Barr, the 77th and 85th United States attorney general under George H. W. Bush and Donald Trump, allowed politics to play a role in individual prosecutions. According to Elie, Barr was a political animal first (which is why he crossed so many lines) and viewed himself as Trump's personal lawyer— using the DOJ to go after Trump's political enemies (or perceived political enemies), protecting Trump's political cronies, etc.Later in the show, Jay and Elie discuss Barr's confirmation process, and where the Justice Department is now. According to Elie, there was a palpable sigh of relief with Bill Barr left office, and the Trump administration moved on. In Non-Compliant Episode 34, Host Jay Edelson, nationally recognized plaintiff's attorney and Founder of Edelson PC, is joined by Professor Carolyn Shapiro, the founder and co-director of Chicago-Kent's Institute on the Supreme Court of the United States (ISCOTUS).To start the show, Jay and Carolyn discuss the monumental decisions to come out of the most recent Supreme Court Session. According to Carolyn, the Chief Justices relied on their hallmark move— making decisions that do not appear to be earth shattering, but contain the seeds for significant applications and legal changes (4:20).Next, Jay and Carolyn discuss the confirmation process (14:30). For Jay, confirmation hearings seem inconsequential, as nominees know the questions they're going to be asked, and the correct way to answer them. Because of this, it's hard to determine a candidate's actual judicial philosophy.Later in the show, the extreme significance of the Supreme Court's decisions on average Americans is discussed (31:00). Professor Shapiro notes that she was particularly upset about the voting rights decision that came down at the end of the term, which essentially re-wrote the voting rights act to make it extraordinarily difficult to challenge voting restrictions that benefit Republicans and hurt Democrats (31:30).To end the show, Jay and Carolyn discuss TransUnion, which looks at Article III standing (38:00). According to Carolyn, TransUnion is notable for two reasons: (1) it makes it harder to establish a class in a case, and (2) it expands court's authority at the expense of Congress (40:00). For the first time in the NBA's history, racial justice issues were openly discussed, and players had the opportunity to express themselves by adding phrases, including Black Lives Matter, to their jerseys.Next, Jay and Sam dive into how far NBA athletes have come since Charles Barkley announced he was not a role model, and that he was not paid to be a role model (10:50). Today, many athletes (like Lebron James) use their platform to speak out on political and social justice issues.Later in the show, Jay and Sam talk about getting players to smaller market teams (42:35). According to Jay, the NBA could have a single slot for a super max contract, where players are eligible to get 50% more than they usually could by playing for a smaller market, which wouldn't be counted against the salary cap (43:00). Jay also argues that teams should be penalized for picking up free agents on the cheap (43:35).To end the show, the two podcast hosts talk about Jay's first love— The Boston Celtics (46:40).If you liked the show, please subscribe, and leave a review. Calls to take down abusive and harassing content is often met with apathy from the largest tech companies. As victims of this online abuse can’t wait for law enforcement to act, social platforms must step up to remove this harmful content and step out from behind Section 230’s liability shield. In Non-Compliant Podcast Episode 32, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Carrie Goldberg, Founder of C.A. Goldberg Victims’ Rights Law Firm and author of Nobody’s Victim, discuss sexual harassment and abuse on the internet, the problems with Section 230, and why Big Tech companies need to do more to stop online predators To start the show, Carrie dives into her work to protect people who face cataclysmic online abuse, including revenge porn, cyber-stalking, sextortion, and the lasting impacts of child pornography (2:30). Carrie explains that the bulk of the harm her clients face happens on major social media platforms like Facebook, Instagram, and Snapchat, which do little to prevent these abusive actions—often ignoring requests to take down damaging content (5:30). Next, Jay and Carrie discuss how tech companies face limited accountability for ignoring requests to remove harassing content under Section 230’s liability shield (7:30). Through the lens of one of Carrie’s cases against Grindr, she explains that the provision is getting attorneys to seek other legal theories, such as product liability, to force tech companies to take down abusive content that can ruin people’s lives (12:30). Jay and Carrie continue their discussion on Section 230 as they pivot to the power dynamics of Big Tech’s stranglehold of Congress and the courts that has cemented the online liability shield (20:00). Even with a flurry of bills to reform Section 230, Big Tech’s power to influence the debate will limit any short-term changes to the law (21:00). But the public’s shift in their views of