Welcome back to the Connected Leadership Podcast! We kick off 2025 with a returning guest, commercial mediator Jane Gunn, who joins Andy Lopata to discuss her new book, "The Mole and the Mountain." This parable explores the journey of overcoming obstacles and finding personal fulfillment, offering valuable insights for goal setting and personal growth in the New Year. Jane explains the two key principles of mediation that underpin the book: self-determination and being fully informed. She introduces the "Map of Experience" that guides the mole's journey and represents the stages of mediation. The first stage, "Now," involves understanding the narrative and identifying the challenges we face. This is about stepping out of our comfort zones and embracing curiosity. Andy and Jane then discuss the importance of mentorship in pushing ourselves out of our comfort zones and overcoming fear. Jane emphasises the role of a mentor who provides challenge without taking control. Next, they explore the fear of being wrong, a common obstacle in both mediation and personal life. Jane talks about shifting from a "win-lose" mindset to a "win-win" approach, emphasising the importance of understanding people's needs and interests rather than focusing on who is right or wrong. The focus turns to the importance of clarity in creating a vision for the future, the need to dig deep and understand what truly drives us. Andy and Jane also discuss the concept of "no one is coming to save us," the importance of self-determination and taking responsibility for our own decisions. Jane argues that mediation is a "grown-up" way of resolving disputes, allowing individuals to find creative solutions by taking control. Staying on track despite obstacles and setbacks, they share their personal experiences of perseverance and the importance of vision and a clear "why" to motivate them during difficult times. The episode concludes with a discussion on the importance of celebrating successes and recognising that failure can often be a stepping stone to greater success. What we discussed · How to deal with change that snatches us out of our comfort zone · How to overcome the fear that stops us following our dreams · How to create a clear vision of the future and belief that we can make it · How no one is coming to save us and we must dig deep when we are stuck · How to stay on track and never give up despite the obstacles and setbacks · How hardship and pain is part of the journey and path to triumph · How in the end it is up to us to decide and no one can take the journey for us Connect with Andy Lopata: Website | Instagram | LinkedIn | X/Twitter | YouTube Connect with Jane Gunn: Website |LinkedIn |X/Twitter The Financial Times Guide to Mentoring The Mole and the Mountain
Welcome to Monday Night Live! On this week's episode of Monday Night Live, hosted by Derek Arden, the guest was international mediator, lawyer, and author, Jane Gunn. Known for her innovative approach to mediation, Jane has handled everything from personal disputes to high-profile commercial cases. In this episode, Derek engages Jane in an insightful discussion about the art and science of mediation, the hidden costs of conflict, and her strategies for creating a calm and fair environment, even in the most heated disputes. The Role of Chocolate in Mediation Derek starts the conversation with a light-hearted but intriguing question: “Why do you always bring sweets and chocolates to a mediation?” Jane explains that something as simple as offering a snack can break tension, energize the participants, and even help people think more clearly. She mentions that during a long and emotionally charged mediation, people tend to skip meals or neglect their basic needs, which can exacerbate stress. By offering small comforts like chocolate, she subtly encourages breaks that help people step back, recharge, and re-enter the discussion with a clearer mindset. Managing David and Goliath Situations A key theme of the discussion was the challenge of mediating imbalanced power dynamics, or "David and Goliath" situations. One audience question asked, “How can a mediator ensure a fair outcome when one party holds more power?” Jane stressed the importance of balancing the scales by giving both parties the space to be heard, challenging their perceptions, and fostering an environment where they can interact as human beings rather than adversaries. Mediation, she emphasized, is about helping people step off the "conveyor belt" of conflict escalation. Instead of heading straight for court, Jane helps them explore different perspectives, think about their relationships, health, and the real costs—emotional, financial, and personal—that conflict brings into their lives. The Cost of Litigation Jane's experience has shown her that people often underestimate the impact litigation can have on their health and well-being. Many clients enter a legal battle convinced they are right, focusing only on winning. But they fail to account for the strain prolonged litigation can place on their mental and physical health, relationships, and overall quality of life. One of the most eye-opening moments in her career came during a commercial property dispute where one of the participants had an epiphany: if he spent the next two years litigating, he would lose precious time with his chronically ill wife. This realization shifted his priorities from winning a legal battle to preserving his personal life. Dealing with Uncertainty and Fear Jane touched on the increasing uncertainty people feel today, from financial concerns to global instability, and how these external anxieties fuel personal conflicts. People's fears about the future can spill over into how they interact with others, making conflicts harder to resolve. In mediations, Jane helps participants acknowledge these underlying emotions and address them so they can focus on resolving their differences. Mediation Techniques and The Power of Listening Derek and Jane explored the importance of listening—not just to each other but also to oneself. In her mediations, Jane encourages people to deeply reflect on what really matters to them. This kind of introspection helps to break away from the surface-level demands and focus on deeper needs, beliefs, and goals. She also uses tools like flip charts to visually display the cost of conflict, encouraging clients to see the broader impact of their decisions and the ripple effects on their lives. Jane's mediation approach is rooted in “principled negotiation,” a method from the Harvard Negotiation Project. This process moves beyond positional bargaining—where each side is fixed on their demands—and digs deeper into underlying needs a...

