In October, 2024, the Law Union of Ontario held their 50th anniversary conference, titled "Revolutionary Advocacy." Its keynote speaker was Harsha Walia, who is alleged to have led "Death to Canada" chants at an anti-Israel protest hosted by Samidoun, the designated terrorist organization.If an Ontario lawyer participated in that conference, they would have received credit from the Law Society of Ontario, and that infuriated Ontario human rights lawyer Bryant Greenbaum, who soon filed a complaint against the society for recognizing the validity of such an event and its speaker.But the LSO did not apologize or backtrack, which forced Greenbaum to take both them and the host, the Law Union of Ontario, to the Ontario Human Rights Tribunal.

The decision stems from a case involving undisclosed exculpatory evidence, and the outcome confirms courts can enter an acquittal if a new trial is unnecessary. Then, they explore the disciplinary suspension of a BC lawyer who received a 90-day IRP and attempted to leverage his status to avoid consequences—an act deemed "conduct unbecoming" by the Law Society. Kyla and Paul unpack the implications for lawyers and other regulated professionals who blur the lines between personal misconduct and professional ethics. Finally, they revisit the Bajwa case, where a man with a long history of driving prohibitions was filmed using the toilet at a police station after his arrest. Despite the Charter breach, the judge declined a stay of proceedings and instead considered the violation at sentencing. The transition year student won for her essay on the role the law can play in addressing hate crime. Another student at Presentation, Listowel Molly Linnane was a finalist in the competition. Jerry spoke to Hazel and to her English teacher, Gemma O’Loughlin, who also teaches Molly.

In Leaders Getting Coffee episode 40, our guest is Lawyer turned Novelist, Rachel Paris. Success is a recurring theme in the life of Rachel Paris. With degrees from Auckland University in Economics and Law, and the Law Society’s prize for the top law student under her wing, she joined one of the country’s most prestigious law firms, Bell Gully. A spectacular law career in New Zealand and around the world followed. Along the way she completed her Master of Law degree at one of the world’s most prestigious law schools, Harvard Law. Her dissertation there was cited as ‘influential’ by the Wall Street Journal. After her Kiwi OE via a law firm in London, she returned to New Zealand, quickly becoming a Partner back at Bell Gully where, she became an expert in Banking and Finance law in the free lending days before the GFC, and she oversaw much of the post-crash restructuring that became the aftermath of those heady days. Uniquely, she put that career aside and left the law partnership, as her family moved to London, following husband Jason’s career at Vodafone. There, she created her own boutique law firm specialising in Blockchain technologies and supporting her global client base part time while organising a growing family in a new part of the world. But, having returned to New Zealand, it is her latest adventure that is the most fascinating. A masters degree in creative writing back at her old stomping ground at Auckland University and now a new book. And not a book about the law or even blockchain. But a novel, a twisting turning thriller about toxic rich people behaving badly! The book, published in New Zealand and Australia, is called “See How They Fall” and has already attained Number 1 Bestseller status, while a Hollywood production company has optioned the rights for the big screen. And with the UN Chief declaring we're seeing the 'mainstreaming of misogyny' we're examining how real, passionate and tireless action leads to monumental change for women.Lawyer, advocate, survivor and Dharug woman Karen Iles joins the discussion as we examine the significant recommendations handed down by the Australian Law Reform Commission this week that could seriously change things for victim-survivors of sexual assault, the majority of whom are women.Less than 1 per cent of perpetrators are ever held as solicitors and advocates for victims/survivors of sexual assault and domestic violence, leveraging her legal expertise and public platform to drive systemic change.The ALRC found that with one in five women and one in 16 men experiencing sexual violence since the age of 15, fewer than one in ten such incidents are reported to police. From there, 75 to 85 per cent of such reports do not proceed to charges, and even fewer go to court. As such, the ALRC has outlined a roadmap for fixing the justice system, including 64 recommendations for meeting the twin goals of access to justice and accountability. This week, the BC Conservative MLA for Vancouver Quilchena reposted a National Post article about the former residential school site in Kamloops, adding a comment that the number of confirmed child burials at the site is zero. The article is about James Heller who pushed the Law Society of B.C. to change its training material to say there were "potentially" burial sites at the former residential school in Kamloops — instead of more definitive language. Brodie is only one of a number of BC Conservative candidates who has questioned the history of residential school abuse. To discuss these comments and their impact on truth and reconciliation, we speak with Sean Carleton, professor of history and Indigenous studies at the University of Manitoba.

Arthur Cox LLP and Wind Energy Ireland are pleased to announce the continuation of the Niamh Burke Renewable Energy Bursary, with Arthur Cox offering a €10,000 boost to students pursuing studies related to renewable energy. This initiative aims to support the next generation of innovators and leaders in the field of sustainable energy. The bursary was established in memory of former Arthur Cox partner and consultant Niamh Burke, who played a significant role in the development of the Irish wind energy sector and advised on many of Ireland's largest energy, infrastructure, and construction projects. It provides financial assistance to help cover tuition fees, research costs, and other educational expenses. All relevant disciplines are open for consideration including economics, engineering, law, planning, policy, science and others. It is open to students planning to study in these or related fields in Ireland at the postgraduate level in 2025. If more than one person is selected, the bursary monies will be split between the successful applicants. Previous recipients have used the bursary to study at Dublin City University, the Law Society of Ireland, Trinity College Dublin, University College Cork, University College Dublin and the University of Galway. Last year's recipients, Jarlaith Brady and Thomas Walsh impressed the judging panel with their commitment to working to tackle the climate emergency and their passion for their chosen fields of Mechanical and Sustainable Engineering and Energy Systems Engineering. Danielle Conaghan, Partner and Head of Environment and Planning at Arthur Cox LLP, commented, "We are proud to provide the Niamh Burke Renewable Energy Bursary. In 1973, three young lawyers founded Heenan Blaikie in Montreal, which grew to be a prominent Canadian law firm with notable members, including former political leaders. Despite its close-knit atmosphere, the firm faced significant internal issues, leading to its collapse in 2014. Adam Dodek, an impartial observer, examines the firm's rise and fall, highlighting its unique culture alongside underlying problems like workplace bullying, challenges for women and minorities, and sexual harassment. The narrative is contextualized within broader societal changes, including economic shifts and crises. Dodek's thorough investigation serves as an essential read for legal professionals and those interested in the dynamics of corporate failure. Adam Dodek is a professor in the Faculty of Law at the University of Ottawa. Among his numerous publications are In Search of the Ethical Lawyer; The Canadian Constitution, Third Edition, named by the Hill Times as one of the top 100 books on Canadian public policy; and Solicitor-Client Privilege, which won the Walter Owen Book Prize. He is a recipient of the Canadian Association of Law Teachers Prize for Academic Excellence, the Mundell Medal for excellence in legal writing, and the Law Society of Ontario's Law Society Medal. He is also a director of the Canadian Association for Legal Ethics and the Canadian Legal Information Institute, and a past governor of the Law Commission of Ontario.
