Send us a textCan a single oath determine who gets to practise law in Canada? Gavin Tighe and Stephen Thiele unpack a fascinating Alberta Court of Appeal decision that struck down a mandatory oath of allegiance for lawyers as unconstitutional. Through the case of Amarjeet Singh Dhariwal, a Canadian born Sikh lawyer who refused to swear allegiance to the Crown on religious grounds, the discussion explores how freedom of religion, the rule of law, and professional licensing collide. They examine why sincerity of belief mattered, how the Law Society of Alberta failed to justify the oath under the Charter, and what this ruling means for lawyers, regulators, and professional bodies across the country. Along the way, they raise deeper questions about tradition, citizenship, and whether symbolic rituals still have a place in modern legal practice. Listen For:01 Are religious convictions absolutely protected under the Canadian Charter?2:32 Can a professional oath be unconstitutional?5:30 Does being born in Canada change the obligation to swear allegiance?9:43 How do courts assess sincerity of religious belief?15:07 Why did Alberta lose the Charter challenge? My guest this week is the Hon. A. Brian Peckford, former Premier of Newfoundland, the last living First Minister to sign the Canadian Charter of Rights and Freedoms and a true patriot. We discuss the “supremacy of God and the rule of law”, the foundational statement found in Part 1 of the Charter. Mr. Peckford describes the recent efforts by Alberta lawyer Roger Song to have the Law Society of Alberta (LSA) officially recognize the supremacy of God and the rule of law. Mr. Peckford then spoke about the tremendous importance of the “supremacy of God” as it pertains to the Constitution and the tragic consequences of it being ignored in the courts and legislatures. Send us a textIf becoming a lawyer no longer requires proving what you know, what does the profession really stand for? Gavin Tighe and Stephen Thiele take on the Law Society of Ontario's proposal to scrap bar exams in favor of a training course, arguing that removing substantive testing undermines both public protection and the meaning of being called to the bar. Drawing on their own experiences in law school and practice, they explore how legal education has changed, why baseline legal knowledge is essential, and how lowering standards risks public confidence in the profession. They discuss the concerns about competency, mentorship, AI misuse, and an increasingly saturated legal market, ultimately questioning whether a profession without rigorous gate-keeping can still claim legitimacy as a learned profession. Tonight on The Huddle, Child Fund CEO Josie Pagani and Tim Wilson from the Maxim Institute joined in on a discussion about the following issues of the day - and more! The disgraced lawyer at the centre of the Russell McVeagh #MeToo scandal has been granted a new practising certificate by the Law Society, which says he's fit to return as a barrister. Do we believe in second chances? The Government has pushed out the return to surplus for another year - and Ruth Richardson has responded by calling off the debate between her and Nicola Willis. What do we make of this? Auckland Council has moved to scrap a proposed trial for fortnightly rubbish collection in some Auckland suburbs. Do we think this is the right move? Will the new MCERT mega-Ministry actually improve anything? LISTEN ABOVESee omnystudio.com/listener for privacy information.
The lawyer representing victims of a former Russell McVeagh partner, whose behaviour helped ignite New Zealand's #MeToo movement, says it'll be up to clients whether they want to work with him. James Gardner-Hopkins was found guilty of six misconduct charges by the Lawyers and Conveyancers Disciplinary Tribunal in 2021 - and suspended for three years. He's now been granted a new practising certificate by the Law Society, which says he's fit to return as a barrister. Steph Dyhrberg says the decision will put some clients off, but others may not see it as a barrier. "That's the thing about having a practicing certificate, you've sort of got a brand on you from the Law Society that you're a fit and suitable person." Lawyers say they can't pinpoint the reason there's been an increase in complaints. The Law Society's annual report reveals more clients are raising their concerns, particularly around incompetence. New Zealand Law Association Vice President Julie-Anne Kincade told Andrew Dickens with more people using AI to research their legal issues, they're needing to manage expectations. She welcomes clients doing their own research but it's important people remember lawyers are the experts. LISTEN ABOVE See omnystudio.com/listener for privacy information.
New figures from the Courts Service show a record increase in the number of people dying in the state. Grants of administration have risen from 3,670 in 2023 to 4,451 last year. The Law Society of Ireland, together with the Clare Bar Association is urging Clare residents to seek trusted legal advice when making a will, highlighting the importance of future planning for families, farms and local businesses. A panel discussion on the Employment Rights Bill held at the Faculty of Law on 4 December 2025. Lord (John) Hendy KC and Councillor Nick Denys from the Law Society shared their insights on the parliamentary process, the merits (and weaknesses) of the ERB, and its (practical) future once it is voted into law. The UK's anti-money laundering (AML) landscape is undergoing a significant transformation. The government has confirmed that the Financial Conduct Authority (FCA) will take over from the Solicitors Regulation Authority (SRA), the Law Society of Scotland, and other professional bodies to become the Single Professional Services Supervisor (SPSS) for AML supervision. This marks the first time law firms and accountancy firms across the UK will be regulated under a single AML authority. In this webinar recording, VinciWorks' legal compliance experts, alongside our partners at The Compliance Office and special guest Mike Ross, Director & MLRO at Anderson Strathern, break down the details of this major shift. We discuss what the government's consultation on the new structure entails, what questions remain unanswered, and the potential implications for firms across the UK, including specific insights into how Scottish firms might be affected. In this recording, you'll hear about: • The FCA's new role as the Single Professional Services Supervisor • Key insights from the consultation, including unanswered questions • A comparison of the FCA's and SRA's approaches to AML regulation • The views of Scottish firms and the Law Society of Scotland • What MLROs need to know and prepare for • The potential timeline for the transition This session is essential for compliance professionals, MLROs, and legal teams working in the UK's legal and accountancy sectors, providing critical insights into what the future of AML regulation will look like and how to prepare.