Hello and welcome to another episode of the Perception Podcast with me your host Caroline Partridge. In today's episode I once again have the pleasure of welcoming back expert mediator Jane Gunn, to discuss her new book, 'The Mole and the Mountain'. In this book Jane provides a map to understanding the conflict journeys that can arise anywhere and at any time in our lives. Jane also talks about what prompted her to write this book and why more than ever we need to understand how to navigate conflict. We also discuss the narratives and challenges that hold us back from self determination and authenticity. Please join me as we look at life through a different lens. KEY TAKEAWAYS Jane's book visually maps the process of resolving conflict through four symbolic stages represented on a compass: the storm, the murky swamp of reality, the bridge of courage and crossroads, and the mountaintop of experience. People often resist the 'murky swamp of reality' phase of seeking clarity because it requires exploring difficult emotions like underlying fears. We increasingly want others to solve problems for us and have lost the ability to think critically, gather alternate viewpoints, and navigate challenges independently. Normalised societal rules often promote safety over opportunities for creativity, play, risk-taking, and authentic self-growth. Families and social groups frequently challenge our independence and growth out of care but end up holding us back from our journeys. Polarized viewpoints and cancel culture shut down opportunities for nuanced perspectives; we need "big conversations" to understand each other. Staying grounded in our own thinking and being our authentic selves is the unshakeable gift no one can take from us. BEST MOMENTS "When you end up in a murky swamp, your temptation is to sort of keep thrashing around to try and get out of it. And it just makes the water muddier and less clear." "How we express what we want is very different. And of course, all the conditioning we've received along the way plays into the mix." "Have we lost some elements of childhood and adulthood and growing up about playing and being creative and exploring?" "Nobody controls us, we are the creators of our own destiny." "If you can stay grounded in your thinking and behaviour towards others, that's the key." Life changing is achieved by a map to happiness. Jane Gunn points to a compass of North, East South and East and West with a link to personal and professional values. N in North, what we're trying to do is to say, what's going on Now? What is the immediate challenge? Essential, even if you're starting up a collaboration. E in East stands for "Explore". Where am I with this? What am I thinking? What am I feeling? What are my own hopes and dreams? You know, we need to really understand ourselves better, and then understand each other better. S in South, stands for "Solutions". Decide on what criteria do we make that decision? What criteria could we apply to this? Also, what values do we have? What personal values do we have? What group values do we have? How do we apply those to this thinking process? We think deeply, we question everything, we question ourselves as to see what the right way through challenging times is. W in West stands for "Walking Forward". It's a commitment, it's an ability to leave any bad feelings from the past behind, so to draw a line in the sand. It also stands for wisdom. It's reaching that higher level of wisdom and possibly learning from yourself and from the past. What have I learned? What do I take forward with me?
