Calls to take down abusive and harassing content is often met with apathy from the largest tech companies. As victims of this online abuse can’t wait for law enforcement to act, social platforms must step up to remove this harmful content and step out from behind Section 230’s liability shield. In Non-Compliant Podcast Episode 32, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Carrie Goldberg, Founder of C.A. Goldberg Victims’ Rights Law Firm and author of Nobody’s Victim, discuss sexual harassment and abuse on the internet, the problems with Section 230, and why Big Tech companies need to do more to stop online predators To start the show, Carrie dives into her work to protect people who face cataclysmic online abuse, including revenge porn, cyber-stalking, sextortion, and the lasting impacts of child pornography (2:30). Carrie explains that the bulk of the harm her clients face happens on major social media platforms like Facebook, Instagram, and Snapchat, which do little to prevent these abusive actions—often ignoring requests to take down damaging content (5:30). Next, Jay and Carrie discuss how tech companies face limited accountability for ignoring requests to remove harassing content under Section 230’s liability shield (7:30). Through the lens of one of Carrie’s cases against Grindr, she explains that the provision is getting attorneys to seek other legal theories, such as product liability, to force tech companies to take down abusive content that can ruin people’s lives (12:30). Jay and Carrie continue their discussion on Section 230 as they pivot to the power dynamics of Big Tech’s stranglehold of Congress and the courts that has cemented the online liability shield (20:00). Even with a flurry of bills to reform Section 230, Big Tech’s power to influence the debate will limit any short-term changes to the law (21:00). But the public’s shift in their views of tech companies is likely to lead judges and lawmakers to make important long-term changes to the liability shield. Later in the show, Jay and Carrie chat about the difficulties to stop online sexual harassment (30:00). Often, local law enforcement act too slow to stop abusers due to limited resources and the inability to force tech companies to remove content. Outside of the criminal justice system, abusers are often judgment proof which gives little to no value in pursuing civil claims (34:00). As Carrie explains, it is often crueler to victims to have them go through lengthy court proceedings with their abusers when the outcome is unlikely to stop the harassment. To wrap the show, Carrie explains that her experiences with revenge porn and online abuse led her to launch her own victims’ rights firm and to become a leader in the field (40:45). Carrie saw that there weren’t attorneys that had expertise dealing with all aspects of digital abuse cases and has made it her mission to protect online harassment victims that need someone in their corner fighting the fight against Big Tech’s inaction. And congratulations on your new show. Thank you. Thank you. Thank you for even being interested in talking to us I was so excited when I got the call that I was going to be able to talk to you all because I'd already seen you posted on your Instagram. Post the preview and I was like oh my god, this is gonna be good. ...shenanigans shenanigans. I hope we live up to the teasers that they've been able to put out so we're doing our best. Yeah, they made us look funnier than we may. you're gonna live up to it. Well, I like to start every interview by asking What is something that you're grateful for? A great way to start an interview, okay. I'm praying I'm Amen. I am grateful for Believe it or not the year 2020 Hmm, I'm grateful for the way in which it has made America the world, pay attention to things that matter. Um, it's very easy to be like 2020 is perfect vision but I feel no one can hide any longer under the guise of being a good person or being a part of a movement that they really aren't a part of. I think although I think that we are removing all the the disingenuous people out of society and we're seeing who people are for who in their true state admit to me, I'd rather know what I'm dealing with and not so for me, grateful for that education. No matter how painful it's been, no matter how hard it's been. I am grateful for that education. This year has been beautiful for me professionally. I walked away and jumped off the ledge of ESPN and decided to trust myself and bet on myself. And it has paid dividends huge. And so this year has been nothing but great for me. I know it sounds horrible to say, but really just looking at it from a big picture, I just see that in society, we have to be at a better place. And we're exposing all of these fakes. And we are letting people who have authentic voices and real true good hearts push through and be elevated. And that's what we need. I think I'm grateful for the season. I mean, because more than I guess, the year because it could be beyond just 2020. I'm grateful for this season in life. You know, I think a lot of black women in particular are stepping into their power. I think we're reflective of being to black women who are stepping into theirs. As Carrie mentioned, she not to me, it feels like you left ESPN like years ago, and it's only been a few months. Yeah. And she got all the jobs, all the jobs, all the jobs, right. So there's something really significant about what