The idea behind the RICO Act is to take on whole organizations rather than targeting individual members. In order to gain a RICO conviction, prosecutors have to prove a defendant has performed two or more underlying crimes — such as murder, kidnapping, drug trafficking and wire fraud — as a part of a criminal enterprise. Unlike a simple conspiracy, where two or more people get together to commit a crime, the “criminal enterprise” must be an organization that exists independently from the folks committing the crime. For instance, if Jack, Joe and Mary get together and sell dope out of their trailer, that's a conspiracy. If Jack, Joe and Mary join the Pagans Motorcycle Club and sell dope on behalf of the organization, that could be a RICO Act violation. That's because the Pagans would be an organization that stands on its own. In addition to doing it as a part of an organization, prosecutors have to prove that a defendant had some decision-making power in the venture. Going back to our dope dealers, if a federal prosecutor can prove they were setting street-level prices, that shows they had some say in how the organization was run. One of the biggest factors in a RICO violation is if the crimes affect interstate commerce. With the dope dealer's example, moving a little bit of meth might not meet that standard. “Allow yourself to understand that your emotions are completely valid and sometimes you do need help for understanding and adapting to these emotions.” Jack Thomas is a survivor. Quite literally. About five years ago, when Jack was seventeen years old, he was involved in a serious workplace accident that nearly cost him his life and in the end, it did cost him an arm. As a result, Jack thought for a moment that he would never play drums, bass, or guitar again.  It has not been an easy transition as you can imagine. Re-learning how to play instruments with the use of only one arm has been both rewarding but also frustrating too for Jack. But with mental strength and support from his friends and family Jack has managed to achieve something most people would consider an impossibility. Jack’s story is remarkable, tragic, and not one without a struggle.  He had recently been featured on Drumeo and amongst other content, Jack performed “Duality” by Slipknot. The video has surpassed 1,000,000 views with an incredible degree of positive feedback. It has resulted in capturing the interest of several media outlets and exposure to a large audience. He has also earned a position at Drumeo, which he had started about a month ago (at the time of the interview). Overall, Jack has worked hard to get to where he is today and did so under very difficult circumstances. We can all learn something from Jack.   You Will Hear About…. This podcast is dedicated to John Bogle   Michael and Andrew would like to dedicate this podcast episode to the icon who passed away just before this recording was made, John Bogle, founder of the Vanguard Group, and author of such classics on investing as The Little Book of Common Sense Investing was a real Vanguard and revolutionary. Bogle started the world’s first index fund so they tip their hats in tribute.     Guest profile     Michael Falk is a CFA charter holder and a certified retirement counselor. He is a partner at the Focus Consulting Group and specializes in helping investment teams improve their investment decision making, investment firms with their strategic planning, and mediating firms’ successions. Previously, he was a chief strategist at a global macro fund and a chief investment officer in charge of manager due diligence and asset allocation for a multibillion-dollar advisory practice. Michael is an author, co-author and frequent speaker. in 2016.  He wrote the CFA Institute Research Foundation monograph Let’s All Learn How to Fish…to Sustain Long-Term Economic Growth. He is on the CFA Institute’s approved speaker list. In the past, he has taught on behalf of the CFA Society Chicago in their Investment Foundation Certificate program. He has been a contributing member of the Financial Management Association’s practitioners’ demand-driven academic research initiative group and taught at DePaul University in their Certified Financial Planner Certificate Program. He’s frequently quoted in the financial press and presents in industry events.    Moneyball man  Michael was an athlete who played competitive baseball until he was 31 years old. But in his early 20’s, he realized that he couldn’t make a career of this, so he decided to get an education, and graduated from the University of Illinois with a B.S. in Finance, adding to his interest in growing wealth. It caught his attention, but it wasn’t about getting large amounts. It was about how money drove behavior. But still, he played ball and was working on the side until his body’s aches and pains started to surface.      Summary  In this episode, Michael recounts his experiences as a private wealth manager advising a client on what to do about holdings in two big companies. The story revolves around what is seemingly his not-so-lucky share-price level, US$8/share. He shares his take on the fortunes of these huge companies and the reasons why he didn’t take the risk of investing in them, even though he was an educated investor and had advised his client to hang on to the stocks. Andrew will tell add why execution is a vital part of building an investment plan through his six-step process. Inherent in that is how crucial it is to avoid taking huge positions aggressively so you don’t end up in the same sad state as do most investors.      “Lose profitably. Use your takeaways and your learnings from those losses to not repeat the same mistakes. They say there’s no such thing as failure if you’re learning. So, my parting comment is, if you’ve got to lose, at least lose profitably.”  – Michael Falk     W$8/share investments and the odd stories behind them  Apple Inc. (AAPL:US) is now trading at US$199.23/share  Apple was starting to drop, before Steve Jobs returned and saved the company. It was trading at around $8/share. Michael was a fan of Apple computers and so his friend who was curious about the drastic consequences if the company should fall. He was confident that it wouldn’t. Buying the stock was an absolute steal, given these two probable scenarios: 1) The company would rebound, or 2) Microsoft would buy them because of the value of the technology. Surprisingly, he didn’t follow the instructions that he gave to his friend. He didn’t follow the instruction he gave to his friend.     Philip Morris  Philip Morris International Inc. (PM:US, $86.19); Altria Group Inc. (MO:US, $56.94)  Michael started his career in private wealth management. He had a client named Jack, who inherited a stock portfolio from his father. As he was doing an audit on the low-cost basis portfolio, they were unable to decide whether or not to hedge out the risks. One of the companies they were looking at was Philip Morris, which was also trading at $8/share too. Philip Morris had started to take a BD (broker-dealer) at that time because that was when the US government was going after the tobacco companies in terms of the healthcare lawsuits.    Michael’s analysis:  1.The dividend payment at that time was 8%, and he believed it wouldn’t stopped. (D/P ratio or Dividend Payout Ratio = Dividends Paid/Net Income)   2.He dug into legal research and started to read the case history on the lawsuits against Philip Morris. He realized that the government wouldn’t put them out of business since it needed the company to survive so it would have money to settle the lawsuits that had been filed against them.  3.Jack thought of selling his shares but Michael, told him flat out: “If you sell Philip Morris, I’m going to slap you.” Backed by his research, his solid strong reasons were the following:  a.The 8% dividend growth was scarce.  b.The government couldn’t put them out of business.  c.If Jack sold his shares, his tax bill would be quite high.   d.You have every incentive to hold on to this stock.   Michael personally avoided buying Philip Morris’ stocks for the reason that it was trading at $8/share.    “It wasn’t about losing money. It was about not making money.”  –  Michael Falk    Michael’s takeaways     He admitted having had the following downfalls in investing. Most often:     He doesn’t take a lot of risk.  He has eluded buying individual insecurities to avoid conflicts of interest due to the nature of his work in private wealth counseling or institutional advisory services.   He held on to either active or passively managed mutual funds so I have very few stories other than the fact that I take very little risk, consistently.    Michael called himself out for his unwillingness to take risks, and it did hurt his self-esteem. He is a professional, an educated investor who knows so much and yet he made such mistakes.     “We have to come to recognize that what I took away from it is for better or for worse, most often remain invested, depending upon what the purpose of the money is and what your goal is and where your goal is out in timescale.   Stay the path and … research.”    –   Michael Falk    Lessons from Hendrik Bessembinder.  Michael credits this professor who published his research in January 2017 to answer the question “Do Stocks Outperform Treasury Bills?“  Quoting from this paper’s findings, Michael says:    “… 58% of stocks fail to beat treasury bill returns over their lifetimes; 38% of stocks beat treasury bill returns by just moderate amounts. If you look at the total return of the market index over time, trouncing treasury bills for just over 4% of stocks are responsible for all of it …”    The research made Michael ask himself whether he should pick stocks at all, citing it as the same theme that the lottery companies use to pull people in. “You got to be in it to win it.”     “If you’ve got an appropriate time to be invested, get invested, be widely diversified and stay the course.”  –  Michael Falk      Andrew’s Takeaways  A key part of building an investment plan is executing it. – Andrew outlines his six-step process in investing he came up from his works and previous interviews:  Step 1: Find an idea.  Step 2: Research the return.  Step 3: Assess the risks.  Step 4: Create a plan.  Step 5: Execute the plan.  Step 6: Monitor the progress  He emphasizes that Step 6 may not always be the last step. You might want to keep holding, so monitor the progress.  But the point is, “You’ve got to act.”  Michael adds Step 7.     Step 7: Find an educated and skilled person to be the devil’s advocate, the raging skeptic, and take all of your research and findings to them and ask them to tear it apart and poke holes in it.     