In this Monday Night Live interview, Derek Arden interviews Jane Gunn, a mediator, discussing various aspects of mediation and its evolution in the age of COVID-19. Jane's impressive qualifications include FCI, FRSA, FPSA, CMC, IMI, and recognition in the Who's Who Hall of Fame. Online Mediation: Jane and Derek delve into the world of mediation, highlighting its close connection to negotiation. Jane's insights reveal that mediation has seen significant changes since the onset of the pandemic, particularly in its transition to online platforms like Zoom. While online mediation lacks the nuances of body language and carries the risk of participants easily leaving the virtual meeting, it offers unique advantages such as convenience and flexibility in scheduling. One notable shift Jane mentions is that parties who were initially reluctant to meet face-to-face have increasingly embraced online mediation. This adaptation often eliminates the need for lengthy travel and accommodation expenses, making it more accessible for parties who prefer not to meet in person. "Pre-mediation" Deals: Another change in mediation dynamics discussed is the potential for "pre-mediation" deals or requests for offers and documents before formally entering the mediation process. Jane clarifies that mediation relies on a confidentiality agreement, ensuring that discussions and offers made during the mediation process won't impact participants' legal cases later on. Attempting to negotiate or exchange documents beforehand often disrupts the essential confidentiality that mediation relies on. Derek's questions also touch on the preparation involved before a mediation session. Jane emphasizes the importance of thoroughly reviewing legal documents, position statements, and other pertinent materials, which can take several hours. She discusses the shift to reading documents on screens and highlights the challenges of not being able to mark up physical copies. Presence Of Legal Teams: The conversation explores the presence of legal teams, including solicitors and barristers, in mediation sessions, which can significantly increase costs. Jane explains the difficulty of private discussions with parties due to the need for consent and confidentiality. Jane also shares her approach to setting ground rules during mediation, emphasizing values such as listening, learning, love, and laughter. These principles aim to create a psychologically safe space for participants, allowing for effective communication and problem-solving. The interview touches on the unpredictability of legal outcomes and how mediation focuses on helping parties make informed decisions based on their individual circumstances and the potential consequences of protracted litigation. For Future Monday Night Live Interviews Towards the end, the discussion briefly touches on the impact of social media on mediation. Jane underscores the importance of respectful disagreement and open dialogue in an increasingly polarized world. Hello and welcome to another episode of the Perception Podcast with me, your host, Caroline Partridge. In today's episode, I have the absolute pleasure of talking to the Barefoot Mediator herself Jane Gunn. Jane who is an expert in the field of conflict resolution, and has spoken at the United Nations, and The White House, demystifies and distils down for us the real essence of what mediation actually means. We look at the narratives that drive us into conflict and discuss the alarming disappearance of balanced debate and conversation. Please join me as we look at life through a different lens. KEY TAKEAWAYS Mediators create a better interaction between two people, who've got some kind of conflict between them, enabling them to solve their problem. If you can listen to someone else's story, and acknowledge it, you're not saying it is right. You're saying, I hear your story. I understand where it comes from. The principles of conflict resolution are the same in all scenarios. Most people do not set out to hurt you. Be open to having conversations with those who do not agree with you, but don't fall out with them. The way we live today isolates us from others, so we are losing our conversational skills. BEST MOMENTS‘Mediation is actually a conversation. ´‘Was your intention to hurt me, harm me? It's usually not the case at all.'‘There's nothing more interesting than having a challenging conversation with someone. ´ ABOUT THE GUESTJane Gunn is an expert in the field of conflict resolution, a trained mediator and facilitator, known to her clients as 'The Barefoot Mediator'. So many people find themselves avoiding the issue, keeping quiet so they avoid confrontation. It is a flawed approach which often leads to unhappiness, frustration and conflict. In today's show we highlight the significant difference between confronting the issue and being confrontational.
In his second interview with Jane Gunn, the Barefoot Mediator, Andy Lopata asks Jane about the professional relationships that have had the most impact on her career. Jane gives him one example where she received the support and trust she needed from her senior partner despite the challenge of being a junior and a women in a male dominated environment. When relationships become challenging, taking a step back to think about it calmly is usually the best strategy. Jane recommends two books that have influenced her thinking.
