctification?” Paul is a wonderful teacher in his use of illustrations. He has already helped to define sanctification as being “in Christ,” and last week he helped to define sanctification through the lens of the slave and master relationship. This week, as we turn our attention to Romans 7, Paul uses marriage to help define the believer’s relationship with the law. Far too many believers are attempting to go back and live under the law. You can often recognize them by their frustration and critique of those who don’t live up to their own set of convictions. Others use their freedom from the law as an excuse to ignore the law or even to break the law. Both of these reactions to the law are a gross misinterpretation of the gospel. The law of God is divinely inspired and relevant for our lives, but it was never intended to save us. We will spend the next few weeks walking through Romans as Paul masterfully paints a picture of our freedom in Christ and how uniting with Christ free’s us up to live in the beauty of God’s law. Make plans now to join us. Don’t wait until Sunday morning to decide. Make the decision now that worship this weekend will be a priority to you and your family. — Pastor Chad McDonald

There is no freedom, if there is no equality. Activists have vowed to challenge a new law in Namibia that explicitly outlaws same-sex marriage and overturns a landmark LGBTIQ-affirming ruling by the Supreme Court. The Act explicitly limits the definition of marriage to “a legal union between two persons of the opposite sex.” It further states that “a marriage or marital union between persons of the same sex wherever concluded” is not recognised in Namibia. This clause is widely seen as an attempt by the government to overturn the historic May 2023 Supreme Court ruling, which ordered the state to recognise same-sex marriages legally performed in other countries. Who instated this new law come from? And why is this sudden change? Prominent Namibian and co-founder of Equal Namib Omar van Reenen joins us now.See omnystudio.com/listener for privacy information.

Thailand has become the first country in South East Asia to legalise same-sex marriage. The new law means that LGBTQ+ couples will have the same legal rights as other couples when it comes to adoption, inheritance and medical decisions. It's taken activists years of campaigning to get to this point, and in September 2024 Thailand's king signed it into law. It will come into force in January 2025. BBC Thai journalist Panisa Aemocha, in Bangkok, explains the same-sex marriage legalisation in Thailand and attitudes towards LGBTQ+ in the country. This includes how Thailand has embraced boy love (BL) and girl love (GL) TV series - which show same-sex couples. We also hear from Best Chitsanupong Nithiwana, an activist who co-founded the Young Pride Club in Chiang Mai, who tells us what this new law means for same-sex couples in Thailand. Divorcing Traditions is an ethnography of Islamic legal expertise and practices in India, a secular state in which Muslims are a significant minority and where Islamic judgments are not legally binding. Katherine Lemons argues that an analysis of divorce in accordance with Islamic strictures is critical to the understanding of Indian secularism. Lemons analyzes four marital dispute adjudication forums run by Muslim jurists or lay Muslims to show that religious law does not muddle the categories of religion and law but generates them. Drawing on ethnographic and archival research conducted in these four institutions-NGO-run women's arbitration centers (mahila panchayats); sharia courts (dar ul-qazas); a Muslim jurist's authoritative legal opinions (fatwas); and the practice of what a Muslim legal expert (mufti) calls "spiritual healing"-Divorcing Traditions shows how secularism is an ongoing project that seeks to establish and maintain an appropriate relationship between religion and politics. A secular state is always secularizing. And yet, as Lemons demonstrates, the state is not the only arbiter of the relationship between religion and law: religious legal forums help to constitute the categories of private and public, religious and secular upon which secularism relies. In the end, because Muslim legal expertise and practice are central to the Indian legal system and because Muslim divorce's contested legal status marks a crisis of the secular distinction between religion and law, Muslim divorce, argues Lemons, is a key site for understanding Indian secularism.

