On Tuesday's Mark Levin Show, peace is not mere avoidance of conflict but a state secured through strength and decisive action against threats like Iran's nuclear ambitions. No great president—Washington, Lincoln, Reagan, or Trump—would tolerate such dangers. "America First" prioritizes national security and global stability, not isolationism. It demands pragmatic, not ideological, foreign policy, assessing each threat uniquely. Labeling prudent action as "pro-war" is a misnomer; opposing nuclear-armed terrorists is pro-American.  A Kamala Harris presidency, aligning with appeasement, would weaken America and allies like Israel. Trump's leadership, grounded in common sense, rejects endless wars but never shies from necessary action. Also, Israel has a right to live in a free society. These attacks from Iran, ongoing for years and escalating since October 7th, force Israelis to live in constant fear, with frequent sirens driving families to seek shelter in protective rooms or basements multiple times a day. This relentless situation disrupts normal life, preventing children from playing in parks or attending school regularly, and could cause significant psychological strain. Later, some members of Congress, mostly Democrats and a few Republicans, are attempting to undermine the President's authority as Commander-in-Chief by citing the War Powers Act of 1973. This law is unconstitutional, as it shifts power from the President to Congress, contradicting the Constitution's design. The President, it asserts, holds sole authority over military decisions, while Congress's role is limited to declaring war and controlling funding.  Afterward, Sean Hannity calls in to discuss the Israel/Iran war.  Hannity explains that Trump's leadership is defined by common-sense principles, particularly his consistent stance since 2011 that Iran must never acquire nuclear weapons. Because of what was at stake, we have all been given a gift of grace and more time. We cannot underestimate what God has just done—He spared us from calamity. That being said, we need to pray now more than ever. This battle is not over. Why do I say this? Look first at what's happening right now. Today, Ukraine has fired its first barrage of long-range missiles into Russia. Joe Biden (or whoever is currently running this country) just approved the use of these long-range missiles, which we supplied, to be used inside Russia. This marks a major escalation of the Ukraine war.  There is no reason, in my opinion, for the Biden administration to take this step other than to deliberately try to pull us into World War III before the inauguration, sabotaging President Trump's incoming administration. What kind of evil people make their primary focus the death of unborn babies? What kind of deranged people try to drag the world into a nuclear war? We need to seriously consider the level of evil we are dealing with here. These individuals seem to have no regard for life at all. Or are their minds completely reprobate? No person in their right mind would do what they are doing now. There is no logical reason for these actions. These missiles will only escalate the conflict without any real chance of winning the war. We now clearly see one of their major plans to disrupt the incoming administration, but this is only the beginning. Americans need to understand what is truly at stake. Our news media is not reporting the situation with the urgency it demands. Every American needs to grasp the gravity of what a full-scale conflict with Russia and her allies would look like. This is not a game. Millions of lives are at risk. The stability of the world is at stake. If globalist leaders succeed in pulling us into this war before the inauguration, it could mean invoking the “War Powers Act.” While I am not saying this will happen, it is a possibility. Additionally, Russia will be forced to retaliate against these attacks. What will that retaliation look like? Cyberattacks? Cutting undersea internet cables? Could it even be a staged operation by our own agencies, similar to the Gulf of Tonkin incident? Who knows? Please continue to pray against these demonic plans and the people carrying them out. Pray that God continues His grace on America and that we, as the Body of Christ, maintain the pressure through prayer and fasting against all these evil plans and agendas. I have not even addressed some of their other schemes. We cannot afford to go to sleep right now. This is just one of their plans; there will be others. Pray.

Aaron Ross Powell: Welcome to Zooming In, a project of The UnPopulist. I'm Aaron Ross Powell. I'm joined today by my colleagues, Shikha Dalmia and Akiva Malamet for our editors' round table. Recent reporting has uncovered plans by Trump allies, and Trumpist think tanks, and other organizations to deconstruct the administrative state.A transcript of today's podcast appears below. It has been edited for flow and clarity.Aaron Ross Powell: I think all of us agree that the administrative state is unaccountable and too large, so what's wrong with Trump's plans to reform it?Shikha Dalmia: Good morning, Aaron and Akiva. We haven't done this in a while, right? We are getting together in this format after a long time, but I'm surprised, Aaron, you didn't use the word “deep state,” because that's the term of art these days, right? What's wrong with the “deep state?” There are actually plenty of things wrong with the deep state, but we actually in the US don't really have a deep state.Deep state is an idea that was originally meant to describe the kind of bureaucracy we had in countries like Turkey and Egypt, which was controlled by the military and security forces. They engaged in all kinds of machinations behind the scenes to control civilian authorities and the populace at large. Their functioning was completely opaque and the subject of all kinds of conspiracy theories in the Middle East.That's not what we have here in the United States. What we have in the United States is a problematic situation, where those of us who believe in government of limited size and scope, the federal government is very large. It performs functions far beyond what, I think it's fair to say, the Founders originally visualized and the bureaucratic state, the administrative state, has grown apace.Now, if you talk to my friend Frank Fukuyama, he will tell you that actually, the bureaucracy is not large enough because the federal government's functions have grown far, far more than the bureaucracy has, and the bureaucracy simply can't keep up with providing the kinds of professional and efficient execution that it was meant to do. Now, regardless of what you think about that view, I think from our point of view, an administrative state that in its current form is quite problematic, but it is part of a bigger problem with the federal government.As the federal government was originally envisualized in this country, each branch had very specific role, and had very specific powers and functions. Each side was supposed to guard that, guard their functions in a very, very jealous way. The idea was that would allow the public at large to keep each government branch publicly accountable, and at the same time, each branch would provide a check on the other.Now, that actually has not how things have worked out in the United States. Over a period of time, Congress has delegated too much of its authority to both the president and the executive agencies under the president. If you think of the War Powers Act, it was supposed to curtail the president's war-making ability. But Congress has got used to giving very large authorization of power to wage all kinds of wars in all kinds of countries post 9/11. That was one huge usurpation of power by the executive, not intentionally, but in effect from Congress.Congress also writes very broad and vague legislations and then lets the administrative branch define them in any way it wants to. That essentially means, this is the critique of the administrative