Mary and Andrew begin this week by tackling a decision by a U.S. District Judge to dismiss criminal charges against Kilmar Ábrego García, calling the administration's case against García a vindictive prosecution for challenging his illegal deportation last year. Mary and Andrew couple this topic with a conversation about the “Broadview Six” case, involving a group of Chicago ICE protesters whose criminal case was dropped, similarly, due to misconduct by the DOJ. Then, Mary and Andrew continue a discussion from last week about Trump's $1.776 billion settlement with the IRS — specifically about an addendum to the settlement which grants Trump and "affiliated individuals" extremely broad protections from future prosecutions. They then talk about Carmen Lineberger, a former federal prosecutor indicted for sending unreleased files from the Jack Smith report to her personal email account. Plus, a conversation about a decision by a federal judge who has ordered the White House to comply with the Presidential Records Act, undermining the DOJ's ability to give the administration a legal way to destroy White House records from the second Trump term. Send us Fan MailThe hosts discuss what they describe as a major bulletin that medical marijuana is now legal nationwide when compliant with state licensing, tying it to a DOJ executive action by Acting Attorney General Todd Blanche and U.S. treaty obligations that would require a government monopoly over medical cannabis. They react to 4/20, YouTube channels being yanked for on-air smoking, and update progress on opening their Pekin, Illinois dispensary while noting Illinois “social equity” status helped with licensing but not loans, creating urgent debt. They outline how rescheduling was split into two lanes, reference OLC reasoning under CSA 811(d), anticipate lawsuits and resumed hearings (June 29), and argue IRC 280E may be retrospectively disallowed around 2023. They also debate hemp loopholes, “full spectrum CBD,” checkpoints/transport issues, employment drug tests, home grow under state law, and emphasize freeing incarcerated people and building coherent cannabis rules.00:00 Medical Legalization Shock00:09 Show Intro and QR00:25 Illinois Dispensary Update01:18 420 and Channel Strikes02:28 Why Nothing Changed Yet03:01 DOJ Executive Action Deep Dive06:51 Treaty Monopoly Explained07:56 Farm Bill Hemp Loopholes09:14 Full Spectrum CBD Debate12:53 No Smoking and Creator Risks14:43 Rescheduling Precedent Talk16:51 Illinois Loan and Lawsuit Math22:17 280E Tax Fallout25:14 Hearing Restart June 2926:19 Checkpoints and Federalism27:20 Rescheduling Reality Check27:36 Interstate Transport Risks29:10 420 Culture and Protest31:42 Medical Model Expansion34:42 Hemp Loopholes and Safety38:47 Workplace and Drug Tests41:18 Policy Memos and Politics43:47 Homegrow and State Compliance50:55 Wrap Up and What's Next52:19 Sponsor Collateral BaseSupport the showGet our newsletter: https://bit.ly/3VEn9vu
4. Guest: Josh Blackman. Blackman discusses a 2026 OLC opinion suggesting the 1978 Presidential Records Act is unconstitutional. He draws parallels between Nixon's record disputes and the modern indictments of Donald Trumpregarding documents at Mar-a-Lago. The conversation explores whether these legal challenges are attempts to restore traditional presidential powers after post-Watergate erosion. 41589 HOLLAND NETHERLANDS
SCHEDULE JOHN BATCHELOR SHOW 4-24-20261740 BATAVIA Guest: Jeff Bliss. John Batchelor and Bliss discuss potential fuel shortages impacting Las Vegas tourism and airport traffic. They address rising gasoline prices in California, which exceed five dollars due to heavy refinery regulations and reduced domestic production. The conversation also covers the environmental and economic impacts of importing fuel into the region. Guest: Jeff Bliss. Bliss analyzes the first gubernatorial debate, where leading Democratic candidates gave Governor Newsom high grades for handling homelessness, while Republicans issued an "F". The discussion highlights the audience's negative reaction to these high marks and notes how the candidates focused heavily on criticizing Donald Trump throughout the evening. Guest: Josh Blackman. Blackman reviews the history of the 1974 Presidential Recordings and Materials Preservation Act, which prevented Richard Nixon from destroying White House records. He argues that the Watergate investigation created a political "fever," leading to legal maneuvers that potentially compromised constitutional principles regarding executive branch authority over internal disputes and documents. Guest: Josh Blackman. Blackman discusses a 2026 OLC opinion suggesting the 1978 Presidential Records Act is unconstitutional. He draws parallels