In particular, Maharrey explains the way that congress has completely abdicated its role of declaring wars—instead, they have ceded that power fully to the president. Maharrey reminds us that all empires collapse eventually, and indeed that empire is often the final stage in a civilization’s existence. Mike Maharrey untangles the complex web of legal history that has given America the system known as qualified immunity, which in practice shields police officers from just about any civil lawsuit. The doctrine, which has emerged out of the precedents set by repeated federal court rulings, makes it almost impossible to sue state agents for constitutional violations or other damages suffered during the performance of their jobs. This is mainly because the courts have decided that unless there is specific precedent for the situation the officer finds himself in, discretion must be left up to the officer. In the prominent cases this has meant that if a cop shoots a civilian, as long as other cops say that the shooting was reasonable at the time, the officer will walk free. Maharrey calls for a system that doesn’t rely so much on strict interpretation of specific legal precedent, but instead can allow a judge and jury to use some common sense in adjudicating each situation, the way common law systems operated prior to the founding of the United States. However qualified immunity comes to an end, Scott and Maharrey agree that it is the most important first step in creating a more just police system. Progressives don't like it so much when the government expands its own power in ways they don't like. One of the first articles I wrote for the Constitution 101 series was titled "Living and Breathing Is Dead." It makes the fundamental point that if the government can interpret and apply the Constitution in such a way that it expands its own power, the Constitution itself is meaningless. You can't have "rule of law" when the "rule of law" is subject to reinterpretation at the whim of government judges, bureaucrats and elected officials. A constitution must mean what it was intended to mean when ratified, or it's really pointless to have one. WikiLeaks founder Julian Assange was arrested by London police and will likely be extradited to the U.S. to face charges in connection with secret documents obtained by Chelsea Manning and published on the WikiLeaks website. These documents revealed government malfeasance. Nevertheless, people on both side of the political spectrum are cheering Assange's arrest, despite the grave threat his prosecution poses to free and open journalism. Most of these cheerleaders won't directly address the information these documents revealed or the service Manning and Assange provided by revealing government criminality. Instead, they justify Assange's prosecution with the refrain, "But he broke the law."