state, is that therefore the administrative branches have very sweeping legislative powers through their powers of interpretation that nobody can really control. Congress can't control the executive agencies and the president can't control the executive agencies either, because many of these people are civil servants and bureaucrats and they are protected by rules of a professional bureaucracy. So they become largely unaccountable.If you are listening to our conservative friends, there's an additional problem, which is that the civil servants tend to be somewhat leftist in their biases. They have an ideological agenda…to promote environmental legislation or equity legislation and what have you. All that becomes a problem for them. Now, I would be in favor of limiting the size and scope of the administrative branch if it was part of broader reform of government, where the Congress took back its legislative powers and therefore the administrative branches had to do less in terms of interpretation and execution. Then you could shrink the size of the administrative state too. But that's not what Trump is proposing.What Trump and the Republicans are proposing is not, in my view, a deconstruction, which is a term of art, or the rationalization of the administrative state. They want to co-opt and take over the administrative state for their own ends. Their ends are essentially twofold: To punish their enemies and rewards their friends. Their ends are essentially twofold: To punish their enemies and rewards their friends.”— Shikha DalmiaIn Trump's case, it means punishing enemies means not just ideological enemies, which is certainly a part of it, but actually, his personal enemies who have tried to hold him accountable for things like calling a mob to ransack the Capitol. He wants to go after Biden and Hunter Biden for purely political purposes. That's not really a reform of the administrative state. That's a co-optation of the of the administrative state.Now, how is he planning to do that? He's got a three-part plan to do this. The first part is that all presidents get to appoint 4,000 political appointments across federal agencies. That is not something that Trump alone would do, every president does that. What is different in this case is that most presidents will look for people who have expertise and merit, have some kind of claim to merit to run the agencies. That's not what they want to do. Heritage Foundation and America First Policy Institute and then Steve Miller's, I think it's America First Legal. They have a plan to install loyalist—Trump loyalists in these positions. That's a problem.The second part that they want to do is there are 50,000 employees who are Schedule F employees, and they are off-limits to the political branches in a certain sense. Trump wants to re-up his old executive order, which will essentially make them at-will employees and allow him to fire them. Again, if he was planning to do this in order to streamline and rationalize the administrative state, that would be one thing. That's not what it is. He [Trump] wants to flatten the points of resistance that he encountered in his initial first term that prevented him from implementing unconstitutional plans, many of which he still managed to do. For instance, on immigration and what have you. That's what he's trying to do. That's why it's all problematic from our point of view. Even though we want a smaller administrative state, we want a well-defined government with specific roles. Even though we want a smaller administrative state, we want a well-defined government with specific roles.”— Shikha DalmiaAkiva: I think those are excellent points, Shikha. I think one of the things that's important to emphasize here is the idea that there is a distinction between harnessing government for your own ends and making government smaller in general. That really the function of what Trump wants to do is to make government a tool of his own ends. One of the things that I think is critical here is that he doesn't really have a plan for what he wants to do in society. What he does is he has certain temperaments about who he likes, who he doesn't like, who his friends are, who his enemies are, and then follows those as a almost random or not random, but very disorganized set of policies to—what he wants to do is in a very disorganized way, punish his friends and reward his enemies and rather than enact any comprehensive plan of reform. In general, what he wants to do is change institutions wholesale so that they no longer serve the so-called “liberal elites” that he's so constantly in favor of attacking.Now, this resembles in many cases a similar plan that has been enacted in many European populist contexts in Hungary, Turkey, Poland, and so on, where there's no real plan for what government should or shouldn't do. There's an idea that there are certain people in power who we don't like, certain outgroups, social outgroups—liberals, feminists, gay rights advocates, and so on. We want them out of power. Instead, we want to put in our own socially conservative, hardline, nationalist stormtroopers. In essence, what we have is a cultural fight over which culture should the institutions of government be wielded. Should they be wielded in favor of a progressive "woke agenda" or they should be wielded in favor of a socially conservative, regressive, reactionary agenda? Of course, independent of whether you're on one side or another, there's one question which neither side has asked, which is should the institutions of government be wielded for these purposes at all? It's clear that what Trump is doing is simply agreeing with the progressives that the institutions of government should be wielded in order to force people into certain modes of action and modes of being but he wants to do it on behalf of his own conservative, reactionary forces rather than progressive ones.“There's one question which neither side has asked, which is should the institutions of government be wielded for these purposes at all? It's clear that what Trump is doing is simply agreeing with the progressives that the institutions of government should be wielded in order to force people into certain modes of action and modes of being but he wants to do it on behalf of his own conservative, reactionary forces rather than progressive ones.”— Akiva MalametAaron: That seems like that describes Trump who is just pure id without much in the way of ideological grounding or even conceptual coherence. He has a sense that there are people who are obsequious to him and he likes those people and people who aren't and he doesn't like those people. Does that describe the broader plan here?When the Heritage Foundation is putting out its 900-page proposal for policies, their Project 2025, I think it's called, or when they're vetting people to take over all of these roles in the administrative state that Trump will make vacant through these various machinations, it feels like those sorts of organizations and people like Stephen Miller do have a more coherent view of what they want society to look like, why they are doing this. They're using Trump as the way to gain power, and then these mechanisms are a way to further assert power because Trump has a certain sort of popularity with a distressingly large portion of the population and we can leverage that, but this feels much more calculated than what you're describing, Akiva.I agree, the Viktor Orban analogies, I think, hold, that there is this sense that we just-- what we want is what we, meaning the people advancing these plans, not me, want is a society that holds to a certain set of conservative views and values and uses the oppressive power of the state to stamp out feminism and LGBT identities and wokeism, whatever they happen to mean by that, and doesn't make white people uncomfortable by teaching the history of racism, and so on.It doesn't feel like just we want to change the culture of the institutions. It feels much more like there is