Send us a textI may not agree with his every conclusion about the history of the Special Prosecutor and Special Counsel office  and the people who have held it. But I can say that I could find no fault with how this one man handled the job. The Special Counsel and Special Prosecutors Office, begun in 1974, as a way to investigate the sitting President and his staff for alleged wrongdoing, has a history so awful, with so much wrongdoing itself, that it is literally almost impossible to defend as an institution. I don't think the abuse of power has any equal in our governmental history. The shameful conduct of Archibald Cox, Leon Jaworski, Richard Ben-Veniste, Henry Ruth, Lawrence Walsh, Ken Starr, and even the behaviour of our modern day investigators in the Trump-Biden-Trump era is enough to make even the worst tyrants blush. In my opinion, there are possibly two exceptions to this appalling record of power hungry maleficence, Robert Hurr, who investigated the records found in Joe Biden's garage, and Robert Fiske, the original Whitewater Scandal Special Prosecutor. Both men laid out what they saw in detail, and then either walked away, or were in the process of doing so when they were replaced. You cannot ask for anything more than that. In this episode, we get a real treat, as Robert Fiske traveled to Vermont to speak on the history of the Special Prosecutor and Special Counsel Offices and put the Robert Mueller Investigation into historical context. That investigation was ongoing when this lecture occured. The lecture was hosted by the Vermont Law and Graduate School and it runs nearly an hour. Send us a textFew offices in the history of our government have produced more harm, to more people, more often, and more efficiently that the office created in 1973 to investigate the Watergate Scandal. The Special Prosecutor's statute stayed on the books the rest of the 20th century and was used to wound the reelection campaign of George H. W. Bush, and then cripple the final years of the Presidency of Bill Clinton. It has horribly damaged the historical legacies of four United States Presidents: Richard Nixon, Ronald Reagan, George H. W. Bush, and Bill Clinton. Ironically, the very party who dreamed this evil institution up, the Democratic Party,  was the same one to end it when the statue expired in 1999, but only after it had been effectively used to demolish a President of their own party, even as the Impeachment attempt failed to remove Bill Clinton from office.  Then congress invented its bastardized cousin, the Special Counsel statue. While it does have some modest restraints compared to the absolute total powers of the Special Prosecutor's statute, the record of abuse there may not be fully known until our current era, centered around Donald Trump, is over. As we look back at the 1992 Presidential Election and its controversial end. We thought this the perfect opportunity to show to our listeners the full impact of the 30 years of dishonesty that has been used to devastatingly wound four American Presidencies. But even worse than the damage done to the institution of the Presidency is the personal destruction it has wrought on the innocent aids to these Presidents. Often young men and women, whose only real crime was earnestly wanting to play role in the history of the nation and seize the opportunity so few people get in life, the chance to work for the President of the United States. Instead, many faced prison time, and were financially wiped out, while the most dastardly, horrible , unethical people you could have ever dreamed up paraded themselves on television and in books as lawyers who champion justice while playing on the trusting nature of a naive public that still believes that our Justice System is the one uncorrupted branch of government left in the land. Here we lay everything out, the abuses of power, and the intentionally corrupt birth of the most evil office our government has ever created. We hope it will serve as a warning for what we have seen in our more modern times, so that perhaps wise heads will see to it that this institution dies, with a stake through its heart. Just like the last time she was on, each of you gave as good as you got.I tend to agree more with her, because I fear that sometimes you come off as what Jeane Kirkpatrick called the “blame America first crowd” — not that we haven't committed our sins. But if we didn't exist, Putin would still be evil and want to recreate the Warsaw Pact, and the mullahs in Iran would still be fanatics despite our CIA involvement. It's complicated.Another on foreign policy:I despise Putin, my sympathies are totally with the Ukrainians, and I get angry when people like Rod Dreher and Tucker Carlson imply that the Russians were forced by the West to invade Ukraine. But, so what! You hit the nail on the head with the Obama quote — that Ukraine is never going to mean as much to us as it does to them (the