Andrew adds that he has done just that it creates constructive ideas during meetings and raises the quality of a decision.    “When I work with investment teams … I teach people how to properly do devil’s advocacy, how the role gets assigned, how it rotates among team members, and how the action is supposed to be taken in a decision-making meeting. You can actually create constructs around this topic, to materially raise the quality of a decision, so your input is great stuff.”  – Andrew Stotz    2. Take a small position. – The mistake most people make is that they think of a huge position immediately and it overwhelms them.    “Keep in mind that if it really is going to be a Juggernaut, that small position is going to become a huge position. It’s just a matter of time. You got a 4% chance of that according to the research.”  –  Andrew Stotz    To avoid the same fate   Make your investments simple instead of dreaming about buying the next Amazon, Google or Apple, TenCent or Alibaba.       Number 1 goal to achieve in the next 12 months   A follow-up book is all set to be released by the end of 2019 based on the CFA Institute Research Foundation monograph Let’s All Learn How to Fish, which Michael published in 2016. The three initial chapters in the forthcoming book are: 1) Work, 2) Artificial Intelligence and Robots, and 3) Universal Basic Income.    The first book is downloadable in Amazon Kindle for free. It was about rethinking entitlement policies to generate sustainable economic growth. The book focused on 1) Retirement, 2) Health Care, and 3) Education, and these were the three main policy chapters as well.  Michael has lectured on this book in 14 countries.     Parting tips from Michael    Take valuable lessons from monetary losses. You might lose money from your decisions. Jack Fischl and Kyle Wiggins studied across the Charles River from each other in Boston, but they didn’t meet until they both became Peace Corps volunteers in Panama. Even then, they were placed in two communities that were a 14-hour bus ride apart. So how did they build a successful Latin American travel marketplace together? It started with a simple Wordpress site they created over several visits to their local internet cafes. After realizing their communities had no way of marketing the unique tours they were offering, and that local tour guides were being ripped off by large corporations, Jack and Kyle came up with Keteka. In this episode, Jack and Kyle explain what they learned from going through Start-Up Chile and the Booking.com Accelerator program, raising a funding round through Latin American angel investors on FounderList, and receiving investment from more traditional VCs like my firm Magma Partners. But it all started with the lessons they learned in the Peace Corps. Tapping into Panama’s tourism dollars: a “dignified economic opportunity” If Jack and Kyle’s communities from the Peace Corps had anything in common, it was that both looked to tourism as a potential economic opportunity for their area. However, traditional tourism would not come easily in a place with no electricity or running water, let alone WiFi and payments systems. Kyle and Jack realized there was a need to bridge the gap between these rural communities, their skilled local tour guides, and a tourism market that operates through online transactions. From this epiphany came Keteka, originally a Wordpress website built in an internet cafe in Panama. When a friend emailed Jack the link to apply for Start-Up Chile, he almost didn’t believe the opportunity existed. This post should help you understand the difference between a testamentary trust and an inter vivos trust. All trusts are either testamentary or inter vivos. Inter vivos trusts are also called "Living Trusts." The best way to describe the difference is to put them in context of a real-life situation. Let's say Jack is engaged in his estate planning. He is married to Jill and he has two children. He wants to leave his estate in a way so that Jill is taken care of, but after Jill dies, he wants his estate to go to his two children. Jack goes to an attorney and the attorney prepares a Will with Testamentary Trust. The terms of the trust are a part of Jack's last will and testament. Jack's will says that when Jack dies, Jack's estate will go to the "Jack Testamentary Trust." After Jack dies, Jill and Jack's kids assume that no probate is necessary because "Jack had a trust." However, their assumption is incorrect. There will always be a probate (or in Louisiana called a "Succession") when someone leaves their assets or estate to a testamentary trust. When Jack dies with a testamentary trust, his assets that are in his name when he dies will be frozen, and the courts must oversee the management and ultimate transfer of the assets to the trust. Now, instead, let's say that, instead of Jack creating a testamentary trust, he creates the stand-alone "Jack Inter Vivos Trust" or the "Jack Living Trust," If Jack transfers his asset to the Jack Living Trust during his lifetime, no Succession or Probate will be necessary when Jack dies because the assets will already be in the trust and there will be no assets in Jack's name that would be frozen and subject to the court-supervised transfer process.