a specific end goal of remaking society to look like a certain thing in mind.Shikha: No, I think that's exactly right. In Trump's first term, there was a disconnect, right? The existing conservative establishment had, which reflected the Reagan era consensus of a certain fealty to limited government principles … at least it offered lip service to those principles, and also wanted certain limitations on the power of the state. They may have had a cultural agenda, just as the left had a cultural agenda, but they had a higher loyalty to these sort of other principles. And they felt that if Trump came along, they could use the Federalist Society to put such jurists in courts and who were not primarily—who were originalists, limited government types, textualists, and what have you, first, and culture warriors second.Trump came along on a populist agenda. His was a populist mandate. He got elected as a culture warrior. Now, one can debate whether Trump is truly a culture warrior or not, it doesn't matter, but he got elected on a culture warrior agenda. That was combined with a certain taste for power in him. To the extent that the courts, the bureaucratic branches, the Republican Party was populated with these other kinds of conservatives, there was a mismatch in what he wanted, and his mandate, and what they wanted, and their long-standing, loyalties and commitments.That has all shifted now. Now there is a harmony in the mandate that Trump wants to get elected on and what the right-wing establishment wants to do. That's where the Heritage Foundations of the world come in. Heritage now looks very different. Heritage was never to my taste, but the Heritage of today is very different from the Heritage of pre-Trump. Now it's in it for the power. The whole idea of a limited government because you at least worry about what your opponents are going to do when they come to power is gone through the window. They want to amass as much power to cram as much of their culture war agenda as they possibly can. Trump, they see, will play ball on that. There will be no tension between that agenda and what Trump wants to accomplish.Trump's added need is for loyalty. Trump's added need is for personal power which they are just happy to go along with because in this case, his power will, in fact, serve their ideological goals.“The right is arguably the most radical political contingent in the United States right now, has abandoned conservatism and doesn't hold at all to a desire to maintain governing institutions but instead…is simply a political movement for exercising heavy power in the service of creating or reestablishing certain hierarchies that they see as having eroded under liberalism.”—Aaaron Ross PowellAaron: It seems like we are seeing then in the way that you describe it, something of a broader version of a longtime hobby horse of mine that I've written about, which is we, especially United States, tend to treat the right and conservatism as synonyms. They both just mean the same thing. If you're on the right, you're a conservative, if you're a conservative, you're on the right and their political projects are identical. It feels like what's happening now and what was recognized in the first Trump administration with the kinds of people, they appointed a lot of conservatives to positions of power.What they didn't get from that was a sufficient quantity of people who were the necessary degree of being on “the right” to do the things that they wanted. That these people had conservative commitments to institutions and principles and so on that got in the way of a far-right agenda. A second Trump term and this split in the Heritage Foundation, the Heritage Foundation used to be a conservative organization. Now it is a far-right organization that is not conservative. That there is this real decoupling and that the right is arguably the most radical political contingent in the United States right now, has abandoned conservatism and doesn't hold at all to a desire to maintain governing institutions but instead, it ties back to what the right has traditionally meant, is simply a political movement for exercising heavy power in the service of creating or reestablishing certain hierarchies that they see as having eroded under liberalism.Akiva: Yes, I think that's right. I think what's happened is we've had a destruction of the idea of conservatism, not just in the sense of small government, but in the sense of conserving institutions, in the sense of there being checks and balances and balance to power and preserving a certain liberal legacy of America's founding documents and a shift towards trying to exercise power for its own sake and to exercising power on behalf of certain culturally conservative ends. We have a shift from conservatism in the sense of conservation or conservatism in the sense of limited government to conservatism as revolutionary.“We've had a destruction of the idea of conservatism, not just in the sense of small government, but in the sense of conserving institutions, in the sense of there being checks and balances and balance to power and preserving a certain liberal legacy of America's founding documents and a shift towards trying to exercise power for its own sake and to exercising power on behalf of certain culturally conservative ends.”— Akiva MalametThis is something that Tom Palmer talks about in an unpublished paper that he delivered to the Mont Pelerin Society about the idea of a conservative revolutionary. This is something that the conservative revolutionary in the original sense were actually the predecessors to the Nazi regime in Germany. These were people who saw the whole business of democratic politics, of the give and take of democratic politics as impeding their ability to enact their will on the populace and to impose their social conservative agenda, and to revive the cult of the nation, and so on.Describe themselves very much as conservative, but not in the sense of everlasting principles and certain code of ethics and so on, but conservative in the sense of being right wing and right wing in the sense of being nationalist, being socially conservative, and so on. We see this repeat itself in the Trump administration to a greater extent and which is trying to follow in the lead of contemporary populists like Viktor Orban, like the former prime minister of Poland, like Giorgia Meloni in Italy and so on, and who see their role as agents of the right and the right being defined in a revolutionary way to transform society into an organ of their own making. An organ that is suffused and constructed to favor certain social classes and hierarchies to defend traditional gender roles, to defend the traditional family unit, to be anti-LGBT and so on.Shikha: Right. Yes, I think, Tom Palmer's piece on the conservative revolution was actually sort of eye-opening because it was so historically grounded, right? If you don't like the so-called liberal radicals, wait till you get the conservative radicals who get their hands on the levers of the state. It is pretty terrifying what they would want to do. If you look at some of like the blueprints of what the Heritage Foundation and Steve Miller have in mind, it's downright chilling.Steve Miller, his immigration agenda, and he has said that, he's openly mocking immigration advocates right now and saying, wait till our second term, you won't know what's hit you. The kinds of things he wants to do, not only will he re-up everything he did in his first term, he has plans to build all kinds of huge detention camps to throw immigrants, undocumented immigrants and anybody else coming into the country. There will be deportation raids galore. Beyond that, plans to take away, deport people who are openly pro-Palestinian or anti-Israel. At least this is Steve Miller's agenda.There will be litmus tests on the immigrants who are coming into the country to make sure they actually tow sort of like a right-wing line. Now, this kind of meddling, trying to socially engineer a public to serve the state ends of the right is kind of scary and not where this country has gone before, as best as I know, even under the worst of circumstances. Yes, so sort of the idea is to have some a conservative revolution in which you use the levers of the state to cram as much of the conservative social agenda as possible and then to hell with the next, the Democratic government once it comes into power. My fear is not just that, what conservatives are doing will end with conservatives, but then it will be picked up by progressives in future administrations to push their own, draconian ends. It's a downward spiral.I don't think we want to do is become cheerleaders for the administrative state in the way that in the early Trump administration and throughout the Trump administration, you suddenly saw progressives embracing the FBI as this force for preserving and protecting democracy and our freedoms.