In the second part of HBW Insight's chat with Bristows digital health regulatory expert Jamie Hatzel, we talk about artificial intelligence. Specifically, we discuss what happens to Software as a Medical Device within incoming EU artificial intelligence legislation, which has now entered trilogue negotiations. Issues such as the meaning of “high risk” within the proposed AI Act, in contrast to its meaning in the existing Medical Device Regulations, highlight the importance for manufacturers in this space or thinking about entering it of getting good advice, Hatzel points out.
Digitalisation is a hot topic in consumer health, and “digital health” covers a broad spectrum of applications, from wellness apps to virtual reality therapeutics. In this episode, HBW Insight speaks to regulatory expert Jamie Hatzel to get some clarity on “software as a medical device” – a subset of medical device regulatory frameworks within which many digital health applications are classified. In the first part of a two-part podcast, Hatzel briefly outlines the UK and EU regulatory approaches to SaMDs, before we discuss specific examples such as symptom trackers, wellness apps and digital therapeutics. In the second part, we talk about artificial intelligence, how incoming AI regulations impact SaMDs and whether OTC firms should take the plunge into this highly regulated but nevertheless very exciting space.
Since Brexit happened, there are multiple waves of changes in the UK. First the UK Responsible Person (which is a hybrid of the EU AR and the EU Importer), then the UKCA requirements, then the new legislation consultation (which will largely harmonise UK law with the MDR and IVDR) and now the extension of the unilateral recognition of CE Marks to allow manufacturers more time to obtain a UKCA marks. Post By: Adam Turteltaub With the 25th annual HCCA Compliance Institute about to take place we have been collecting some rememberances of the last 25 years from various members of the compliance community. In this podcast, SCCE & HCCA board member, and the association’s next president Robert Bond shares his history in compliance. Robert, who is Senior Counsel and Notary Public at the London firm of Bristows actually has roots that dig even. About 35 years ago he was living in the Midlands of the UK and had a neighbor who was developing (loudly) a video game, often at all hours of the night. As Robert and the neighbor talked, it became clear that the programmer needed some legal help, which led Robert eventually to move fully into the then emerging field of video game law. Even at that time, he reports, gaming firms were collecting vast troves of data with often insufficient understanding of both the opportunities and risks it posed. By the time of the first Compliance Institute he had moved to London and was leading a small firm’s multimedia practice. Notably by the 1990s privacy, which Robert specializes in, was already becoming a concern. As he shares in the podcast, with the birth of the web, more data was collected and increased focus was being paid to the ethical side and the need to be careful with what was fast becoming the new oil. His advice when it comes to data; don’t think about a privacy compliance program. Think about a compliance program and how data protection and privacy fit in. In 2017, Edel Harris became the first woman to be named EY Scotland Entrepreneur of the Year. What arguably made that an even greater achievement was that she is CEO of a third sector organisation – the Aberdeen-based health and social care charity Cornerstone. Edel is a strong and charismatic leader, but also down-to-earth, which helps her carry people through times of significant change. She began her career as a police officer, left to start a family and then worked her way up to CEO status after returning to work at admin level and gaining a first-class honours degree through the Open University. From an Irish background but brought up in England, she has since been adopted by Scotland, is a director of the Scottish Council for Development and Industry, and is big fan of Aberdeen Football Club. Edel was interviewed in front of a live Scottish Business Network audience, at the London HQ of Bristows LLP, by Fraser Allen of White Light Media.