In this edition of the Connected Leadership Podcast, Andy Lopata discusses managing conflict in professional relationships with Jane Gunn, The Barefoot Mediator and former lawyer. If professional relationships underline executive success, what happens when conflict arises and threatens to breakdown relationships or collaboration? Jane explains how conflict is a process by which we express our disatisfaction with a person or a situation. A bad conversation or assumptions can escalate and cause resentment and misunderstanding. Strategies to overcome these problems include a clear mindset, a constructive response and mediation. Also important is a framework within organisations for managing conflict in these situations.

This week Rachel is thrilled to welcome back Jane Gunn – lawyer, mediator and expert in conflict resolution who has been known as the Corporate Peacemaker. This episode is for you if the thought of addressing a difficult issue with one of your colleagues send you running for the hills…When the Coronavirus crisis first hit, we collectively started to behave a bit better – give each other a break and make allowances but as time has gone on, our old ways of behaving coupled with anxiety, uncertainty and stress may well have made old issues raise their ugly head (a bit like Christmas with the relatives which has gone on a bit too long!). In this episode, Rachel and Jane talk about why this has started to happen and discuss what can happen if conflict is left to fester. Often conflict which hasn’t been addressed escalates quickly and Jane shares the ladder of escalation steps which help to explain what’s going on. We talk about how you get off this ladder with simple techniques for having important conversations, the importance of listening and of really trying to dig down into the real issue. We chat about the importance of having an easy to follow process in an organisation that doesn’t rely on grievances but instead empowers people to have these conversations early and how modelling vulnerability as a leader can make this possible. Jane’s top tips for managing conflict are:Take the time to write down what you want to say and what you really want before you have the conversationListen to and be honest with yourself and othersTry to de-escalate as much as possible (make a molehill out of a mountain!)We are sending out a weekly email with new resources, tips and useful content especially for doctors and healthcare professionals throughout the COVID-19 crisis. In this episode, Rachel is joined by Jane Gunn, a ex-lawyer, mediator, trainer and expert in resolving conflict in the workplace. Jane is known as the ‘Corporate Peacemaker’ and works with GPs, doctors and professionals in other organisations and partnerships. We talk about why we delay or deny conflict and the problems that we can cause when we sweep stuff under the carpet for fear of addressing issues. We discuss how it’s useful to have a ‘conflict resolution’ strategy hard baked into the organisation or the partnership agreement so that things are addressed quickly without having to go through HR, so that there is an obvious process that can be followed. Often conflict escalates because we don’t take the time to listen to the other person and really understand where they are coming from. Jane talks about a simple process to help us bring up an issue – say how you feel, explain the potential impact …then shut up and listen! When we truly understand where the other person is coming from, often the solution becomes obvious and we can move forwards. Knowing what the conflict is really about and what need the outcome to be is also helpful.Podcast linksGood to Great by Jim CollinsGetting to Yes by Fisher and UryThe 5 Dysfunctions of a team: A leadership Fable by Patrick LencioniHere is the link to Jane’s website www.janegunn.co.uk and mini video series www.janegunn.co.uk/solved-by-midnight/ Sign up for downloadable CPD reflection forms plus more tools and resourcesTo let me know the 2 things that keep you awake at night please click here Find out more about the Beat Stress and Thrive online course and communityFor more episodes of You are not a frog, check out our website www.shapesfordoctors.com/podcasts/ and sign up to our mailing list here for loads of useful resources about thriving at work. It has been said that no one ever achieved anything of great significance on their own. To achieve great success today you must collaborate with other people. As a mediator and international speaker in high demand, Jane Gunn says: ‘You need to create strong collaborative relationships with everyone who helps you to develop and keep your business on track. Also, you must seek out new opportunities to collaborate to take your business to the next level'. While collaborating though (and I write from experience), it is so easy for things to go wrong and quickly become emotionally draining and financially expensive. We should also remember that collaboration is essential for successful personal relationships. This is why Jane's book has the title 'Bedlam in the Boardroom and Boredom in the Bedroom'. On this show, we will discuss with a leading expert how to avoid the pitfalls and ensure collaborations add value, keep you ahead of the game, feeling energized and with money in your pocket!