Russians). You also made another very good point that the Russians can't even conquer Ukraine, but we're supposed to fear they will march West? How they going to do that?!Another took issue with several things from Anne:You raised the immigration issue, and Applebaum completely dismissed it: Hungary doesn't have a migrant crisis. … Because it's a useful symbol [to] create fear and anxiety. … This is the oldest political trick in the book, and the creation of an imaginary culture war is one of the ways in which you build support among a more fearful part of the population.WTF? Are Hungarians not allowed to see what is happening in every other European country that has allowed mass migration and see the problems it has caused and proactively decide to prevent this?! Are they not allowed to be concerned until Budapest has the banlieues of Paris, the car bombing gangs of Sweden, and the grooming gangs of England?! And in Germany, it has been recently reported that almost half of people receiving social payments are migrants.Applebaum followed that up with an even bigger gobsmacker about Biden's cognitive decline: “This is another road I don't want to go down, but I know people who met with Joe Biden a couple months ago, and he was fine” (meaning I just want to make my statement but will not allow you a rebuttal). And then:I've met [Harris] a few times, mostly in the context of conversations about foreign policy and about Russia and Ukraine and other things. And she's an intelligent conversationalist. … I was impressed with her. And these are way off-the-record conversations... And I was always more impressed with how she was off the record. And then I would sometimes see her in public. And I thought, she seems very stiff and nervous. … You'd like her if you met her in real life.Translation of both of these excerpts: “You plebes who aren't insiders just don't understand, but trust me — the connected insider — instead of your lying eyes.”Another adds:I think for the next few months, you're going to have to push people like Anne Applebaum to be more open to criticizing the Biden-Harris record. She's a smart person with important things to say, but she clearly dared not criticize the current administration, lest she be seen as helping Trump. And another:She says, unironically, that autocrats rig court systems with exotic new lawfare to attack their political enemies to seize or cling to power. I wonder what that makes Alvin Bragg and Merrick Garland.This Dishhead listened to the episode with his teenage son:The notion that Trump supporters want a dictator is beyond ridiculous. They are among the most individualistic and freedom-loving people in America. They are the Jacksonians, the Scots-Irish heart of this country. They are ornery as hell, and if Trump tried to force them into anything, he'd have another thing coming.  Just look how he tried to get them to take “his” vaccine. That didn't work out so well, did it? The truth is, they view people like Anne as the ones who are taking away their rights and freedoms through their absolute dominance of the media and all cultural institutions. Now maybe Trump will deliver them from that and maybe he won't, but that is what they are seeking — not a dictator, but someone who will break the hideous grip that the liberal elite has on the culture.My son is 18 years old and was also listening to the episode. He is highly engaged in national and world affairs, and he also thought Anne was way off track. He's already announced to his mother (much to her chagrin) that he will be casting his first vote for Trump. And get this: he's going to Oberlin College this fall. I can assure you he's not looking for a dictator. He's looking to say “eff you” to a system that has no use for upper-class, normal white boys like him. The elites hate him and his friends.But I'm glad you have a diversity of views on the Dishcast. It really is the best. I look forward to listening to it every week.I can't back Trump, but I do think your son is onto something. On a few other episodes:Lionel Shriver — I love her! I wished you'd talked more about her novel, Mania. It's not perfect, but it's good.On the Stephen Fry pod, I was resistant! He's irritated me at times. But I loved it when you two started doing Larkin! I shouldn't admit this, but “Aubade” could be my autobiography. I think one or both of you misinterpret “Church Going.” Larkin doesn't wish he had faith. I don't think that's relevant to him. Fry talked about how he liked everything about Anglicanism except for the detail about God (and I always suspect that for Anglicans, God is a somewhat troubling detail). I'm probably just guessing, but I don't think that's Larkin. Larkin didn't wish he had faith. He was elegiac about the past in which there was faith. I think you'll see this sensibility in “An Arundel Tomb.”Agreed. Another on Shriver:She seems to think that “liberals” are mistaken in believing that