tech companies is likely to lead judges and lawmakers to make important long-term changes to the liability shield. Later in the show, Jay and Carrie chat about the difficulties to stop online sexual harassment (30:00). Often, local law enforcement act too slow to stop abusers due to limited resources and the inability to force tech companies to remove content. Outside of the criminal justice system, abusers are often judgment proof which gives little to no value in pursuing civil claims (34:00). As Carrie explains, it is often crueler to victims to have them go through lengthy court proceedings with their abusers when the outcome is unlikely to stop the harassment. To wrap the show, Carrie explains that her experiences with revenge porn and online abuse led her to launch her own victims’ rights firm and to become a leader in the field (40:45). Carrie saw that there weren’t attorneys that had expertise dealing with all aspects of digital abuse cases and has made it her mission to protect online harassment victims that need someone in their corner fighting the fight against Big Tech’s inaction. Check out the show to hear more about Section 230, why privacy is not dead (48:50), and a preview of cases Carrie is bringing next (51:33). The nostalgia of the 80’s and 90’s is a driving force of our pop-culture today. With the rise of streaming services like Netflix and thrilling documentaries like HBO Max’s Class Action Park, it is now easier than ever to get a glimpse into that era and make us push the limits of our recollections of the past. In Non-Compliant Podcast Episode 31, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Seth Porges, Co-Director of hit HBO Max documentary Class Action Park, discuss the murky areas of nostalgia, the wild story of Action Park, the rise of streaming services, and the process of making a documentary. To start the show, Jay and Seth get nostalgic and talk about how 80’s and 90’s culture that has shaped who we are today (4:15). It is fascinating to see the transformation of kids that were often left alone to push their limits in that era, as they turn into the helicopter parents today that are hyper-focused on their children’s activities. Next, Jay and Seth delve into the wild true story behind Class Action Park and how its chaotic atmosphere made life-long memories for anyone that experienced its glory (10:05). While such a park doesn’t exist today, the documentary gives viewers a chance to ask themselves how they would respond to the anarchy and chaos (12:23). On a broader scale, Class Action Park also gets viewers to revisit their own experiences of growing up in the 80’s or 90’s in an era with more freedom (14:30).Later in the show, Jay and Seth discuss the growing popularity of documentaries that have evolved from Ken Burns-style informational shows to the wild-romps like Class Action Park (25:04). The rise of streaming services like Netflix, Hulu, and HBO Max have allowed for more viewers to access documentaries for the first time, especially during the pandemic (27:36). But the uptick in popularity is also due to the differing style of documentaries we see today that force us to take a fresh look at reality (29:00). To wrap the show, Jay and Seth break down the process of making a documentary and how Class Action Park went from concept to one of the most popular HBO Max movies (30:50). Even with multiple streaming services, filmmakers must put in a lot of work to get attention for their projects to reach wider audiences through promotions and word of mouth. But at the end of the day, documentaries and movies will capture the most audiences if they are authentic and feel like they come from people with a passion for the underlying narrative (38:00). The legal profession is going through a period of disruption that is leading some firms to think creatively by bringing in non-lawyer executives and consultants to run their day-to-day operations. The vision of seasoned business executives can help many firms take it to the next level, while allowing lawyers to focus on what matters the most: practicing the law and getting significant results for their clients. In Non-Compliant Podcast Episode 30, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Sara O’Reilly, Chief Executive Officer at HMB Legal, discuss what it’s like running a law firm as a non-lawyer, why firm’s need to professionalize their business operations, and why diversity is imperative to the long-term success of the legal industry. To start the show, Jay and Sara discuss recent efforts by forward-thinking law firms to bring in non-lawyer executives to oversee their business operations and usher in professionalization across all functions (3:20). To be successful in the legal profession, executives need to appreciate the history, talent, and culture of law firms so they can successfully implement long-term strategies (6:30). Next, Jay and Sara dive into the best ways to take law firms to the next level (10:40). Law firms, under the charge of seasoned executives and consultants, should approach their business operations with long-term strategies that work within the firm’s ecosystem (15:30). A key way to usher in these long-term