Welcome to episode 125 of the IPSERIES podcast, where we discuss the latest news and trends in the world of intellectual property. I'm your host and today we're going to talk about the top IP highlight for 2023. Intellectual property covers various types of creations such as inventions, artistic works, designs, trademarks, and trade secrets. Intellectual property rights grant the creators or owners of these creations the exclusive right to use, sell, license, or otherwise exploit them. However, intellectual property is not static, it evolves with the changing needs and challenges of society, technology, and the economy. In 2023, there were many developments and controversies in the IP field. So, what was the top IP highlight for 2023? Well, according to our survey, the most controversial topic was the issue of IP ownership from AI-generated content. Artificial intelligence (AI) is the ability of machines or software to perform tasks that normally require human intelligence, such as learning, reasoning, and creativity. AI has been advancing rapidly in recent years and has been applied to various domains, such as healthcare, education, entertainment, and of course, IP. AI can generate content that may qualify as intellectual property, such as music, art, literature, or even inventions. But who owns the IP rights to these AI-generated creations? Is it the human who designed, trained, or operated the AI system? Is it the AI system itself? Or is it no one at all? This complex and unresolved question has sparked a lot of debate and litigation in 2023. So, what's your opinion? Should AI be able to own IP rights? Or should IP rights be reserved for humans only? Or should there be a third option, such as a shared or collective ownership model? Please leave your thoughts and opinions by commenting via email at ipseriesinfo@gmail.com or by tweeting us at @ipseries. And don't forget to subscribe to my podcast for more IP insights and analysis. Thank you for listening, and see you next time on the IP Series podcast! The Authors Guild of America strike in 2023 is an ongoing labour dispute between the Writers Guild of America (WGA), a labour union that represents 11,500 authors, and the Alliance of Motion Picture and Television Producers (AMPTP), which started at 12:01 a.m. PDT on May 2, 2023. The primary points of contention in the strike are the residuals from streaming media, the size and length of authors' rooms, and the use of artificial intelligence in the writing process. The WGA asserts that AMPTP's portion of these residuals has significantly reduced the average wages of writers compared to a decade ago. Additionally, writers prefer that artificial intelligence, such as ChatGPT, be utilized to support rather than replace them in script development or research. In episode 101 of the #IPSERIES podcast, I invited Larry Zerner, a US Entertainment Lawyer, to discuss the ongoing WGA Strike, its effect on the film industry, and many more. Following the popularity of the term "ELLU P" which was birthed during the just concluded presidential election, it raises questions on the rights of an unregistered trademark owner who stands the risk of his mark being misused for commercial purposes, straying from its function as a trademark, losing its distinctiveness and Losing a trademark before (registration) you even begin using it for commercial purpose. In episode 94 of the IPSERIES podcast, I discuss the implication of a trademark becoming generic, the defense to a trademark infringement suit, intellectual property considerations for creatives who want to do merchandise, and the possibility of it becoming generic from being overused, among other things. The spring up of other products and collaboration between a Twitter user @leyeconnect who happens to be a designer and the originator of the phrase "ELLU P" inspired today's #IPSERIES post. An IP story involving the Independent National Electoral Commission (INEC) involving a lawsuit alleging patent infringement and the unlawful use of their long-time special contractor Bedding Holdings Ltd now that the first round of voting is over (BHL). In episode 93, I go over several topics, including how IP mechanisms like patents and industrial designs overlap, a central license, infringement of a patent and design, how protecting inventions with patents benefits inventors, how to prove a patent is being violated, what remedies are available, and much more. In episode 91, i was inspired to do a crash discussion on copyright basics following my attendance at the British Council's "Creative Hustle" seminar-style event, which took place in Port Harcourt, Rivers State, in collaboration with British Council Startups South and Women in Port Harcourt (WIP). I discuss how creatives can use online platforms to expand their businesses by employing intellectual property, the different eligible works and their bundle of exclusive rights, and how to make the most of their online presence and use it to their benefit. #StartupSouth #startups #art #creative #iam4art #innovation #business #collaboration #creativity #brandprotection #startupsouth #creativeentrepreneurs #ngbritisharts #networking #entrepreneurs LinkedIn version https://www.linkedin.com/posts/rita-anwiri-chindah-aciarb-aidr-3347b472_women-artists-using-intellectual-property-activity-7033099968458469376-jhkS?utm_source=share&utm_medium=member_android Twitter version https://twitter.com/ESMERALDOANWIRI/status/1627368515920445440?t=y3P_O2Gqlpo465HXcLSXDA&s=19 --- Send in a voice message: https://podcasters.spotify.com/pod/show/rita-chindah/message Support this podcast: https://podcasters.spotify.com/pod/show/rita-chindah/support
The innovation associated with a fashion brand is preserved via trademark and intellectual property mechanisms. An essential condition for trademark registration is distinctiveness. To steer them clear of the concerns with infringement and counterfeiting, the fashion firms' unflinching inventiveness is kind of a test. In episode 90 of the #IPSERIES podcast, I analyzed the role of a registrar, pertinent intellectual property rights, grounds for trademark invalidation application, trademark dilution, and many other factors in the case of Thom Browne's victory over Adidas over his four-stripe motif against the vase of Louis Vuitton losses the checkerboard patterns aka Damier Azur following a petition for invalidation by Mr. Norbert at the EUIPO. A copyright infringement case can have a variety of outcomes, depending on the specifics of the case. Generally speaking, a successful claimant may be entitled to monetary damages, injunctive relief, and/or attorneys' fees. The number of damages that a claimant may receive will depend on several factors including the number of profits that the infringer made from the infringement, the number of damages caused to the copyright holder, and the relative sophistication of the parties. A script or screenplay is a detailed expression of an idea, which enjoys copyright protection immediately after it is in a tangible format. It can be daunting when you send your script to a producer, agent, or anyone and they turn around to use it without your consent. The first episode of the #IPSERIES podcast for 2023 highlights the basics of copyright for screenwriters, pitfalls to avoid, benefits of intellectual property, the importance of a Non-Disclosure Agreement, and many more.