everyone can be equal, but I think she is mistaken in thinking that is what they believe — at least those I know. Liberals do think that 1) expectations play a role in what people achieve; and 2) given the right circumstances, many people find they can achieve more than was expected. Low expectations do lead to low outcomes (and yes, there is research to support that statement). Does that mean everyone can do anything they wish? No. Neither you nor I will ever be a concert pianist, but let us not condemn everyone to the garbage heap based on false expectations.Thanks as always for your provocative discussions.Here's a guest rec:Musa Al Gharbi, a sociologist at Stony Brook, has written for Compact, American Affairs, and The Liberal Patriot. I have preordered the book, and it should be a timely read for an election in which class (education), not race, has become the preeminent dividing line in our politics.Here's a guest rec with pecs:I have a recommendation that may sound bonkers, but hear me out: Alan Ritchson, the actor whose career has taken off thanks to playing Jack Reacher on Reacher.The fact that he's really, really, really ridiculously good-looking is the least interesting thing about him. I'd love to hear a conversation between you and him for a few reasons. First, he's bipolar and speaks openly about it. Second, he started taking testosterone supplements after his body broke down from working out for Reacher, and he speaks openly about that too. Third, he's a devout evangelical Christian who speaks openly about his faith — and about his disgust with Christian nationalism and the hijacking of Christianity by many Trump supporters. Fourth, he posted what read to me as a thoughtful, sane critique of bad cops, thereby angering certain denizens of the Very Online Right. Thus, he could speak to a number of major Dishcast themes: mental illness, masculinity, and Christianity. To me, he manages to come across as a guy's guy whose comments on political matters sound like the result of actual reflection, rather than reflexively following a progressive script, which is how most celebrities come across. He's articulate, and the way he's navigating this cultural and political moment is fascinating. And if you do snag him, you should supplement the audio with video.Haha. But seriously, we're trying to keep the podcast fresh and this is a great out-of-the-box recommendation. Next up, the dissents over my views on Harris continue from the main page. A reader writes:I have no particular attachment to Kamala Harris, and share some of your concerns, but your latest column reads more like a Fox News hit piece than a real assessment. The main problem is that you seem to be judging Harris almost exclusively on the basis of statements she made in 2020, at the height of the Democrats' woke mania because of George Floyd. Do you not remember that she was destroyed in the primary because she was a prosecutor, and was to the right of almost everyone else in the primary, except for Biden and Sanders? That's why she lost: she wasn't woke enough. So as VP, of course she pivoted to shore up her appeal to the base, like any good politician would. It's terribly unfortunate that she had to tack hard left precisely as the country was moving back to the center and rejecting wokism, but that doesn't mean she's the “wokest candidate,” as you say. It just means she's a politician.My criticism also extended to her management and campaigning skills in the past. And look: I don't think it's fair to compare my attempt to review the evidence of her record with a Fox News hit-piece. It's important to understand her vulnerabilities as well as he core ideas, if she has any. This next reader thinks she is off to a good, non-woke start:I agree with your criticisms of Harris, at least some of them. We need to have stronger border enforcement, we can't have riots in cities, and racism is real but DEI excesses are also bad. And it's troubling that she has a history of being a bad boss. I can only hope that she has learned from her mistakes. But I take heart from her campaign speech in Wisconsin: she said not a word about DEI, nothing about “vote for me to show that you're not sexist/racist, because I'm a woman of color,” and not much about “Trump is a threat to democracy.” It was all, “I have experience dealing with sleazy crooks and sex offenders like Trump, and I want to help middle-class Americans and protect health care and a woman's right to choose.” Sounds like a popular message!You also say, “She is not a serious person.” Bro, have you *seen* the other party's candidate?

