Chipotle has filed a lawsuit against Sweetgreen for trademark infringement, alleging that the salad chain's "Chipotle Chicken Burrito Bowl" menu item copies the name and branding of Chipotle's burrito bowls. The complaint, which was filed in a California federal court, claims that Sweetgreen's use of the word "Chipotle" in its advertising and the dish's name is likely to cause consumer confusion. Chipotle alleges that Sweetgreen has used the word "Chipotle" as a source-identifying trademark and that Instagram users have associated the two companies. In addition, a restaurant industry news article has noted that Sweetgreen's new dish "veers directly into arch-rival Chipotle Mexican Grill's territory." Chipotle had contacted Sweetgreen about branding concerns and recommended that the chain rename the dish to use "chipotle" in lowercase, but Sweetgreen did not respond, according to the complaint. The Mexican food chain owns five federal trademark registrations for the word "Chipotle." Sweetgreen has not yet responded to the lawsuit.Chipotle Sues Sweetgreen for ‘Chipotle Chicken Burrito Bowl' (1)IRS-authorized tax e-file software provider, eFile.com, was found serving JavaScript malware called 'popper.js,' containing a base64-encoded code that attempts to load JavaScript from a third party website. This code aims to prevent caching and load a fresh copy of malware when visited. This issue concerns eFile.com and not the IRS e-file infrastructure or domains. Researchers have found the malware to be present on almost every page of eFile.com until April 1st. Additionally, the same Amazon AWS endpoint was serving another file called 'update.js' that prompts users to download next-stage payloads, which establish a connection to a Tokyo-based IP address, hosted with Alibaba. The same IP address also hosts an illicit domain associated with the incident. Further analysis revealed the PHP script as a backdoor malware that remotely accesses an infected device, connects to a remote command and control server every ten seconds, and receives a task to execute on the infected device. The malware can allow full access to a device, providing the threat actor initial access to a corporate network for further attacks. The company has yet to release the full scope of the attack and if it has infected any of its customers. EFile.com has been approached with questions but has not responded. Two new lawsuits have been filed against producers of the Netflix film "Rust," including actor/producer Alec Baldwin. Baldwin killed cinematographer Halyna Hutchins during the filming of the movie in October by accidentally shooting her in the chest. Hutchins' family has filed a wrongful death lawsuit, and a medic on the set has filed a lawsuit for emotional trauma after she failed to save Hutchins' life. Also: A couple in Florida has been charged with child abuse for allegedly forcing their adopted son to live in a small structure in their garage. A U.S. judge has ordered the Air Force to pay $230 million to the victims of a mass shooting at a Texas church in 2017 that claimed 26 lives. The court had previously found that the Air Force failed to report a conviction that could have prevented the shooter from legally purchasing a gun. An 80-year-old nun was sentenced to a year in prison for stealing $835,000 from an elementary school to pay for lavish gambling trips. Support the show

Blocking annoying popups in Google Chrome; keep your coffee warm for eight hours; Netflix email scam In the show today, Marcello Sukhdeo talks about a Google Chrome update that will prevent websites from taking advantage of us by opening new tabs, a smart mug that can keep your coffee warm for up to eight hours, and if you are a Netflix subscriber there is an email scam that you need to be aware of.  Show Notes:  Google Chrome will now do more to prevent those annoying ways that websites try to take advantage of us. Google is planning a new update which will prevent these websites from automatically launching new tabs and windows you never intended on opening in the first place.  According to a blog post from Google, it says: "One piece of feedback we regularly hear from users is that a page will unexpectedly navigate to a new page, for seemingly no reason.” The source of these redirects, according to Google, is often content embedded within the site itself.  Now, with the latest update, Chrome will block third-party content from launching new pages unless you're actively interacting with that content. With this update, you will get a notification to let you know the redirect has been blocked.  A smart mug The Ember Ceramic mug is a smart mug that connects to your phone through Bluetooth and allows you to set an ideal temperature for whatever you’re drinking (up to 62 degrees Celsius for Canadians). Once the beverage reaches that temperature, the mug will maintain it for up to eight hours. The ceramic mug will retail for $79 US and is available exclusively at Starbucks and on Ember’s website.  Netflix email scam A well designed scanned email has been landing in the inboxes of millions of Netflix subscribers asking them to update their billing information. This of course is part of a large-scale phishing operation. The email, which has the subject line: ‘Your suspension notification’, includes a link that takes readers what looks like a genuine Netflix home page. From there, readers are prompted to enter private information, regarding their billing details.  Tech Bytes Some 800 schools across the US have been targeted by hackers and their websites redirected to an Islamic State-sponsored YouTube video. The attack, which lasted a few hours, affected schools in Arizona, Connecticut, Virginia and New Jersey. The hack, which also affected private companies and government websites, is being investigated by the FBI. Apple has offered to help the FBI with an encrypted phone belonging to Texas church shooter Devin Patrick Kelley after learning the bureau was having trouble getting into the device. A statement from Apple reads: “Our team immediately reached out to the FBI after learning from their press conference on Tuesday that investigators were trying to access a mobile phone. We offered assistance and said we would expedite any legal process they send us." Facebook has announced version 2.2 of Messenger. This new version introduces a series of new business-friendly features to the messaging platform. It includes a customer chat plugin that lets businesses integrate Messenger into their own website.