between Nixon's record disputes and the modern indictments of Donald Trump regarding documents at Mar-a-Lago. The conversation explores whether these legal challenges are attempts to restore traditional presidential powers after post-Watergate erosion. Guest: Jim McTague. McTague reports on the economic climate in Lancaster County, observing light city foot traffic and high commercial rents. He discusses how rising gasoline prices affect small businesses and seniors on fixed incomes. The segment concludes with a look at the local fishing season and McTague's interactions with the Amish community. Guest: Lorenzo Fiori. Fiori addresses the suspicious poisoning of wolves in Italy's Abruzzo National Park, noting conflicts with local farmers. He recommends travelers visit the historic "star city" of Palmanova and nearby Roman sites to escape over-tourism in major cities. The segment concludes with a culinary tip for preparing a traditional potato dish. Guest: Richard Epstein. Epstein critiques the California Supreme Court's disbarment of attorney John Eastman. He argues the decision is a politically motivated "hit job" that ignores First Amendment protections for legal advocacy. Epstein suggests such judicial interventions into political campaigns are dangerous and warns that the decision misshapes the entire American polity. Guest: Richard Epstein. Epstein examines the crisis in the Strait of Hormuz, noting fuel emergencies in the Pacific. He advocates for opening alternative domestic energy supplies by bypassing regulatory hurdles. Epstein argues that military force may eventually be necessary to counter illegal Iranian blockades and protect national security interests against bad-faith negotiations. Guest: Andrew Graham Dixon. Art historian Dixon explores the background of Johannes Vermeer in 17th-century Delft. He details Vermeer's father's role as an innkeeper and the family's involvement with the Remonstrants, a liberal religious group. This group advocated for peace and tolerance during an era characterized by brutal and devastating religious wars. Guest: Andrew Graham Dixon. Dixon investigates Vermeer's artistic origins, proposing Gerard ter Borch as his teacher based on archival documents. He notes that Vermeer was fatherless at twenty and likely viewed his master as a father figure. The discussion emphasizes that Vermeer's training occurred outside of Delft, contributing to his sophisticated and subtly lit style. Guest: Andrew Graham Dixon. Dixon recounts Vermeer's marriage to Catharina Bolnes and his conversion to Catholicism to appease his mother-in-law, Maria Thins. He highlights the unique religious toleration in Dutch society, where diverse faiths worshiped in private. The narrative focuses on the domestic tensions Vermeer faced living in Thins' wealthy, strictly Catholic household. Guest: Andrew Graham Dixon. Dixon discusses Vermeer's primary patrons, Peter van Ruijven and Maria de Knuijt, identifying them as radical Remonstrants. He reveals a "smoking gun" discovery: their home was adjacent to a hidden Remonstrant church. Dixon argues Vermeer's paintings were deeply personal expressions of the fellowship and faith shared with these patrons. Guest: Henry Sokolski. Sokolski highlights the overlooked plutonium path to nuclear weapons in Iran, focusing on the Bushehr reactor's spent fuel rods. He explains that while uranium enrichment is publicly monitored, reprocessing these rods could yield hundreds of bombs. He argues that current inspections fail to provide a "timely warning" for such diversions. Guest: Henry Sokolski. Sokolski discusses modernizing civil defense to address non-nuclear threats like drone strikes on critical infrastructure. Following European models, he suggests Americans should prepare for 72-hour utility failures by securing water, cash, and physical protection for power transformers. He notes the administration is only beginning to articulate these essential requirements. Guest: Bob Zimmerman. Zimmerman reviews NASA Administrator Jared Isaacman's testimony regarding budget cuts and the cancellation of the Lunar Gateway project. He compares slow European government space programs with agile commercial startups. Additionally, he notes technical failures with Northrup Grumman's rocket boosters that have delayed military launches and impacted ULA's finances. Guest: Bob Zimmerman. Zimmerman provides updates on the Curiosity rover's climb of Mount Sharp, noting unusual tile-like rock formations on Mars. He also explains the significance of the Artemis Accords, an alliance of sixty-three nations favoring private property and enterprise in space. This political alliance serves as a counter-strategy to Chinese and Russian lunar ambitions.
