This week I focus on two NS Court of Appeal decisions. One relates to the delay in Judge Rickola Brinton's decision in the sexual interference and exploitation trial of Brandon McNeil (who now goes by the name Brynn Milner), and the plentiful blame that can be laid at the feet of Judge Brinton, as well as former Provincial Court Chief Judge Pam Williams. The other is the successful appeal of a 2nd Degree Murder charge by Gregory Purvis. The Court of Appeal found that his rights were violated through improper instructions by the trial judge to the jury deciding his case. I review those errors, and the allegation of ineffective counsel. Also covered are the appointment of former Lieutenant Governor Myra Freeman to chair the Mass Casualty Commission implementation committee, the Trump verdict (with some commentary on the performances of the two main lawyers on the case), the lawsuit filed by the Province of Newfoundland and Labrador's Justice Minister John Hogan against the Federal Government regarding equalization, along with some comments on the death of Robert Pickton and the decision to drop all charges against world #1 golfer Scott Scheffler.

On today's show I sit down with a a former juvenile offender convicted of 2nd degree murder turned paralegal who has recently written a bill to give juvenile offenders the right to have their cases reviewed. In this true crime story - Richard Midkiff was sentenced to 38 years in prison for felony murder, related to a 1996 robbery and murder. He was only driving the getaway car. Richard is now the President and CEO of RSMC, a paralegal consultancy company specializing in appellate, post-conviction matters, prison reform and re-entry. He applied his legal skills to his own case and obtained a ruling that released him 15 years earlier than his original sentence. A 14-year-old boy has been charged with murder after a stabbing at a North Carolina high school that left one student dead and another hospitalized, officials said.The stabbing happened during a fight at Southeast Raleigh High School on Monday morning, Raleigh police said in a news release. Officers and school security responded to a report of a stabbing around 11 a.m. and two teens were taken to a local hospital. We recently told the story of Zach Peterson, a man found guilty of 2nd degree murder even though the jury not only believed him not to be the shooter but also that he wasn't even near the crime when it occurred. He was found guilty using the 'Felony Murder Rule'. Today I sit down with OMR's voice of reason and defense attorney Michael Leonard to discuss the case and the Felony Murder Rule.On Tuesday January 18th 2011 just after 2pm police get a call about gun shots and a man lying in a pool of blood at the Sunset Trailer Park off Lenoir Street in South Columbia. The following day at 1:30pm police would say that Zach Peterson was their main suspect in the death of 31 year old James Leon Porter, killed during a suspected drug deal gone bad. Zach has never denied setting up the deal and driving James Porter to the location, however he says that was the extent of what he knows from that day as he would leave Mr. Porter at the trailer park and drive across town and would later find out things went bad and James had been shot. At trial Zach's defence would bring strong evidence to help prove he was not in fact the shooter in this crime. The jury would later decide that they did not in fact believe Zach to be the shooter however he would still be found guilty of 2nd Degree Murder, why? the Felony Murder rule. Hosted on Acast. In a long-awaited conclusion to a two-decade-old case, Jennifer Hall, a former respiratory therapist, has been sentenced to 18 years in prison for her role in the deaths of two hospital patients. The sentencing comes after a series of events that began in 2002 at Hedrick Medical Center in Chillicothe, Missouri.  Originally facing charges of two counts of first-degree murder, Jennifer Hall ultimately pleaded guilty to reduced charges of first-degree involuntary manslaughter in the deaths of 75-year-old Fern Franco and 37-year-old David Wesley Harper. Additionally, Hall pleaded guilty to one count of attempted second-degree assault in connection with the case. The deaths occurred amidst a cluster of incidents that medical authorities described as "medically suspicious."  Fern Franco and David Harper were among a total of nine patients who tragically lost their lives at Hedrick Medical Center during several months in 2002. The charging documents highlighted the unusual circumstances surrounding these deaths, leading to a renewed investigation that spanned years.  Livingston County Prosecuting Attorney Adam Warren expressed his thoughts on the sentencing, stating, "A sentence 20 years in the making… But for now we all sleep better now knowing she is behind bars."  The unsettling case began when Hall commenced her employment at the hospital in December 2001. Until she was placed on administrative leave in May of the following year, a notable increase in cardiac arrests or "Code Blue" events had been observed, soaring from an average of one per year to 18 incidents during her tenure.  The case resurfaced after an analysis of Fern Franco's tissue samples revealed the presence of morphine and a potent muscle relaxant, both unauthorized substances in her system. These findings led investigators to question the circumstances surrounding Franco's death and sparked suspicions about Hall's involvement due to her close proximity to the affected patients, her access to potentially lethal medications, and her consistent notifications of patients' cardiac emergencies.  Over the course of the investigation, it was determined that nine patients had succumbed to their conditions while under Hall's care, while another nine managed to recover. The case eventually resulted in Hall being charged with first-degree murder in Fern Franco's death.  