—Aaron Ross PowellAaron: We have a situation where you have a past president who hopes to be a future president who wants to come in and re-engineer the state along essentially to be what Polemicus thought of as justice, which as we've mentioned, is punishing your enemies and rewarding your friends. Married to these conservative intellectuals who want to take those urges and use them in the service of re-engineering society towards far-right ends.A lot of this is being spoken about is, to go back to our opening remarks, a lot of this is being spoken about in the language of reforming the federal bureaucracy, shrinking the administrative state, making it accountable, making career bureaucrats easier to fire so that we can get turnover and we can get accountability. All of these are things that classical liberals have talked about for decades, right? These are, we need to reform the administrative state. We need to figure out how to reform the administrative state. We need to figure out how to make it more accountable. We need to shrink it. We need to return lawmaking power to Congress or demand that Congress retake lawmaking power instead of writing this legislation that's like, this bill will, tasks the EPA with making the environment better and then lets the EPA fill in all the details of what making the environment better means and so on.All of that sounds very classical liberal, but is now being co-opted for decidedly anti-liberal, if not, outright authoritarian ends. What do we do about that? Because what I don't think we want to do is become cheerleaders for the administrative state in the way that in the early Trump administration and throughout the Trump administration, you suddenly saw progressives embracing the FBI as this force for preserving and protecting democracy and our freedoms. Shikha, when you were saying at the beginning that you didn't think there ever was a deep state in the US, the one counter example I could think of is like J. Edgar Hoover's FBI was about as close to what you were describing as I think, as far as big institutions go.We don't want to just become Pollyannish about the administrative state because all of those classical liberal critiques still hold, right? What do we, what do we do about this current situation? How do we fight back against misuse of administrative state reform without giving up on the real need to reform this for liberal ends?Shikha: One of the things that the Trump era did was to make me re-evaluate my positions about the administrative state. I think I've mentioned to you guys, I grew up in the India of the License Raj and the Yes Minister BBC series. The License Raj was this hidebound bureaucracy which controlled the lives of citizens because it had these powers to extract rents in the form of bribes from them for everything that an ordinary citizen wanted to do. You want to build a house? You're not going to get clearance from the bureaucrats till you give them a hefty bribe. There was so much corruption in India due to the administrative state that the reform of the administrative state was something that appeals to me inherently. The one thing that the administrative state in the US has done well—and I take your example of J. Edgar Hoover, Aaron completely, not just that he was going after Martin Luther King, they were going after Martin Luther King, the FBI was, and infiltrating civil rights groups for the worst possible ends—but that said, by and large, the administrative state has done a pretty good job of keeping public corruption at bay in this country.American bureaucracy and American government, at least at the federal level, is really not all that corrupt. I can't overstate just how much stability and trust that builds in institutions when you have institutions that at least don't have this one big vice, which is corruption. In the Trump era, the administrative state performed quite well, I think. It provided advice to him and provided resistance to his worst possible designs. Things on immigration would have been a whole lot worse if there hadn't been bureaucrats within the Department of Homeland Security telling Trump, no, you can't throw people into concentration camps, essentially, right?“American bureaucracy and American government, at least at the federal level, is really not all that corrupt. I can't overstate just how much stability and trust that builds in institutions when you have institutions that at least don't have this one big vice, which is corruption. In the Trump era, the administrative state performed quite well, I think. It provided advice to him and provided resistance to his worst possible designs.” — Shikha DalmiaYou can't simply go around taking funds from the military and putting them towards the wall, although Trump tried to do it via an executive order. The one role that the administrative, and this is where I agree with Frank Fukuyama, is there is a need to defend a certain amount of independence of the administrative state so that it can provide a check on the nefarious designs of government officials who wield a whole lot of power and ensure that they are wielding this power in a responsible and a non-corrupt way. How do we give some autonomy to the administrative state to provide this check on public corruption, while at the same time, not becoming monstrous and a bane on the public itself is a difficult question.What you don't do, you don't do is flatten these points of internal resistance so that a populist demagogue can simply come in and do exactly what he pleases, regardless of whether it fits in with the broader constitutional design or not. I don't know, that doesn't answer your question, but I think, the issue is to get the incentives right within the administrative state rather than to simply throw out the baby with the bathwater.Akiva: Yes, I agree with that. I think one of the things that classical liberals often overlook is that they may not want much of a state, but those parts of a state that they do want to function, have to function well. Even if you wanted a really small state, a night watchman state even, you need the courts to be not corrupt. You need the bureaucracy to be non-corrupt, to be accountable to people. One form of accountability is avoiding awarding political office on the basis of patronage, on the basis of nepotism, on the basis of special connections, because of bribes, and so on.“Even if you wanted a really small state, a night watchman state even, you need the courts to be not corrupt. One form of accountability is avoiding awarding political office on the basis of patronage, on the basis of nepotism, on the basis of special connections, because of bribes, and so on.”