Pravin Gordhan, who passed away this week, was a respected ANC Cabinet Minister renowned for his battle against state capture and his two terms as Finance Minister. Tributes have poured in, highlighting his pivotal role in strengthening the South African Revenue Service against state capture, with whistleblower Johann van Loggerenberg dubbing him a “superhero.” In the heady days of the nineties, following Nelson Mandela's release from prison and amidst the negotiations for a new Constitution at Kempton Park, Gordhan was entrusted to lead the Convention for a Democratic South Africa (CODESA) and the Transitional Executive Council (TEC), which set the stage for the country's first democratic elections in 1994. Working closely with Gordhan at that time was Theuns Eloff, who served as the head of administration for the multiparty negotiation process. Eloff described Gordhan in an interview with Biznews as a principled negotiator and facilitator who understood compromise in order to reach the best solution. “There were three individuals during the negotiations who, behind the scenes and not in the public limelight, really made the process work: Mac Maharaj, Fanie van der Merwe, and Pravin Gordhan.” Regarding the criticism levelled at Gordhan over his handling of state-owned enterprises, Eloff said that what he accomplished during the negotiations and as Finance Minister overshadows “any rightful criticisms one might have regarding his time at Public Enterprises.” He concluded that Gordhan's legacy is “largely positive.”

The recent attempted assassination attempt on a SARS advocate and the still unsolved assassinations of liquidator Cloete Murray and his son who who had done work for SARS have shone the spotlight on the threats faced by SARS for going after organised criminals for tax evasion. In this interview with BizNews, SARS whistleblower Johann van Loggerenberg details the threats faced by investigators during his time at the Revenue Service. “It's either I'm going to bribe you, and if I can't bribe you, I'm going to threaten you. And if I can't threaten you, I'm going to make sure that you lose your job. And if I can't do that, then I'm going to hurt you or someone close to you. If I can't do that, and/or, I'll get rid of the evidence. And if that won't work, I'll kill you. And if that won't work, well, we'll just disassemble all of you. “Recalling the “fall” of the then enforcement component at SARS, he says: “We not only made enemies amongst criminals, but we made enemies amongst politicians, influential business people, organised criminals, organised criminal syndicates, and even people who were behaving or misbehaving or behaving badly among our friends in the criminal justice system and the intelligence service…” Van Loggerenberg says this is not a war that the country can afford to lose, and details the measures needed to fight it effectively.

Episode 17 is with Lukas van Loggerneberg of Van Loggerenberg Wines based in Paarl, South Africa. Lukas is a gentle giant. He's a quiet, modest man who makes some of the country's best wines. That's by no means a stretch of the imagination, as he is a Tim Atkin first growth producer, a title reserved for the best 25 winemakers in all of South Africa. We're lucky enough to import his entire collection of wines, which includes a more premium range – wines like the Graft Syrah, Breton Cabernet Franc, and Kameraderie Chenin Blanc – and then your more every day wines in the ‘Break a Leg' Series – a Chardonnay, Cinsaut rosé, and Merlot. Lukas' wines reflect his character; they are quiet wines that don't brag or boast, and yet they are showstopping. His Breton Cabernet Franc should be the next wine you seek out if you haven't yet tried it. Anyway, wine wasn't really a part of Lukas' family history growing up in the Breedekloof Valley. He did grow up around vineyards, but those grapes were mostly being used for brandy production. He got his start at Elsenberg Agricultural School in Stellenbosch, and worked for other folks in South Africa and the US before going it alone. The decision to do so came during a trip to the Loire Valley with his college roommate, Reenen Borman of Boschkloof, and their wives. They were at Domaine de la Chevalerie, and the cork had just been pulled on a 1989 Cab Franc. Right then, smelling that beautiful Italian herb aroma from 15 feet away, Lukas knew he was going to resign from his job as soon as he got home. But, surely, in order to have the guts to do that, one needs to have some good experience under their belt. After graduating from Elsenberg, Lukas cut his teeth at a winery on the east coast of the US. As luck would have it, right before he was supposed to get on his flight, he broke two bones in his foot. Remember his "Break a Leg" wine series? There's a theme here - but we'll get to all that. If you are assuming, like I did, that Lukas went to work in the Finger Lakes, you'd be wrong. President Cyril Ramaphosa will not be summonsed to appear before the Section 194 Committee handling Public Protector Busisiwe Mkhwebane's impeachment. The committee made the decision after hearing a legal opinion on Tuesday. Mkhwebane's counsel, advocate Dali Mpofu SC, at the start of the impeachment hearings last month, said he would call Ramaphosa as a witness. Mkhwebane's attorneys subsequently wrote to Ramaphosa to invite him to testify before the committee, but the president declined. Thereafter, they wrote to the committee to ask that it subpoena Ramaphosa. According to the legal opinion received from parliamentary legal advisor, Fatima Ebrahim, only witnesses whose testimony will be relevant to the committee's work can be called – which is to determine whether Mkhwebane misconducted herself or is incompetent. Several African National Congress MPs said they did not see the relevance of calling Ramaphosa as a witness. Freedom Front Plus MP Corné Mulder concurred. GOOD MP Brett Herron suggested that Mkhwebane provide the committee with a substantive motion on why Ramaphosa should be called. Ebrahim said they already had such an opportunity, and she "struggled to unpack" what the request was about. She was concerned about opening a dialogue about the matter. "Members have spoken; we are not asking the chair to subpoena the president," said committee chairperson, Qubudile Dyantyi. The committee also decided not to recall former South African Revenue Service executives Johann van Loggerenberg and Ivan Pillay as witnesses. The hearings will resume on Wednesday, with Public Protector human resources manager, Gumbi Tyelele, set to testify.