Politically motivated attacks on the legal profession in the UK have led to barristers, solicitors, advocates and judges being subjected to violence, death threats and rape threats. Some have faced threats to their family members. This is according to the The Bar Council of England and Wales, the Law Society of England and Wales, the Law Society of Scotland, the Faculty of Advocates, the Bar of Northern Ireland and the Law Society of Northern Ireland. These organisations represent a quarter of a million lawyers across the UK, and they have come together to warn about an increasing climate of hostility against legal professionals. They say that law firms have been targeted by protesters, and they point out that lawyers are not their clients. Witness to Yesterday (The Champlain Society Podcast on Canadian History)
In 1973, three young lawyers founded Heenan Blaikie in Montreal, which grew to be a prominent Canadian law firm with notable members, including former political leaders. Despite its close-knit atmosphere, the firm faced significant internal issues, leading to its collapse in 2014. Adam Dodek, an impartial observer, examines the firm's rise and fall, highlighting its unique culture alongside underlying problems like workplace bullying, challenges for women and minorities, and sexual harassment. The narrative is contextualized within broader societal changes, including economic shifts and crises. Dodek's thorough investigation serves as an essential read for legal professionals and those interested in the dynamics of corporate failure. Adam Dodek is a professor in the Faculty of Law at the University of Ottawa. Among his numerous publications are In Search of the Ethical Lawyer; The Canadian Constitution, Third Edition, named by the Hill Times as one of the top 100 books on Canadian public policy; and Solicitor-Client Privilege, which won the Walter Owen Book Prize. He is a recipient of the Canadian Association of Law Teachers Prize for Academic Excellence, the Mundell Medal for excellence in legal writing, and the Law Society of Ontario's Law Society Medal. Click here now to access the tool > How to Raise Your Visibility on LinkedIn Without Feeling Loud or Pushy For many business owners, LinkedIn can feel overwhelming. But it can also be one of the most powerful places to connect with your dream clients and potential collaborators and grow. It's a place where thoughtful voices are heard and real opportunities can take root. So this week on The Brilliant Book Festival, I was delighted to be joined by Louise Brogan, author of Raise Your Visibility on LinkedIn. Her approach is refreshingly different: no cold messages, no forcing yourself into someone else's mould, just clear, consistent steps that help you build a presence people trust. Louise shows us that visibility isn't about being the loudest. It's about being the one who shows up with clarity, humanity, and the quiet confidence to let your expertise speak for itself. Prefer to WATCH instead of read? https://www.youtube.com/watch?v=72DfGZtzUws “The people who decide you're the expert are the people watching you show up.” – Louise Brogan Why Visibility Matters For many introverted entrepreneurs, the idea of “getting visible” online can feel daunting. Louise reminds us: visibility doesn't mean becoming someone you're not. It means showing up consistently in a way that feels natural to you, so that when potential clients need your expertise, they already trust you. LinkedIn works because: People on the platform have resources to spend. Often corporate budgets or personal income. Most people never post. They're silent observers (“hidden buyers”) waiting for the right voice to resonate.. You need to be the clearest. You don't need to be the loudest. You need to be the clearest. As Louise puts it, showing up regularly to share insights creates an ecosystem where others decide you are the expert. Becoming Seen as an Expert One of the biggest barriers to posting on LinkedIn is the feeling of: “Who am I to say this?” Louise gently reframes this. You don't need to declare yourself “the top expert in the world.” You simply need to answer the kinds of questions your dream clients are already asking. Visibility isn't about grandeur—it's about consistency. If you regularly share your perspective, your network begins to associate you with your area of expertise. Even better, others amplify you by engaging, commenting, or tagging you in conversations. As Louise explained: “The people who decide you're the expert are the people watching you show up.” The metaphor here is a pair of rowers in a boat. If both row on the same side, you go in circles. But when you learn to pull in sync from opposite sides, you glide forward faster and straighter than you ever could alone. “One thoughtful conversation outweighs a hundred copy-paste messages. LinkedIn is about networking, not spamming.” – Louise Brogan A Favourite Story: Selling Art on LinkedIn Louise shared the story of an artist who initially thought LinkedIn wasn't “for her.” Once she began posting about her work, not only did she start selling to businesses (who wanted art for their offices), but she was also featured in Vogue and went on to collaborate with a furniture designer. Why? Because LinkedIn isn't about industries—it's about people. And people buy from people they connect with. The Quiet Power of Consistency The heart of Louise's message is that LinkedIn works when you build a trusted rhythm of presence. Not through noise. Not through hacks. But by showing up in a way that feels true. If you've ever felt hesitant about LinkedIn, let Louise's story reassure you: visibility can be both strategic and soulful. You don't have to shout. You simply need to resonate, consistently. Final Thought to Reflect On What could shift for you if you used LinkedIn as a space for building steady, human connections? In this episode, Steve Fretzin and Stephen Seckler discuss:How lawyers can better align their personalities with business developmentNavigating career transitions within the legal professionHow meaningful networking creates long-term career momentumLeveraging authenticity and consistency to build a professional brand Key Takeaways:Lawyers who struggle with traditional selling can ease into business development by focusing on small, genuine actions like reconnecting with familiar contacts and writing about subjects they care about.Clarifying which types of clients, cases, and activities energize or drain you is an essential first step before deciding where and how to focus your marketing efforts. The most productive networking conversations happen when lawyers ask clear, focused questions, such as “What's a good introduction for you?”—and balance listening with intentional follow-up.Professionals can avoid wasting time in aimless meetings by preparing a loose agenda beforehand, staying focused on mutual goals, and knowing what specific outcome they want to achieve by the end of each interaction.
