Bringing humanity to the heart of conflict resolution is former commercial lawyer turned ‘Barefoot Mediator', Jane Gunn. Inspired by a chance encounter with a library book, Jane's mediation work focuses on the importance of understanding needs, self-determination and collaboration transforming adversarial mindsets and fostering productive, respectful conversations and interactions. Emphasising the application of principles, skills and mindsets vital for resolving conflicts and building better relationships at personal, organisational, and societal levels, Jane's approach is helping empower people to map their own journeys to success and joy. Her love-centred approach is completely revolutionising conflict resolution. KEY TAKEAWAY ‘We've gone through the physical revolution, the biological revolution, the agricultural revolution, the industrial and now we're in the technology revolution, which is being driven very much by AI currently. What is next? Where do we go from here? Do we want to be totally absorbed in the technology revolution or is there another level above that really, which I call the resolution revolution? Can we step into our humanity?' Hello and welcome to another episode of the Perception Podcast with me your host Caroline Partridge. In today's episode I once again have the pleasure of welcoming back expert mediator Jane Gunn, to discuss her new book, 'The Mole and the Mountain'. In this book Jane provides a map to understanding the conflict journeys that can arise anywhere and at any time in our lives. Jane also talks about what prompted her to write this book and why more than ever we need to understand how to navigate conflict. We also discuss the narratives and challenges that hold us back from self determination and authenticity. Please join me as we look at life through a different lens. KEY TAKEAWAYS Jane's book visually maps the process of resolving conflict through four symbolic stages represented on a compass: the storm, the murky swamp of reality, the bridge of courage and crossroads, and the mountaintop of experience. People often resist the 'murky swamp of reality' phase of seeking clarity because it requires exploring difficult emotions like underlying fears. We increasingly want others to solve problems for us and have lost the ability to think critically, gather alternate viewpoints, and navigate challenges independently. Normalised societal rules often promote safety over opportunities for creativity, play, risk-taking, and authentic self-growth. Families and social groups frequently challenge our independence and growth out of care but end up holding us back from our journeys. Polarized viewpoints and cancel culture shut down opportunities for nuanced perspectives; we need "big conversations" to understand each other. Staying grounded in our own thinking and being our authentic selves is the unshakeable gift no one can take from us. BEST MOMENTS "When you end up in a murky swamp, your temptation is to sort of keep thrashing around to try and get out of it. And it just makes the water muddier and less clear." "How we express what we want is very different. And of course, all the conditioning we've received along the way plays into the mix." "Have we lost some elements of childhood and adulthood and growing up about playing and being creative and exploring?" "Nobody controls us, we are the creators of our own destiny." "If you can stay grounded in your thinking and behaviour towards others, that's the key." Hello and welcome to another episode of the Perception Podcast with me, your host, Caroline Partridge. In today's episode, I have the absolute pleasure of talking to the Barefoot Mediator herself Jane Gunn. Jane who is an expert in the field of conflict resolution, and has spoken at the United Nations, and The White House, demystifies and distils down for us the real essence of what mediation actually means. We look at the narratives that drive us into conflict and discuss the alarming disappearance of balanced debate and conversation. Please join me as we look at life through a different lens. KEY TAKEAWAYS Mediators create a better interaction between two people, who've got some kind of conflict between them, enabling them to solve their problem. If you can listen to someone else's story, and acknowledge it, you're not saying it is right. You're saying, I hear your story. I understand where it comes from. The principles of conflict resolution are the same in all scenarios. Most people do not set out to hurt you. Be open to having conversations with those who do not agree with you, but don't fall out with them. The way we live today isolates us from others, so we are losing our conversational skills. BEST MOMENTS‘Mediation is actually a conversation. ´‘Was your intention to hurt me, harm me? It's usually not the case at all.'‘There's nothing more interesting than having a challenging conversation with someone. ´ ABOUT THE GUESTJane Gunn is an expert in the field of conflict resolution, a trained mediator and facilitator, known to her clients as 'The Barefoot Mediator'. How we perceive the world is rooted in everything that has influenced us throughout our lives, emotionally and psychologically. We become the sum of our parts and each of us has our own unique view of the world. 'Vision' truly is an act of interpretation. In this podcast series through fascinating conversations, I set about trying to understand how we form our perceptions, view different perspectives, and examine how perception has influenced, inspired, or hindered the lives of each of my unique guests.
