In this episode David Sheehan and Camille Bent of the Baker Hostetler team offer a tutorial on the new precedents established in the case that will provide a game plan for those that are charged with managing recovery after massive Ponzi schemes and will benefit victims of such cases. The most significant of these legal victories is court acceptance of the use of a net equity approach to fairly determine the claim amounts of investors in what has become known as a “net winners/net losers” game plan.

EASY LISTENING DEP'T.: The great difficulty in trying to convey what happens with this president and this presidency is that Donald Trump is a profoundly addled and frivolous person who doesn't care or understand the things he says or does, but he is also the president of the United States, so that the things that he says and does are real and serious. Trying to start from the fact that he is the president and impose a kind of sanity and meaning on his behavior that isn't there while addressing his absurdity and irrationality as supplemental detail to be euphemized or paraphrased creates a perniciously false picture. What the Times did in today's paper is to frankly start with the incoherent rambling and then to assemble a sort of collage around the serious things it means. In this episode of Passing Judgment, Jessica Levinson unpacks the legal issues behind Jimmy Kimmel's temporary show suspension. She explains the distinction between private action by ABC and possible government coercion from the FCC or the President, outlining why the First Amendment generally protects speech from government—not private—actions. Jessica also discusses the limited circumstances under which the FCC could revoke broadcast licenses and what this case means for free speech and media organizations moving forward. Here are three key takeaways you don't want to miss:1. The Suspension and Return of Jimmy Kimmel's ShowJessica Levinson opens the episode by explaining the sequence of events around Jimmy Kimmel's temporary suspension from ABC after a controversial comment in his monologue. She emphasizes that although he has now been returned to air, the legal issues discussed still remain relevant.2. The Role and Limits of the First AmendmentA central theme is clarifying what the First Amendment protects. Jessica explains that the First Amendment limits government action against speech, not actions taken by private entities like ABC. If ABC alone had suspended Kimmel with no government involvement, it would not be a First Amendment issue.3. Government Involvement and the FCC's RoleThe episode explores concerns about potential government overreach, specifically whether statements made by the FCC chair or the President could constitute government coercion. Jessica details how, if the government pressures a private company to take action against someone's speech, First Amendment concerns are triggered.Follow Our Host: @LevinsonJessica

From Bolton's role in the Trump administration to prior warnings from a federal judge about his handling of sensitive information and why the DOJ under Biden dropped its earlier investigation, Victor Davis Hanson unpacks the full backstory behind the raid on today's episode of “Victor Davis Hanson: In His Own Words.” “ When Donald Trump's home was raided on August 9th, 2022, John Bolton spoke out. And he said, ‘Let's not prejudge, you,' basically, you pro-Trumpers, ‘let's just let all the evidence, you know, be seen before we make snap judgments.' Meaning, you know, he's probably guilty. But more importantly, then he said, ‘Donald Trump was just—anything that came across his desk. He saw french fries, he got 'em. He saw classified documents, he did, just because he could.' And then on another occasion, ‘He has no respect for classification. And that's a lie, that he personally classified these.' So he was very critical of anybody who objected to what he thought was an FBI, legitimate raid on Mar-a-Lago. Now it's ironic. We'll see if he uses the same tropes and themes to protect himself in the way that he blasted Trump about a similar raid.”
