Canadian Criminal Law in Ten Cases explores the development of criminal justice in Canada through an in-depth examination of ten significant criminal cases. Martin L. Friedland draws on cases that went to the Supreme Court of Canada or the Privy Council, including well-known cases such as those of Louis Riel, Steven Truscott, Henry Morgentaler, and Jamie Gladue. The book addresses such issues as wrongful convictions, the enforcement of morality, Indigenous experiences with criminal law, bail and trial delay, and the impact of the 1982 Charter of Rights on the criminal justice system. Friedland describes in a masterful way the factual background of each case and the political, social, and economic conditions of the time. Each character – the accused, judges, and counsel – is described in detail, as are the relevant laws and procedures. Friedland includes recommendations on how the criminal justice system can be improved, such as by creating a new federal commission devoted solely to criminal justice and by the enactment by Parliament of enhanced codes of evidence and criminal law and procedure. Canadian Criminal Law in Ten Cases is an indispensable guide to understanding the criminal justice system for lawyers, students, and anyone interested in criminal law and the administration of criminal justice. June 9, 1959. Clinton, Ontario. After failing to return home, 12-year old Lynne Harper is reported missing and her body is discovered in a woodlot two days later. She has been sexually assaulted and strangled to death with her own blouse and suspicion turns towards her 14-year old classmate, Steven Truscott, who claims that he gave Lynne a ride to the highway on his bicycle and saw her climb into a passing car. Steven is soon charged, convicted and sentenced to death for Lynne's murder, but his sentence is commuted to life imprisonment and he is paroled in 1969. Decades later, Steven files a successful appeal to have his conviction overturned, but there is still a lot of debate about who was actually responsible for Lynne Harper's murder. On June 9th, 1959 a 12-year-old-girl would disappear in Clinton, Ontario, about 80 kilometres northwest of London, Ontario from nearby the Royal Canadian Air Force Base. Seemingly the last person to see her alive would be a young man who was also a classmate of hers at The Air Vice Marshal Hugh Campbell School. The two had gone for a ride oh his bicycle. When the young girl did not return home, the young boy would in fact become a suspect in her disappearance. On June 11th, two days after she had gone missing, tragically her body would be found and on June 12th, the young man would be arrested and charged with first-degree murder. Police felt that this was an opened and closed case. We don't get a lot of movie premieres here in Guelph, so when one happens it's kind of a big deal. Coming to the Bookshelf Cinema this Friday is Marlene, the story of self-selecting Guelphites Marlene Truscott and her husband Steven Truscott, whose life story involves one of the worst miscarriages of justice in Canadian history. Now it's a movie, and according to its director, a romance at that. Steven Truscott was the youngest person ever to be sentenced to death in Canada, and it was for the 1959 rape and murder of 12-year-old Lynne Harper in Clinton, Ontario. Truscott himself was just 14 at the time, and though he was later remanded to life in prison, he always maintained his innocence. Truscott was paroled in 1969, and was finally acquitted by the Court of Appeal in 2007, 48 years after his conviction. Throughout much of Truscott's nearly 50-year journey from condemnation to exoneration, Marlene was by his side though they didn't meet until years after his conviction. Marlene ended up becoming Steven's most passionate and vocal advocate, and they got married and had a family together after he was paroled. This was a story ready made for the movies, an innocent man endures a terrible fate only to find great love in his darkest time. It was a story Wendy Hill-Tout wanted to tell. Hill-Tout joins us on this week's podcast to talk about the making of Marlene, how she got interested in the story, and why she decided to make Marlene Truscott the point of view for telling it. We also talk about the the political and social issues around Steve Truscott's experience, like how young Truscott was a victim of the “tough on crime” ethos, how the media played a crucial role in promoting his case, and the role sentencing a 14-year-old to hang played in ending capital punishment in Canada. Dempsey Bryk is a Canadian actor based out of Los Angeles, CA, and Toronto, ON. His recent work includes leading the Facebook Watch show "The Birch" as Thurston Polk, playing Rob in Netflix's "The Silence" as well as the Netflix shows "V-Wars" and "Black Mirror", Cinemax's "Jett", and his role as Wyatt on CBC's "Heartland." He also recently starred in the Circle-X production "Punkplay" at the Atwater Village Theatre. Dempsey is leading in the upcoming boxing film "The Fight Machine", and playing Steven Truscott in the biopic "Chasing Justice." Dempsey is also a writer, having placed a production Off-Broadway in New York City and producing his own short films. Multiple projects are currently in development.