Summary: Josh Blackman Josh Blackman previews his analysis of a 2026 OLC opinion declaring the Presidential Records Act unconstitutional, discussing how Watergate-era legal precedents regarding executive documents now influence modern criminal proceedings against former presidents.1972 KISSINGER, NIXON, HAIG.

Legal operations is growing fast, but there's no standardized pathway for professionals entering the field. That's the gap Colin S. McCarthy and Anne Graue are working to close with Our Legal Community (OLC). On this episode, Colin and Anne share why they created OLC—a global community focused on certification, knowledge sharing, and career growth for legal ops professionals. They pair newcomers with experienced coaches who've built legal ops programs from the ground up, creating the certification standards the industry has been missing. We also talked about AI's role in legal teams, the future of in-house legal departments, and what makes OLC different from other networking groups. If you're in legal ops or thinking about starting a legal ops function, this one's worth your time.
Donald Trump's dirty DOJ leadership is engaged in a shell game, a game of three-card monty, a game of misdirection designed to dupe the American people.DOJ's Office of Legal Counsel (OLC) is a component of the Department of Justice that issues advisory opinions regarding the legality or illegality of conduct by federal government officials, attorneys, law enforcement, and military operations. Historically, OLC has tried to do its work in good faith, and in accordance with the law and the Constitution. But that is not the case under the current corrupt DOJ leadership.OLC is now offering indefensible legal opinions - for example, trying to give top cover to the Trump administration when it unlawfully enters Venezuela and takes into custody its president and first lady. Indeed, virtually every respected military law expert recognizes that this was an illegal operation. The same is true for the unlawful, deadly strikes on small Venezuelan boats in international waters.OLC also rendered an opinion of how fake US attorney Lindsay Halligan could continue to sign official court documents as "United States Attorney" even though a federal judge had ruled that she was unlawfully and unconstitutionally in that position. But there's also supposed to be another safeguard against, in particular, DOJ attorney misconduct. The office of professional responsibility (OPR) is supposed to investigate allegations or suspected incidents of DOJ attorney misconduct and misconduct by law enforcement officers, like FBI agents. However, the head of OPR was wrongfully removed from the job months ago, and there is no indication that there even is a current, legitimate head of the OPR. This corrupt shell game that Trump's dirty DOJ leadership is playing - having OLC issue memos to give wrongdoers top cover, and then neutering OPR so that the attorneys who engage in misconduct will not be held accountable - is destroying the legitimacy of the DOJ.To those of us who spent decades serving the American people at the Department of Justice, we see exactly what they're doing. All of the American people also need to see this for what it is - abject corruption at the DOJ. Distance learning doesn't fail because of tools—it falters when leadership, policy, and systems don't align around student success. In this episode, Seth Fleischauer and Allyson Mitchell sit down with Dr. Alexandra Salas, founder and CEO of the Delmarva Digital Learning Association, to unpack what institutional readiness for digital learning actually requires.Drawing on her experience in higher education leadership, instructional design, and nonprofit systems change, Dr. Salas challenges the idea that digital learning is merely a delivery mode. Instead, she frames it as a connective infrastructure—one that can support access, belonging, wellness, and persistence when designed intentionally. The conversation moves beyond emergency remote learning to examine how organizations evaluate readiness, why frameworks matter, and what leaders must confront if digital learning is going to meaningfully support students rather than strain them. What This Episode ExploresWhy digital learning should be evaluated at the systems level—not course by courseThe difference between emergency remote teaching and sustainable digital learningHow leadership, governance, policy, and student support services shape online successWhy “online readiness” is about people