— Akiva MalametYou want a culture of meritocracy to exist so that you have a set of people in these agencies who are loyal to the agency and to upholding the rule of law and to upholding norms of impartiality rather than worrying about whether they're friends with their boss or whether their boss is friends with the president and so on. On this day in legal history, September 29, 1983, the War Powers Act was invoked for the first time – by President Ronald Reagan in order to keep a U.S. Marine presence in Lebanon.On September 29, 1983, the U.S. House of Representatives voted 270 to 161 to invoke the War Powers Act concerning the deployment of American Marines in Lebanon for an additional 18 months. The resolution had bipartisan support, including from President Reagan. This marked the first time the House invoked the War Powers Act, a law designed to limit the President's war-making powers, which was enacted a decade earlier. The Senate would go on to approve the resolution.President Reagan thanked the House for its bipartisan vote, emphasizing the importance of cooperation between the legislative and executive branches. However, the vote also revealed concerns among lawmakers about the U.S.'s role in the Middle East and the potential for the Marines to be drawn into a larger conflict. Some representatives warned that the resolution was tantamount to a declaration of war and could result in American casualties.The debate in the House was marked by a sense of urgency but also caution. Lawmakers were torn between the risks of pulling out and staying in Lebanon, with some describing it as a "very unhappy choice." Despite reservations, the prevailing sentiment was that Congress had to back the resolution to support the President during a crisis.The War Powers Act mandates that the President must notify Congress when American troops face combat and withdraw them within 60 to 90 days unless Congress authorizes their continued deployment. Interestingly, President Reagan had not made such a notification, but the compromise resolution asserted the Act's applicability, making Reagan the first President to acknowledge its validity. This failure to abide by the initial notification requirement, coupled with the later request for an extension, in full light of history, was a major step forward in placing the power to declare war in the office of the presidency.At the time, the Senate was also debating an amendment requiring more detailed reporting from the President on the Marines' mission in Lebanon. The House had rejected a similar amendment, which would have postponed a decision on the Marines' future for 60 more days. The debate touched on the balance of power between Congress and the President, the definition of success in Lebanon, and the long-term implications of U.S. involvement in the Middle East. In the ensuing 40 years, every president has either explicitly or tacitly leaned on the War Powers Act to substantiate action abroad. By way of brief background, the War Powers Resolution mandates that the U.S. President can only deploy armed forces abroad through a formal declaration of war by Congress, "statutory authorization," or in the event of a national emergency caused by an attack on the U.S. or its armed forces. The President must notify Congress within 48 hours of committing troops to military action and cannot keep them deployed for more than 60 days without an additional 30-day withdrawal period, unless Congress authorizes the use of military force or declares war. The resolution was enacted by a two-thirds majority in both the House and Senate, overriding President Richard Nixon's veto. Despite its provisions, allegations have been made that the resolution has been violated in the past, such as George W. Bush's invasion of Iraq in 2003 and Bill Clinton's involvement in the NATO bombing of Yugoslavia in 1999. While Congress has disapproved of these incidents, no successful legal actions have been taken against any President for such alleged violations.Suffolk University Law School in Boston has a significant impact on the Massachusetts legal landscape despite its lower ranking in national lists. As of 2021, the school is the leading source of judges in the state, contributing 118 out of 440 judges on the Massachusetts bench. Additionally, three of the seven justices on the state's highest court and Judge Gustavo Gelpí of the US Court of Appeals for the First Circuit are Suffolk alumni. High-profile roles in the state, such as the Secretary of State and Chief Public Defender, are also filled by Suffolk graduates.However, Suffolk Law ranks fifth in the Boston area and falls in the bottom third nationwide, according to U.S. News & World Report. Despite this, the school has a high retention rate for local graduates, which is crucial for Boston's legal market that faces competition from larger cities like New York and Washington, D.C. In 2022, 73% of Suffolk Law graduates took their first-year job in Massachusetts, a higher percentage than graduates from Boston University, Northeastern, and Boston College law schools.The school's strong presence in the state judiciary and public service sectors has created a cycle that attracts students interested in these fields. For example, state Sen. John Cronin chose Suffolk for its reputation in producing practice-oriented lawyers with distinguished careers in public service. The school's curriculum focuses on experiential programs, allowing students to gain real-world experience.Suffolk Law School also addresses a growing need in Boston's legal market by training scientists to become lawyers for biotech clients. The school offers a nighttime program in intellectual property law, attracting individuals with doctorates in science. Firms like Foley Hoag LLP and Foley & Lardner LLP have hired these specialists and sponsored their education at Suffolk's evening program.In summary, Suffolk University Law School plays a pivotal role in Massachusetts' legal ecosystem, particularly in the judiciary and public service sectors, despite its lower national ranking. Its strategic programs and high local graduate retention rate make it a cornerstone in the state's legal community. It stands as a clear example of the shortcomings and difficulties in trying to reduce a school's educational worth to a hierarchical ranking scale. Underdog Boston School Churns Out Judges, Big Law Partners (1)The IRS has released a plan outlining its operations in the event of a government shutdown, which appears increasingly likely if Congress fails to reach a funding agreement by October 1. The plan involves furloughing approximately 60,000 IRS employees, a change from last year's contingency plan. About one-third of the workforce will continue to work, funded by the Inflation Reduction Act, special compliance funding, and user fees. Essential functions like mail processing, criminal law enforcement, disaster relief transcript processing, and income verification for mortgage lenders will continue.However, the IRS will halt all audit functions, return examinations, non-automated collections, and will not answer taxpayer phone calls. Doreen Greenwald, President of the National Treasury Employees Union, expressed concern over the stress and financial insecurity that furloughed IRS workers would face. She also warned that a shutdown could exacerbate the agency's existing backlog by preventing new hires.Initial discussions had suggested that the IRS would remain fully operational by using funds from the Democrats' Inflation Reduction Act, which are not subject to annual appropriations and are available until September 2031. During the last government shutdown in 2018-2019, many IRS operations were halted, but tax refund checks would have been issued if the shutdown extended into tax-filing season. Eileen Sherr of the American Institute of CPAs advised taxpayers to use e-filing for error-free and direct-deposit refunds, as these will be the only ones processed during a shutdown.IRS to Partially Close, Furlough Staff in Federal Shutdown (2)A National Labor Relations Board (NLRB) judge has ruled that Starbucks violated federal labor law by increasing wages and benefits only for employees in non-unionized stores across the U.S. This marks the first nationwide ruling against Starbucks, which has been resisting a wave of unionization for the past two years. The judge, Mara-Louise Anzalone, stated