changes is to spend considerable time and resources to train the next class of attorneys, staff, and future legal executives (30:00). Later in the show, Jay and Sara delve into why diversity should be a top priority for law firms—not only to better the legal profession, but also to bring in new voices to the practice of law (35:20). Firms must not take the approach that diversity is a numbers game, rather they must take a more holistic approach, including by recalibrating where they recruit summer associates and by exploring new ways to reach diverse candidates (36:44). To wrap the show, Jay and Sara discuss the recent trend of states opening up non-lawyer ownership of law firms and what the industry could look like over the next 5 to 10 years. (42:25). Such ownership and control, Jay and Sara explain, allows for a new type of thinking and increased competition within the legal profession that would further increase diversity of thought across the board.Check out the show to hear more about how firms benefit by bringing in non-lawyer executives (8:00) and why firms need a five-year plan to be successful (17:30). This is the audio-only version of DEVICE LOVE Live! #29, originally recorded February 25, 2021. There has been plenty of discussion regarding what "good enough" means with respect to compliance to the MDR and IVDR. There are many new requirements, and the EU is enforcing much stricter interpretations of requirements that existed under the Directives. A recurring theme is that there will be no “grandfathering” for legacy devices, which means that in some cases significant technical documentation remediation may be required (with similarly significant associated costs). There is also a more explicit emphasis on PMS, PMCF, and continual updates of related documentation. At the same time, the MDR requires much greater transparency of information, as evidenced by requirements such as SSCP, and this will require public disclosure of evidence that manufacturers may previously have considered confidential. As a result, manufactures may choose to "test the waters" first by submitting technical documentation that pushes the boundaries of what may be perceived to be acceptable. However, does this really save manufacturers money in the long run? You may be surprised to learn from our former notified body leaders and regulatory experts how much this strategy really costs you. The SolarWinds attack reminded everyone that the U.S. government, major corporations, and small businesses can all fall victim to sophisticated supply chain attacks. What went wrong and how can we limit the impact of the next attack? In Non-Compliant Podcast Episode 29, Host Jay Edelson, nationally recognized plaintiff’s attorney and founder of Edelson PC, and Guest Shawn Davis, the firm’s Director of Digital Forensics and leader of the firm’s tech investigations team, discuss the SolarWinds hack, vendor cybersecurity, geopolitical fall-out of cyberattacks, and what everyday companies can do to up their information security game. To start the show, Jay and Shawn breakdown the wide-scale SolarWinds hack that targeted major government institutions, Fortune 500 companies, and many other businesses throughout industry (4:05). The attack shows that even well-regarded vendors like SolarWinds are prone to nation-state cyberattacks due to the wealth of highly sensitive information and access their customers hold (7:25). Jay and Shawn continue their discussion on SolarWinds and why the attack highlights the potential dangers and risks of trusting third-party vendors (8:58). Shawn explains how the hack worked and how the attackers launched a broader attack through the Solarwinds updates, but then targeted specific valuable targets like Microsoft and the Department of Homeland Security for further compromise. Next, Jay and Shawn turn their discussion to the difficulties of attributing a cyberattack to a nation-state or any threat actor (12:00). Shawn explains that sophisticated nation-state attackers can easily mimic where the attack is coming from and often are familiar with the coding and hacking styles of other foreign adversaries. Shawn further divulges that human intelligence can be one of the best ways to figure out who is behind a foreign cyberattack. Later in the show, Jay and Shawn delve into why nation-state cyberattacks have the possibility of escalating into physical attacks that can disrupt the core of our national infrastructure (22:45). Jay and Shawn discuss that if such an attack happened, countries could escalate the situation to full-out kinetic warfare (26:20). That’s why many nation-states limit cyber-activities to gathering intelligence, steal trade secrets, and influence elections. To wrap the show, Jay and Shawn discuss why physical security – such as protecting laptops– is just as important as limiting online threats (31:35). The human element is important as many in the C-Suite often don’t follow the rules they set out for their own companies (34:45). Shawn further shares his best practices for any company trying to limit cyberattacks and why information security should always remain top-of-mind (37:35). From Lebron James to Barack Obama, confidence