In 1983, a 25 year old Nancy Cruzan was thrown from her car while driving home in Missouri, landing in a water filled ditch. She was resuscitated by EMS, but did not regain higher brain function, and was eventually diagnosed as being in a persistent vegetative state.  In 1988, Cruzan's parents requested that her feeding tube be removed, arguing that she would not want to continue in this state. The hospital refused without a court order, and the case eventually made its way to the Supreme Court. Arguing for the state of Missouri against the Cruzan's was Ken Starr, who would later be assigned the role of special prosecutor in the investigation of the Clintons (Whitewater, Lewensky, etc). In 1990 the Supreme Court ruled…for the state of Missouri.  On the one hand, this was unfortunate, as it meant Nancy Cruzan could not be disconnected from the feeding tube immediately. On the other hand, the ruling allowed states to set their own evidentiary standards to refuse or withdraw life sustaining interventions.  Missouri set a very high bar, explicit written documentation that applies to this specific circumstance, which the Cruzan's eventually cleared.  Other states set lower bars, including oral assignment of surrogate decision-makers. The Cruzan ruling led to a flood of interest in Advance Directives, and eventually to the Patient Self Determination Act, which mandates provision of information about advanced directives to all hospitalized patients. Today, we talk with Bernie Lo, prominent bioethicist and practicing primary care internist, and Laurie Dornbrand, geriatrician at the IOA On Lok PACE, about the legacy of Nancy Curzan.  We use Bernie's NEJM Perspective as a springboard for discussion.  We discuss, among other things: How and why in the 30 years since the Cruzan ruling the emphasis has shifted from advance directive forms to in-the-moment discussions And validating the importance of the advance directive forms in some circumstances, and in starting conversations The role of the clinician in engaging patients in advance care planning and in-the-moment serious illness conversation: what questions are important? What words to use? Is the POLST useful? How? Under what circumstances?  Should we abandon the term, “comfort measures?” In case you miss the introductions at the start of the podcast, Bernie and Laurie are married, and offer wonderful reminiscence of their clinical practice over the last several decades.  So when Bernie says, “I've heard you take these phone calls in the middle of the night, Laurie…” Now you know why! In a jaw-dropping development, even for him, even for his declining acuity, even in the vast Fog of Trump, he has just endorsed TWO rival candidates in the same congressional Republican primary. Saturday, at the Young Republicans banquet, Trump endorses Bo Hines, hoping to be chosen as the Republican running for North Carolina's 6th Congressional District. Then yesterday, Trump writes “Addison McDowell just announced he is running for North Carolina's 6th Congressional District… has my Complete and Total endorsement." There are SIX Republicans in the primary. Plenty of time for Trump to endorse all six of them. The primary isn't until the 5th of March. This should stop being a surprise.  The man is mentally impaired, declining fast, doesn't know which number World War the NEXT World War would be, continually confuses Obama for Biden, doesn't know what city he's in, thinks Hungary's Viktor Orban is the dictator of Turkey, and this is after he STARTED with any one (or more) of a dozen psychological and maybe physiological problems that could be summarized under the heading “his brain doesn't work right.” It is not just a question of what Trump would do that he wanted to do but thought he couldn't get away with the first time. It is also a question of what Trump would do that he would never know he was doing – out of sheer mental incapacitation. Like endorsing two candidates in the same race. Within 89 hours. Just to put a cherry on top of this cake of crazy, as I was recording the podcast Trump was speaking in Iowa. He was supposed to boast about the "U.S. Economy." But he didn't say that. He said the "Eunice Economy." Eunice. So good economic news for anybody named Eunice. Also: Hunter Biden humiliates Jim Comer and Jim Jordan, and the Republicans address the danger that Joe Biden is to America by launching a formal inquiry into impeaching him and then immediately going on vacation for the rest of the year. The show trial impeachment of Joe Biden is SO fraudulent that it has even by noticed by Chuck Todd, who has written 1,947 of the dumbest words imaginable on the topic, including the idea - as if he had dreamt it up - that the concept of impeachment has now been diluted. What Chuck did not mention but I will, is the role NBC News played on the day impeachment - and our original form of government - died. September 21, 1998, the day NBC and all the other networks prostituted themselves to the GOP and ran, unseen and unedited and without any context, Bill Clinton's Grand Jury testimony that had been illegally given to the Republican-run House Judiciary Committee and then illegally broadcast on all the networks while not one of tv's "journalists" made one complaint. It was