that Starbucks engaged in a "corporate-wide effort to manipulate its employees' free choice" by tying their pay and benefits to their willingness to avoid organizing. The ruling orders Starbucks to compensate thousands of unionized workers who were unlawfully denied increased wages and benefits.This decision is significant as it is the first to find Starbucks in violation of labor laws on a nationwide scale, as opposed to previous rulings that were limited to individual stores. The unionization campaign against Starbucks has led to nearly 350 organized cafes in 37 states, and the NLRB has filed almost 100 complaints against the company. Of these, at least 75 are still pending.Starbucks has publicly denied any legal wrongdoing and argued that increasing pay for unionized workers would itself be illegal, as federal law prohibits unilateral changes to union workers' conditions. However, Judge Anzalone dismissed this argument, stating it wasn't made in good faith. She also ruled that Starbucks' actions illegally discouraged other workers from joining the union. While the judge did not order additional training for Starbucks managers on labor laws, she did mandate that the CEO read a notice of employee rights to U.S. workers and post it in every store.Starbucks Illegally Kept Wages, Benefits From Union Workers (1)The U.S. Patent and Trademark Office (PTO) has enough funds to continue operations for about three months in the event of a government shutdown. The agency plans to use its $1.04 billion operating reserves to cover patent and trademark expenses. The PTO is primarily self-funded through patent and trademark filing fees but still requires annual appropriations from Congress. In the past, the PTO has remained open during government shutdowns, including the 35-day shutdown from December 2018 to January 2019.However, some patent attorneys have expressed concerns about the PTO's long-term ability to function if appropriations are not made. The agency's financial stability during short-term shutdowns is a change from the past when Congress would divert part of the PTO's revenue to fund other government activities. Although a provision to prevent such diversion was removed from the America Invents Act of 2011, Congress has since committed not to divert PTO fees.Legal practitioners seem largely unconcerned about a potential shutdown affecting the PTO, as the agency has successfully weathered past shutdowns. The Patent Public Advisory Committee and PTO officials have planned for such contingencies by increasing the reserve fund. If a shutdown were to last beyond the reserve's capacity, most PTO employees would be furloughed, and the agency's regional offices would close.A prolonged shutdown could also affect the rulemaking process, including proposed changes to the Patent Trial and Appeal Board and requests for comment on artificial intelligence issues. Other agencies involved in the rulemaking process, like the Office of Information and Regulatory Affairs, could be impacted by furloughs. Finally, while the PTO would continue to collect fees, it would not be able to use those funds without congressional authority.Patent Office Has Funds to Stay Open Three Months Amid ShutdownThe U.S. Supreme Court is set to hear a case involving Zackey Rahimi, who argues that his Second Amendment rights were violated by a law preventing individuals under a domestic violence restraining order from owning firearms. This case could have broader implications for where guns can be carried, including in malls and parks. The court's decision will be its first opportunity to clarify its 2022 ruling in New York State Rifle & Pistol Ass'n v. Bruen, which has led to varying interpretations in lower courts.In Bruen, the Supreme Court established that the government must prove a law restricting gun access aligns with the nation's historical tradition of firearm regulation. However, this has led to inconsistent rulings, as judges lack clear guidance on how closely a modern law must resemble historical laws to pass constitutional muster. The ambiguity has particularly affected laws prohibiting gun possession in "sensitive places" like parks and libraries.Judges have been divided on what counts as a "sensitive place," leading to contrasting rulings. For example, a New Jersey judge ordered the state to stop enforcing provisions that prohibit gun possession in parks and libraries, while a similar challenge in New York received the opposite treatment. Legal experts anticipate that the Rahimi case could provide much-needed clarity on how to apply the Bruen test.If the court sides with Rahimi, it could have far-reaching implications for existing gun legislation, including laws about carrying firearms in "sensitive places." Roger Stone, a partisan Republican, and Gene Valentino compare the political past to the political future. Roger Stone predicts Trump will be the nominee.  He compares his firsthand relationship with Richard Nixon to his current relationship with Donald Trump.  He says Trump will be the beneficiary of a more open/honest election through effective oversight. How much of Trump's past experience in government will reflect the way he leads in the future?  Roger Stone capsulizes the inside truth about the John Durham report that there was an illegal use of the FISA warrants to spy of Donald Trump and staff. Roger describes that there were wire taps on his phone as well as Paul Manafort, and Carter Page, claiming they had ‘Russian collusion' communications.  He reflects on John F. Kennedy's presidential campaign against Richard Nixon.  “Had Nixon had the internet to launch counter offenses against Kennedy, he would have survived against Kennedy,” says Roger Stone.  Stone was also accused of Wikileaks communications with Julian Assange, which was not the case.  Evidence shows no such communication existed. Not only Donald Trump, but Roger Stone as well have questioned anomalies in the last 2020 election. Roger talks about the unsubstantiated accusations against Trump that led to the Trump indictments. Trump considers himself the sole reason Ron DeSantis became Governor.  Trump's support of DeSantis reinvigorated the doomed candidacy of DeSantis. For this reason, Roger says there's no chance Trump would entertain a Trump/DeSantis ticket. Roger wants DeSantis to focus on Florida's malaria epidemic and insurance crisis. On Biden's term of office, Roger thinks it's possible Biden will stay in office long enough to pardon himself and the others in the Biden Crime Family whether he's the Democratic nominee or not.  He believes Biden will enact the War Powers Act in order to avoid the next presidential election entirely, in order to postpone the next election indefinitely.  He says Trump will prevail across the board on all of these charges. Prof. Juni brings a fresh, though disorienting, skepticism about “self-evident” perspectives on good vs. evil, proposing that our world views are totally blinded by our own ideology. Our international prism thus lacks any relationship to reality. Dr. Juni advances his provocative point of view,based on interpersonal psychology, that our perceptions and judgments are secondary to our needs and agenda. Is Putin a patriot or a villain? Juniargues that our individual perspectives – whether you live in New York or in Moscow – have been programmed by sociocultural factors and lack objectivity. To hundreds of millions, Putin and Lincoln are Patriots. Both were presidents of colonial powers. Both defended their amalgamated states against secession. Both engaged in warfare and justified killings based on nationalist values. And both were vilified by those who saw things differently. Donning his Civil War Historian aficionado hat, R. Kivelevitz notes the uneven appreciation by Americans – and even among Republicans -- of Lincoln. While historian Harry Jaffa portrays Lincoln as the sagacious ultimate noble human being, he was decried by many as an unscrupulous dictator and tyrant who wantonly suspended