In February of this year, the Supreme Court heard arguments in Ohio v. EPA. This case challenges the Environmental Protection Agency's ability to enforce the Good Neighbor Plan which aims to curb pollution carried by the wind into neighboring states. As usual, legal proceedings can easily become confusing as a lawsuit makes its way to the Supreme Court. Fortunately, we are welcoming back Steve Bradbury, a distinguished fellow at the Heritage Foundation, to help us unravel this case as we discuss the background and ramifications of this lawsuit.

Chris Murray's guest is Steve Bradbury. He served in the Trump Administration as the Senate-confirmed General Counsel of the U.S. Department of Transportation (DOT) from November 2017 until January 2021. As the Department's chief legal officer, he oversaw all of DOT's rulemaking and enforcement actions. During his time at DOT, he also served as the Acting Deputy Secretary of Transportation and briefly as the Acting Secretary of Transportation. During the Bush 43 Administration, Mr. Bradbury served as the Principal Deputy and Acting Assistant Attorney General for the Office of Legal Counsel at the U.S. Department of Justice. As the head of OLC from 2005 to 2009, he advised the President and the Executive Branch on a wide range of constitutional and statutory questions and received the Edmund J. Randolph Award and the Secretary of Defense Medal for Outstanding Public Service, among other awards. Aside from government service, Mr. Bradbury has been a litigation partner at Kirkland & Ellis LLP and at Dechert LLP in Washington, D.C., where his practice focused on regulatory enforcement and investigations, rulemaking and judicial review of agency actions, appellate cases, and antitrust matters. Mr. Bradbury clerked for Justice Clarence Thomas on the Supreme Court and for Judge James L. Buckley on the D.C. Circuit. He graduated magna cum laude from Michigan Law School and received his B.A. from Stanford University. The Biden administration and regulators in California are “trying to force the auto industry to convert its production of vehicles from gas-powered vehicles to electric vehicles,” warns Steve Bradbury, a distinguished fellow at The Heritage Foundation. (The Daily Signal is the news outlet of The Heritage Foundation.) “And they really have in mind a ramp rate to do that that gets to 100% electric, all-electric cars and trucks, SUVs, pickups, your crossovers. All those vehicles that American families need and love would have to be all-electric by sometime in the middle of the 2030s,” Bradbury says. “They also have that plan for big, heavy-duty trucks. The FBI needs to be fixed, because it has become a threat to the fundamental liberties of Americans, Steve Bradbury of The Heritage Foundation argues in a lengthy new white paper released this week. "The liberty of the American people is under threat from politicized national security agencies, exemplified by the abuses of the Federal Bureau of Investigation,” Bradbury writes. The Heritage Foundation on Monday published the report authored by Bradbury, a distinguished fellow in the executive vice president's office there. (The Daily Signal is the news outlet of The Heritage Foundation.)Bradbury's nearly 9,800-word report, "How to Fix the FBI," contains "extensive suggestions for Congress to rethink the entire FBI at a fundamental level: to start over from scratch and reconstruct the Bureau to refocus on law enforcement, bring it under meaningful oversight, and restrain it to protect Americans' constitutional rights."So, what's at stake if the FBI isn't fixed?"Well, the liberties of the American people. It is written by a sufferer and it specifically addresses what happens to relationships around an individual who is stricken by the illness and should educate those that don't know much about this life-threatening condition. For those that have experienced the illness (first or second hand), it's a story you can empathise with. For those who haven't, it's a story you can sympathise with.