before Chuck's time at NBC. It was NOT before mine. He was looking for - and all the statements by the judge unsealed yesterday confirms this - for the DM's Trump sent, and any sent TO him. I've been struck by John Mulaney for years — his delivery, his unique understanding of the world, his deep empathy for the human condition. I didn't know until last year he is also a Constitutional Law nerd. I mean, seriously, he texts me all sorts of questions about random Supreme Court cases. All the time. And they are damn good questions.John's questions are really what launched me on this podcast Courtside, because it occurred to me that Constitutional Law should not be the province of a bunch of lawyers — it belongs to all of us.You are about to get treated (whether a paying subscriber or not) for what I've had the privilege of seeing with John, an absolutely first rate mind who brings joy and playfulness to everything he encounters. He picked Morrison v. Olson (1988), one of the most important cases in constitutional law. The case concerns how to prosecute Presidential or high level Executive Branch wrongdoing. When he picked it, we didn't know Donald Trump would be getting a target letter for the January 6 events at the same time, but the imminent criminal indictment of Donald Trump raises the importance of this episode even more.Morrison v. Olson was a sweeping Supreme Court decision, decided in 1988, that found the Independent Counsel Act of 1978 constitutional. This Act was responsible for the appointment of independent prosecutors such as Ken Starr, who kickstarted the sprawling and viciously partisan investigation of Monica Lewinsky, and Lawrence Walsh, who was tasked with investigating the Iran-Contra affair during the Reagan Administration. While the Court issued a 7-1 ruling in favor of the Act (with Chief Justice Rehnquist writing for the majority), the decision is widely thought to have been a mistake. Most believe that Justice Scalia's lone dissent was ultimately correct, and some even argue that it is the finest dissent he ever wrote.John is pinpoint accurate in describing Morrison, and the ways in which it matters. Yet the Constitution doesn't provide for any alternative. This is a problem of governance that goes back millenia — to Juvenal's query Who Guards the Guardians? (Or, as Dr. Seuss put it, bee-watchers watching the bees, and bee-watcher-watchers watching the watchers.)Regardless, the American public is about to see one model, the Special Counsel regulations, come into force as Jack Smith prosecutes former President Donald Trump. Ken Starr, the former federal judge and independent counsel who became famous for his investigation of President Bill Clinton, died this week on September 13 at age 76. Sam and Emma host Jane McAlevey, Senior Policy Fellow at the University of California, Berkeley's Labor Center, to discuss her recent video for The Nation "You Voted To Form A Union. Now What?" Then they are joined by T.J. Kitchen, Organizing Director for the Teamsters Joint Council #43, to discuss the recent organizing efforts at a Chipotle franchise in Lansing, Michigan. Sam and Emma begin by running through updates on early Russia-Ukraine negotiations (including Putin rejecting a No-NATO pledge), WV's new abortion ban, and Starbucks' firing of organizer Jaz Brisack, also touching on Lindsey Graham launching his bill to finally lead America out of the wacko dark ages of “Bodily Autonomy.” Then Jane McAlevey joins as she, Sam, and Emma get right into contextualizing the growth of the American labor movement over the last two years (since McAlevey's last appearance on MR), exploring the mass growth in organized labor action in the wake of the heightened tensions of 2020 and the labor exploitation of the COVID-19 pandemic, and how the Biden administration's NLRB has failed (and occasionally succeeded) in capturing that rage. Following up on that discussion, Jane gets into the next iteration of challenges facing new US unions, looking at how the rise of independent unions (Starbucks Workers United, Amazon Labor Union, etc), fails to capitalize on the preexisting organizing expertise and experience found in national unions (and preferably in the NLRB) or to mobilize for demands on a larger-scale. After they get into the continuing complicity of the Democratic Party in undermining labor power in the US, also covering their response to the recent Freight Rail strike, they wrap up by assessing how the US working class became so overworked and under-compensated while rent and healthcare prices continue to skyrocket, and what we can do to close that gap. TJ Kitchen then joins to dive into the recent organizing at a Lansing Chipotle, discussing how the workers there reached out to the Teamsters Joint Council #43, how they were able to prepare the workers and strategize for the union-busting that would surely come (and did), and how this action can grow moving forwards.
