Stanford law professor Michele Dauber first came to prominence following the sentencing of Stanford student Brock Turner, who was convicted of sexually assaulting an unconscious woman. Turner received a sentence of just six months from Judge Aaron Persky, and Dauber subsequently led a voter initiative to remove Persky from the bench. Recently, she has launched the Enough Is Enough Voter Project, which is committed to making violence against women a voting issue by actively exposing lawmakers and candidates who have been credibly accused of sexual assault, harassment, or domestic violence, and then working to defeat them at the polls. Also, residents in the 8th congressional district may have recently seen billboards with the website, TheRealDinoRossi.com, on them, and wondered what that's all about. Both the billboards and the website are the work of members of Indivisible Washington's 8th district (and are funded by the Indivisible Project—not in conjunction with any candidate or candidate's committee). Brock Turner. January 18, 2015. Stanford, California. Two Swedish PhD students riding bicycles discover a young man on top of an unconscious woman between some dumpsters. They intervene and chase him down. Police arrested Brock Turner, who claimed to have had a consensual encounter with the woman he had been seen with. But an investigation finds that she was unconscious at the time and he is prosecuted. A jury agrees and finds him guilty of sexual assault. Both Brock Turner and the judge who sentenced him faced a public backlash after Turner was given a 6 month sentence. A recall effort is currently underway to get Judge Aaron Persky removed. But Brock and the judge also have their defenders. Did the judge act within the law? Was the sentence too lenient? What should we take away from this case?

In this episode of Aider & Abettor, Avi and Sajid are joined by retired Santa Clara County Superior Court Judge Ron Del Pozzo, someone who they both appeared in front of during their public defense careers before the Judge’s retirement. In the first segment (2:20), they all discuss the nuances of plea bargaining in criminal cases including the relative power of judges and prosecutors during the process. The conversation dovetailed into reflections on the interplay of bail, plea bargaining and outcomes for indigent people compared to the more affluent accused of crimes. They brainstorm ways to help level the playing field and to achieve more fair dispositions for all. In the second segment (42:30), Avi, Sajid and Judge Del Pozzo trade thoughts on the trial of Brock Turner, his sentence and the effort to recall Judge Aaron Persky. Judge Del Pozzo shares about what it was like to run for Judge against Persky, his thoughts about Turner’s sentence and his view of Perksy’s reputation on the bench. They question the prudence of the recall effort and discuss the recall’s potential consequences. Recently widespread outrage has erupted over the bias and leniency in court decisions involving rape and the general acceptance and prevalence of violence against women. In California, a judge's decision to give a white former Stanford University swimmer an unusually lenient six-month jail sentence for sexually assaulting an unconscious Stanford student sparked a campaign to have him removed after the victims stomach churning impact statement went viral. The outrage of women has succeed in forcing Judge Aaron Persky to give up his docket of criminal cases. This is just one of the many cases of sexual assault that women have been protesting in the media garnering widespread attention and also raising the issue of how race and class influences sexual assault decisions. Another incident which Black feminists have taken the lead in debating is the alleged sexual assault by actor and director Nate Parker 17 years ago, which came to the attention of the media after his recent remarks about the victims suicide while promoting his new film “Birth of Nation” about the 1831 slave rebellion led by Nat Turner, a film which had been destined for an Oscar. Today we talk about that case and how class and race intersect with issues of sexual assault with  African American Lesbian Feminist filmmaker and writer Aishah Shahidah Simmons.  Simmons directed the groundbreaking film “No! Angie probes the call for Judge Aaron Persky to step down or be removed, the unexpected reach and impact of the victim's statement, and the appropriate relationship between societal standards and the legal system.

In my professional career, I never thought I would see the day when people would be able to hide their crimes behind their stupidity and wallets. But it's happening right before our eyes, and I'm not so sure we can put this genie back in the proverbial bottle! Affluenza is a 'Coverup Crime' for rich snobs. affluenza - a psychological malaise supposedly affecting wealthy young people, symptoms of which include a lack of motivation, feelings of guilt, and a sense of isolation. As a legal or psychiatric term, “affluenza” has no standing. But there’s a growing body of research that “sometimes poor little rich kids really are poor little rich kids.” although former Stanford University student Brock Turner was convicted in March on three felony counts—assault with intent to commit rape of an intoxicated or unconscious person, sexual penetration of an intoxicated person, and sexual penetration of an unconscious person—it didn't end up being the justice his victim was hoping for. In total those charges carry a maximum ten-year sentence. Following impassioned pleas regarding Turner's character and his potential Olympic swimming career, now dashed, he was sentenced to six months in county jail. "A prison sentence would have a severe impact on him. I think he will not be a danger to others," Judge Aaron Persky said in his decision. In December 2013, State District Judge Jean Boyd sentenced a teenager from Texas, Ethan Couch to 10 years' probation for driving under the influence and killing (murdering) four pedestrians and injuring 11 after his attorneys successfully argued that the teen suffered from affluenza and needed rehabilitation, and not prison. The lawyers had argued that Couch was unable to understand the consequences of his actions because of his financial privilege. We are now starting to see this as not only a defense against light-way crimes like drunk driving and shop-lifting, but how about rape and murder! So now if you have a bulging wallet, you can also claim that you have a bulging ego that affords you all kinds of leeway to commit crimes. To say the least, I am a little hot on this one... as you'll see on the show today. My guest today, Author Clarissa Star Crystal-Belle, LMHC, takes on the toughest, neediest kids and families in her role as a therapist for troubled children.
