Recently, I've been feeling very inspired by listening to content from creatives outside the arts and crafts industries. A couple of weeks ago I watched the Project Iceman documentary produced by Yes Theory!, and I absolutely loved it, and keep mentioning in all sorts of conversations. It's one of those pieces of content that not only resonated with me, but it truly inspired and motivated me as a creative entrepreneur... which is why I want to share about it with you, in case you need the same kind of boost. In this episode we're talking about what Anders accomplished in Project Iceman mentally, and specifically what he accomplished despite everyone telling him he would fail. It's true: entrepreneurship isn't easy. Following your dreams and passions as a creative are not easy. And it isn't any easier when it feels like you don't have a proper support system around you. However, Anders proves to me that you can prove the naysayers wrong even if you don't have people believing in you. You can build your support system slowly, but what's going to be most important is your own belief in yourself and your determination to follow through. My goal with this episode is to pass along just a smidgen of the inspiration that I felt from this documentary. To remind you to pursue your dreams, even when it's hard, even when folks tell you it's not possible. Your journey is your journey, and your journey alone. It's ok if other folks don't get it. Keep crushing it, and I'm here cheering you on!-------Need more business and design resources and support? We will be chatting about all of these questions: Why are contracts important? When should I use a contract in my business? What are the key elements of a contract? And Kiffanie even provides an audit on this episode of the contracts that she's signed with me!If you're feeling uncertain at all about contracts in your business, this episode is for you!-------Resources from Kiffanie:NextLegalStep.comTheArtistsCourtyard.comLegal Roadmap for Your Creative Business book*LLC for Your Creative Business book**Note: these links are my affiliate links through Amazon, meaning I may receive some compensation, if you purchase through the link. We also shed light on the importance of having a business framework and getting the right permits and licenses. The conversation wraps with the importance of contracts, not just as a business necessity, but as a gift to clients, ensuring a win-win for both parties. We hope this episode leaves you enlightened, empowered, and ready to tackle the business side of photography with a renewed vigor and a clear roadmap.Key Takeaways(00:00) Finding Accountants and Attorneys(08:57) Legal Considerations for Photographers(20:06) Starting a Photography BusinessShareable Quotes"Most of the lists that you see out there are all the legal projects you need to do as a photographer. They're written from an attorney's perspective to get you to pay them fees, or they're written assuming you have a large chunk of money to spend upfront, and most photographers most creatives in general are bootstrapping their businesses.""A sole proprietorship and partnership are basically the same thing. Just sole proprietorship is you're doing it alone, and partnership you're doing it with one or more partners business friends, collaborators and those you just automatically become as soon as you start offering products or services.""Contracts get a bad rap. Contracts often are seen as something we're like lording over our clients or we're only having them to make sure we get paid or that we don't get screwed over. But I want you to flip your mindset around contracts. It's a gift you're giving your clients because you're professional and they've seen the output that you've done previously and they want that same output."Connect with GUESTWebsite - https://stahlelaw.com/Linkedin - https://www.linkedin.com/in/kiffaniestahle/Medium - https://medium.com/@kiffaniestahleInstagram - https://www.instagram.com/kiffaniestahle/?hl=enYoutube - https://www.youtube.com/channel/UCT-UtdpAPFPPUVnJ9dt3jGQ
Welcome back to The Abundant Artist, the show that dispels the myth of “the starving artist” and shares how you can live an abundant life as an artist and make a living from your talent one interview at a time. Joining Cory in today's podcast is Kiffanie Stahle, the “friendly” lawyer who helps artists get the legal side of their art businesses in order. A firm believer in focusing on the “why” rather than the “what”, Kiffanie advises artists to first decide what they actually need to meet their business goals, rather than just investing big in legal matters that may not be required at all in their specific circumstances. In this episode, Kiffanie spells out the six basic rules that every professional artist must adhere to, to avoid getting caught in the legal net. She mentions some free templates available on her website that may be a good starting point for artists just beginning their art career. Kiffanie also talks about how easy it could be to gather tax and other legal information in your state – often just a phone call away. Tune in to today's episode for more legal insights, a bit about Kiffanie's minimalist life traveling the western US since 2020, and her goal to make life easier for small creative businesses. Well, legally at least. Key Takeaways: [1:12] Cory asks Kiffanie to tell the TAA audience a little about how she started her journey as a lawyer helping artists with legal dos and don'ts. [3:00] Kiffanie reminisces about how she founded the artist's J.D. as a place to provide legal tools and resources for artists, and how it has now evolved into a membership community, offering books, courses and templates. [4:38] How the year 2020 made a big life change for Kiffanie, and how her minimalist lifestyle impacted her legal thoughts. [6:39] Is getting a trademark necessary? [7:00] Kiffanie believes that there are only six things that are required of artists when it comes to the legal side of their small creative