Not everyone understands the Constitution, but not all misunderstandings of the Constitution are equal. Over the years I've gotten a lot of very bizarre comments that make outlandishly wrong and even conspiracy theory level claims about what is actually in the Constitution, or what has become of it. Is the Australian Government actually a corporation registered in Washington DC? Are Australians secretly classified as cargo under maritime law? Is Western Australia non-existent? Did Gough Whitlam secretly replace the Constitution with a different colour? Of course not. None of these claims make any sense. So to debunk them I've got Professor Anne Twomey, constitutional expert, to explain how it actually works and to encourage people to do the most basic fact checking exercise of all: actually reading things. King Charles' cancer diagnosis is casting doubt on his future role. The Palace reports he will continue official duties until further notice. Sydney University Constitutional Law expert Anne Twomey says what duties he performs, remain within his control at this stage. But she says if he becomes incapacitated, decisions will move to his spouse Queen Camilla, two Parliamentary officials and two people from the court. "Amidst those five, if three of them decide that he's incapable of fulfilling his activities, he can have a regent. And then the regent can take over his powers." What is the Voice to Parliament? What does the Voice to Parliament do? Why put it in the constitution? And why would that be different to creating a legislative Voice instead? These questions and more I ask directly to a constitutional expert - Professor Anne Twomey - who was a member of the constitutional expert group advising the referendum working group on some of the constitutional and legal aspects about the Voice. When women in NSW won the vote in 1902 some thought the fight was over – but in fact, it was just beginning. The voices of women still weren't being heard in the places where the big decisions were being made: parliament, courts and government. Today women can be lawyers, judges and members of the NSW Parliament, but it has taken decades to see women in those roles and true equality is a long way off – especially for Indigenous Australian women.
