These 26 words, known as Section 230, are the core of an Internet law that coats the tech industry in Teflon. No matter what happens, who gets hurt, or what harm is done, tech companies can't be held responsible for the things that happen on their platforms. Section 230 affects the lives of an untold number of people like Matthew, and makes the Internet a far more ominous place for all of us. But also, in a strange twist, it's what keeps the whole thing up and running in the first place. Why do we have this law? And more importantly, why can't we just delete it? Carrie Goldberg is a pioneer in the field of sexual privacy and a Brooklyn-based victims' rights attorney who is best known for her work fighting revenge porn and representing victims of sexual abuse and related online harassment. In fact Carrie began her career to become the lawyer she needed after she found herself the victim of a calculated scheme of harassment and threats to release intimate photos and was unable to find an attorney who knew how to help. Since then, Carrie has appeared in documentary films and news programs, been featured in numerous articles, including for The New Yorker and Elle. She has testified before Congress, sat at the table to discuss how to fight cyber exploitation with now Vice President Kamala Harris and other leaders in big tech. She has authored a book, Nobody's Victim: Fighting Psychos, Stalkers, Pervs, and Trolls. And she has been engaged by “celebrity” clients, including Lucia Evans and Paz de la Huerta – victims of film producer Harvey Weinstein – and politicians, including former Congresswoman Katie Hill. Carrie's work includes fighting against big tech companies to take responsibility for online harms. She has sued several social media platforms, including Snapchat in A.M. v. Omegle and Grindr in Herrick v. Grindr, where she sought to hold the gay dating app Grindr responsible under a product liability theory.  In addition to running her own law firm and her efforts toward legislative change both at the state and federal levels, Carrie currently serves on the Advisory Committee for the Cyber Civil Rights Initiative, a national nonprofit that serves thousands of victims around the world and advocates for technological, social, and legal innovation to fight online abuse. Calls to take down abusive and harassing content is often met with apathy from the largest tech companies. As victims of this online abuse can’t wait for law enforcement to act, social platforms must step up to remove this harmful content and step out from behind Section 230’s liability shield. In Non-Compliant Podcast Episode 32, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, and Guest Carrie Goldberg, Founder of C.A. Goldberg Victims’ Rights Law Firm and author of Nobody’s Victim, discuss sexual harassment and abuse on the internet, the problems with Section 230, and why Big Tech companies need to do more to stop online predators To start the show, Carrie dives into her work to protect people who face cataclysmic online abuse, including revenge porn, cyber-stalking, sextortion, and the lasting impacts of child pornography (2:30). Carrie explains that the bulk of the harm her clients face happens on major social media platforms like Facebook, Instagram, and Snapchat, which do little to prevent these abusive actions—often ignoring requests to take down damaging content (5:30). Next, Jay and Carrie discuss how tech companies face limited accountability for ignoring requests to remove harassing content under Section 230’s liability shield (7:30). Through the lens of one of Carrie’s cases against Grindr, she explains that the provision is getting attorneys to seek other legal theories, such as product liability, to force tech companies to take down abusive content that can ruin people’s lives (12:30). Jay and Carrie continue their discussion on Section 230 as they pivot to the power dynamics of Big Tech’s stranglehold of Congress and the courts that has cemented the online liability shield (20:00). Even with a flurry of bills to reform Section 230, Big Tech’s power to influence the debate will limit any short-term changes to the law (21:00). But the public’s shift in their views of tech companies is likely to lead judges and lawmakers to make important long-term changes to the liability shield. Later in the show, Jay and Carrie chat about the difficulties to stop online sexual harassment (30:00). Often, local law enforcement act too slow to stop abusers due to limited resources and the inability to force tech companies to remove content. Outside of the criminal justice system, abusers are often judgment proof which gives little to no value in pursuing civil claims (34:00). As Carrie explains, it is often crueler to victims to have them go through lengthy court proceedings with their abusers when the outcome is unlikely to stop the harassment. To wrap the show, Carrie explains that her experiences with revenge porn and online abuse led her to launch her own victims’ rights firm and to become a leader in the field (40:45). Carrie saw that there weren’t attorneys that had expertise dealing with all aspects of digital abuse cases and has made it her mission to protect online harassment victims that need someone in their corner fighting the fight against Big Tech’s inaction. This episode of The Wedding Biz is Andy’s first roundtable event held on the last day of Engage at Nizuc, Mexico. The roundtable guests for this episode are Rishi Patel, the CEO of HMR Designs, Carrie Goldberg, the Travel and Weddings Director at Harpers Bizzaar, and Christina Matteucci, the Executive Director of David Beahm Destinations. During the roundtable, Andy and each of his guests bring up a key takeaway that they got during the conference and discuss them as a group.  