plays an important role in success. But there is a fine line between taking calculated risks based on your skills and ignoring the high-chance of failure that comes with every venture. That is why people must appreciate their level of confidence to better approach business decisions, negations, and the hiring process. In Non-Compliant Podcast Episode 28, Host Jay Edelson, nationally recognized plaintiff’s attorney and founder of Edelson PC, and Guest Don Moore, overconfidence and organizations professor at the UC Berkeley Haas School of Business” discuss overconfidence, how confidence plays a role in negotiations, and how to change the recruitment process to better, and more fairly, measure future success. Jay and Don first discuss how adolescence plays a role into how much confidence humans display (3:01). Don, the author of “Perfectly Confident,” shares that youth often struggle with confidence because they don’t know their place in the world and are unsure of their abilities to function as an adult (4:36). Jay and Don continue the discussion of confidence and how people need to make better bets with the skill sets they have (9:00). To limit the chance of being too-confident, people need to take a data-driven approach and weigh the risk of failure with the potential rewards of starting a venture or pursuing their dreams (13:00). The ultimate journey, career growth, and connections can all weigh in favor of being confident in a particular pursuit (15:23). Next, Jay and Don delve into how fraudsters and politicians can often tap into overconfidence to scam individuals (25:35). From former President Trump to the Music Man, fraudsters can often thrive because people often take others' displays of confidence as their potential for leadership. People must anticipate these risks and ask leaders to put up or shut up. Later in the show, Jay and Don break down how to successfully navigate negotiations and how overconfidence plays into the results of a deal (28:40). Don explains that putting incentives into a deal and making it more costly to decline is a good way to expose adversaries' misguided confidence. A good strategy, Jay explains, is to lean-in to people’s positions to get them to recalibrate their overconfidence for a better result for all parties (35:24). To wrap the show, Jay and Don explore the role confidence plays in recruiting and the difficulties in predicting the future performance of a candidate (37:55). Many companies get the hiring process wrong and need to restructure their interviews to focus on objective questions that focus on a candidate’s actual skills (43:17). Don explains that offering candidates a longer probationary period with financial rewards can better predict a candidate’s performance and screen out overconfident individuals (47:26). Section 230 and content moderation are hot topics in Washington amid calls for change to the tech liability shield. While some of these efforts come from a misunderstanding of Section 230, there is room for reform that could open the door to hold social platforms accountable. In Non-Compliant Podcast Episode 26, Host Jay Edelson, nationally recognized plaintiff’s attorney and founder of Edelson PC, and Guest Jeff Kosseff, professor of cybersecurity at the U.S. Naval Academy and author of The Twenty-Six Words That Created the Internet, discuss Big Tech regulation, Section 230 reform efforts, First Amendment protections, and digital anonymity.Jay and Jeff first discuss what Section 230 of the Communications Decency Act really means and why so many lawmakers and so-called experts get it wrong (5:10). Jeff says he supports some efforts to change the liability shield citing court rulings that say platforms don’t have to take down posts because of Section 230 (6:20). The discussion turns to former President Trump and the GOP’s efforts to repeal Section 230 (9:00). Jay and Jeff expose why these efforts actually harm the GOP’s arguments over conservative censorship and would lead to more aggressive actions by social platforms to block content (10:00). Jay and Jeff continue with their discussion on the GOP’s strategy against the Big Tech companies arguing that Republican arguments aren’t about legal strategy, but rather they are focused on politics (12:30). Jeff believes it's part of an effort to pressure Big Tech so they will do less moderation – something that is unlikely to happen after platforms doubled-down after the January 6th attack on our Capitol (14:30).Next, Jay and Jeff turn their attention to the judicial system and how the U.S. Supreme Court played a role in broadening Section 230 (20:00). Jeff discusses options for making it easier on people to have a chance against social platforms, including allowing limited early discovery. Later in the show, Jeff explains why so many people confuse First Amendment protections with Section 230 (34:00). The First Amendment doesn’t apply to private businesses and only restricts the actions of the government. On the other hand, the dominance of Big Tech platforms show that they could censor anyone if it’s a message they don’t believe in (37:30).To wrap the show, Jeff discusses his upcoming book United States of Anonymous Speech