and structures as much as platformsThe role of reflection frameworks (Quality Matters, OLC, ISTE, and others) in continuous improvementHow wellness, trauma-informed practices, and student belonging intersect with distance learningWhat teaching yoga online revealed about presence, connection, and learning in virtual spacesWhy distance learning is better understood as connected, accessible, future-ready learningGolden MomentDr. Salas shares an early career story from her time as an instructional designer—partnering with faculty to bring courses like anthropology, chemistry, and Arabic online before large-scale platforms made it commonplace. The moment highlights a recurring theme of the episode: trust, curiosity, and collaboration matter more than tools when innovation involves real change. Why Distance Learning? In Dr. Salas's words, distance learning isn't about distance at all. It's about access, inclusion, and possibility—especially for learners in rural or underserved communities. When aligned with strong leadership and intentional systems, digital learning becomes a bridge rather than a substitute.Mentioned Work & ResourcesDelmarva Digital Learning Association — https://delmarvadla.orgUnited States Distance Learning Association - https://usdla.org/Bestemming Yoga — https://www.bestemmingyoga.com/meet-ytNumbers and Sense by Alexandra SalasQuality Matters, OLC, Blackboard, and ISTE digital learning frameworks (referenced conceptually)Host LinksDiscover more virtual learning opportunities at CILC.org with hosts Tami Moehring and Allyson Mitchell.Seth Fleischauer's Banyan Global Learning combines live virtual field trips with international student collaborations for a unique K12 global learning experience. If you've ever felt at a loss when your child — especially a child with autism — is in the middle of a meltdown, you are not alone. Today I'm sharing the Firefighter Technique that completely changed the way I support my children. Instead of trying to reason or explain while they're overwhelmed, I now think like a first responder — calm, clear, and focused on getting them safely back to their “safe and social” state. This one mindset shift has made all the difference. ✨ Free Download: 100 Signs of Autism Printable
This episode was really supposed to be, at the least, more about host Wood's inaugural experience at the annual MACC One Love Century Labor Day weekend road cycling event. The OLC did get brought up but time had to be spent reacting to the content world's most popular topics in Shannon Sharpe, (the fallout from) Cam'ron getting Adrien Broner together, Cam Newton and his 4th and 1 podcast. The message from IAP will continue to be the need to keep turning away from most of this noise and messiness. It's all too costly to remain living while under the influence.

OA1093 - In this episode recorded on Thanksgiving Day, two vegetarians carve up the Canadian turkey born Aubrey Drake Graham. Are Drake's exploratory legal actions against Universal Music in response to Kendrick Lamar's “Not Like Us” the weakest move in the history of rap beefs? Matt shares some of his favorite diss tracks before we consider these filings and how Drake thought he could possibly come out of this looking good. We also take a look at Jack Smith's motion to dismiss both of the federal criminal cases against the 47th President-elect of the United States, and what we can learn about the possible future (?) of these cases from both his motion and DC federal judge Tanya Chutkan's order granting it. Finally, in today's footnote Thomas provides valuable evidence for the prospective plaintiffs in a cease and desist demand recently made against the ONLY guitar endorsed by Donald Trump. As the Special Counsel winds down the DC criminal case and the Florida appeal, veteran prosecutors Mary McCord and Andrew Weissmann analyze the strategy behind getting a dismissal without prejudice before Donald Trump takes office, while dispelling the notion that Jack Smith “folded” in any way. Then, they head to New York to break down the nuance of Judge Merchan's decision to postpone Trump's sentencing, as he accepts briefing on a motion to dismiss the case that both parties agreed to. And before wrapping up, Mary and Andrew review some of the presumptive nominees Trump has named for top Justice Department posts, and the contrast of working on behalf of a client versus working on behalf of the Constitution.A note to listeners: Since we recorded, the 11th U.S. Circuit Court of Appeals also granted