Marriage is an institution that is historically filled with restrictions. From age, to gender, to social status, various restrictions are placed on marriage by communities, religious institutions, legal traditions and states. Marriage age. The minimum age at which a person is able to lawfully marry, and whether parental or other consents are required, vary from country to country. In the U.S. the minimum age for marriage without parental and or judicial approval is 18 except for Nebraska (19) and Mississippi (21); but most states allow exceptions to the general minimum age in some circumstances (see Marriage age in the United States). In England and Wales the general age at which a person may marry is 18, but 16- or 17-year-olds may get married with their parents' or guardians' consent. If they are unable to obtain this, they can gain consent from the courts, which may be granted by the Magistrates' Courts, or the county or High Court family divisions. Gender restrictions. Legal, social, and religious restrictions apply in all countries on the genders of the couple. In response to changing social and political attitudes, some jurisdictions and religious denominations now recognize marriages between people of the same sex. Other jurisdictions have instead "civil unions" or "domestic partnerships", while additional others explicitly prohibit same-sex marriages. In 1989, Denmark became the first country to legally recognize a relationship for same-sex couples, establishing registered partnerships, which gave those in same-sex relationships "most rights of married heterosexuals, but not the right to adopt or obtain joint custody of a child". In 2001, the Netherlands became the first country in the world to legalize same-sex marriage. As of date, marriage between same-sex couples is legally performed and recognized in 34 countries, namely the Netherlands, Belgium, Spain, Canada, South Africa, Norway, Sweden, Portugal, Iceland, Argentina, Denmark, Brazil, France, Uruguay, New Zealand, Luxembourg, the United States, Ireland, Colombia, Finland, Malta, Germany, Australia, Austria, Taiwan, Ecuador, United Kingdom, Costa Rica, Chile, Switzerland, Slovenia, Cuba, Mexico and Andorra. Civil union, civil partnership, domestic partnership and registered partnership statuses offer varying legal benefits of marriage. As of 5 June 2023, countries that have an alternative form of legal recognition other than marriage on a national level are: Bolivia, Croatia, Cyprus, the Czech Republic, Estonia, Greece, Hungary, Italy, Liechtenstein, Monaco, Montenegro and San Marino. Further religious conflicts. These developments have created a political and religious reaction in some countries, including in England, where the Church of England, after long debate, officially banned blessings of gay couples by Church of England clergy, and in the United States, which continues to experience conflicts, based upon religious grounds. Kinship restrictions. Kinship is two people that are related by blood or adoption, such as brother, sister, mother, father, aunt, uncle etcetera. No European country prohibits marriage between first cousins. The U.S. is the only western country with cousin marriage restrictions. Societies have often placed restrictions on marriage to relatives, though the degree of prohibited relationship varies widely. In most societies, marriage between brothers and sisters has been forbidden, with ancient Egyptian, Hawaiian, and Inca royalty being prominent exceptions. In many societies, marriage between first cousins is preferred, while at the other extreme, the medieval Catholic Church prohibited marriage even between distant cousins. --- Send in a voice message: https://podcasters.spotify.com/pod/show/law-school/message Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

Greg Baylor: How a proposed marriage law targets religious liberty

The Respect for Marriage Act "poses a pretty significant risk to religious Americans, both individuals and organizations. Like the Equality Act, it hopes to cement into federal law the idea that marriage is not the institution, defined by God, consisting of the union of one man and one woman. It goes, obviously, far beyond that...The first thing it does is to repeal the Defense of Marriage Act that was passed by huge bipartisan majorities and signed by Pres. Clinton in the 1990s. It also imposes an obligation on many — including, potentially, religious organizations — to recognize same-sex marriage. And that's the piece that creates a lot of the religious liberty problems. And then the last thing it does is to define marriage for federal government purpose," said Greg Baylor, director of Center for Religious Schools and Senior Counsel for Government Affairs at Alliance Defending Freedom.  Follow @GregBaylor on Twitter and listen to previous Respect Life Radio interviews with him: "Fairness for All Act a bad compromise on religious liberty" in 2020 and "Equality Act an assault on religious freedom" in 2019.

Steven Spielberg's remake of the musical West Side Story has hit the big screen and with it there is renewed interest in its origins as a story of two lovers divided by religion. The man behind the screenplay for the new version, award winning writer Tony Kushner tells Edward about the film's Jewish roots. In a candid interview with Edward, the former Bishop of Liverpool, James Jones talks about his latest book ‘Justice for Christ's Sake' in which he which draws heavily on the lessons he learnt while chairing the Hillsborough Independent Panel. This week the Government reaffirmed its commitment to banning so-called Conversion Therapy. BBC Religious Affairs Journalist Harry Farley talks us through the government's proposals and two Christians with very different views respond to the plans. Reverend Graham Nicholls is Director of Affinity - a Fellowship of Churches, Evangelical Agencies and Christians. He fears a new law would criminalise the teaching of traditional Christian beliefs on marriage. Elinor Kershaw of the Quaker Gender and Sexual Diversity Community thinks the plans may not go far enough. We hear how a delay in plans to reform marriage law in England and Wales has left thousands in unregistered religious marriages without legal protection. Edward speaks to Roxana Rais of the Muslim Women's Advisory Council, and Russell Sandberg, Professor of Law at Cardiff University and Author of ‘Religion and Marriage Law'. And as the last in a trio of reports looking at Anti-Semitism on Social Media is published, Dr Julian Hargreaves, Director of Research at the Woolf Institute, explains its findings. And Sunday listeners tell is what makes for truly great Christmas music. Producers: Jill Collins and Louise Clarke Rowbotham Editor: Helen Grady

Land Reform and the 1950 Marriage Law began a process of social and economic transformation, including agricultural collectivization and urban industrialization. The Great Leap Forward was a high tide of this process, but was undermined by bureaucratic abuses within the CCP. The Soviet Union, which had aided China in the 1950s, withdrew that aid in 1959 as the Sino-Soviet Split intensified. Efforts at Party reform in the early 1960s left Chairman Mao frustrated with the Party’s alienation from the masses, and the Cultural Revolution was aimed at encouraging mass oversight of the Party. Today, Nick Stember, the expert on Chinese Manhua (similar to Japanese Manga), joins us as we discuss a short manhua cartoon booklet that was published in 1950. The booklet was meant to be a simple way to explain the 1950 Marriage Law, one of the first acts passed by the new Communist government. The Law legitimized the Communists in the eyes of many Chinese women and their progressive allies. It was the first Chinese to legalize a woman's right to divorce (divorce had been permitted before, but under circumstances generally unfavorable to women), and it modernized many of the old customs in rural China. This was the first in a series of feminist policies the Communists implemented, and the text we explore today provides an interesting angle through which to explore gender, propaganda and ideology in 1950's China.