habeas corpus, illegally invoked the War Powers Act, and usurped private property by freeing slaves. R. Kivelevitz drew the parallel between Korach and Putin, citing various rabbinic sources (including Zohar) which feature silver linings about Korach and his constituents. Noting that history is written by the winners, Juni muses, “What would the Chumash look like if Korach had prevailed?” Prof. Juni is one of the foremost research psychologists in the world today. He has published ground-breaking original research in seventy different peer reviewed journals and is cited continuously with respect by colleagues and experts in the field who have built on his theories and observations. Dr. Juni is a board member of the Association of Orthodox Jewish Scientists and has regularly presented addresses to captivated audiences. Associated with NYU since 1979, Juni has served as Director of PhD programs, all the while heading teams engaged in cutting-edge research. Professor Juni's scholarship on aberrant behavior across the cultural, ethnic, and religious spectrum is founded on psychometric methodology and based on a psychodynamic psychopathology perspective. He is arguably the preeminent expert in Differential Diagnostics, with each of his myriad studies entailing parallel efforts in theory construction and empirical data collection from normative and clinical populations. Prof. Juni brings a fresh, though disorienting, skepticism about “self-evident” perspectives on good vs. evil, proposing that our world views are totally blinded by our own ideology. Our international prism thus lacks any relationship to reality. Dr. Juni advances his provocative point of view,based on interpersonal psychology, that our perceptions and judgments are secondary to our needs and agenda. Is Putin a patriot or a villain? Juniargues that our individual perspectives – whether you live in New York or in Moscow – have been programmed by sociocultural factors and lack objectivity. To hundreds of millions, Putin and Lincoln are Patriots. Both were presidents of colonial powers. Both defended their amalgamated states against secession. Both engaged in warfare and justified killings based on nationalist values. And both were vilified by those who saw things differently. Donning his Civil War Historian aficionado hat, R. Kivelevitz notes the uneven appreciation by Americans – and even among Republicans -- of Lincoln. While historian Harry Jaffa portrays Lincoln as the sagacious ultimate noble human being, he was decried by many as an unscrupulous dictator and tyrant who wantonly suspended habeas corpus, illegally invoked the War Powers Act, and usurped private property by freeing slaves. R. Kivelevitz drew the parallel between Korach and Putin, citing various rabbinic sources (including Zohar) which feature silver linings about Korach and his constituents. Good morning, this is Toby Sumpter with your CrossPolitic news brief for Tuesday, January 7th, 2020. In response to the US killing of Iranian Terrorist Qasem Soleimani last Friday, the Iranian President Hassan Rouhani said that the US had committed a grave mistake. On the day of the attack, Iran's Foreign Minister Javid Zarif tweeted that the airstrike was an “act of international terrorism,” suggesting that General Soleimani had been the most effective force fighting ISIS and Al Qaeda. The Foreign Minister said the act was “extremely dangerous & a foolish escalation” adding that “the US bears responsibility for all consequences of its rogue adventurism.” “Soleimani was the international face of resistance,” Iran's Supreme Leader Ayatollah Ali Khamenei said in a statement, “and all lovers of resistance will be his avengers.” He added that “harsh retaliation is waiting.” Khamenei has ordered three days of public mourning, according to the AP.  The Daily Mail reports that on Saturday, Iranian General Gholamali Abuhamzeh, a Revolutionary Guards commander in the southern province of Kerman, threatened that Iran had itendified 35 targets for potential strikes and raised the red flags of revenge over every key mosque. Abuhamzeh said vital American targets in the region had been identified a 'long time ago', including ships in the Persian Gulf, the Strait of Hormuz and Tel Aviv. “The Strait of Hormuz is a vital point for the West and a large number of American destroyers and warships cross there … some 35 U.S. targets in the region as well as Tel Aviv are within our reach,” he said, according to Reuters. Trump responded on Sunday via Twitter: “Iran is talking very boldly about targeting certain USA assets as revenge for our ridding the world of their terrorist leader who had just killed an American, & badly wounded many others, not to mention all of the people he had killed over his lifetime, including recently.... ....hundreds of Iranian protesters. He was already attacking our Embassy, and preparing for additional hits in other locations. Iran has been nothing but problems for many years. Let this serve as a WARNING that if Iran strikes any Americans, or American assets, we have... ...targeted 52 Iranian sites (representing the 52 American hostages taken by Iran many years ago), some at a very high level & important to Iran & the Iranian culture, and those targets, and Iran itself, WILL BE HIT VERY FAST AND VERY HARD. The USA wants no more threats!” Many commentators pointed out that the threat to strike 52 cultural sites would seem to be a breach of international law. Others were also quick to say that this is the sort of international crisis they feared Trump would blunder into. But Trump continued on Twitter undeterred: Quoting a tweet from Texas Representative Dan Crenshaw who asked what is so controversial about there being repercussions for terrorists attacking the US, Trump said, “They attacked us, & we hit back. If they attack again, which I would strongly advise them not to do, we will hit them harder than they have ever been hit before! Trump followed up with two more tweets on the subject: “The United States just spent Two Trillion Dollars on Military Equipment. We are the biggest and by far the BEST in the World! If Iran attacks an American Base, or any American, we will be sending some of that brand new beautiful equipment their way...and without hesitation! These Media Posts will serve as notification to the United States Congress that should Iran strike any U.S. person or target, the United States will quickly & fully strike back, & perhaps in a disproportionate manner. Such legal notice is not required, but is given nevertheless!”  The US House Foreign Affairs Committee's Twitter account shot back, quoting this last tweet from the President, “This Media Post will serve as a reminder that war powers reside in the Congress under the United States Constitution. And that you should read the War Powers Act. And that you're not a dictator.” It seems that the House is suddenly interested in the constitution again…  On Sunday Iran announced that it is withdrawing from the 2015 nuclear deal. In exchange for economic sanctions being lifted, Iran had agreed to end all uranium enrichment programs for at least 15 years and submit to various inspections. However, last May, Trump had reinstated sanctions against Iran and states that trade with Iran, effectively ending America's participating in the deal. Iran responded by giving the other nuclear deal signatories 60 days to protect it from US sanctions, threatening to resume production of enriched uranium. Nuclear watchdog IAEA says that Iran has recommenced enriched uranium production. Trump responded to Iran's announcement on Sunday with all caps and an exclamation point: “Iran will never have a nuclear weapon!” Meanwhile the Iraqi Parliament passed a non-binding resolution asking US forces to leave the country, and Reuters reported Monday that the US Marine Corp Brigadier General William H. Seely III, the commanding general of Task Force Iraq had written a letter addressed to the Iraqi defense ministry's Combined Joint Operations Baghdad, stating, “Sir, in deference to the sovereignty of the Republic of Iraq, and as requested by the Iraqi Parliament and the Prime Minister, CJTF-OIR will be repositioning forces over the course of the coming days and weeks to prepare for onward movement… We respect your sovereign decision to order our departure.” [This letter was later repudiated by Defense Secretary Mark Esper, who insisted that the US has no plans to withdraw troops, according to Reuters. Trump also said such withdrawal would only be accompanied by severe sanctions.] Finally, on this topic, it's worth noting that a 1996 interview with Joe Biden captures him on a news program insisting strongly that if Iran every attacked a US facility it should be considered an act of war and that ANY retaliation would be warranted. Hmmm… We'll just let simmer for a bit and see if anyone notices. Probably not.  