businesses. [9:49] Kiffanie explains how a simple email can also be a valid contract in the eyes of the law. [11:39] Cory asks Kiffanie how Entrepreneur Magazine has a trademark, given that a business name that merely describes what you do is not eligible for a trademark. [16:15] When do you need to do more legal stuff, if you have covered the six necessary tasks already? [17:54] Kiffanie has a free template on her website which artists can use to create a really simple, easy and readable privacy policy and terms of service. [20:04] Cory asks Kiffanie to quickly define GDPR and CCPA. [22:02] If your creative stuff is primarily targeted at children, there's a whole lot of separate laws that you will need to be cognisant of. [23:25] Cory asks Kiffanie to explain what one needs to do to comply with the various tax requirements. [24:18] Kiffanie often recommends her clients to get in touch with their respective Chambers of Commerce for understanding the tax rules and regulations applicable to them. [31:39] At what point should artists start reviewing their tax affairs on a regular basis? [33:30] Who are enrolled agents, and how are they different from CPAs? [35:35] To decide what legal tasks you must complete, you must know where your business is going. [37:29] Kiffanie has been out of social media for three years now – this is one of her experiments in life minimalism. [38:22] Cory asks Kiffanie how artists would get in touch with her if they are curious to learn more about legal matters or need legal help. [40:06] What is Kiffanie's takeaway from spending so much time working with creative people? [42:08] Cory thanks Kiffanie for a super-informative episode! Mentioned in This Episode: the artist's J.D. When is it a good (or bad) idea to have multiple projects, brands, or businesses in the same LLC? Watch this video to learn! The short answer is that you can have them under the same LLC umbrella if you are okay with them impacting each other. Because if something goes wrong in one project, brand, or business, the law sees no distinction between them. So if something goes bad in one, it’ll impact the rest. I also suggest that you use the same 13 questions that help you decide if it’s time to become an LLC, to decide if you are okay with having them all in the same LLC. We are back with Part 2 with Kiffanie Stahle. If you missed part 1, go here and listen. In Part 2, we are tackling what to do if you are copied. This is an important conversation about legalities, kindness and how to treat other artists. Be sure to connect with Kiffanie on her Facebook page for her live videos! Have you joined our Facebook group yet? We've worked hard to create an awesome space for Product Based Biz Owners who are ready to rock! We don't bite so come join us! About Kiffanie: Hi! I’m Kiffanie Stahle, but you can call me Kiff. I’m the friendly legal eagle behind the artist’s J.D. I’m also a photographer, fellow creative business owner, and lawyer living in Oakland, California. The law fascinates me. That’s the reason I went to law school, started my own law practice, and love practicing law. If you hand me a contract, I’ll go off in a corner, read it, and break down all the things wrong with it. In my free time, I’ll perform a Google search on different kinds of contracts to learn how other attorneys structure them and figure out what not to do. (Yep, I’m a nerd.) I also spend hours translating contracts from legalese to regular ol’ English to help my clients. What makes me different than most lawyers, is that what started as a fun hobby has grown to define who I am and how I interact with the world. That little hobby is photography. I started taking photographs way back when shooting film was the only option. Back then I used a Brownie camera, but now I’ve graduated to a mix of film and digital cameras. I still try to take photographs every day. But since 2011 I’ve also been helping artists and creative entrepreneurs in my law practice. Practicing law has solidified my passion for teaching the creative community about the law. And providing you resources that empower you to tackle and understand the legal aspects of your creative business. Kiffanie Stahle is making the law fun again. She is the ultra-inspiring and creative Founder of The Artist?s JD and Stahle Law where she helps creatives realize that the law isn?t a big scary Godzilla. After college she adventured to National Parks all over the Western United States, utilizing her passion for photography and travel. The Artist's JD is dishing legal advice, tools and action plans to help your creative business grow and succeed. Kiffanie is one of the COOLEST guests that I?ve ever connected with! ;) Here are the highlights of my funky conversation with Kiffanie: / / 05:08 : Her goal of breaking the mold and busting the lawyer stereotypes by empowering people and making them look at the law differently for their businesses to thrive, / 09:20 : Sharing her obsessions for pickling fruits, having a soft spot for vintage Law and Order and her background on being a wildlife biologist, / 11:45: Her adventures when she spent an entire summer touring the National Parks of the Western United States and how she quickly transitioned to being in the law school literally right after that, / 15:22 : Working for the California Lawyers for the Arts on her first year in law school, gaining exposure through that program and continuing on with her eyes fixed on her goal of opening up a law firm right after she graduated, / 20:10 : Creating The Artist?s JD platform and enjoying spreading the message, / 22:22: Being a big visualizer and a goal setter, and how visualization boards and baby steps can help you get to the goals you have set, / 28:07 : The most common problems that she helps artists on such as copy cats, contracts, LLCs and trademarks, and / 34:55: Her big plans for The Artist JD such as membership sites and incorporating community aspects around it to teach and empower the creative community about the law.