The Incident & The Suspect * Below are elements of the official story as I know them, not necessarily what I believe. The massacre inside the First Baptist Church in Sutherland Texas was caught on camera. For seven minutes, a man wearing all black body armor, a protective helmet and possibly a grim reaper mask moved from aisle to aisle shooting churchgoers and their children execution style, in the head. When he left, 25 of the 50 or so member congregation were dead and 21 more victims were wounded, 1 of which would later die in the hospital. I say possibly wearing a grim reaper mask because there has been some inconsistencies in the reporting on this. That man who investigators say is responsible for the worst mass shooting in Texas history is twenty-six year old Devin Patrick Kelley, a former Air Force member who court-martialed in 2012 for beating his wife and cracking his 2-year old step-son's skull. Prior to his court martial, according to the El Paso Police Department, Kelley had escaped from Peak Behavioral Health systems in Santa Teresa, New Mexico. Kelley had been committed after having been caught sneaking firearms onto the Air Force base in what authorities believe was an attempt to carry out death threats he had previously made towards his chain of command. The following year, in 2013, he was investigated for sexual assault. In 2014, he plead guilty to a cruelty to animal charge after being accused of repeatedly punching a dog in the face. And in the months approaching the shooting, he preached atheism on Facebook and mocked those who believed in religion. Oh, and it was initially reported that he once taught 4 to 6 year old children bible studies. So there's your suspect in a nutshell. I'm sure I'm leaving a few things out. The Alleged Motive Investigators have suggested that the shooter's motive was related to a domestic issue, and that his mother-in-law, who often attended the church, might have been the target. She was not present on that day however. This raises questions. If he was after his mother-in-law, why was he in full SWAT gear? Why did he need an assault rifle capable of holding more than 400 rounds of ammunition? Why did he need multiple extra weapons which were found inside his vehicle? Why wouldn't he just go after her? While his mother-in-law may have been one of his targets, it's hard to believe the simple domestic related motives that have been suggested. The Good Samaritan Heroes Upon leaving the church, the suspect was met with gunfire from a local who is being hailed a hero. Stephen Willeford was in relaxing in his home a few blocks away when his daughter alerted him to the gunfire. Willeford, a former NRA instructor, grabbed his rifle, a few magazines and was out the door before even putting his shoes on. (Reminiscent of John McClane in the original Die Hard movie) Taking cover behind a neighbors truck, Willeford exchanges gunfire with Kelley from across the street. Kelley is shot twice. (Willeford was aiming for the gaps in the body armor). Kelley then drops his rifle, flees to his SUV and speeds off. I don't know how long this gunfight lasted. The likely assumption is that it was brief, just not sure how brief.  After Kelley speeds away, Willeford notices a truck sitting in the intersection. He approaches the truck and enlists the help of the driver, Johnnie Langendorff, the other hero of the story. Willeford hops in Langendorff's truck and the two good samaritans race after the suspect at speeds reaching 95 mph. During the chase, Langerdorff spoke with police as he drove and Willeford fired at the suspect's SUV, shattering its back window.  After about a 11 mile chase, Kelley's vehicle hits a road sign, speeds up and then overturns in a ditch nearby. The two locals then pull up to the scene. Willeford exits the truck with his rifle and calls for the suspect to get out of the overturned vehicle. There is no response. Willeford keeps his gun fixed on the overturned SUV until police arrive. Authorities later allege that prior to driving into the ditch, the shooter called his father and told him that he wasn't going to survive his injuries. Then he shot himself in the head. This is quite a story, one that raises many questions. Today's show looks at two men with troubled beginnings who became polar opposites: one a mass murderer and one a scientific advisor to presidents. The murderer was Devin Patrick Kelley, who made headlines for shooting up a Texas church. The scientist is Mark Kingston Levin. Both came from dysfunctional homes and showed signs of trouble from an early age. But, Devin fell through the cracks and manifested psychopathology, including: cruelty to animals, domestic violence, a mental hospital escape and ultimately mass murder. Mark's childhood trauma was his father's early death and his mother's remarriage to an alcoholic abusive stepfather. But, Mark found mentors who guided him on an ambitious path: a coach who got him into football and a teacher who had him join the rocket club and fall in love with science. Football gave him confidence. The rocket club launched his prestigious career in science. Now he uses his real-life science background to write award-winning science fiction.

A gunman identified as Devin Patrick Kelley killed at least 26 worshippers and wounded at least 20 others in the latest mass shooting. Kelly was court-martialed in 2012 on charges of assaulting his wife and child, and sentenced to 12 months confinement. He received a “bad conduct” discharge in 2014, according to Ann Stefanek, the chief of Air Force media operations.On this episode of "Fault Lines," hosts Garland Nixon and Lee Stranahan discuss the mass shooting at the First Baptist Church in rural Sutherland Springs on Sunday.