In her new book, historian Jennifer Altehenger, a Senior Lecturer in Contemporary Chinese History at King’s College London, grapples with the complex issue of how authorities and cultural workers attempted to create effective law propaganda.  Legal Lessons: Popularizing Laws in the People’s Republic of China, 1949-1989 (Harvard University Asia Center, 2018) traces the techniques used and challenges using a series of case studies including the 1953 Marriage Law mass campaign and the 1954 constitution national discussion. These efforts sought not only to inform Chinese citizens of the law but also involved them in such ways that they would feel obliged to then follow the laws in the future. Drawing from a wide variety of archival sources including government documents, periodicals, advice manuals, memoirs, and posters, Altehenger highlights the tension between the intention of the government to educate and the interpretations the people made themselves about new laws. She explores law dissemination into the 1970s and 1980s, locating a revival of efforts to popularize laws, including the use of new media and five-year plans. These techniques have a lasting legacy in China, making this book important reading for anyone interested in propaganda and the governance of China. Laurie Dickmeyer is an Assistant Professor of History at Angelo State University, where she teaches courses in Asian and US history. Her research concerns nineteenth century US-China relations. William Kuby is an Assistant Professor of History at the University of Tennessee-Chattanooga. His book, Conjugal Misconduct: Defying Marriage Law in the Twentieth-Century United States (Cambridge University Press, 2018), examines the complicated legal and cultural history of heterosexual marriage. Long before the controversy over same-sex marriage, Americans found multiple ways to object to certain heterosexual marriages and divorce. The commercialization of courtship through advertisements and marriage bureaus, trial and common law marriages, rising divorce and remarriage rates, interracial coupling, and onerous waiting periods and requirements created a marriage crisis in law. It also created a crisis in social policy and norms as people experimented with unconventional unions and attempted to redefine gender roles and expectations. The marriage market was rife with unrealized expectations. Often the attention from conservative critics and journalists was greater than any real threat to marriage and the family. Kuby has shown us how marriage has been an area of legal contest and the how it continually generated anxiety about the foundations of society. This episode of New Books in Gender Studies was produced in cooperation with the Society for U.S. Intellectual History Lilian Calles Barger, www.lilianbarger.com, is a cultural, intellectual and gender historian. She is the author of The World Come of Age: An Intellectual History of Liberation Theology (Oxford University Press, 2018).

SubjectACT's Nathan Gubler investigates the Australian Marriage Law Postal Survey and the campaign for marriage equality with two different guests with two different perspectives. Todd Schild is a supporter of marriage equality and LGBTI rights, yet will be boycotting the Postal Survey on the grounds of his fundamental objection to the courting of public opinion on human rights issues. Kevin Boreham, ANU College of Law lecturer who specialises in human rights law, will be voting 'yes' (despite similarly objecting to the Postal Survey) as he believes a boycott would be ineffective. Included in our discussion is the use of human rights language to back the 'no' case despite the absence of a federal bill or charter of rights, how having no charter will effect the challenge of the survey in the High Court, the chances of the High Court challenges succeeding, and how Australia's protections against hate speech compare to other parts of the world. China's top legislature has begun reviewing a draft amendment to the Advertisement Law, which proposes a ban on baby formula advertising to promote breast feeding. The draft stipulates that dairy products, drinks and other food advertisements that claim to partly or completely substitute breast feeding are banned from mass media and public venues. The proposal stipulates that advertisers, clients, agents and publishers that violate the rule could be fined up to one million yuan, roughly 160,000 U.S. dollars.Supporters believe that breast feeding is the best source of nutrition for newborns, as it increases their immune systems and reduces the likelihood of obesity in adulthood.top legislature n. 最高立法机关 根据宪法规定,中国的最高立法机关是全国人民代表大会,即National People's Congress,简称NPC。所以China's top legislature和NPC相当于同义词。draft amendment to the Advertisement Law n. 广告法修订草案 中文里总是说“修订草案”,但英语里顺序正好倒过来,是draft amendment。如果要再具体说是关于什么的修订草案,则在后面加上to …。以此类推,环境法修订草案是draft amendment to the Environment Law,婚姻法修订草案是draft amendment to the Marriage Law,等等。could be fined up to one million yuan 最高罚款可达一百万元 这种表述很常见,其中的could和up to都是留有余地的体现。因为违反规定(to violate the rule)是一个很宽泛的概念,程度不尽相同,所以处理力度也不能一概而论。加了could和up to,表示有足够的调节区间。要狠罚可以一百万,要轻罚也可以一百块。immune system n. obesity n.
