In Chambers v. Florida and the Criminal Justice Revolution, historian and former ABA Journal reporter Richard Brust lifts the veil on a case that laid the groundwork for some much more famous civil rights victories. On May 13, 1933, shopkeeper Robert Darsey was robbed and murdered in Pompano, Florida. Four Black migrant farm workers—Izell Chambers, Walter Woodard, Jack Williamson and Charlie Davis—were seized and pressured by the local sheriff into confessing to the murder under threat of lynching. Their appeals eventually reached the U.S. Supreme Court through the efforts of some dedicated African American attorneys, and succeeded in 1940. In Justice Hugo Black's written opinion for the majority, the justice drew parallels between the Jim Crow regime in the American South and the rise of authoritarianism and fascism in Europe. Chambers v. Florida forbade the use of psychological coercion—such as threatening to turn prisoners over to lynch mobs—as well as physical abuse to extract confessions. The court's ruling declared that the protections of the Bill of Rights extended into states' criminal cases, and began to change the kinds of cases that made it onto the Supreme Court docket.Brust sees it as part of a trio of cases, which includes Moore v. Dempsey (1923) and Brown v. Mississippi (1936), that led to a “criminal procedure revolution,” he tells the ABA Journal's Lee Rawles. In this episode of The Modern Law Library, Brust discusses the lawyers who worked on the case, most prominently Simuel D. McGill, a Black attorney in Jacksonville. Mast cell activation syndrome isn't widely recognized, but for many women, it may explain years of pain, fatigue, and hormone related chaos no one could solve.I see a lot of patients who are struggling with fatigue, pain, and hormone symptoms that don't seem to make sense on paper. And I've noticed a pattern but I wanted to talk to someone who lives in the complexity of it every day.Dr. Tania Dempsey, is one of the few physicians who's helped bring mast cell activation syndrome (MCAS) into the spotlight. Years ago, she was treating a patient who just wasn't getting better until she stumbled on a paper about mast cells that changed everything. That one article led to a phone call, a new way of thinking, and a career shifting collaboration with one of the leading voices in the field.In this conversation, we explore how MCAS shows up in gynecology especially in cases involving PCOS, perimenopause, and unexplained pelvic pain. Nick Dempsey is an Australian disability advocate, motivational speaker, and content creator whose life changed dramatically after a diving accident on his 21st birthday left him with a spinal cord injury and quadriplegia. While celebrating with friends at his parents’ home, he misjudged a dive into a shallow backyard pool, dislocating his neck upon impact. "Just after talking about how good my mates are, they broke my neck and then went down to the pub..." Nick has since become a powerful voice in the disability community. He shares his journey candidly on platforms like TikTok and through his podcast “Chats From A Chair,” where he explores life with a disability and broader issues of representation and accessibility. In an episode of the ListenABLE podcast, Nick discussed his lived experience and the innovative solutions he’s developed to maintain independence—including an adaptive drinking glove he designed himself. And it was definitely a day for work in the Dempsey because the weather in Seattle couldn't make up its mind. Half the day was sunny and breezy; the other half was flat-out stormy. What does it mean to commit to performance so fully that it transforms how you move through the world? Winnipeg artist Shawna Dempsey reveals in this week's episode how performance art can be a radical tool for change. Dempsey recalls the inspiration behind some of her and collaborator Lori Millan's iconic works like Lesbian National Parks and Services, where she and Millan became uniformed officials "protecting the lesbian wilds" while educating the public about the inherent queerness of nature. Their performances blended humour, authority, and subversion to create transformative encounters decades before mainstream acceptance of LGBTQ+ identities. Learn about a time in the not-so distant-past where donning a ranger uniform emblazoned with the word "lesbian" forced constant coming out in 1990s Canada – a time when queer people had few legal protections and homophobia was abound. Dempsey and Millan are still creating work, like Thunderhead, Canada's new LGBTQ2+ monument commemorating victims of The Purge. The financial realities of life as a non-commercial artist pose a counterpoint to creative freedom, and Dempsey explores how she walks this tightrope. Despite international recognition and exhibiting at prestigious institutions like MoMA and the Winnipeg Art Gallery, Dempsey remembers that sometimes the most they earned in a year was under $19,000 each while touring five months of the year. "Supporting oneself as an artist in Canada is very challenging, especially if you don't make anything saleable," she explains, detailing how they survived through teaching, writing, and "pretty much anything for $50."As co-executive director of Mentoring Artists for Women's Art (MAWA), Dempsey confronts the persistent inequality in visual arts, where women artists in Canada still earn only 70 cents for every dollar male artists make. Aspiring artists will find wisdom in Dempsey's journey – from playing pretend as the famous artist "Miss Shawna from New York" as a child to creating groundbreaking feminist work that's changed lives. He's continued to publish books and even better, he and Pete become parents of twins.The political landscape may be grim, but they cannot take our joy.
