During ContractsCon 2023, Foster Sayers joined Mike Whelan to discuss OpenAI's Terms of Service and their application to ChatGPT. According to Sayers, the terms of service may have applied well to the users of OpenAI's API connections, but perhaps not everyday consumers. Now that ChatGPT is explicitly targeting consumers, should their terms change? Review the contract here: https://web.archive.org/web/20230228014736/https://openai.com/policies/terms-of-use

In this episode, Sarah interviews Mike Whelan, the author of Lawyer Forward. They chat about his work helping solo attorneys, breaking out of the task-oriented law world, and moving towards a system that allows people to thrive and succeed. You'll hear about his experience starting law school in his 30s right as the recession hit and find out how that impacted his choice to start his own firm after graduation. It's a fascinating conversation that focuses on the idea that your job is not your identity and how lawyers can use their strengths to find a fulfilling career path. Let's jump in! We're on a brief break while we gear up for Season 2 of FSC, but we still want to give you something to think about (or revisit) in the mean time, especially if you missed it the first time around. Mike Whelan sat with us to discuss expert status, what it can mean to you, and how to market it. ----- We know that attorneys are respected (and paid) for having knowledge of the law. But as a lawyer, you have a defining choice to make: create your market value as either an exceptional technical expert or as an accessible relationship builder. Today, we focus on the former choice, and how to make sure folks *know* you're the expert. Lawyer Forward's Mike Whelan joins us once again to unpack the various, often contradictory, ideas about being an expert that we as lawyers are constantly being told. We discuss where to draw your lines, where to focus your time and effort, the VORL (Value Over Replacement Lawyer) model, and ways to focus your expertise into products. Being so weird, so unique, so nerdy, and so “you” CAN actually be the foundation of your business plan. Jared talks with Mike Whelan about the ins and outs of using personality-driven content creation to grow your law firm. Worried that you don't have a personality? Well, don't worry–you do! Mike offers tons of insights on recognizing your strengths, translating them into content ideas, and using them to “be yourself out loud.” Later, the Rump Roast returns! In yet another questionable, made-up trivia game—”Bag of Dicks”—Jared quizzes Mike on a variety of “Dicks” throughout history, sports, pop culture, and more. In Jared's opinion, a perfect album not only contains no bad songs, but also encapsulates the time period in which it was created. So, perfect album number two is – Snoop Dogg's “Doggystyle” of 1993. Jared talks us through what he considers to be the greatest rap album of all time, with Snoop Dogg's musical genius on full display in its adroit illustration of the early 90s west coast scene. Mike Whelan, Jr. is an attorney, author, and CEO at Lawyer Forward, a community of attorneys looking for practical ways to advance their practices. ----- Don't you dare stop at just 'Doggystyle'. Check out these classic 90's rap tunes we've put together for you. ----- Our opening track is Two Cigarettes by Major Label Interest. The music for the Legal Trends Report Minute is I See You by Sounds Like Sander. Our closing track is Space Money by Ghost Beatz.

Why do we attend legal conferences? What makes a great conference? Where do we find the most value? How can we make the most of legal conferences and how do we make the mediocre ones better? After a couple recent conferences, I got to talking with friend of the show, Mike Whelan, about what makes bad conferences bad, and makes great conferences great. We all know that designed learning sessions can sometimes be a waste, and the current CLE system is pretty broken. Sometimes it's hard to even remember why you're at a conference in the first place! But networking and community are still a huge value source from conferences, especially post-pandemic lockdown. Making and strengthening your connections, gaining knowledge, and learning together with colleagues makes the shared experience even more valuable. Mike and I discuss how and why conferences are succeeding and failing, and what organizers and attendees can do to ensure all the effort is worthwhile. “put forward with such a quiet air of mastery” [STOC] As regular readers and listeners know, Michael F. Whelan, BSI ("Wiggins") passed away in October of 2021. His contribution to the Sherlockian game was more than any one person could adequately describe. To honor his memory, we gathered a number of Baker Street Irregulars to remember Mike beyond his Sherlockian self — people who knew him well and could comment on his interests, his personality, and his character. These were: Peter Blau, Ross Davies, Steven Doyle, Les Klinger, Hartley Nathan, Otto Penzler, and Steve Rothman. We hope you can appreciate the man Mike Whelan was, what he did for the Sherlockian community, and the kind of leadership he represented.
