Section 230 of the 1996 federal Communications Decency Act immunizes online platforms from civil liability based on third-party content as well as for removing such content in certain circumstances. Twenty-five years after its enactment, has this immunity gone too far in protecting the behemoth internet companies from accountability and facilitating their pervasive growth and online presence? In this episode, co-hosts Alicia Downey and Christina Ma talk to O’Melveny partner Tod Cohen, a former in-house legal and public policy counsel for a number of prominent social media and e-commerce companies, about the connection between Section 230 and antitrust concerns regarding certain Internet platforms, and why Section 230 has become such a focal point of controversy. Texas, the latest lawsuit challenging the constitutionality of the Affordable Care Act. A number of other important benefits cases will also come before the court in the coming months. In this episode, special guest host James Klein, American Benefits Council president, speaks with Meaghan VerGow, a partner and litigator with the law firm of O’Melveny and Myers and a former clerk for Supreme Court Justice David Souter and for D.C. Following a similarly stellar record in NYU’s Graduate Tax Law Program, where she was a Tax Law Review Scholar, she practiced law with O’Melveny & Myers LLP and Irell & Manella LLP. Professor Lipman joined the faculties of Chapman University’s School of Business and Economics in 2001 and the School of Law in 2003. Professor Lipman is an elected member of the American Law Institute, the American College of Tax Counsel, and the American Bar Foundation, and an editor and former committee chair for the Tax Section of the American Bar Association. She has been a visiting professor at UC Hastings College of Law and the University of Nevada, Las Vegas. In 2016, Governor Brian Sandoval appointed, and in 2020 Governor Steve Sisolak reappointed, Professor Lipman to serve as Nevada Tax Commissioner. The Nevada Tax Commission consists of eight Nevadans with various professional and business backgrounds. The Commissioners supervise the overall administration and operations of the Nevada Department of Taxation. Professor Lipman has written extensively on tax and accounting issues for legal journals, including the Wisconsin Law Review, Florida Tax Review, Virginia Tax Review, SMU Law Review, Nevada Law Journal, American University Law Review, Harvard Environmental Law Review, Harvard Latino Law Review, Harvard Journal on Legislation, The Tax Lawyer, The Practical Tax Lawyer, Taxes and Tax Notes. At Coinbase, Brian is responsible for the company’s legal, compliance, internal audit, government relations, and global intelligence groups. Brian talks about his approach in managing compliance at one of the most prominent cryptocurrency-related companies in the industry. Brian joined Coinbase in September 2018 from Fannie Mae, where he served as Executive Vice President, General Counsel and Corporate Secretary. Fannie Mae, ranked 22nd on the 2019 Fortune 500, is the largest financial institution in the United States as measured by its assets of $3.2 trillion. Brian was elected to Fannie Mae’s Board of Directors in March 2019 and currently serves on the Risk Policy & Capital Committee and the Strategic Initiatives and Technology Committee. Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Joseph Blocher, a constitutional law expert and Duke Law professor, to discuss the ins and outs of the Supreme Court’s Heller Decision 10 years after the ruling and its impact on arguably the most partisan piece of the Constitution, the Second Amendment.   As partisan lines continue to intensify, we wanted to reevaluate one of the most contentious and controversial issues facing the nation right now, gun control and the role of the Second Amendment. Specifically, we wanted to talk about one of the most impactful legal decisions on the topic a decade after the High Court’s ruling was handed down. In today’s episode, Aaron talks to Joseph about his role as a young associate working on the Heller case and his academic work in the decade since. Joseph explains the scope of the decision as well as what has followed. Aaron and Joseph discuss the Heller case specifically but also consider the general arguments surrounding the Second Amendment and the current political climate.   Joseph is a professor at Duke Law. After graduating from Yale Law School, Joseph started at O’Melveny and Myers in D.C. where he worked closely with attorney and constitutional law expert, Walter E. Dellinger. Through his practice at the firm, Joseph found an interest in the Second Amendment. His principal academic interests include federal and state constitutional law, including the First and Second Amendments, property and legal history. At Duke, his current scholarship addresses issues of gun rights and regulation, free speech, sovereignty, and refugee law. Jones, decided by the United States Supreme Court on January 23, 2012, held that a police department’s attachment of a GPS device to an unknowing suspect’s vehicle and the subsequent monitoring of that device constituted a search under the Fourth Amendment.