she said about betting on yourself. I've been in this season now, since I left ESPN and I left in 2018, where I've just taken all these different chances and risks, and really been very vigilant about not compromising who I am to have work and been very thankful that I don't have to do that, too, in order to work and work abundantly in this business. And so I think that's a big reason why we're at this point right now with this with this show is like we both did the same thing, and that we both bet on ourselves. Big news folks. Not only do we have Carrie back on to help us with this episode, but we have another super special guest as well. The author joined our crazy trio of talkers to answer some questions. Welcome to our show, Julianna Jones! The daughter of Weezie Simonson and the writer of a few Power Pack comics, Julianna provided us with some great behind the scenes information about how she came up with her stories, and how she ended up writing Power Pack comics. I promise you, we behaved while we were speaking to her and we did not hit any shuttlecocks at her head. This is the point where I talk about the pictures we have chosen and included, and somehow tie them into a non sequitur conversation. So here we go. First, after our guest joined us, Jeff dumped a plate of food on his head. As Carrie and I started to yell at Jeff, that silly boy ran off...making a mess as he went. Then Jeff took off his pants. After that, things got really crazy. Somehow, Jeff inverted gravity. We are really not sure how he did this. It was everything that Carrie and I could do to make sure Julianna did not leave. We even had to promise to clean her house. Of course, that was after Jeff started to walk on her walls...ARGHH!  At least Jeff did not throw anything at Julianna....that would have been the final straw. Take a look at the labels on food packages near you or in your kitchen. What do you see? These food labels can confusing, leading to misinformation and often guilty feelings that we're not doing the right thing for ourselves and our family. How do we filter through the marketing to understand what labels have true meaning? How can and should the agriculture community join in to clear the air on these topics? When Carrie and I sat down for this episode of the podcast, there were two label terms that were top of mind for us. Antibiotics and Hormones. Both things that spark emotion in us with the concern of these contaminants being in our food supply. Is it safe to eat? Is there reason for those labels to be there at all when we know there are regulations and inspection procedures in place to ensure food safety? We've both written about these topics before as restaurant chains have capitalized on labeling trends. But we also recognize the fact that this is marketing. And in some ways, agriculture advocates may have contributed to the hysteria and concern surrounding food labels, including Non-GMO Project, or any number of free-from labeling trends. We really shouldn't blame consumers for asking questions and being confused. There are so many options in the market today. As Carrie describes, her local grocery store is putting in a new section of coolers to be stocked solely with dairy options. Be sure to stay tuned as we describe some terms we've used that we now realize could be misinterpreted (cows on drug withdrawls?!?) and offer a few key tactics advocates can use to better engage in these discussions with others. My guest for The Happy Hour # 186 is Carrie Rozema. Carrie is co-author of 'The Least of These', a personal testimony of the redemptive power of Christ in the face of her husband's heroin addiction.  Carrie and her husband Neal share their personal testimonies in hopes of bringing insight and freedom to those held captive by drug abuse and incarceration. In today's episode, Carrie says "God is in the business of redeeming broken people", and throughout our conversation today, I know you'll hear so many examples of how God will pursue us no matter what the circumstances. Carrie begins by sharing how God rescued her from an unsafe marriage, and how she came to know God through His Word. As Carrie was healing and growing more in her faith, in walks Neal - the exact opposite "type" of man Carrie thought God would pick for her. You guys, she even told him on the first date that she wasn't the girl he was looking for. Carries describes how a few months into the relationship, he admitted he was on parole. She tells us how she finally learned the truth about his heroin addiction when he was sent to prison. She first told Neal to lose her number, but instead throughout Neal's years in prison, God continually pursued both of them, and they ended up married just ten days after Neal was released. At the end of our conversation, Carrie gives a convicting challenge to the church: she encourages us to step out and welcome people who come from hard situations such as abuse, addiction, or prison.  I loved how she said even if it seems messy or hard, we should "roll out the red carpet". {You can listen to the show HERE. And of course, I would love if you would share with your friends. Carrie’s artwork depicts the traditional icons of the Western landscape with a thoroughly modern twist using vibrant colors and fluid forms.  Her work is free spirited – her paintings and designs offer a sophisticated, yet fresh, style that appeals to the maverick within each of us – and certainly within me!
