For the last 35 years, Rinaldo Brutoco has devoted himself to asking – and answering – these crucial questions. Rinaldo graduated from Santa Clara University with degrees in economics and philosophy and later received a J.D. from UCLA School of Law in 1971. The Digital Markets, Competition and Consumers Act recently received Royal Assent. So what should businesses be doing to stay informed of the Act's rollout as the Competition and Markets Authority begins its enforcement? Fiona Garside, Chris Eberhardt, and Hayden Dunnett of Ashurst's UK based Antitrust, Regulation and Foreign Investment Team delve into the three main pillars of the newly enacted Digital Markets, Competition and Consumers Act which promises significant regulatory changes. The team dissects how the new digital markets regime allows the Competition and Markets Authority (CMA) to designate firms with strategic market status (SMS), in order to impose bespoke conduct requirements and pro-competition intervention orders. The discussion highlights that the CMA's draft guidance leaves significant questions about how the CMA will exercise its broad powers, particularly in relation to conduct requirements and pro-competition interventions. What is Consumer Law? Consumer law refers to the regulations and statutes that provide a legal framework to ensure the rights of consumers are upheld in the marketplace. This field encompasses a variety of areas including product safety, fair trading, credit and finance, privacy, and false advertising. The primary goal of consumer law is to safeguard consumers from exploitation and to ensure that they have access to accurate information to make informed purchasing decisions. 2. Key Aspects of Consumer Law. a. Consumer Rights. Every consumer has fundamental rights, which include the right to safety, the right to be informed, the right to choose, and the right to be heard. These rights ensure that consumers receive products that are safe to use, are well informed about their purchases, have a variety of options available in the market, and can voice complaints about products or services. b. Product Safety and Liability. Product safety is a cornerstone of consumer protection. Manufacturers, distributors, and retailers are obligated to ensure that their products are free from defects that could cause harm to consumers. In cases where a product is found to be unsafe, liability laws ensure that those responsible can be held accountable, offering consumers avenues for compensation. c. Fair Trading. Fair trading laws protect consumers from deceptive and misleading practices. These regulations ensure that businesses conduct their operations honestly and provide clear, accurate information about their products and services. Practices such as false advertising, bait and switch selling, and wrongful pricing are prohibited under these laws. d. Consumer Contracts. Consumer contracts are another critical area covered under consumer law. These contracts must not contain unfair terms, and must be presented in a clear and understandable manner. Consumers have the right to expect that the terms and conditions of any contract they enter into are fair and respect their rights as consumers. e. Credit and Finance. Credit and finance laws protect consumers when they borrow money or purchase goods on credit. These provisions ensure that lenders and credit providers operate transparently and responsibly. Important aspects of these laws include the requirement to clearly disclose interest rates, penalties, and all terms of the credit agreement. f. Privacy Protection. In the digital age, consumer privacy has become increasingly significant. Privacy laws protect personal information collected by businesses. Consumers have the right to know how their information is used and have a right to privacy concerning their personal details. 3. Consumer Protection Agencies. Several agencies and organizations are dedicated to enforcing consumer laws and protecting consumer rights. These include the Federal Trade Commission (FTC) in the United States, the Competition and Consumer Commission in Australia, or the Consumer Rights Protection Councils found in many countries. These bodies offer resources and support to help consumers understand their rights and seek redress in instances of injustice. 4. How to Resolve Consumer Disputes. When consumer rights are violated, there are several steps that individuals can take to seek resolution. These include: a. Direct Complaints. The first step is often to contact the business directly. In this episode we talk to Michael Mckenna from the VACC (Victorian Automotive Chamber of Commerce) about consumer law and how it is impacting their members the Licenced Motor Car Traders. Michael explains that dealers are facing increased complaints related to issues like buyers remorse and technical issues. He believes these complaints have risen due to increased consumer awareness of their rights, more complex vehicles and repairs, extraordinary high prices after Covid which are now coming down (buyers remorse) and tighter finances putting pressure on dealers and customers. He outlines dealers' obligations under consumer law to provide fit-for-purpose vehicles, honour warranties, avoid misrepresentation and resolve disputes fairly. If dealers fail to meet these obligations, they can face penalties, legal action, and loss of reputation. Consumers and dealers are well protected under current laws. Potential new protections could include a lemon law and protection around such vehicles. While aimed at protecting consumers, Michael believes this does not cover the complexity of vehicles and the additional cost burdened by the dealers to administer such a policy would be unfair and be taken from other social support dealers provide to the community. To help dealers, the VACC provides training on consumer law, industrial relations, contract and legal obligations, customer dispute resolution procedures and customer service best practices, a technical library and technician apprentice program. They also canvass politicians and work with other industry bodies. By keeping dealers informed and setting industry standards, the VACC aims to promote fair trading and fewer complaints. Overall Michael provides insightful perspective on the pressures facing dealers and how consumer laws attempt to balance their interests with consumer rights.
