Back in 2021, the Ontario government used the notwithstanding clause to push through changes to campaign finance laws. Critics say these changes violate the Charter of Rights and Freedoms. This week, the Supreme Court heard the case and its decision could have a major impact on the next provincial election.Back during the height of the Covid-19 pandemic, provincial courts began offering a deal to certain cases where a person was charged with driving under the influence. The person could plead guilty and rather than face federal charges, they would be charged under the Highway Traffic Act, which offers less severe penalties. This deal was offered to clear a backlog of cases. Steve and JMM discuss how this squares with a provincial government that has made itself known for being tough on crime. And, another story where politics run into reality as the federal government squashes an attempt by the city of Toronto to decriminalize drugs for personal use. All thanks to a letter from Doug Ford.See omnystudio.com/listener for privacy information.

The official opposition is accusing the Ontario government of shutting down debate on a private member's bill called Lydia's Law. The bill deals with sexual assault and was set to be debated this week before Progressive Conservatives sent it to committee. The PCs say they are trying to speed up the legislative process, but the NDP are crying foul.Minister of Health Sylvia Jones said this week that Ontario does not have a doctor shortage, a statement that raised a lot of eyebrows. Steve and John Michael dig into the story behind the comments. And, this week brought some significant new penalties for car theft. John Michael explains why this law could lead to a challenge under the Charter of Rights and Freedoms.See omnystudio.com/listener for privacy information.

Lawyer Marty Moore takes us through a complex Supreme Court of Canada decision, Dickson v. Vuntut Gwitchin First Nation, about whether First Nations governments are subject to the Canadian Charter of Rights and Freedoms. If they are, then what protections would they have to preserve what is known, legally, as "indigenous difference?"Vuntut Gwitchin First Nation is in the very north of the Yukon Territory and centred in the remote community of Old Crow (pop. 221) on the banks of the Porcupine River. 2022 marks the 40th anniversary of Canada's bill of rights, or what is formally known as the Canadian Charter of Rights and Freedoms.Against that backdrop, in this episode we examine the present-day landscape in Canada for freedom of religion – the first fundamental freedom listed in the Charter. We talk about the implications of COVID restrictions; why recent federal legislation banning conversion therapy may be the greatest threat to religious freedom at this moment; and what the U.S. Supreme Court's recent ruling on abortion may or may not mean for Canada. We also discuss a unique type of “trial” for members of today's legal profession – namely, the ability to practice one's faith while practicing law.Joining us is Albertos Polizogopoulos, one of the most prominent legal practitioners in Canada when it comes to cases and questions involving freedom of religion.  On behalf of his broad range of clients – churches, charities, dioceses, schools, universities, hospitals – Albertos has appeared numerous times in front of the Supreme Court of Canada.Albertos is a partner and founder at his Ottawa-based law firm, The Acacia Group.Documents/Websites referenced Albertos Polizogopoulos' biography (The Acacia Group)Canadian Charter of Rights and FreedomsBill C-4, An act to amend the criminal code (conversion therapy)U.S. Supreme Court - Dobbs vs. JacksonSupreme Court of Canada - R. v. 29jan22 - Inspired and activated by the Truckers Freedom Convoy to Ottawa, the incredibly enlightening interview with Jordan Peterson and the Hon. Brian Peckford, along with the palpable enthusiasm and unifying voice sweeping the nation, Glenn and I invited back one of our favourite guests for our very first live streamed podcast so we could talk about the topic of the day - freedom! It was so fun to welcome back psychology and philosophy student, writer, editor, and critical thinker extraordinaire, Emily Rodgers. And, much to our collective joy, our conversation was rich, engaging, and full of ideas and questions as we got caught up on how each of us was feeling about the ongoing Covid response in our country and the province of British Columbia, how we all felt so ignited by the Peterson Peckford interview, and what the Truckers Freedom Convoy represented for hundreds of thousands of Canadians who were finally starting to feel heard and that they were not alone. Emily began by saying how grateful she felt to be, "no longer screaming into the void," and how she felt a sense of relief, pride, and connection she hadn't felt as a Canadian in a long, long time. We talked freedom, unity, peace, charity, and support. We talked about how there was something inherently Canadian about truckers protesting peacefully (even having a good time while doing so) in their big 18-wheelers, with steam and exhaust hissing from valves and pipes; about flags on hockey sticks waving, and warm breath steaming up the cold winter air; and coming together across this nation of ours as one, unified voice. Sticks and carrots, lack of opposition and debate, "who governs me?", and resilience were just some of the aspects of freedom that bubbled up during our time together. Glenn also gave a shout out to journalist and author of "The Field" and "The Power of Eight", Lynne McTaggart for her blog post, "Keep on Truckin' Together" in which she talks about the profound power of intention. This, and so much more...! For links to referenced posts, please scroll down below.