and how courts have created First Amendment rights to online anonymity (40:00). Jeff and Jay end the show by discussing the downside to anonymity and how to balance the need to mitigate real world harms it causes.Check out the show for even more from Jay and Jeff and for a preview of our upcoming animated rap video (0:55).If you liked the show, please subscribe and leave a review. The Capitol Insurrection shook our nation as then-President Trump incited a violent mob to go after one of our sacred institutions. While Trump’s divisive rhetoric was the main cause of the attack, a deep-partisan divide in our nation and the lack of real moral leadership in the GOP added fuel to the fire. In Non-Compliant Podcast Episode 25, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Dr. Lara Brown, associate professor and director of the Graduate School of Political Management at the George Washington University, discuss the deep-rooted partisan divide in Washington that led to the rise of Trump, what led to the Capitol Insurrection, and the upcoming Senate impeachment trial. Jay and Lara first discuss how Congress has become hyper-partisan since the 1990’s and why that opened the door for Trump to become president (2:20). Trump played into the fears of an electorate that felt that their identity wasn’t privileging them in ways that did in the past leading to calls that the system is rigged (9:30).Lara and Jay further explore the role early GOP leaders like Newt Gingrich played in creating the political tensions we now see in America (11:30). However, Lara explains that both political parties are to blame for the lack of congressional compromise on major pieces of legislation that would help the country (14:20). It will be hard for America to move forward with the ongoing demonization, name-calling, and stalemating.Next, Lara, the author of Amateur Hour: Presidential Character and the Question of Leadership, shares her insights on the Capitol Insurrection and how Trump’s divisive rhetoric over the years led to the January 6th attack (23:20). Some mainstream Republicans went along with Trump’s message to avoid political pushback from Trump’s base, while others on the fringe may support locking up political opponents. Lara hopes that more in the GOP stand up for legislative principles rather than limiting primary challenges (25:00).Later in the show, Lara dives into Trump’s second impeachment and why she feels the House should have gone further with their articles of impeachment (30:45). Lara told Jay that the House should have gone after Trump for pressuring the Georgia Secretary of State and for his failure to react once the insurrection began. To wrap the show, Jay and Lara discuss what the GOP will do during Trump's second impeachment trial (40:30). Lara explains that some Republicans want to move on from Trump, but Senate Minority Leader Mitch McConnell may not have enough votes in his party to get that done (44:00).Check out the show to hear more about why some members of the GOP supported election fraud claims (24:00) and why Republicans could have won the 2020 election if Trump was impeached the first time (41:00).If you liked the show, please subscribe and leave a review. President Trump is reportedly set to issue a wide swath of pardons that may include close confidants and family members. There are also talks of Trump issuing a pardon for himself to stave off possible federal investigations. Trump’s probable use of the pardon power is likely to push the boundaries of Constitutional norms and may wind up empowering future presidents to go even further. In Non-Compliant Podcast Episode 23, Host Jay Edelson, nationally recognized class action plaintiff’s attorney and Founder of Edelson PC, and Guest Kimberly Wehle, professor of law at the University of Baltimore School of Law and legal expert and commentator for CBS News, dive into Trump’s use of the pardon power and what it means for our Democratic Republic. Jay and Kimberly first discuss how Trump is unlike other presidents and won’t face the same political pressures as some of his predecessors (7:25). Although most presidents have used the pardon power for some personal gain, Trump is pushing the boundaries with the GOP backing his every move. Kimberly, the author of What You Need to Know About Voting--and Why and How to Read the Constitution—and Why, share her insight on the limits of presidential pardons and what role the courts play into interpreting this power (14:35). Jay and Kimberly also discuss the nuts and bolts of how pardons work and if it means you are guilty of a crime (23:30). Later in the show, Kimberly gives her thoughts on who Trump might pardon and what these actions might look like (29:00). Jay and Kimberly also discuss whether Trump will use pardons for family members and associates tied up in the Mueller probe. They also talk about if Trump can issue blanket pardons for unknown crimes and if anyone will challenge a potentially invalid pardon (36:25). To wrap the show, Jay and Kimberly chat if Biden can hold Trump accountable for his actions and if he has the political capital to bring federal investigations for possible crimes committed in office (47:20).
