New communications technology has changed the way many divorce cases are tried these days. Prior to the internet with its chat rooms and pornography, social media websites, such as Facebook, and cell phones with text messaging, proving a partner's infidelity or financial indiscretions was a difficult task. Today, it's quite common during a divorce to subpoena the contents of a spouse's computer, cell phone records and text messages. You've probably heard of politicians and celebrities being brought down, in part, by what was discovered in their email, text messages or internet browsing history. In today's program, family law attorney, Henry Gornbein, and I discuss the fall-out of today's technology and address how the discovery of this information can affect a marriage and, ultimately, a divorce. We'll take a look at this from a legal perspective pertaining to your right to privacy, and we'll provide strong advice regarding the use of this new communications medium during a divorce. In this episode of Divorce Source Radio with Steve Peck, Attorney Henry Gornbein and Therapist Susan Pease Gadoua discuss the legal and emotional side of divorce. When people enter into divorce, it seems it's all about the legal aspect. We soon realize that divorce is an extremely emotional time in our lives. If one or both of the parties have a controlling mindset, the situation can become more hostile, potentially leading to a lengthy, destructive, and unnecessarily expensive divorce process. Tempers flare, heels dig in, and none of it leads to satisfaction in the end. Susan shares tips on how to navigate your divorce in a more peaceful manner and shows the value of therapy. Henry provides advice on dealing with an attorney who is trying to stir the pot between you and your ex. Susan reminds us of Maslow's Hierarchy of Needs, which suggests that people are motivated to fulfill basic needs before moving on to other, more advanced, needs. If you're worried about your survival, it's hard to get to a place of love. If safety and esteem are an issue, you can't get to self-actualization. This is a "must hear" for any of our listeners new to the process of divorce. As a specialist in family law for over 40 years, Henry Gornbein strongly believes that a divorce should be the last resort, not the first resort, and that too many people file for divorce, often for the wrong reasons. The Parental Divorce Reduction Act's purpose is to reduce unnecessary divorce, decrease parental conflict and litigation surrounding a divorce, and educate parents regarding the impact of divorce on families. As a practitioner with extensive experience over many years specializing in family law, Henry has concerns, because many marriages have an imbalance of power between the parties. Often, one spouse is very controlling, and the other spouse feels powerless While Henry believes there is a lot that is good in the proposed legislation to reform marriage and save as many marriages as possible he discusses his concerns and reservations in this episode.