Andy’s takeaway from the conference was from Christina’s message of “audacious transparency.” Christina speaks about what she meant by that, and the group talks about vulnerability and owning your own personality. They discuss how social media can give a client a false perception of who you are, so when you meet the client for the first time, it is like an audition. Christina’s surprising takeaway was from a breakout session with Bruce Russell and Tara Fay wedding and event planners with their TV show, My Big Day: Home Or Away. She loved what they said about taking care of each other behind the scenes because the TV show pits them against each other on-screen. The group speaks about always taking care of each other in the industry, information, and trade secret sharing because there is plenty of business to go around, and everyone’s point of view is different. Rishi feels like knowing what you are selling is the biggest takeaway for him. The group agree and discuss how knowing what you have to offer makes it possible for the client to feel joy at the end of the day. You have to be yourself because you can’t be like anyone else, and what you are can’t be stolen. They also chat about how one of the focuses of this Engage was redefining the word luxury as a more authentic emotion, and how what used to be so different and unique is now quite common. A key takeaway for Carrie was pricing and making money. If you are not making a profit, then you are not in a business you have a hobby. The brain trust says that you should know what your profit margins are before the event even happens. After the fact, you should analyze it and decide what you will do or who you will work with on the next event. Andy is very excited to welcome Carrie Goldberg. She is the Digital Travel & Weddings Editor at Harpers Bazaar where she oversees all things weddings and travel for HarpersBazaar.com. She is in charge of content, strategy, and visuals for Bazaar's digital travel and wedding verticals and editor of their new membership program Bazaar Bride. She has worked on Live with Regis and Kelly at ABC and as fashion editor for Martha Stewart Weddings to name a few. When she joined Harpers Bazaar, they didn't really focus on weddings and she changed all of that. Since then she has published dozens of original fashion and decor content for the site, plus she has created a considerable brand voice.  Carrie and Andy chat about her internships and working the red carpet at the Oscars with Faith Cromas, Kelly Ripa's stylist. She speaks to us about working with Martha Stewart Weddings, which helped her gain the knowledge to succeed in her job at Harpers Bazaar. Carrie says she has the job she always wanted, even as a small child, and couldn't be happier. [14:20] Carrie tells us she is surprised that more women aren't planning their weddings on their phones. [15:10] She believes that women's personal styles are more layered than they ever realized. [17:14] Do you have any thoughts on something that might compete with Instagram? [19:03] Graduating their readers from honeymoon travel to regular travel is a way for them to keep their readers longer. [20:30] She feels very passionate about redefining what luxury is. Luxury is no longer a synonym for expensive. [23:47] Martha Stewart Weddings was a finishing school in styling for Carrie. Taking the red carpet style on people and putting it on the printed page was something she had never done. [26:15] Lighting is huge because it can invoke a feeling depending on what kind of lighting is used. [27:03] She has accumulated and publishes a list of the best planners, best florists, and best photographers. [29:13] She asks real brides who they could or couldn't use and why. She keeps them in mind to watch for her list. [31:10] How are you dealing with the immediacy of today's digital world and people's ability to instantly share content? [33:15] Fashion is the first thing that grabs her attention for the magazine, second is diversity in every way. Carrie Goldberg’s life changed when an ex-boyfriend threatened to post naked pictures and videos of her online. She was already practicing as a lawyer, but quit her job to start her own firm and give her clients - as she puts it - “the lawyer I needed when I was going through hell.” When she began in 2014, there were few laws against what is now known as “revenge porn” – the non-consensual sharing of explicit photos online. Now many countries and US states have passed anti-revenge porn laws. Movements like #MeToo have also focused attention on sexual consent and harassment. Carrie Goldberg tells BBC Trending how she has won legal victories for her clients. And she explains why social media and dating apps are both part of the solution and part of the problem. This month on Flash Forward, we go to a future where anybody can make a video of you doing anything they want. And that technology is cheap and easy to access. What happens?    