2023 marks the tenth occasion in which CEDR has released its biennial audit of the United Kingdom Commercial Mediation marketplace. For 20 years it has tracked the development of commercial mediation in the UK as well as identifying key trends, challenges and possible solutions to issues. Its importance stretches far beyond the UK and is used internationally as both a source of inspiration and a north star for the development of mediation. Authored by Graham Massie, it is run each year in partnership with the Civil Mediation Council and this iteration is based on the responses of 328 commercial mediators. This podcast summarises the key findings you need to know about Commercial Mediation in the United Kingdom.
In this episode, we focus on mediation. Brick Court Chambers is home to many of the UK's – indeed the world's – most highly-regarded mediators. As mediation has taken on a more prominent role in commercial litigation, so Brick Court's mediation practice has grown alongside it. For this podcast, we brought together four of the busiest and best known – Sue Prevezer QC, Stephen Ruttle QC, Tony Willis and Bill Wood QC – to chat about the past, present and future of mediation. Their discussion ranged widely, as one would expect, and covered topics such as working as a mediator within a barristers chambers, the relationship of the bar with mediation and the role that mediation could and should play in resolving disputes. Bill Wood QC Bill Wood chairs the programme. A leading commercial QC, Bill trained as a mediator in 1999. He was awarded Mediator of the Year 2018 and is ranked #1 Mediation Silk 2019 in WWL's UK Bar Guide. He is consistently ranked in the top tiers by Legal 500 and Chambers and Partners. Stephen Ruttle QC Stephen has been in practice at Brick Court Chambers since 1978. He stopped practising as a barrister and QC in 2002 and since then has worked full time as a commercial mediator. For many years he has been rated as one of the leading mediators in the UK. Stephen is also the founder director and chair of Wandsworth Mediation Service. Tony Willis Tony is a commercial mediation pioneer, among the first to be trained in 1990, among the first to mediate regularly and then, in 1998, among the first to launch his own independent practice as a full time commercial mediator as the Woolf Reforms to Civil Justice were about to take effect. His background as a litigation partner in Clifford Chance for more than 25 years gave him the experience and standing to undertake a wide range of commercial matters. Tony joined Chambers as a full-time mediator in 2004. Sue Prevezer QC After 25 years in practice, including 8 years in silk, Sue was the co-managing partner of Quinn Emanuel in London from its inception in 2008 to January 2020 Sue decided to come back to the Bar, joining Brick Court in April 2020 to practise as an arbitrator, mediator and consultant. Sue is an accredited CEDR mediator, a Civil Mediation Council registered mediator, a mediator on the for the Court of Arbitration for Art Panel and a member of the London Chamber of Arbitration and Mediation panel of mediators. Following the publication of the Civil Justice Council's report on Mandatory Mediation, Lauren McGuirl (Director of Commercial Disputes, CEDR) and Tony Allen (CEDR Mediator & Lawyer) look at the Civil Mediation Council's (CMC) response as well as the wider issue of Mandatory Mediation. The podcast explores: A summary of the report and the response from the CMC The wider issue of Mandatory Mediation The key issues surrounding Mandatory Mediation How will Mandatory Mediation be deployed in specific sectors

Questions addressed by the speakers in this podcast include "Is a profession really a profession unless it is regulated?", "Will regulation increase confidence in mediation?", "Will regulation increase the use of mediation?", "Is the demand for regulation more about marketing for the mediators and less about what users actually need?" and more... For the motion: Alan Langleben, mediator Against the motion: Amanda Bucklow, mediator Chair: Paul Randolph, CMC Academic Committee NB: The views expressed in the debate are those of the speakers and not the views of the CMC Board.