But speaking of fires, Australia continues to be ravaged by the worst wildfires seen in decades. CNN reports that dozens have died and more that 1300 houses have been destroyed, with over 14.7 million acres burned across six states, with 8.9 million of those acres in the hardest hit New South Wales. It's estimated that perhaps a third of the koalas in New South Wales may have been killed by the fires, which has caused some Hollywood elites to speak out in great alarm. But of course you can get more sympathy in Hollywood for koalas than you can for human babies, as evidenced by the applause and tears Actress Michelle Williams received at the Gold Globe Awards on Sunday night, when she announced that she had employed “a woman's right to choose,” implying that she had killed at least one of her children, so that she could pursue a career in acting.  But back to the Australian forest fires, higher than average temperatures, high winds, lightning strikes, arsonists, and the recent legalization of sodomite marriage in 2017 are all blamed by leading scientists. However, what you won't hear in the news is the fact that beginning the 1990s, Bob Carr's liberal Labor government began a massive forest lock-up program. Peter Austin writes at theland.com.au, “Before that "greening" frenzy began, soon after Carr came to office in 1995, national parks and reserves accounted for some 4.8 per cent of New South Wales. Today the total area of the state controlled by the National Parks and Wildlife Service is more than 9pc. In less than 20 years, therefore, the area of national parks and related reserves has virtually doubled, but the resources deployed to manage this vastly expanding empire have not doubled with it. On the contrary, it was revealed last week that even since 2011, successive budget cuts have resulted in the NPWS slashing its staffing of rangers by one-third, thereby impairing its capacity to conduct hazard reduction burns. But before Carr took over, much of the coastal bushland now locked up in national park was prudently managed state forest, where fuel loads were kept down by logging programs, regular thinning and cattle grazing.” Turns out that the GREEN Religion doesn't keep things Green at all. It just results in them turning black. And I'm not just talking about the United Methodist Church. This a lesson in government incompetence. But it's also a lesson in biblical jurisdictions. It is not the Civil Magistrate's job to managed forests. Incidentally, it's not the civil magistrate's job to fund the arts or media or news or education. God did not give those jobs to that office. Therefore, it is disobedience to God and inevitable tyranny for the State to assume those powers. Should Christians care about the environment? Of course. But we should care about it through private ownership of land, and private foundations and associations that will have skin in the game. Personal responsibility is key to success. Bureaucrats and committees cannot be expected to care that much about what doesn't actually belong to them. The other thing to note here is that God commanded mankind to take dominion of the earth and cultivate it. This means in part that the earth needs cultivating. We need godly foresters and loggers and conservationists who understand that just like man is not good all alone and needs a helper, so too, the land is not good all alone and needs gardeners. United States remains in a heightened threat environment fueled by several factors including an online environment filled with false or misleading narratives and conspiracy theories in other forms of miss this and mall information which they give an acronym of MDM right we are introduced and/or amplified by foreign and domestic threat actors who these threat actors seek to exacerbate societal friction to sow discord and to undermine the public trust in government institutions to encourage unrest which could potentially inspire acts of violence mass casualty attacks and other acts of targeted violence conducted by lone offenders in small groups acting in furtherance of ideological beliefs and or personal grievances pose an ongoing threat to the nation while the conditions underlying the heightened threat landscape have not significantly changed over the last year the convergence of the following factors has increased the volatility on predictability and complexity of the threat environment the proliferation or the proliferation of false or misleading narratives which sew discord or undermine public trust in US government institutions continued calls for violence directed at US critical infrastructure and soft targets and mass gatherings faith-based institutions such as certain churches synagogues mosques institutions of higher education racial and religious minorities government facilities and personnel including law enforcement and the military the media and perceived ideological opponents and caused by foreign terrorist organizations for attacks on the United States based on recent events so that was a bunch of words basically to say that they are now defining a terrorism threat as having different ideologies and ideological beliefs then our is literally horrifying horrifying that the what will be the ramifications of this what will they now be able to do now that they've put this bulletin on this was released a week ago what are you to be able to do now there going to be able to enact the patriot act for sure if the label you a terrorist because that's the patriot act is for so now because if you so disbelief by disagreeing with her a small conflict in Ukraine I would be highly concerned if I was in the military right now so I speak from the heart I could very well have been 18 right now join the military and been under Joe Biden and that seriously concerns me as as a father as a as a man a military aged man and a veteran mind you so I'm not just speaking on these things frivolously must begin on them because II have no experience with the military I was active duty in the military and because of that it concerns me even more and so to me you have to you have to keep the war machine turning because the second that you're not you're no longer in the conflict we have 800+ military bases across the country across the world I'm sorry don't be nuts if we have crossed the country 800 military bases in the world in many probably more than that if you include the ones that we don't talk about so how well do you think that business would do if they just said were done with more we think that we should be a peaceful nation and we think that we should not involve ourselves in the wars of countries that you know our citizens should not shed blood over how well do you think that was fair for a military as a business and how well you think that would fear for the trillion dollar industry of military-industrial complex corporations that are involved in the lobbying that got Joe Biden even put in the place invasion was in happened on Wednesday specifically called out as being on Wednesday and then backtracked almost immediately and there a lot of financial institutions and things plummeted as a result