This episode we start by talking about the technology as it exists now. Hamed Pirsiavash the show to explain his research into generating videos using algorithms.     So that’s where the technology stands now. But once it gets better, there are all kinds of applications. Hal Hodson, a tech reporter at The Economist, tells us about how it could be used in movies. Right now, movie-makers use CGI to project faces onto other faces. Recently, in the latest Star Wars, the faces of Princess Leia and Grand Moff Tarkin from the original trilogy were projected onto actors faces for the few scenes in the new movie. Here’s a look at how they did it.    But in the future, they might not have to do any of this. They could simply generate the video they need using images of Leia and Tarkin’s faces. Which also means that movie stars could wind up being in hundreds of movies a year, since they don’t have to actually be there, on set, to act. And they could keep acting in movies long after they’ve died, too.     That’s a fun thing to think about. Here’s a less fun thing to think about: how people would use this technology to seek revenge and ruin people’s lives. And to talk through the legal implications, I called Carrie Goldberg, a lawyer who specializes in revenge porn cases. She explains how these generated videos of the future would actually get around today’s revenge porn laws.     Then, to wrap it all up, I talk to Jenna Wortham, a writer for the New York Times Magazine and the co-host of an amazing podcast called Still Processing. In a world where online identities are not only personally valuable, but economically valuable, what does this do to us? When anybody can torpedo your finely crafted online persona with a fake video, do we all just give up? Do we try to erase everything from the internet about ourselves? Or do we lean into this and start making wild aspirational and experimental videos? Part 1 with guest Dr. Carrie James Beyond Online Safety: Teaching Moral and Ethical Decision Making Dr. Carrie James, sociologist, researcher at Harvard's Project Zero, and author of Disconnected: Youth, New Media and the Ethics Gap talks about the impact of growing up digital on our young people and our communities. Dr. James explains the research and shares the results of the interviews they did with youth age 10 to 25.  This valuable and interesting discussion covers the following points and more: Digital life and ones moral and ethical dilemmas Privacy, ownership, codes of conduct and developing norms in the digital realm Consideration of others when making decisions about online actions Blindspots in the thinking of youth when it comes to online actions Concerns among youth about their online life versus what parents are concerned about Carrie James is a sociologist and a researcher at Project Zero at the Harvard Graduate School of Education. Her research explores young people's digital, moral, and civic lives.  With Howard Gardner, she co-directs the Good Play Project, a research and educational initiative focused youth, ethics, and the new digital media, and the Good Participation project, a study of how youth “do civics” in the digital age. Carrie is also co-PI of the Out of Eden Learn project, an educational companion to Pulitzer Prize-winning journalist Paul Salopek's epic Out of Eden walk. Her publications include Disconnected: Youth, New Media, and the Ethics Gap (The MIT Press, 2014). Goldberg, PLLC and television legal correspondent talks about the litigations against backpage.com and their aiding and abetting in child sex trafficking. She explains how they are claiming immunity from liability under Section 230 of the Communications Decency Act (CDA) which immunizes websites from liability for content their users post. Carrie Goldberg is the founding attorney at C. A. Goldberg, PLLC in Brooklyn, New York. Carrie litigates in the arenas of Internet privacy, sexual assault, and elder abuse in state and federal courts. Among the trial and appellate cases Founding Attorney Carrie Goldberg has litigated is In the Matter of A. M., the case of first impression in NYS Supreme Court Case transferring end-of-life medical decision-making to responsible family members to promote humane deaths. She has lectured about exploitation, revenge porn and guardianship at numerous law schools and bar associations and repeatedly for the NYS Office of Court Administration. Carrie blogs (www.cagoldberglaw.com/blog) about privacy, the law and sexual victimization and is frequently interviewed about emerging news stories involving sex crimes and nonconsensual sexual exposure online, including by the BBC, The Atlantic's The Wire, Elle, HuffPost Live, Vice News, Fox411.