Scott Lindley, the county coroner, alleged that hospital officials attempted to cover up concerns about Hall's actions to avoid negative publicity. Despite the concerns, no criminal investigation was initiated at that time.  A wrongful-death lawsuit was filed in 2010 on behalf of the families of five deceased patients, naming the hospital and its current operator, St. Luke's Health System. However, the lawsuit was dismissed by the Missouri Supreme Court in 2019 due to the expiration of the statute of limitations.  St. Luke's Health System released a statement clarifying that it assumed control of Hedrick Medical Center over a year after the events occurred. Meanwhile, Prosecutor Adam Warren took up the investigation in 2012, driven by the belief that a comprehensive inquiry had not been carried out previously.  The patients affected by the events ranged in age and health conditions, from World War II veteran Charles O'Hara at 88 years old to 37-year-old David Harper, who had been on the path to recovery from pneumonia before his untimely death. Shirley Eller, aged 49, was on the verge of being discharged after treatment for pneumonia when she suddenly collapsed and passed away.  The unsettling circumstances surrounding these deaths raised questions about the nature of the fatalities. Jennifer Hall's actions were scrutinized, leading to the conclusion that her involvement led to the unfortunate demise of some patients.  In the case of Fern Franco, a vulnerable and elderly patient, Hall's actions were particularly damning. The administration of the muscle relaxant succinylcholine resulted in what prosecutors described as a "ghastly death from suffocation" while Franco remained conscious. Hall's administrative leave following Franco's death coincided with a "Code Blue" incident drop.  Although Hall was eventually terminated from her position, it was not directly due to the patient's deaths. Her firing came after hospital authorities discovered her conviction for an arson incident at Cass Regional Medical Center in Harrisonville, a previous workplace. Martens, a former FBI agent, and his daughter are awaiting re-trial for murder in North Carolina. In the early morning hours of August 2, 2015, Molly's husband, Jason Corbett was beaten to death with a paver wielded by his wife and a child's bat wielded by his father-in-law, Martens. Their self-defense claims were quickly rejected by investigators, who presented the case to a grand jury that indicted the pair for 2nd Degree Murder and Voluntary Manslaughter. Kyle and Lisa talk about the evidence against Molly and Martens, their initial trial and state appellate claims and the appellate court decisions that granted their new trial requests.

This week, Kristin starts us off with an old, yet very timely story. In 1992, Yoshihiro Hattori and his friend Webb Haymaker arrived at what they thought was the location of a halloween party. In reality, the two teenage boys were at the wrong house. When they went up to the house and knocked on the door, a woman opened a side door, spotted the two boys, then quickly slammed it shut. Yoshi and Webb were confused, but they figured they'd arrived at the wrong home. As they were walking away, the door opened again. This time, a 30 year old man stood in the doorway with a gun. When Yoshi approached him, saying that they were there for the party, the man shot Yoshi in the chest. Then Brandi tells us about Maribel Ramos, who thought she'd found the perfect roommate when Kwang Choi “KC” Joy responded to her ad on Craigslist. KC described himself as an easygoing professional. He soon moved into Maribel's home in Orange County, California. Initially, Maribel and KC got along great. They even went on vacation together. But when KC couldn't pay rent, their relationship went downhill. Maribel feared that things might get violent between them. Then she disappeared. And now for a note about our process. Dinwiddie County Commonwealth's Attorney Ann Cabell Baskervill charged seven Henrico County Sheriff's deputies with second-degree murder after she viewed a video she described as a 12-minute struggle between the deputies and 28-year-old Irvo Otieno. During the deputies' arraignments Wednesday, Baskervill said the video showed deliberate and cruel treatment during which Otieno was smothered to death by the weight of seven deputies on top of him. Baskervill cited videos from Central State Hospital and Henrico County jail in court. Neither video was made available to the public yet. Lorenzen Wright, an NBA star basketball player, goes missing on the night of July 18th, 2010 leading to a 10-day search that ends when investigators find Lorenzen Wright's remains in a heavily wooded area near Germantown, Tennessee. By the time his body is found, the 6'11” star athlete has decomposed to the point of his remains totaling only 57 pounds, just one of the many struggles that investigators need to overcome in order to solve this case. It took over 7 years, but investigators finally found the gun that they believe was used to murder Lorenzen Wright, leading to multiple convictions related to 1st Degree Murder. In this episode of Body Bags, forensics expert Joseph Scott Morgan and Jackie Howard provide details on Lorenzen's life including the death of one of his children, the financial troubles that may have played a role in the motives behind his murder, and why it can be so difficult to find sufficient evidence in a forensic investigation that starts ten days after a death has occurred. In this podcast about culture we discuss the developing crime story about a 29 year-old Florida Woman, who shot her boyfriend in Gainesville Florida. A Gainesville woman has been indicted for first-degree murder for the shooting death of her then-boyfriend, the state attorney's office announced late Monday. Rachael Laniese Wilks, 29, was arrested on Feb. 1 after admitting to shooting her Brian Rashad Brown. Wilks was reportedly pregnant with twins and Brown was believed to be the father. Wilks said she was unaware that she killed Brown and said she did so in self-defense. A grand jury and prosecutors, however, say otherwise.