An Israeli watertech company, Blue Green Technologies, cleaned up the Setumo Dam in the North West Province on the Molopo River of the contaminated toxic algae blooms making its water unsafe to drink. It was basically a dead aquatic zone. Michael Avery speaks to Johann van Loggerenberg, about his fourth book, Cop Under Cover. In it Van Loggerenberg describes his life with killers, drug lords and corrupt officials in vivid detail. This portrait of the criminal underworld also reveals the price he had to pay to lead a double life and how the struggle between the old and the new guard in the police continued for many years into the new democracy.
In the early 1990s, the police established the Organised Crime Intelligence Unit (OCIU) to investigate organised crime. This move gave detectives access to secret funding, safe houses, as well as agent and informant handling systems. A young Johann van Loggerenberg, who had just completed his national service in the police instead of the army, was approached to become a long-term deep cover agent for this unit. As agent RS536, he took on the guise of a drug smuggler in the Durban underworld and slowly infiltrated different crime syndicates. His transformation was so complete that within a few years he became one of the top five most wanted individuals in KwaZulu-Natal. At the same time, the information he supplied to the OCIU led to several contraband busts and criminal convictions. But then his cover came under threat. As a young policeman, Van Loggerenberg was given documents containing information on so-called third force activities - where Military Intelligence and the Security Branch supplied weapons to the Inkatha Freedom Party - which he shared with the Goldstone Commission. Disaster threatened when former members of the Security Branch, who had since joined the OCIU, got wind of this and accused him of being a spy. They threatened to discredit him to protect the old guard. Michael Avery speaks to Johann van Loggerenberg, about his fourth book, Cop Under Cover. For our 49th episode we are joined by the superstar Anton van Loggerenberg who went one step further than the likes of Graeme Smith and Cesc Fabregas, by not only playing injured, but starring in a title win. ***NB*** We are in the middle of a government enforced lockdown here in South Africa where the sale and movement of wine is, at least for now, forbidden. So to keep ourselves busy we have decided to release a new podcast episode every day during lockdown. Today on the podcast we have Lukas van Loggerenberg, winemaker and owner of Van Loggerenberg Wines – a wine brand based in Stellenbosch which, with a few others like Reenen Borman and Mick and Jeanine Craven, has been leading a renaissance in that region over the last 4-5 years. Previous to the emergence this group (and others) a lot of the international attention South African wine was getting was focussed on the Swartland (think Sadie Family, David and Nadia, Mullineux, Badenhorst et al.) and the Overberg (think Alheit, Crystallum). I am painting with very broad brushstrokes, but the traditional centre of premium grape growing and winemaking, Stellenbosch, was more or less left in the shade of the other two regions. In 2020 Van Loggerenberg moved the winemaking duties off the Fransmanskraal farm in the Devon Valley to a much more well-equipped and bigger facility just down the mountain from the Taal Monument in Paarl. Lukas has immense passion for the Loire Valley varietal duo of Chenin Blanc and Cabernet Franc. Yet both his Cinsaut and Syrah wines are universally agreed to be among the best currently being produced in South Africa. He is a truly exciting producer. We chat about his journey in creating Van Loggerenberg wines and he talks us through each of his 2019 wines. Also a quick note on the quality of the audio – as we are in lockdown at the moment in South Africa and we are relying on the internet to record these podcasts, and it doesn’t always behave. The case against three former SARS officials has been postponed until June this year. They appeared in the Pretoria Magistrates Court today on charges of corruption and contravention of the RICA Act. These relate to the so-called rogue unit at the revenue service which was alleged to have taken part in illegal spying. Ivan Pillay, Johann van Loggerenberg and Andries van Rensburg were served with summonses last week.
Two former employees of the South African Revenue Services (SARS) have teamed up in writing a book that allegedly exposes a "rogue unit" operating within SARS. The book , titled Rogue: The Inside Story of SARS's Elite Crime-busting Unit is the work of Johann van Loggerenberg‚ with Adrian Lackay.