Special Counsel Jack Smith's request to dismiss that appeal without prejudice.Want to listen to this show without ads? Episode 170 Tom Brose of Confront After trying to dig in on the Chubby Fresh episode and not getting deep enough, we were pointed towards Tom Brose, who would eventually connect with and bring many of the great 80's Revelation Bands and more to the area. Confront was a band started by kids in high school and were invested in the straight edge bands that were growing in popularity. Having a direct line of traffic as a major stop for most touring bands, starting Confront gave Tom, Steve Murad (Mean Steve later of OLC) and others like Outface - Charlie Garriga of Civ, Derrick Green of Sepultura and later Tony Erba and Face Value ample opportunities to play with a host of out of town bands. We go deep in Cleveland hardcore from as early as Tom could recall and we walk our way up to the 1st Integrity 7" , which soon after Tom moved to DC. Tom's story is a classic and his ability to recollect details from the past allows the story to fully develop in the conversation. www.darkempire.bigcartel.com/product/pre-sale-confront-our-fight-87-90 www.instagram.com/theclevostyle www.instagram.com/crossfitdc www.instagram.com/jiujitsudc
Even after the New York DA's position with respect to a dismissal of Donald Trump's New York case was filed, there are lingering questions about what happens next with his other criminal cases as he begins his transition back to power and unveils his cabinet nominees. MSNBC legal analysts Mary McCord and Andrew Weissmann give an insider's perspective on what a final report in the DC case might look like from Special Counsel Jack Smith, as is a requirement within the special counsel rules. What will it encapsulate? And will it be made public? Next up: a few cases involving J6 rioters have been denied a stay, while others have had their trials postponed, but an overarching theme is that Trump's immunity should not extend to these defendants. And finally, Mary and Andrew ‘nerd out' on the Constitutional process of how a recess appointment works, why the early framers thought it necessary, and how the president-elect is angling to use it to avoid the Senate's long held role of advice and consent when it comes to political appointees. There's a lot to unpack around Donald Trump's ongoing criminal and civil cases after he won last week's election. To begin with, veteran prosecutors Mary McCord and Andrew Weissmann explain why Judge Merchan agreed to the joint request to put off today's decision on the impact of immunity in his hush money case. Then, they dig into the constitutional arguments against prosecuting a president while in office, whether federally or as a state prosecution, and how that might also relate to sentencing in New York. Next up, Andrew and Mary illustrate how Trump's win might impact his civil cases, to include both E Jean Carroll cases and his New York civil fraud case. And wrapping up, the duo reflect on the efforts by those convicted in J6 cases to have them dismissed or stayed, as they await a potential pardon by the president-elect.Want to listen to this show without ads? In October 2021, the House of Representatives voted to find Trump associate Steve Bannon in contempt of Congress after Bannon refused to comply with a subpoena from the House select committee investigating the Jan. 6 insurrection. In November 2021, the Justice Department indicted Bannon, and the trial is currently scheduled to begin this summer. So what's been happening in the interim? To catch up, Quinta Jurecic spoke with Lawfare senior editors Roger Parloff and Jonathan David Shaub. Roger has been following the Bannon prosecution closely and wrote about it in a recent Lawfare article—and Jonathan has written a great deal on Lawfare about the Office of Legal Counsel's positions on executive privilege, including how they might affect prosecutions for contempt of Congress. Bannon recently filed a motion to dismiss, making the argument that he believed Donald Trump's supposed invocation of executive privilege made it unnecessary for him to comply with the subpoena—relying heavily on memos from OLC. What should we make of Bannon's arguments? How is the Justice Department navigating a legally tricky situation? And what, if anything, might this case tell us about the other contempt of Congress cases coming out of the Jan. 6 committee, which the Justice Department has yet to bring?Support this show http://supporter.acast.com/lawfare.
